BUSINESS FROM THE FLOOR New Brinhton Road - Placement of UtIlities ------------------------------------------ Ralph Perry, 3670 New Brighton Road, stated that he had been told by Engr. Roper Short that the water improvement would be I nsta II ed on the west side of New Brighton Road; however, the survey was belnp made for the east side of the road. He felt it would be more practical to have the sewer on the east side, as proposed, with the water on the west side. Counc II requested him to confer with Engr. Cou rtney regarding the title for this property. Attorney Courtney pointed out that there are deed restrictions on this lot wh ich are va lid unt i I 1976. The use of this lot for parkinp could possibly be in violation with the residential only use restrictIon. Attorney Courtney Informed the council of three possible actions which the council cnuld take; 1. The contract could be vol ded as the pro- pe rty is not lI11rketable for the proposed use. 2. Village could apply to the District Court to have the restrictions set aside. 3. The v i I I age could take the r I s k. H. Lagerstrom, chairman of the Parks and Recreation Committee, felt the proposed use of the lot would not be Questioned since the village did receive a petition f rom the residents In the area whIch reouested improvement of this playground. Councilman Crepeau moved that Atty. Courtney be authorized to conclude the apreement for the purchase of Lot 32, Block I, Arden Hills No. 2 , wi th .It.. Public Works Committee found no objection to Hr. Amendment to Ordinance No. 99 - First Reading Co un cT 1m an -Henderson-Introduced -il y- fT ff e-a'nd- moved the first reading be given to an ordinance amending Ordinance No. 99, the 70nlnll Ordi- nance~ to expand permitted encroachments and establish time limitations for variances and special use permits; seconded by Councilman Olmen; motion carried. Engr. . Lund fee I s I f Roberts se I I s one bu II ding then the Village should force a second connection. Mayor Bjorndahl expressed concern because Roberts has done work before In the vlllage without first obtaining permits. No permit was taken out fo r th is Installation and no approval for an exception to the ordinance was requested. A representative of the fire protectIon service which dId the installation was present; he explained ths present system and also the proposal for the future. He stated that no permit was required two yea rs ago when the system was instal led In the first building, but It was n.llllllence on his part for not applying for a permit for the connection to the second building. Mr. Beecher confirmed this statement by Informing the council that the first Installation was made in Ju I y, 1967, which was prior to the adoption of the ordinance. Atty. Councilman Henderson stated he was in favor of overlooking the violations since they occurred during the transitional period; Councilman Crepeau and Councilman . Olmen agreed. Councilman Henderson moved that Roberts ConstructIon Co. apply and pay for a water connection permit and, as recommended by Mayor Bjorndahl, a stipulation be p I ace d on file with the village from Roberts Con- struc,tlon Co. stating that If one of the buildings is sold, a separate . connection will be made; seconded by Councilman Crepeau; motion carried. Lund reported he had checked with the M. A. C. and also the F. A. A. and was told that a warning light Is not necessary on the water tower; they were not concerned unless the structure was at least 200 ft. In height. Mayor Bjorndahl expressed his concern for light planes and also helicopters, which are often not over 150 ft. ; he believes the cost of $1,000 for the I ight would be a good Invest- ment. Engr. Lund requested to further check the cost of a light. North Area Sewer Matter Engr:-Cund-fnformed-the council that a report will be ready by this Friday concerning sewer for the north area - specifically for the Twin City Trailer Park and the Griffis property. The council wi II then have time to study the report before the next council meet I ng. He stated that New Brighton wi II act on servicing the area, a f te r receiving a request from Arden Hi lis. Mr. Adams of the Twin City Trailer Park was present and understood the situation. Lift Station Valves EngF:-Cund-reported that the Iowa Valve Co. would supply new valves free of, charge for the ones that fal led at the Lake Johanna and In ge rson Road 11ft stations, If Arden Hills will agree to pay for the Installation. The company would like the valves that failed for study purposes. The counc I I ag reed to this proposal and requested Engr. Lund to so inform them. Engr. Reactivation of Sewe r Meters Engr:-Cund-fnformed-fhe-councl I that Rosevllle is Quite-anxious to have these Arden Hills sewage meTers reactivated. He, was requested to obtain Information regarding magnetic meters. . REPORT OF COUNCILMAN HOLLENHORST - Planning and Zoning (Absent) Reconsideration of Case No. 68-38 Mayor-Slorndahf-feff-fhfs-dfscusslon should be based on generalities; he expressed his opinIon that variances for convenience should he accomp I r shed In complete accord with neighbors. He read a portion of the Board of Appeals recommendatIon In which the Boa rd recommended approval with reservation in this particular case. Mr. DavId Wes:tlund, the applicant for the variance was present and stated he was under the impression that the neighbors were agreeable TO his request to construct a garage within the side setback area. Mr. H. Lagerstrom, '~r . Westlund's neighbor, voiced his objectio~,to the procedure used, but stated he now withdrew his objection t~ the variance. - 3 - Minutes of Regular Council "'eeting November 25, 1968 Page Four Councilman Crepeau informed the counc i I that the Planning Commission also had a 3 - 4 vote fo,r the I r recommendation of approval. Mayor BJorndahl believed more investigation Is necessary on these variances; be II eves when it is a matter of convenience the neighbors should be the main concern. Mayor SJorndahl apologized to ,Ar. Lager- . strom In behalf of the vlll age for this lack of communication In the chain of command. He requested Clerk Lorraine Stromquist to inform by letter the Board of Appeals and the Planning Commission of the council recommended procedure to avoid a similar situation In the future. . Council action of approval for Variance 68-38 given at the November ii, 1968, meet I ng remained the same. REPORT OF COUNCILMAN HENRY J. CREPEAU, JR. - Public Safety ~~~L~L~~L_~~~tt_~~~~~~~Q~~tL~Q Councilman Crepeau reported a Joint municipal court systemwasdls- cussed by the Public Safety Committee. The committee felt the present Justice of the peace cou rts in Arden Hills have been satisfactory since 1951; the cost to the village Is considerably less than a munl- cipa I or Joint municipal court; therefore, the committee recommends the cou~t system remain unchanged I n Arden HIli s until legislature requ I res a change. Clerk requested to Inform the Village of Shorevlew of the committee's recommendation. Village Lighting -----......---------.... The Public Safety Committee and the Public Works Committee concurred In their recommendation that renting lights from NSP would be much more economical than a village owned system. Councilman Crepeau stated that the Public Safety Committee recommends a complete village lighting system and noted that there were no recommendatio~ for lighting In the Mt~ Clllb and S.1~~~":.be .Cl~IlIPilRV areas. Councilman Olmen stated that the PublIc Works r.ommlttee felt there may be objections to lights from individuals, expecially those with pOl<er , ines Installed In the rear ,of the lots. Clerk Lorraine Stromquist Informed the council of a petition for lights received from the residents on Flora I Drive and also a request from the owner of a home being bu II t on North Sne Illn~j Avenue. Councrlman Crepeau recommended that Village street light committees be activated. Mayor BJorndahl stated that the village should proceed with the lighting for the Industrial and commercial areas as soon as possible and re- Quested Clerk Lorraine Stromquist to start cal ling for committee recom- mendations. . REPORT OF COUNCILMAN HENDERSON - Finance and Civic Center None REPORT OF COUNCILMAN OLMEN - Public Works ~~~~R~_~~~Q~~_I~~Q~~~~Q~Q~ Public Works Committee recommended that Mr. Beecher determine how much land is necessary for maneuvering equipment at this dead end site, possibly an L-shaped area would be the answer. Recommendation was made that written agreements be obtained from all involved property owners. The Committee also recommended that all natural gas, telephone and other utility companies notify Mr. Beecher before works is started. Public Works Radio Units ------------------------ As recommended by the P~bl Ic Works Committee, Counci Iman Olmen moved . the approval of -rhe purchase of radio units for two trucks at an estimated cost of $1260.00; also, the pur;hase of one portable unit at an estimated cost of $652 for a new unl t, or $250 for a used one; seconded by Councilman Crepeau; motion carried. . REPORT OF MAYOR RJORNOAHl - Parks and Recreation Skatinc:l Rinks ------......------ Mayor Bjorndahl reported that the village will provide four warming houses this year for the rinks, and also provide rink attendants. Last year Rosevllle took a survey of the number of skat,rs using the Johanna Jr. High School rink, whiCh showed 80S from Arderr HILI. and '20 from Rosevllle; Arden Hi lis wll I ~ake another survey ml~-year. Mr. Beecher was requested to contact Home Gas Co. for a heatlnc:l unit for the Mounds View High ' - School warmIng House. The Coon Rapids Mayor had called I~ayor Bjorndat. Extract of Minutes of Meeting of the Village Council of the Village of Arden Hills Ramsey County, Minnesota Pursuant to due call and notice thereof, a regular meeting of the Village Council of the Village of Arden Hills, Minnesota, was duly held at the Village Hall in said village on Monday, the ~th ~ fH ,.- day of ~l , 1968, at ~O o'clock p.m. The following members were present:BJorndahl, Crepeau, Of men, Hollenhorst,~ and the following were absent: 11........1 -R~ ~nllnrilm~n ~rApA~" introduced and moved the adoption of the following resolution: RESOLUTION ORDERING PREPARATION OF REPORT ON SANITARY SEWER IMPROVEMENT NO. 12 WHEREAS, it is proposed to improve that portion of the Village of Arden Hills lying generally north of Interstate High- way 694, east of Interstate Highway 35W, except the area previously included in Sanitary Sewer Improvement No. 6 by the construction of lateral sewers and appurtenances and lift station and force main to give immediate service to the northwest corner of the village, together with a main sewage pumping station and force main to serve as an outlet for the entire north area of the village, and to assess the benefited property for all or a portion of the cost of the improvement pursuant to Minn. Statutes Secs. 429.011 to 429.111 (Minn. Statutes 1965). , NOW, THEREFORE, BE IT RESOLVED BY THE VILLAGE COUNCIL OF - THE VILLAGE OF ARDEN HILLS, MINNESOTA: That the proposed improvement be referred to Banister Engineering Company for study and that they are instructed to report to the Council with all convenient speed, advising the Council in a preliminary way as to whether the proposed improvement is feasible and as to whether it should best be made as proposed or in connection with some other improvement, and the estimated cost of the improvement as recommended.
