The minutes of the Regular Council Meeting of September 30, 1968
were approved as submitted.

Mr. Dean Carlson, representing Llv-A-Snaps Inc. requested that Council
grant an 8 ft. height variance, permitting the constructIon of a sign
as proposed by Midway SIgn Company, for their location on Fernwood
Avenue in Arden Hills. This height variance, he said, would help
Identify the Llv-A-Snap location, which Is dIfficult to see from
either Lexington Avenue or from County Road F.
Council suggested that the two water towers and the Control Data
Buildings be used as land marks In describing the location of the
L1v-A-Snaps bur Idlng locatIon, stating that Councl I Is reluctant to
grant sign hleght variances.
Mr. CaIson presented an alternate variation of the sign which does
not require a variance. Council advised Mr, Carlson that this
variation would not require Council actIon and the permit may be
obtained at the Village office. Mr. Carlson agreed to proceed with
the alternate sign, not requiring a variance,

Attorney Courtney advIsed that a letter from the Attorney for Truck
Crane Service Company has been received by AdmInIstrative Clerk
Lorraine StromquIst, dated October 14, 1968,. requesting that the
On and Off Sale Liquor Licenses, held by Truck Crane Service Co.,
. be transferred, effective November " 1968, to 'kGulre's, Inc. The
matter has been referred to Attorney Courtney by Clerk Stromquist.
Mr. Courtney requested that the Clerk notify Attorney Richard Meyers
to submit all necessary documents to her office before October 28,
1968, requestIng that she then refer these documents to him for
. review. Clerk was also requested to send a copy of the Liquor Ordi-
nance to Attorney Meyers.

Attorney Courtney reviewed his letter to the Council, dated October
14, 1968 in which he advised the Council of the Ordinance provisions,
one of whiCh is the requirement of separate water connections for
each buil1ing. He advised that inter-connections, such as has been
described in this case, can cause some problems such as no control
of the water connection to the second building which could result
In a fire hazard to both buildings.
Mr, Courtney suggested that the extra copy of his letter to Council,
be forwarded to Roberts Construction Co., requesting that they furnish
any additional information they may have regarding this water install-
ation. It should be noted also that there has not been a permit
Issued by the Village for the sprInkler system to 1230 Gray Fox
Road, which Is presently being Installed.

Afforney-Courfney-revlewed-hl; letter to Council, dated 19/9/68,
cc to Mr. Brodie, IndlcatlnQ several Items which he felt should be
clarified on the final plat:
Mr. James Johnson, developer of this proposed plat, was present and
advised he had talked with the '~Innesota Hlflhway Oepartment reflardlnfl
. the plat, and was advised that they had approved the preliminary
plat and have no objections to the final plat. He also talked with
N.S.P. Co. reflardlnfl the three Utility Easements referred to In Atty.
Courtney's letter. N.S.P. explained to him that the 1959 easement
was an option that was not exercised by N,S.P., the 1942 easement
~ was also not belnfl used by N.S.P. The third easement extends across
a corner of the plat for a transmission line, which Mr. Georfll has
added to the plat, submitted to Attorney Courtney.
Attorney Courtney advised that Mr. Johnson obtain a release from
N,S.P, for the 1942 and 1959 utility. easements, one of whiCh Includes
a provision for a push brace whiCh Is not shown on the amended plat.
He further advised that Mr. Georgi clarify the descrlptl~ns of the
Highway Dept. takings for concurrence In language.
Because of the time element Involved, and the urgency of potential
purchasers to construct basements for two homes In th I s P I at before
frost, Mr. Johnson requested that the matter be expedited If possible.
It was moved by Councilman Henderson and seconded by Councilman Olmen
that Council approve the amended plat authorizing It to be signed
by Mayor and Clerk as approved by the Planning Commission at a
special meetln g to be scheduled after the amended plat Is submitted by
Mr. Johnson. (Several copies to be submitted). The amended plat
should Include the above clarification requlr~ents; motion carrIed.
The Clerk was requested to forward the executed copies of the plat
to Attorney Courtney for final review. Mr. Johnson was advised that
after this has been accomplished, he then must file the approved
plat with the Ramsey County Plat Commission for approval.

Co. to audit the 1968 VI'IaQe Accounts, at a cost not to exceed

Engineer Lund reported that the 'ot on the north side of Ingerson
Road, across from Ingerson Court, appears to be a buildable lot.
. The Village has the first chance at ownership on tax-forfleted pr~erty,
If It deslr~ to exercise Its option, but the previous owner has
Indicated that he would like to have the property back. The matter
will be considered by the Parks and Recreation CommIttee at theIr
meetlnQ of 10/ 15/68.

Engineer Lund advised that the CouncIl had been polled re proceedlnll
with this possible change order, because the contractor was working
In the Immediate vaclnity. The Change-order has been prepared and
maIled to the VIllaQe offIce. He advised that the orlQlnal cost was
estimated at t7,OOO:00 but the actual cost of $5,852 resulted because
of 200 feet less construction required. I.J-:Y'

Engineer Lund explained that Northern Contracting Co., contractors
for Water Improvement 68-1, have requested payment of their claims
by the 15th of each month. rather than the end of the month. This

was approve by the Council, providing all claims are first approved
by Banister Engineering for payment.
It was moved by Councilman Crepeau to approve payment of vouche rs
#1708, 1709, and 1710, as presented, in payment of claims to Northern
Contracting Co., McDonald and Associates, and Orfel and Sons, I nc.,

Engineer Lund advised that the booster station on Red Fox Road Is
substantially complete, the gas I s In but the electric service has not
. been completed by N.S.P. - they are proceeding, however, according
to schedule,

Engineer Lund a vised that construction of Wa te r Improvement 68-1
Is almost complete; some testing remains to be done; some lines are
now ready for connections.
REPORT OF COUNCILMAN JOHN HOLLENHORST

Mr. Brodie advised that because of a previous Council provision that
the trailer park not be extended to allow more than 93 trailer lots,
Is the recommendation of the Planning Commission to deny the request
for six additional trailer spaces, The Commission recommends approval
of the garage-uti Ilty building, as presented.
Mr. O'Leary and Mr. Adams, owne rs of the Twin City Trailer Park, were
present and advised the Council of major Improvements I n the park,
and that the additional land acquired by Mr. Adams should be ut III zed
In some manner, It is for this reason that the additional lots are
requested.
Mr. Roesler, 1964 Mound Avenue, stated that he does not want to took
at more trailers across the street. It was requested by Mr, O'Leary
that the matter of the additional lots be tabled temporarily. He
requested suggestions for the utillzatton of this vacant land and
was referred to the Planning Commission for suggestions.
Mounds Avenue
Mayor-aj"orndah I advised that he and Councilmen Crepeau and Olmen, as
we II as Engineer Lund and Village Maintenance Supervisor, Ev Beecher,
have visited the Mounds Avenue site, and it Is recommended that a
T-shape turn-around area be created, probably requiring an area of a
about 12' to 15 ' In width and 15' to 20' in length, permitting a
. snow plow to turn around. Mr. 0' Leary asked that the area requ I red
be staked so that the Trailer Park can be fenced accordingly. Mr.
Beecher and Engineer Lund were requested to do the staking,
It was moved by Councilman Crepeau that the Council concur with the
. Planning Commission recommendation of app rova I of the construction of
the garage as shown on the plan; seconded by Commissioner Olmen, carried,

Councilman-Crepeau moved concurrance with the Planning Commission
and Board of Appeals recommendations of approval of the variance as
presented; seconded by Councilman Olmen; carried.

to Lexington Avenue to alleviate a traffic hazard which already
eXists and will be compounded with the addition of 1000 additional
Control Data employees, '~r. Lind agreed to do this.
Mr. Brodie advised that the Planning Commission recommends that
Council approve the Rul Iding Permit applied for by Control Data, as
~ presented, subject to:
1. Agreement by Control Data to meet the parking requirement
of one parking space for each lt employees. (Site plan to
be amended to show this added parking.)
. 2, Approval of landscape plans by Planner C. Dale,
3, Approval of drainage plans by Engineer Lund.
4. Approval of building plans by Rulldlng Inspector Clay
Ke Iley.
Recommending that the Rul Iding Permit be issued prior to receipt of
the above Items so that construction can be commenced before frost,
It was moved by Councilman Crepeau that Council concur with the re-
commendations of the Planning Commission as stated by "r. Brodie and
outlined in the Planning Commission minutes of October 1, 1968;
seconded by Counci Iman Olmen; carried.
Case No. 68-36, Jerome Timm Variance,
i.'r-:--BrodTe-explained that "r, Timm, applicant for the variance, Is a
prospective purchasee of the property, pending the outcome of this
variance request. He explained that a previous variance may have been
granted to Mr, Wilsey, present owne~ of the property, br previous
construction on this site, The Planning Commission recommends approval
of this variance, as presented, subject to provisions possible
outlined in the previous variance which was available to the Planning
Commission, Mr. Wilsey state~ that a previous variance request had
been made but he did not believe a formal variance was filed with
the Village. Clerk offered to check this with the Village records.
Bulldlng inspector Clay Kel ley stated he felt this requested proposal
a definIte Improvement and therefore recommended approval.
It was moved by Councilman Crepeau to approve the variance, as presented
on the plan; seconded by Councilman Olmen; carried.
Case No, 68-30, George Heckman Subdivision Variance
A-feffer-~-dafed September 3D, 1968, from Engineer Lund, was read by
Mr. Brodie In which Mr. Lund recommended that anyone building on this
newly developed lot, advise Banister Engineering Co, so they can
establish the proper grade for building; also that It may be diffIcult
to construct a driveway on this lot along the west edge because of the
rapid change In grade; that there does not appear to be any reason
that would render the lot unbui Idable,
~ Mr. Brodie advIsed that after review of the survey which was submitted,
It Is the recommendatIon of the Planning Commission that Council
approve the subdivIsion as presented, walving the subdivIsion re-
quirements; advising the applicant of the comments of the EngIneer
. regarding establishing proper grade and the possibility of the
difficult driveway situation; advising that a variance will not be
granted in the future for construction on this property.
It was moved by Councilman Crepeau that Councl I concur with the
recommendations of the Planning Commission as outlined; seconded by
Counci Iman Olmen; carrIed.

Mr. Brodie advised that -the Planning Commission recommends approval
of the proposed purchase of the tot south of the Hockey rink for use
as a parking lot.

Mr. Brodie advised that the Planning Commission recommends that
utIlity easements be Included as permltted encroachments within the
setback requlrements, Section 11, Paragraph 8 of the Zoning Ordinance,

When asked by Mayor BJorndahl If this was meant to Include hlQh-
voltage lines as well, '~r. 8rodle said he was of the opinion that the
Planning Commission meant to Include all utility easements as permitted
encroachments, Mr. Brodie was asked to write this Planning Commission
recommendation to Attorney Courtney, '

Mr. BrodIe explained that this case was on the Planning Commission
agenda for their last meetIng but al I the required plans have not
been submitted as requested; consequently, the Planning Commission
. cannot make a recommendation at this time,
REPORT OF COUNCILMAN HENRY J. CREPEAU JR.
News Release
Councilman-Crepeau requested that the Vi I lage residents be Informed,
probably by a news Item In the newspapers, to advise the Pollee
Department when planning to be out of the Vi Ilage for an extended
length of time; the pollee office wIll advise them of precautions
to be taken. He said the Village has been plagued with a series of
break-ins and vandalism.
Mr. Crepeau read a letter from Flaherty's Arden Bowl, praising the
Arden Hills Pollee Department, and specifically Pat Sexton, for the
efficient police action in the recent armed robbery at Flaherty's
Arden Bowl.
Mr, Crepeau reviewed an editorial, written by Wm. Benzick, printed
In the Arden HII Is Jaucees Newsletter, dated October 11, 1968, which
he said be takes except Ion to, stating that the basis for such an
edItorial Is unfounded. Mr. Ron HerrIck, fellow Jaycee and Village
resident, stated that the newsletter wll I print any edItorial
wrItten by a member of the Jaycees. This editorial does not
necessarily reflect the opinion of other Jaycees and was probably
meant to create controversy and Interest in Village affairs.
Mayor BJorndahl further took exception to the statement In this
editorIal whIch stated that the Village does not inform residents
of matters before the Vii lage, and cited several examples when Village
mailings, advising residents of major matters such as water hearings and
and assessment hearings, whIch were only attended by a few residents.
Clerk Stromquist advised that Council meeting agendas and ~Inutes
of both Planning Commission Meetings and Council Meetlnqs are sent
to all Interested organIzatIons, of.whlch the Jaycees Is'one, as well
as to four newspapers.

It Mounds AVenue - This matter was considered earlier in relation to the

. Councilman Olmen advised that MR, Fred Nixon has reslqned from the
Public Works Department, effective Friday, October 4, 1968, Council-
man Olmen moved acceptance of Mr, Nixon's letter of resignation, as
of this date; seconded by Councilman Crepeau; carried,
Clerk Stromquist advised that Mr, Nixon's final payroll check and one
for 40 hours of vacation time have been prepared and are ready for
signatures,

Councilman Stanley Olmen moved that, on the recommendation of Main-
tenance Supervisor, Mr, Beecher, that Counci I approve th~ appointment
of Mr, Albert Hintz as a probationary full-time Public Works Depart-
ment employee, starting October 14, 1968 at the hourly rate of $3.43
per hour; seconded by Counci Iman Crepeau; carried.

Mr, Beecher advised that he has obtained two bids for overhead
heaters for the Public Works building at 1440 West Hi!1hway 96, as
well as a cost estimate for the repair of the present furnace;

costs.

Including tank.

Mr. Beecher explained that these costs Include a small heater In
the office and one In the bathroom. He said If overheac' heaters
are installed, valuable floor space will be available when the old
furnace Is removed, probably enough space for another truck.
He reported that the well on the property Is sTili nOT In working
condition.
It was moved by Councilman Olmen that Council accept the Home Gas
Installation at a COST of $1500.00, as presented by Mr. Beecher;
seconded by Councilman Crepeau; carried.

Human RIQhts Commission MeetlnQ
Mayor-SJorndahf-reported-that-the Human Rights Commission held a
meeting on Monday, Octo be .. 7, aT which IT was The concensus of the
members to try to understand the problems as they exisT in the
suburbs. 'T Is Their IntenT to attend discussions, and Invite
representatives from other Arden Hills orgainzatlons to atTend their
meetln9 to In turn advise their memberships of what the Human Rights
Commission Is doing.

Mayor Bjorndah I advised that the University of Minnesota has been
most cooperative with the Vlllage in the Oak Wilt Survey, and the
University now has requested that the Vil!age conduct a survey to
determine the varieties, and number of each variety, of trees In the
. V i II age. It was suggested that perhaps a VI I lage organization con-
duct this survey.
Mr, Ron !lerrlck, a Jaycees member, stated that he felt this project
. would be one that the Jaycees might be interested in.
REPORT OF BUILDING INSPECTOR CLAY KELLEY
Mayor Bjorndahl read a written report by Building Inspector Clay
Kelley, in which Mr. Kel ley advised the Council that the required
boulevard excavations have been made in the Industrial Park and that
construction of the boulevards should be finished this week,

Clerk Stromquist reported that a letter re the results of the nego-
tiations between Treasurer W. Read and Fiscal Agent Peter Popovich
. has been received, designating the fee schedule at 3/4 regular rate
for minlclpal bond issues fol lowlng temporary financing after an
Interval of two to three years.

. Clerk Stromquist advised the Council that a publication, the Grapev I ne,
from MoundsVlew Schoof District 621, Is being sent to the Village
office each month, In the current Issue, the School Board requests
suggestions for the name for the new elementary school to be located
In Arden Hills on County Road E2.

suggested that about five persons from each neighborhood be Included,

by the Metropolitan Council. Mrs, Stromquist advised that the Village
office would quote these figure estimates as official estimates.
