The minutes of the Special Council Meeting of May 23, 1968, regarding
Water Improvement No. 68-3 were approved as submitted.

Clerk Lorraine Stromquist opened and road the clgtt bids submitted as
attached. All bids were for the truck body and equipment; no bIds were
received for the truck as the automobile companies are now changing over
to the 1969 models and prices are not now avai lable. Attorney Courtney
Informed the Counci I that the awarding of the bid can be delayed for only
30 days.
Councilman Hol lenhorst moved, seconded by Counci Iman Crepeau, that the
bids be referred to the Publ ic Works Committee for recommendation on the
awarding of the bids, and, also to ascertain when truck bids will be avail-
able; motion carried.

Clerk Lorraine Stromquist opened and read the one bid submitted.
Counci Iman Dlmen moved approvai of awarding the bid for sewer roddlng equip-
ment to Flexible Pipe Tool Company, 4725 Excelsior Blvd., Mlnneapol Is,
Minnesota 55416, for the amount of $4,829.00, subject to the approval
of Attorney Courtney; seconded by Councilman Crepeau; motion carried.

Mayor Bjorndahl declared the public hearing open.
Enginee,' Don Lund explained this proposed project consists of 560 lineal
feet of sewer on County Road E2 at a cost of $5,800.00. The Improvement

which stated opposition to the assessment as they do not have any plans
at this time for developing the property; no representation from Bethel

Counci Iman Hol lenhorst moved the adoptIon of a Resolution approving the
construction of Sanitary Sewer Improvement No. 10, authorizing the mayor
and clerk to sign the agreement with the Ramsey County Board. approving
plans and specifications as prepared and previously submitted by Banister
Engineering Co., directed Banister Engineering Co. to prepare bid forms

Mayor Bjorndahl reported that Standard Form 101 has beDn submitted to

regarding apparent ordinance violations to the Building Code resulting
from unsatisfactory completion of the site plans, and also allowing a
building to be occupied without first obtaining a Certificate of Occupancy.
Attorney Courtney further reported that he received a report from Bui !ding
Inpsector Clay Kelley which detailed the circumstances and recommended
notice be served on Roberts Construction Co. as provided in the Building

Cliff Lund appeared in behalf of Roberts Construction Co. and Informed
the Council that -rhe elimination of -rhe islands bet\Hlen buildings three
and four was approved by the Planning Commission as they would create
snow plowing problems, etc.
Mr. Lund stated that it was an oversite that a Certificate of Occupancy

a truck terminal. He informed the Council that if this type of business
was in operation before the passage of the Zoning Ordinance, passage of
the Ordinance can not make the operation II legal.
Council requested Clerk to determine the date on which Mr. Lawrence be9an

letter dated July 23, 1968, from Attorney Courtney to Clerk Lorraine
. Stromquist gave his opinions regarding methods of assessing the residents
on County Road'D in Arden Hills for the water assessment.
Residents on County Road 0 are across the street from the Rosevllle water
line and are permitted to connect to this line by agreement with Rosevllle
and paying an assessment to Rosevllle without any deferment. These resi-
dents are not Included in any proposed Arden HI 'Is Water Improvement nor
are they Included in Water Improvement 68-1; residents tn an Improvement
area are given the option of paying the assessment or spreading the pay-
ments over a 20 year period. Some of the residents on County Road 0 have
requested that they also be given this option. Matter referred to Atty.
Courtney for further study of a method of legally complying with this
request.

Attorney Courtney read a paragraph from his letter, dated July 18, 1968,
to Clerk Lorraine Stromquist regarding the simple division of a lot. He
stated that this could be done as a variance as provided In Ordinance 98.
Clerk Lorraine Stromquist Informed the Council she has several similar
requests. The Council referred the simple division to the Planning
Commission for recommendation to the Council; matters speCifically to be
considered should be uti I ities and access matters. Clerk requested to
submit copy of Attorney's letter to the Planning Commission.
Attorney Courtney also informed the Council that a registered land survey
Is acceptable In lieu of a plot and Is processed as outlined In Sec. 5
of OrdInance No. 98.

Mr. Wagnoner, 638 Harriet Ave., St. Paul, owns and plans to build a home
on a lot on County Road E; this lot abuts on the east side unimproved
Wesley Ave. Mr. Wagoner has requested permission to improve Wesley Ave.
so his driveway would have access to Wesley Ave. Instead of County Road
E.
Attorney Courtney prepared and submitted a rough draft of an agreement
between Arden Hi lis and Mr. Wagoner, which specified the village's
position regarding this private Improvement. Council referred the contract

. delay any study regarding the proposed increase in gas rates until St.
Paul has completed its stUdy; as the suburbs cannot be Included in the
St. Paul study. Arden Hills does have an ordinance, Ordinance No. 10,
regarding gas rates, but no such ordinance concerning electric rates.
Clerk Lorraine Stromquist Informed the Council that Mr. Dries, Public
Relations Representative from N.S.P., is willing to meet with the council
at any time.
Council requested Attorney Courtney to write to N.S.P. to Inform them
that Arden HII Is would I ike to delay a decision regarding the proposed
rate increase.

readings be given to Ordinance No. 108, Ordinance prohibiting unreason-
able acceleration of motor vehicles In Arden Hil Is and providing penalties
therefor, and Ordinance No. 109, an Ordinance repealing Ordinance No. 79,
relative to adoption of the Highway Traffic Regulation Act; adopting the
Highway Traffic Regulation Act as amended through 1967, and providing
penalties therefor; and authorized the Clerk to cause their publication;

. Attorney Courtney Info. rmed the council that Mr. and Mrs. Charles Johnson,
3246 Lake Johanna Blvd., are asking $750.00 for an easement for the Water
Improvement.
An Itemized list of loss of tree~ and shrubs on this property was submitted
by Rose Hill Nursery - estimate of loss amounted to $743.25.
Council referred to EnQlneer Lund to obtain from another nursery an esti-
mated cost of loss. -

Engineer Lund reported that eight bids for this improvement were received
and read on Friday, July 26, 1968. He distributed caples of the tabula-
tion of bids to the Council.
Councilman Olmen moved, as recommended by Engineer Lund, that the contract
for Sanitary Sewer Improvement No.9 be awarded to the low bidder - Orfei
and Sons, Inc., 1156 Homer St.. St. Paul, Minn. 55116, In the amount of
$27,251.75, SUbJect to the approval of Attorney Courtne~ seconded by

Mr. Griffis was present and requested council consideration to allow his
property, located east of 35W and west of Round Lake, to connect to the
New Brighton sewer system. He showed the Council' a map which showed the
property. Engineer Lund expressed his opinion that the best way to service
this area would be thru New Brighton if New Brighton can accommodate the
addition.
Councilman Hollenhorlt moved; seconded. by Councilman Crepeau, that Clerk
Lorraine Stromquist be directed to write to Robert Schaeffer, New Brighton
Manager, and request New Brighton to study the matter of sewer capacity
to accommodate this area; motion carried.

Engineer Lund summarized his letter dated July 12, 1968, to the Council.
He stated that the 1200 gallons per hour pumping capacity might be satis-
factory to both parties as a temporary measure.

requested that a sewer line be instal led at the time the water Improve-
ment is constructed.

Matter referred to Engineer Lund to confer wIth Attorney Courtney regard-
ing the legality of getting a sewer construction price from the water
eontractor.

. Engineer Lund reported that the plans are ready for the construction of
the water I ines to service Bethel College, but he does not have a cost
estimate from the contractor yet. Engineer Lund wi II prepare the speci-
fications for the proJect.

Engineer Lund submitted a plan to solve the drainage problem In the Fern-
wood, Ingerson and Carlton Drive area. He explained the plan was a
composite of plans previously prepared; the plan involves instal ling some
new storm sewers eliminating some, and the regrading of Ingerson Rd.
Estimated cost of the proJect is $13,000.00 and could be constructed when
the water is Installed.
Engineer Lund requested to send a copy of the plan to Clerk Lorraine
Stromquist who wi II forward it with a letter of explanation to David Irwin
of the Lake Josephine Improvement Association.

Letter dated July 22, 1968 from County Engineer Deane Anklan, stated the
proposed re-al ignment of New Brighton Road is not feasible from a safety
standpoint because the next intersection would be a distance of less than
300 feeor.

Engineer Lund reported that Mrs. Reeves has not submitted the information
necessary for him to make a recommendation to the Council.

RESOLUTION CONSOLIDATING WATER IMPROVEMENTS
NUMBERED 67-1 and 67-2, DETERMINING THE
AMOU1;rI' OF THE EXPENSE ~.;HE:C:EOF TO BE PAID
BY 'I'BE VILLAGE OF ARDEN HILLS AND THE AMOUNT
TO BE ASSESSED, AND DDEC~.'nK PREPARATION
OF AN ASSESSMEN'1' ROLL
BE IT RESOLVED by the Council of the Village of Arden
Hills, Minneso'ca, as follows:
1. The Village has heretofore instituted, ordered and
contracted for the construction of water improvements numbered
67-1 and 67-2, pursuant -i;O and in accordance with the provisions
of Minnesota Statutes, Chapter 429. The proceedings for each
of said improvements were instituted in 1967. The proceedings
for each of said improvements havinj been effectively instituted
at substantially the same dates, and both improvements having now
been substantially completed or bein9 near complet:ion and -::he
cost thereof having been ascertained, it is hereby determined
that all of said improvements, although separately instituted,
Clan be more economically comple':ed if consolidated and joined
as one project for the purpose of further proceedings: inasmuch
as it is desirable that a single assessment roll should be
prepared in order to advise the owner of each parcel of the total
amount proposed to be assessed upon such parcel for benefits
conferred thereon by any of such improvemen::s. Pursuant to
the authority contained in Minnesota Statutes, Section 435.56,
the fut,ure proceedings for ,t:hese separate improvemen'c:s are
hereby consolidated, ana hencefor'::h all proceedings shall be
conductea in all respects as if the various separate proceedings
had originally been insti 111 ted as one proceeding.

2. It is furthU dEltermined that the amount of the
tdtal expense of said oortsolidated improvements which the
Village of Arden Hills shall pay, other than any amount which
it will pay as a property owner, is $346,125, and that the
amount to be assessed upon benefi'i:ed properties, within the
areas here'cofore determined 'co be specifically benefited by
said consolidated improvements, is $346,325.
3. The Village Administrative Clerk. with the assis~:ance
of the engineers heretofore selec':ed by the Council for the
planning and supervision of said consolidated improvemen'i:s,
shall forthwith calculate the proper amount to be specially
assessed therefor against every assessable lot, piece or parcel
of land, without regard to cash valuation, in accordance with
the provisions of Minnesota Statutes, Section 429.051. When
completed, the proposed assessment roll shall be filed with the
Clerk and shall be open to public inspection, and the Clerk shall
present the same to this Council at i'i:s next meeting thereafter,
for such further action as may then be deemed necessary and
expedient.
The motion for the adoption of the foregoing resolution
was duly seconded by Crepeau

Arden Hills, Minnesota, as follows:
WHEREAS, the assessment roll for Sanitary Sewer Improvement
No.5 as last finally adopted on November 1, 1963, was filed
and certified to the County Auditor of Ramsey County on
December 3, 1963 for the purpose of including installments thereof
to be collected along' with real estate taxes commencing in
1964, and
WHEREAS, since that date a number of parcels of property
coata1nedwith1n said assessment roll have been divided and
conveyed by previOUS property owners, and
WHEREAS" the County Auditor of Ramsey County requires that
apportionment of the original assessment against each original

WHEREAS, the assessment roll for Sanitary Sewer Improvement
No. 3 as last finally amended and adopted on October 12, 1961,
was filed and certified to the County Auditor of ~sey County
on November 17, 1961, for the purpose of including installments
thereof to be collected along with real estate taxes commencing

ORDERING SAID IMPROVEMENT, APPROVING PROPOSED AGREEMENT
WITH RAMSEY CGUIllTY BOARD RE ASSESSMENTS THEREON Am>
AUTHORIZING EXECUTION THEREOF. APPROVING PLANS AND SPECIFICATIONS
THEREFOR. Am> DIRECTING ADVERTISEMENT FOR BIDS THEREON.
WHEREAS, a Resolution of the Arden Hills Council adopted July 8, 1968
fixed a date for a Council hearing on the proposed sanitary sewer improvement
extending sewer facilities on County Road E-2from approximately 850 feet
east of New Brighton Road. extending such sewer facilities to the proposed
site of the Ramsey County Library branch, requiring laying pipe and appurtenances
a distance of approximately 560 feet, and
WHEREAS, 10 days' published notice of a hearing through 2 weekly publications
of the required notice was given and mailed notice was also given as required
by law, and
WHEREAS, said public hearing was duly held as scheduled on the 29th day
of July, 1968, at 8:00 P.M. at the Village Hall. at which time all persons
desiring to be heard thereon were given an opportunity to be heard,
NOW THEREFORE, BE IT RESOLVED BY THE COUNCIL OF THE VILLAGE OF ARDEN HILLS:
1. Such improvement is hereby ordered as described in the Notice of
Public Hearing and previous resolutions thereon.
2. Banister Engineering Co., Village Engineers, are hereby designated as
the engineers for this improvement and the plans and specifications therefor,
previously prepared by direction of the Council, are hereby in all things approved
and shall be filed with the Administrative Clerk.

3. It is noted that $4.800.00 of the estimated cost of $5,800 of this
improvement, or a proportionate portion of the actual cost thereof, is to be
paid by assessment levied on Ramsey County. The Agreement submitted by the
village attorney with respect to this matter is in all things approved and
the Mayor and Administrative Clerk are directed and authorized to execute
said contract on behalf of the Village after approval thereof by the Ramsey
County Library noard and the Ramsey County Board of Commissioners.
4. The Administrative Clerk and Banister Engineering Co., engineers,
are directed to prepare and cause to be inserted in the official village
paper an. advertisement for bids upon the making of such improvement upon the
aforesaid approved plans and specifications. Said advertisement shall be
published August 1, 1968, shall specify the work tole done, shall state that
bids will be received by the Administrative Clerk until 11:00 A.M., Central
Daylight Time, on August 12, 1968, at which time they will be publicly opened
in the Village Hall by the Administrative Clerk and the Engineer, will then
be tabulated, and will be considered by the Council at 8:00 P.M. on August 12,
1968 at the regular Council meeting in the Village Hall. The aforesaid adve~tisement
shall further provide that no bids will be considered unless sealed and filed
with the Administrative Clerk and accompanied by a cash deposit, cashierk check.
bid bond or certified check payable to the Village of Arden Hills for at least
10 percent of the amount of such bid.
