MINUTES OF REGULAR COUNCIL MEETING Vi Ilage of Arden HII Is Monday - December 9, 1968 - 8:00 p.m. Ca II to Order The meeting was called to order by Mayor BJorndahl at 8:03 p.m. Roll Call Present - Mayor Bjorndahl, Councilmen Crepeau, Hollenhorst and Henderson . Absent - Councilman Olmen Also Present - Engineer Donald Lund, Treasurer Worth G. Read, ~la I nte- nance Supervisor Ev Beecher, Administrative Clerk Lorraine Stromquist and Deputy Clerk Florence Honan . Approval of Minutes The minutes of the regular meeting of November 25, 1968, were approved as amended. 1605 Johanna Blvd. - Broken Sewer Pipe Jerome Wasielewski, 1605 Johanna Blvd., was present and explained that Northern Contracting Co. had broken the sewer line to the pro- pe rty line, which was to service the property at 1609 Johanna Blvd., which he now owns. Engineer Lund Informed him that none of the sewer lines were installed to the property lines, but only to the end of the Improved roadway; however, the contractor did break the end of one section. Mr. Wasielewski also Informed the council that the dr I veways at 1605 Johanna Blvd. and at i936 Grant Road, which he also owns, have been damaged and not satisfactorily repal red. Mayor BJorndahl Informed him that the council Is aware of many similar situations; the contractor wi I I do temporary repair now, and' wi II do permanent repair I n the spri ng. Matter referred to Mr. Beecher. BUSINESS FROM THE FLOOR Ingerson Road Drainage Matter David Irwin, 1200 Ingerson Road, reported on the reactions of the property owners who would be assessed for the proposed Improvement to correct the drainage problem In this area. He contacted about 70-75% of the 80 plus property owners; about 10-15% ml~ht favor the Imp rovement. The people were Interested In the cost 0 the Improve- ment. Mr. Irwin recommended that either the project be droppe d, or a comprehensive plan of the Improvement be obtained which would In- clude the "total area, considering the properties owned by Mr. Jurgenson and also St. Paul Bib I e Co II ege. Engineer Lund stated that a portion of the problem Involved Shorevlew; . Shorevlew would be requested to assist In the financing. Mayor BJorndahl then asked what the opinion of the project was, not considering the cost. . Mr. I rw I n replied that the cost was the most prominent objection; possible 10 property owners would agree to the Improvement at a reasonable cost. Mayor Bjorndahl thanked him for his effort. REPORT OF ATTORNEY COURTNEY (absent) Amended Personnel Ordinance - Final Reading Mayor Bjorndahl read from Atty. Courtney's letter, dated December 9, 1968, concerning this matter, and also read the final draft of this ordinance. Councilman Crepeau moved the app rova I of the adoption of an ordinance repealing Ordinance No. 96 and amending Ordinance No. 83, the personnel ordinance, by adjusting sick leave and vacation benefits and granting additional discretion to the counc II In certain matters; seconded by Councilman Hollenhorst; motion carried. - I - . Resolution - Insurance Benefits Final draft of this Resolution, as submitted by Atty. Courtney, was read by Mayor Bjorndahl. Councilman Crepeau moved the adoption of an amended Resolution, as . attached, ratifying and authorizing payment of Insurance benefits for employees during 1968, and establishing procedure for 1969 and there- after; seconded by Co~ncllman Hollenhorst; motion carried. Water Ordinance Amendment - Final ' Read I ng Mayor Bjorndahl read that portion of Atty. Courtney's letter, dated December 9, 1968, regarding this subject; Councilman Henderson read the final d ra ft. Memo from R. McNiesh, Chairman of the Public Works Committee, was read by Mayor BJorndahl. Councilman Crepeau moved the rules be waived and the second and final reading be given to an ordinance amending Ordinance No. 103, re I a tin g to the municipal water system, to establish a procedure for the pay- ment of connection fees for Arden Hi lis property serviced by outside water systems; altering the charges thereIn as deposits on water meters; and altering the provisions therein regarding water meter settings; seconded by Councilman Henderson; motion carried. Arden Hi lis - Grudnoske Land Purchase Contract Mayor Bjorndahi read the pertinent portion of Atty. Courtney's letter of December 9, 1968. Mr. Grudnoske and his attorney, Mr. Ti mothy Quinn, were present. They were agreeable to the terms of the contract, including the repair of the well before the contract is completed. Councilman Henderson moved that Atty. Courtney be authorized to con- clude the contract between Arden Hills and Harold Grudnoske for the purchase of certain described land south and east of the Village Ha II for $25,000; seconded by Counci Iman Crepeau; motion carried. ~endinQ Machine Ordinance - First Reading Councilman Crepeau Introduced by title and gave the fl rst reading to an Ordinance licensing vending machines, establishing license fees therefor, and establ ishing penalties for violation; secon ded by Counci Iman Henderson; motion carried. REPORT OF ENGINEER DONALD LUND . North End Sewer Report Engineer Lund distributed to the council his report regarding sewer for the north area of Arden Hills Engineer Lund summarized the two plans as follows: . Plan No. 1 utilizes the existing sewers within Arden Hills as an outlet; estimated cost of this plan - $261,600.00 Plan No. 2 utilizes a connection to the sewers In the Village of New Brighton, and ultimately the N.S.S.S.D. - estimated cost of $153,600, excluding costs from Uew Brighton and the N.S.S.S.D. Banister Engineering Co. recommends Plan No. l' the details In the , report show this plan to be more economical than Plan No. 2 . con- sidering future costs. A copy of the report was given to Mr. Adams, Twin City Trailer Park. Counc i I was requested to study the report; clerk directed to send a copy of the report to Atty. Courtney and also to Fiscal Agent Peter Popovich. - 2 - . . . Water Tower Li~ht Engineer Lund Informed the council that he is waiting for a formal proposal from Batzll Electric Co. for a light and Its Installation . on the water tower. They had given him an Informal price of $688.00. Engineer Lund explained that this would be a two II ght system - I f on I j ght fa Its, the second light takes over. Councilman Henderson authorized the expenditure of $688.00 for the . light and its installation; cost to be taken from Water Improvement 67-1 fund; and directed the engineer to so inform Batzl i Electric Co. i seconded by Councilman Crepeau; motion carried. Ma~netlc Sewa~e Meters Engineer Lund informed the council that he had received a rough estimate of $i ,000 per Inch for magnetic meters; this could be very costly_at least one of the meters In an 8" meter. He further ex- plained that magnetic meters are not primarily built for sewage; they need a more homogenous substance to function properly. Councilman Crepeau authorized Banister Engineering Co. to reactivate the sewer meters according to Engineer Lund's original proposal; seconded by Counci I man Hollenhorst; motion carrlell. Fire Underwriters - Notification of Water System Counci I requested Clerk Lorraine Stromquist to send a letter, as drafted by N. Hendrickson - Banister Engineering Co., to Fi re Under- writers to advise them of the Arden Hi lis water system and request a change to Class 8 instead of Class 9 for Insurance purposes. Clerk requested to contact Mrs. Myrtle Schi ller, Publicity Coordinator, to submit an Informational news release to the press. Water Improvements - Estimated Payments Engineer Lund distributed to the council a tabulation of the current water Improvements and estimates of monthly payments through March 1969. Counc i I requested Engineer Lund to continue the monthly break- down on construction projects. REPORT OF COUNCILMAN HOLLENHORST - Planning ana Zoning Case No. 68-48, Grudnoske Subdivision Councilman Holienhorst moved, as recommended by the Planning Commission, that the council waive the subdivision ordinance requ i rements, as permitted under Section 13, Subdivision Ordinance No. 98, and app rove the plat as requested and submitted by Harold Grudnoske and dated . November 13, 1968; seconded by Councilman Crepeau; motion carried. Case No. 68-40, Carroll Furniture Road Request Councilman Hollenhorst I n formed the counc I I that the Pl'annlng Commission had referred to Engineer Lund the matter of a feaslbl'ity report for . a public road between Carrot I Furniture Co. and McGuire's Supper Club on County Road E. Case No. 68-45, Control Data Corporation Road Extensions Councilman Hollenhorst reported that Planner C. Dale and the Planning Commission fee I that the request from Control Data Corporation to extend Fernwood Avenue and Victoria Street is not feasible; therefore, the Planning Commission recommends that the request be den i ed <four voted in favor, two abstained from vot i ng) . Mayor Bjorndahl felt the subject should be considered during the meet I ng scheduled for this Wednesday for the purpose of discussing future highway plans. Case No. 68-41, Housing Policy Councilman Hollenhorst reported that the public hearing regarding the proposed amendments to the Comprehensive Plan's housing policy - 3 - - . Minutes of Regular Council Meeting December 9, 1968 Page Four was held Tuesday, Decembe r 3, 1968. There were two principle topics of discussion: 1) should the "fair housing laws" be incorporated In this section, and 2 ) el iminating the naming of certa I n streets which apartment developments should abut and have immediate acce 5S. . The matter of the "fair housing laws" was referred by the Planning Commission to the council and Atty. Courtney; the second Item was approved to be changed to read "The apartment developments should abut and have immediate access only to major streets". The Counci I and Mr. David I rwi n, Chairman of the Human Rights Committee, discussed . the i ncorporat i on of the "fair housing laws" In the Housing Pol icy and decided that this subject should be a sepa rate ordinance. Mr. II-w i n informed the counc I I that he will bring the matter to the Human Rights committee's attent i on at their next meeting. Clerk Lorraine Stromquist informed the counc II that the village already has a Human Rights Ordinance, perhaps an amendment should be considered. Case No. 68-42, Sign Ordinance The Board of Appeals and the Planning Commission recommend that the front setback requ i rements for signs requiring a license be changed from 50 ft to 25 ft. Counc II referred the matte r 'to Atty. Courtney. Case No. 68,,47, Zoning Ordinance Amendments An ordinance amending Ordinance No. 99, the Zoning Ordinance, was introduced by title at the counci I meeting of November 25, 1968, and referred to the Planning Commission for consideration. The Planning Commission re comme n de d that the words "which are located completely underground," be deleted from the proposed amendment. Referred to Atty. Courtney. Discussion fo I lowed regarding time limitations on variances and special use permits. It was d.eterml ned that work should be started within six months after issuance of the permit. A termination date was discussed, but no decision made. Mayor Bjorndahl stated that he expected the proposed amendment would requ Ire special use permits and variance requests be rev I ewed after six months. Matters referred to Atty. Courtney. St. Paul Bib I e Co I lege Special Use Permit A letter fron Larry BI"od Ie, Chairman of the PlannIng Commission, relating to the status of the St. Paul Bib I e Co II ege' S special use permit was read. Clerk Lorraine Stromquist Informed the council that a special use permit was ne ve r actua II y granted to St. Paul Bible College; tentative approval of such permit was given, pending certain requirements which >lere to be met by St. Paul Bible College. These requ I rements to date have not been satisfied. . Proposed Committee for Business Development The Planning Commission is in favor of Mayor Bjorndahl's suggestion to organize a new five member committee for 1969 for the purpose of encouraging appropriate de ve lopments in Arden HIli s according to the . Comprehensive Plan. Th I s committee would work closely with the Counc i I and the Planning Commission. Board of Appeals Recommendation Letter, dated December 9, 1968, regarding their recommendation for a sign at the Standard Station on County Road E was tabled unt i I the next counc i I meeting. Counci 1- man Hollenhor"st will be unable to attend; Clerk was requested to contact Hunce Lagerstrom and request him to attend. - 4 - - ~ t!'i nutes of Regulal- Counci I ~1eeting December 9, 1968 Page Five REPORT OF COUNCILMAN CREPEAU - Public Safety Squad Car Bids Councilman Crepeau reported that only Ron Saxon Ford Co. submitted a bid for a new squad car. This bi.d was for $4,646.00, less $850.00 . for the trade-in, for a net amount of $3,796.00. Counc i I man Crepeau explained that the bid this year included the installation of some of the options, which i n p rev i ous years were later additions. Councilman Crepeau moved that the coun ell accept the bid of Ron Saxon . Ford Co. in the amount of $3,796.00, for a new squad car, subject to the approval of Atty. Courtney; seconded by Councilman Hollenhorst, motion carried. Fire Protection Aqreeme n t Counci Iman Crepeau moved approval of the 1969 contract agreement for fire protection, with the Lake Johanna Volunteer Fi re Department for an amount of $7,920 - one-half to be paid in January and the balance in Ju I y, subject to the approval of the Atty. Courtney; seconded by Councilman Ho II enhorst; motion carried. Mutual Aid Agreement Counci Iman Crepeau moved approval .of the change in the original draft of the ~1utua I Aid Agreement whereby the words 11 f i rel' and "flood" are to be de!eted; subject to approval of Atty. Courtney; seconded by Counci Iman Hollenhorst; motion carried. 77th Annual Sheriff's Convention Counci Iman Crepeau attended this convention and reported that attendance at this convention was the largest to date. A workshop, instead of a social function was included, which he thought was a great step forward. The convention also prepared a number of suggestions to be proposed at the 1969 legislative session. (j,.~ - " STATE OF MINNESOTA COUNTY OF RAMSEY . VILLAGE OF ARDEN HILLS RESOLUTION ESTABLISHING WAGE SCHEDULE FOR 1969 FOR EMPLOYEES IN DEPARTMENT OF PUBLIC WORKS AND PARKS . WHEREAS, Ord. No. 83, as amended, authorizes the Council to establish wage rates for Village employees, and WHEREAS, the Council deems it advisable to establish wage rates for the year 1969 for employees of the Departments of Public Works and Parks of the Village, NOW THEREFORE BE IT RESOLVED, that the Definitions and Wage Rates set full-t ime forth herein shall apply to/employees of the Departments of Public Works and Parks of the Village of Arden Hills during the year 1969, unless sooner amended by Resolution of the Council, and thereafter until altered by Resolution of the Council: A. DEFINITIONS. Heavy Equipment Operator as used herein shall include employees operating a motor patrol or pick-up sweeper, and also employees assigned by the Supervisor to do mechanical repair work, other than greasing and daily maintenance, on village equipment. LightEquipment Operator as used herein shall include employees operating trucks, tractors, large mowers, oilers, or concrete mixers. Water and Sewer Maintenance Men as used herein shall include . employees of the aforesaid departments while engaged in work on water or sewer facilities of the Village. . B. BASIC WAGE RATES. The basic wage rates during the year 1969 for the employees of the Departments referred to above shall be as follows: Heavy Equipment Operator $4.12 per hour Water and Sewer Maintenance Man $3.83 per hour Light Equipment Operator $3.71 per hour -1- . . In determining such wage rates the Council has considered the estimated amount the Village will pay for health insurance and allied insurance . benefits for such employees during the year 1969, which amount is estimated at 9 cents per hour. It is expected that employees in these Departments will do whatever . work is assigned them by the supervisor, which will undoubtedly mean that .some work during the day may fall under the category of Heavy Equipment Operator, other work under the category of Light Equipment Operator, and other work under the category of Water and Sewer Maintenance. During the time an employee is performing work within either of the two higher wage categories he shall re- ceive the wage rate per hour for that category; provided however, in the event any employee devotes more than 50 percent of his working hours during the calendar month in one of the two higher categories he shall receive the wage rate for such higher category for all working time during that calendar month. C. OVER'rIME'. The standard work week established by the Personnel Ordinance is 40 hours, consisting of 8 hours a day five days a week, Monday through Friday, Any work beyond 8 hours a day, or beyond 40 hours per week, or any work performed on'regularly-established non-work days, legal holidays or days observed as lega 1 ho lidays , is hereby defined to be overtime work and the pay schedule provided herein shall apply to it. A 'Hay" as used herein extends from midnight to midnight. Overtime work shall be performed in the event it is ordered or . directed by a responsible supervisor, and such overtime work shall be con- sidered mandatory when so ordered except in the case of sickness or unless . excused by the supervisor. For overtime work as hereby defined the employee performing the work shall be paid one and one-half (n) times the regular rate of pay established therefor. In the event an employee is put on stand-by alert for Saturdays, Sundays, or holidays he shall be paid at the rate of time and a half for a minimum of 4 hours on each such day, and this shall include an employee assigned to make routine checks on water, sewer and street facilities of the Village. -2- ~ J An employee called back to work after he has completed his regular work day, or called back to work on his day off, shall receive a minimum of two hours pay at the overtime rate. .
