PUBLIC HEARING - SANITARY SEWER NO. 11 Mayor Bjorndahl declared the public hearing open. Engineer Lund described the areas of the four separate projects In- Cluded In this assessment for a total assessed amount of $3,691.40; the cost of the projects was $4,017.52. The assessments were based on $6.90 a lineal foot - $3.10 a lineal foot had already been assessed. Engineer Lund stated that favorable feasIbIlity reports had been submitted to the Council by Banister Engineering Co. Atty. Courtney Informed the Council that he had reviewed the matter; the purpose of the hearing Is to answer questions regardIng the asse ssmen ts. There were no questIons or comments from the floor. Clerk Lorraine Stromquist stated that no letters were received regarding the assess- ments. Mayor Bjorndahl then declared the public hearing closed. Councilman Crepeau moved the adoption of a Resolution, as attached, approving the assessment roll as submitted by Engineer Lund, and directed the Clerk to accept prepaid assessments for a period of 30 days; seconded by Councilman Hollenhorst; motion carried. Clerk reported she had received a written request from Mr. Adams. Clerk Lorraine Stromquist reported . she had received a cal I from Mr. Schaeffer, New Brighton Village Manager. He informed her that Carley Engineering is studying the matter to determine If capacity Is available to accommoda~the trailer park, but New Brighton would like to pursue the matter with ,Arden Hills officials. . Said letter was not received before the counc! I meeting, but the representative submitted a copy of this letter. The requests outlined were as follows: 1. Extend VictorIa west from Lexington along the north boundary of said property to Fernwood Avenue (extended) 2. Extend Fernwood north from Its present terminus near the Arden Hil Is water tower to Victoria (extended), whIch road Is along the west boundary of said property. 3. Provide water, sanitary sewer and storm sewers under said roads. - 1 - -- ----- . .. Minutes of Regular Counci I Meeting - October 28, 1968 Page Two The representative stated that C. D. C. would like the road ready for next summer. Atty. Courtney stated that when roads were dis- cussed at the time of the water tower meeting. C. D. C. didn't feel the road was necessary for their purpose. Atty. Courtney recommended that matter be referred to the Plannin~ Commission to determine If a vi Ilage need exists for the road. - Mayor Bjorndahl felt the plat previously submitted showing the roads . would be adequate for presentation to the Planning Commission. He also felt calling the one road extension "Victoria" could present problems, but this could be considered later. Matter referred to the Planning Commission for its meeting on Monday, . November 3, 1968, and also to Atty. Courtney. Clerk requested to send copy of the Control Data letter of request to Atty. Courtney. C. G. Rein - Case 68-21 Mr~-C~-G~-Reln--and-Mr~-Milton Gray, his attorney, were present. Councilman Hollenhorst reported from the Planning Commission regarding the public hearing, stating that many residents were present In opposition and that a petition of opposition with the names of 186 people was also presented. The Planning Commission recommended denial of the special use request to al low construction of multiple dwellings for the following reasons, as listed in the Planning Commission minutes, dated October I , 1968: 1. The proposed use is not In harmony with the general purpose and intent of the existing housing polley. 2. The proposal does not show satisfactorily why this parcel cannot be utilized successfully as intended with single family dwellings. 3. The commission Is of the opinion that a serious traffic problem would be created with the proposed project, uncommon to that normal traffic load expected of a neighborhood of single family dwellings. 4. Adequate site planning.was not provided, the Quality of construction, based on his estimated costs, was Questionable, and the verbal description of the con- struction would not meet the VillaQe BuildinQ Code. ~~'I...~v, ,,1 Informed the counci I tha; the vi Ila~e planner had requested a site plan; he does not know if this has been sub- mitted, but felt this should be in before the council considered the matter. Mr. Rein Informed the council that he had read the Planning Com- mission minutes, but felt the Council could grant approval subject to the submission of these plans. . Atty. Courtney stated that Mr. Rein should be given an opportunity to present any additional material which was lacking at the Planning Commission meeting that might help his position. . Mr. Gray informed the council that he noted the four points in the Planning Commission minutes on which the Commission has based their recommendation of denial, and would like to deal with them point by point. He stated their purpose is to comply with every reasonable request. Mr. Gray then commented on the individual points, as follows: No. 1 - Mr. Gray informed the councl I that he had read the HousinQ PolIcy of 1966; he felt no pol icy, as such, has been established by the council. He asked what the existing housing pol icy is. No.2 - Letter, dated May 1, 1968, from Mr. Rein to the PlannlnQ Commission, which is on record, gives reasons why they feel property is not economically feasible for single fami Iy dwell ings. Mr. Gray then proceeded'to read the letter, which stated also that the area was feasible for multi-fami Iy dwellings. t!<2.,-_~ - Mr. Gray bel ieves that the "serious traffic problem" Is - 2 - . . . . Minutes of Regular Counci I Meeting - October 28, 1968 Page Three purely speculative as to how much more traffic there would be from the complex in comparison with the traffic from 30 single fam II 'I dwellings. He stated that there are arteries to feed the project and he could get an engineering estimate regarding this. Mr. Re i n displayed an architectural drawl ng of the complex. He won de red whe re in Arden Hills would multi-family dwellings not . increase traffic, sl nce the counc i I will only consider multi- family dwellings in residential districts. He believes 9 - 10 thousand cars travel on Cleveland Avenue in a 24 hour span - the complex would really add a sma II percentage to the traffic load. . No.4 - Mr. Rein stated that all site plans that have been requested have- been submitted. The cost of supplying site plans and construction plans Is not feasible unless the council gives some Indication of granting the permit. He said they will comply with all codes and regulations of Arden Hills and wi II request no waivers; they will comply In every respect. Mr. Rein further stated that he does not know of any deficiencies In the presentation to the Planning Commission. He reported that construction of the complex will be the highest quality within a three mile radius of that site. A buffer zone of 185' will be provided in a II directions and will be used for single family construction; none of the present homes would be neighbors of the multi-family housing. He stated that 51% of a II housing construction today Is mUlti-family. These matters were then discussed by the council and additional questions were raised by various members of the counc I I . The mayor In qui re d into the buffer zone suggested by Mr. Rein and asked whether this had been proposed to the Planning Commission. Councilman Hollen- horst pointed out that there was a question whether the site was suit- able for single family dwellings, and, also, commented that people at the Planning Commission public hearing were overwhelmingly against the application. With reference to the site plan, Atty. Courtney pointed out that this was a prel imlnary requirement under the Housing Policy, that apparently an adequate site plan had not been submitted to the Planning Commission, and It was up to the applicant whether or not he chose to meet the requirement. He also stated the Housing Policy and the Comprehensive Plan, as proposed by the Planning Commission, and approved by the counc II must be considered by the Planning Commission and the council along with the Zoning Ordinance. Atty. Gray stated he felt they should not be required to present a specific plan without first being told that the council was generally In favor of the application since specific plans would be expensive. ~~i~!t the Planning Commission should first consider . any additional material to be submitted. /> After additional discussion, Counc t lft:repeau moved that the matter be re-referred to the Planning Commission to take such additional . information from the applicant as he chose to submit, with the Planning Commission to decide whether or not a new public hearing should be held. Courtney had written a letter, dated October 28, counc I I in which he recommended approval of the transfer of the Ii quor Ii cense for McGuire's, subject to a check by the police and fire departments. Councilman Crepeau stated that these checks have been made and reported that conditions were satisfactory. Co. He stated there was no permit issued for this work. Mr. West informed the counc j I there we re no inspections of the work, because no permit was taken out. The Ordinance requires each piece of pro- perty to have se pa rate se rv ice; Robe rts Is asking for permission for . one service for ~wo bui Idlngs. Atty. Courtney and Counci Iman Crepeau concurred with a recommendation that Mr. l'lest and Mr. Beecher meet with Mr. Roberts concerning the matte rand ,-eport to the council. . Mayor BJorndahl stated that Roberts should be prosecuted for violation of the Ordinance for not taking out the permit, and, If the service is not satisfactory, the work should be done again. Councilman Hollenhorst suggested that perhaps Roberts Should get a statement from Fire Underwr I ters regarding the matter and submit the report to the counci I. Atty. Courtney requested the date w.hen the work was done. Courtney's letter of September 30, 1968; Atty. recommended no action by the Council. Water Assessment Procedure - Co Rd 0 Atty:-CouF'fney-F'eportedTe has a communication f rom the League of Minnesota Municipalities regarding the water improvement assessment for the homes on County Road 0; the present procedure Is TO pay The fu II assessment to Rosevi I Ie as they connect directly to the Rosevllle main. Atty. Cou rtney suggested that if the owner wants to spread the assessment cost over a period of years the cost could be obtaIned from Rosevi lie; Arden Hil Is could then pay Rosevllle and assess the owner. He re,commends revising the Water Ordinance to provide this procedure. Atty. He sta-;-ed that Mr. Krannak is agreeable, and suggested con- currence by tho Ccuncll. Matter referred to the Public Works Committee. The basis for the appraisal was $12,000 per acre. Mr. Krannak Is assuming this easement wi II be in the setback area. Mr. Bettendorf suggested that easements be obtained for a II utilities at once Instaad of one at a time. Mr. Krannak's appraisal considers the sewer easement already on the . property. Mrs. Rank rep lied by letter that she would confer with Mr. Lynch on the matter. Atty. Courtney suggested that, If no agreement can be reached, the easement be obblned by condemnation. Engr. Engineer Lund drew a rough sketch of the site showing the proposed additional area to provide for a turn around. Mr. Roesler questioned the feasibility of the plan. Engineer Lund to prepare a drawing of the plan, an estimate of cost for the Improve- . ment, Including the upgrading of the road, and also an ownership report. ~~~~~~~~~~@~~~~~~~ da~ed October 25, Engineer Lund submitted a letter, 1968, with copies . to the Counc II which described a proJect which would solve the drainage problem In this area. Attac~ed to said letter was a map showing 84 lots which would benefit from the improvement and could be assessed. These were given to the counc i I for study and considera- tion for counc I I action. If, in the future, Mr. Reiling would like water hydrants placed along the main through his property, would the village pay for these, or would the property be assessed: he would like a policy statement. Engineer Lund stated that hydrants are placed on the mains in developed areas only, but felt this should not be an assessment. Councilman Hollenhorst moved the approval of a change order to Water Imrrovement 68-1 at an estimated cost of $1,456.00 to construct an 8" nain across Johanna Blvd. to se rve Lot 26. Block I, Arden Hills; seconded by Councilman Crepeau; motion carried. Engineer Lund explained that the cost appeared to be high, but this I s due to crossing a county roar. Lift Station Problems EnglneerTunrreported that~he 11ft stations at County Road E and Johanna Blvd. and the one o~ Ingerson Road are having problems with . check valves. Codification of Ordinances Clerk-Corrafne-SfromqulsF informed the counc i I that Shorevlew has not completed its codification of the ordinances, that for Shorevlew It has been costly and that their attorney revises Ordinances to a limited degree. Council referred again to Atty. Courtney the codification of the Arden HII Is ordinances to get the project o;tarted and then the project to be referred to the Ordinance Com- ml ttee. RESOLUTION ADOPTING ASSESSMENT ON SANITARY SEWER IMPROVEMENT NO. 11 AND DIRECTING CERTIFICATION OF THE ASSESSMENT TO THE RAMSEY COUNTY AUDITOR. . BE IT RESOLVED by the Council of the Village of Arden Hills, .Minnesota as follows: WllEREAS, pursuant to proper notice duly given as required by law, the Council has mat and heard and passed upon all objections to the proposed assessments for extensions to the Arden Hills sanitary sewer system, said extensions being described as follows: (a) Construction of 8" sanitary sewer along south side of County Road F from Valentine Avenue easterly 200 feet and thence approximately 60' across County Road F to service Lot 13, Block 2, Valentine Hills. (b) Construction of 8" sanitary Sewer along the west side of Lexington Avenue northerly 120 feet from a point 160 feet north of Lakeview Avenue. (c) Construction of 8" sanitary sewer across Lake Johanna Boulevard to serve property described as lot 3, Block 5, Shady Oaks Addition. and, WHEREAS, said hearing was duly held at the Arden Hills Village Hall at 8:00 o'clock P.M. on October 28, 1~68, and it was duly noted that no objections oral or written, were received by the Council at said meeting or otherwise, although proper mailed and published notice of said hearing had been given as required by law and as shown by the file herein, NOW THEREFORE, BE IT RESOLVED BY THE VILLAGE COUNCIL OF ARDEN HILLS, . MINNESOTA: 1. Such proposed assessment, a copy of which is attached her~to and . made a part hereof, is hereby accepted and shall constitute the special assess- ment against the lands named therein, and each tract of land therein included is hereby found to be benefited by the proposed improvement in the amount of the assessment levied against it. 2. Such assessment shall be payable in equal annual installments extendi with over a period of 20 years, the firstaf the installments to be payable BBXDX general ~ taxes collectible in 1969, and shall bear interest at the rate of , -1- -, . ,. 6 percent per annum from the date of adoption of this assessment resolution. To the first installment shall be added interest on the entire assessment from the date of this resolution until December 31, 1969. To each subsequent . installment when due shall be added interest for one year on all unpaid in- stallments. . 3. The owner of any property so assessed may, at any time prior to certification of the assessment to the county auditor, pay the whole of the assessment on such property, with interest accrued to the date of payment, to the village treasurer, except that no interest shall be charged if the entire assessment is paid within 30 days from the adoption of this resolution; and he may, at any time thereafter, pay to the county treasurer the entire amount of the assessment remaining unpaid, with interest accrued to December 31 of the year in which such payment is made. 4. The Administrative Clerk shall forthwith transmit a certified duplicat of this assessment to the county auditor to be extended on the proper tax lists of the county, and such assessment shall be collected and paid over in the same manner as other municipal taxes.
