Absent - None. Also Present - Village Attorney Vincent P. Courtney, Village Engineer Don Lund, Village Treasurer Worth G. Read, Building Inspector Clay Kelley, Village Fiscal Agent Peter Popovich, Administra- tive Clerk Lorraine Stromquist and Deputy Clerk Florence Honan. Approval of Minutes The Minutes of the Regular Council meeting of April 8, 1968, were approved as submitted. Case No. 67-14, Skelly 011 Company Messers Quist, Sundberg and Boyne were present as representatives of Skelly 011 Company. Mr. Boyne presented copies of the landscape plans lOt" 1he proposed Skelly station at Red Fox Road and LexlnJton Avenue. Mr. Boyne referred to a letter from the Council which requested In- formation regarding the need for a station at this location. He displayed a Village map showing the existing stations. Mr. Boyne stated that the proposed station will serve traffic from,Freeway 694 and Lexington Avenue, and from the Industrial Park and Control Data. He stated that Control Data Indicated a need for service for employees' cars. The construction of this station will not be damaging to com- petition as It wIll draw from different areas. Falcon 011 Company does not service cars. Mr. Quist Informed the Council that the construction will be Skelly's latest model, with adequate basket weave fencing for screening, wIth one access road from I.sxlngton Ave. and one from Red Fox Road. The a~ea will be completely landscaped and they sill submit a bond guaranteeIng completion of the landscapIng. Councilman Hollenhorst noted that In the report from Midwest Planning and Research, Inc. suggestions and Inadequacies were mentioned. He also mentioned the Skelly station located less than a mile from the proposed site which Is Intermlttantly closed and opened. Mr. Boyne stated that they would be happy to work with Midwest Planning regarding the matters In their report. He Informed the Council that the station on County Road E was a location mistake, but this Is not so with the' proposed site because of the freeway location. Mayor Bjorndahl stated that the discussion had clarified some of the matters, but would like the Council to study the report from Midwest Planning, which was Just received today. Councilman Hollenhorst stated that buildings unoccupied and/or boarded up result In additional pollee problems, such as break-Ins. Mr. Boyne informed the Council that vacancies do not occur In prime locations as they have company crews who take over. Dr. F. Douglas Whiting, 1191 Tiller Lane, expressed his concern regarding the height of the signs and lights for this proposed station. Mr. Boyne stated that according to the Ordinance the sign Is limited In height, and the lighting Is also governed by Ordinance. -1- ~ , , Council Minutes - April 29, 1968 - continued Page two Schlfskv P~opertv Matter Robert Schlfsky, owner of the property at New Brighton Road and County Road D, was present. Attorney Courtney reviewed the history of this property. Mr. Schlfsky purchased this property when It was zoned commercial. In 1967, the Village rezoned the property to residential. Two plans fo~ developing the land were submitted by Mr. Schlfsky to the Planning Commission In 1966; both were denied. One plan was for a small complex of retail stores, the other for an apartment building. Mr. Schlfsky stated that It Is a very difficult site to develop and Is now, In his opinion, a worthless lot In which he has Invested In excess of $16,000.00. He expressed a desire that the Village purchase the lot from him as he has exhausted all means of using the property. He requests consideration from the Village for his reported loss and damage sustained by the Council action of rezoning. However, he Is open to any sugges- tions for a feasible development. Councilman Crepeau moved the matter be refe~red to Midwest Planning and Research, Inc. for suggestions of a feasible development; Attorney Courtney requested to assist) referred to Planning Commission and Parks and Recreation Committee to review the parcel of land for possible Village USe) seconded by Councilman Hollen- horst) motion ca~rled. Clerk requested to send copy of this motion to Mr. Schlfsky. Attorney Courtney stated that he will arrange a meeting with Carl Dale, Midwest Planning and Mr. Schlfsky. REPORT OF FISCAL AGENT PETER POPOVICH Mayor Bjorndahl Informed the audience that Mr. Popovich Is appearing at the request of the Council to give a report on questions re- garding water costs. Mr. Popovich submitted copies to the Council of his report, dated April 29, 1968. He explained that the Introduction to the report lists the questions as submitted by Clerk Lorraine Stromquist; the report consists of answers to these Individual questions, which he proceeded to summarize. Mr. Popovich recommended no change from the suggestion of the Water Committee except to possibly raise the front foot charge on assessments. Mr. Lewis Downing, 3975 No~th Falrvlew, requested the probable mill rate Increase If the entire water system Is Installed for the popu- lated area of the Village. Mayor Bjrondahl quoted 33.98 mll!s as stated In the report (this figure calculated using present con- struction costs.) BUSINESS FROM THE FLOOR Petition for PlavQround Improvement Mrs. Allen Benson, 1404 County Road E, presented a petition by nearby residents which requested fencing of the east and south boundaries of the playground at County Road E and Highway 51 and other additions for children and adult recreation. Matter referred to the Parks and Recreation Committee. REPORT OF ATTORNEY COURTNEY Water Contract - St. Paul-Rosevll Ie-Arden Hills Attorney Courtney submitted a letter, dated April 29, 1968, to Lorraine Stromquist with copies for the Council and also the final version of the water contract between Rosevllle and Arden Hills. -2- Council Minutes - April 29, 1968 - continued Page three I Attorney Courtney Informed the Council that his sug~sted changes are supposed to be Incorporated In this contract. Councilman Crepeau moved approval of the water contract subject to a final check by Attorney Courtney, and authorized the Mayor and Clerk to sign the contract after approval of Attorney Courtney) seconded by Councilman Olmen; motion carried. Shorevlew Water Request Attorney Courtney Informed the Council that this matter Is covered In his letter of April 29. He suggested that a copy of the signed contract be sent to Mr. Schleppergrell at Shorevlew and Inform him that a meeting could be arranged after he has studied the contract. Sewer Assessment - Ramsev County Llbrarv Clerk Lorraine Stromquist received a letter, dated 4/29/68, from Attorney Courtney which stated that Ramsey County could be assessed for the sewer service to their proposed site, but recommended that a determination be made on other property which would benefit from this Improvement. Matter referred to Engineer Lund to determine allocation of costs. Human RIQhts Ordinance Mayor BJorndahl stated he had received a call from Mrs. Dorothy Sullivan, President of the Arden Hills League of Women Voters, In- forming him that the League has decided to'study the local problem of human rights In Arden Hills; the Jaycees also have an Interest In It. He suggested that copies of the rough draft of this Ordin- ance be submitted to these two organizations for their recommendatlon~ Councilman Hollenhorst moved an Ordinance establishing a human rights commission and providing for Its duties and responsibilities be introduced by title and given Its first reading; seconded by Council- man Crepeau) motion carried. Personnel Ordinance Amendment Attorney Courtney submitted a rough draft, with copies to the Council members, of an ordinance amending Ordinance No. 83, regarding personnel administration, changing sick leave provisions, permitting discretionary sick leave, and authorizing payment of health Insura~cw benefits. Action delayed to allow for further study, Resolution - Public Works Department Salaries Councilman Hollenhorst moved the adoption of a Resolution, as attached, regarding salary schedule for 1968 for employees of Public Works Department; seconded by Councilman Olmen) carried. Contract - Water Booster Station Attorney Courtney reported that the contract for this project Is now In order, and recommends Village acceptance. , Councilman Henderson moved that the contract between the Village of Arden Hills and the Healy Plumbing and Heating Company In the amount of $58,000.00 be accepted, and authorized the Mayor and Clerk tO,slgn the contract) seconded by Councilman Olmen; motion carried. Bulldln~ Code Revisions Attorney Courtney prepared and submitted a rough draft of these revisions, Councilman Hollenhorst moved that an Ordinance amending Ordinance No.3 the Bulldln~ Code, by providing for design of certain buildings by registered architects or engineers, requiring performance bonds In certain cases, and Imposing additional ~oqulrements on construction of multiple family dwelling) be Introduced by title and given Its first reading; seconded by Councilman CrepeDu; motion carried. REPORT OF ENGINEER DONALD LUND Water improvement 68-3, Feasibility Report Engineer Lund reported that signatures representing over 35% of the property owners were on the petitions submitted for Water Areas I and 2, A feasibility report, dated 4/24/68 was prepared and submitted by Engineer Lund with an estimated cost of $563,640.00; this Improve- ment will consist of approximately 415 connections. Councilman Crepeau moved the adoption of a resolution, as attached, approving Engineer's preliminary report and providing for public hearing on Water Improvement 68-3; seconded by Councilman Hollenhorst motion carried, Said hearing to be held on May 23, 1968, at 8:00 p.m., In the Little Theater section of the Mounds View High School. Bethel ColleQe - Water Feasibility Report Engineer Lund submitted a feasibility report, dated April 24, 1968, with a map showing the proposed construction. Councilman Hollenhorst moved that this project become a change order to Water Improvement 67-1 If Attorney Courtney can obtain a waiver from Bethel College to allow Arden Hills to assess the College for the service: seconded by Councilman Crepeau: motion carried. Oak and Pascal Water Improvement Engineer Lund reported an estimated cost of $32,200.00 for construc- tion of water service for Oak Avenue and $7,350.00 for Pascal Avenue. Copies of this report will be sent by Engineer Lund to the Council. These two streets are already Included In the contract for Improve- ment 68-1. Councilman Olmen moved that Banister Engineering Co. be requested to prepare a feasibility report for Water Area No.5; seconded by Councilman Hollenhorst; motion carrled..~ ~_. Water Area No.4 Mayor BJorndahl requested Banister Engineering Company to figure the cost of this area Improvement wIth and without laterals. VIllaQe Hall Traffic Control Engineer Lund received a letter, dated April 26, 1968, (copy to Clerk) from the Highway Department refusing consideration of a crossroad to allow cars from the Village Hall parkIng lot to cross over to the westbound lane of Highway 96, Meter Reactivation Engineer Lund Informed the Council that he will have a report on this matter after he has studied a letter, dated April 26, 1968, concerning the matter from Northwestern Power Equipment Co., Inc. Sewer Service Request - Llv-A-Snaps Engineer Lund Informed the Council of a request from Mr. DeCoster for sewer service for the Llv-A-Snaps Building to be constructed. Engineer Lund stated that sewer service Is available, but construction will have to go through private property. Inspections Inspector Kelley Inspected an area near County Road D and Shoreline Lane for sewage odor, but detected none) however, he did notice a slight odor from stagnant marsh water south of County Road 0 In Rosevllle. Clerk requested to so Inform the complalnant. Inspector Kelley Informed the Council of Inspecting 3404 Johanna Boulevard on April 29. He stated that the dwelling Is not occupied, but entrance Is posr.lble. There Is much debris on the premises and a hazardous heating arrangement which Is dangerous to adjacent buildings. He believes the building Is unsafe and recommends that action be taken as outlined In the Uniform Building Code, Sec. 203, Clerk requested to Inform the owner to either repair or demolish the structure. REPORT OF COUNCILMAN HOLLENHORST _Planning and Zoning Case No. 68-5, St. Paul Bible ColleQe Councilman Hollenhorst reviewed the Special Use Permit request of St. Paul Bible College to allow them to construct multi-purpose housing and stated that a public hearing on the matter had been he'd April 16, 1968 before the Planning Commission. The Planning Commis- sion recommended approval of the project subject to three conditions as listed In the Planning Commission Minutes dated 4/16/6e~ ., Mr. Arthur Jurgenson, owner of undeveloped property adjacent to the St. Paul Bible College property, was present, as was Mr. Eugene Hoppe, his representative. Mr. Hoppe Informed the Council he would like to appear before the Planning Commission wIth Robert Kerr, Ellerbe and Co. Mr. Kerr has been retained by Mr. Jurgenson to plan the entire Jurgen- son property and would iike to discuss street plans. There Is a difference of opinion on this matter between the two developers, St. Paul Bible College and Arthur Jurgenson. There was some discussion on the street matter. Dr. Whiting, 1191 Tiller Lane, mentioned the strong opposition which existed last fall to the multi-purpose proposal and believes the residents have not changed their minds. Dr. Hardwick stated that he had submitted a document of more than 100 signatures of home owners In the Tiller Lane area who are In favor of the project, many of theSe formerly objected. After considerable discussion, Councilman Hollenhorst moved approval of a Special Use Permit, as recommended by the Planning Commission, to allow St. Paul Bible College to construct four multiple dwellings and associated structures as per plans, dated Aprll 16, 1968, subject to the following conditions: i. Further consideration be given by the Planning Commission to road plans as requested by Mr. A. Jurgenson, 2. Submittal of a detailed landscape plan, to be approved by the Village Planning Consultant, Carl Dale, and a performance bond In an amount not to exceed two times the cost of the landscaping (amount to be determined by the Building Inspec- tor Clay Kelley.) 3. Approval of drainage plans by Village Engineer Donald Lund and of building plans by Village Building Inspector. 4. Approval of agreement between C. Garley and St. Paul Bible College by Village Attorney Courtney. Seconded by Councilman Crepeau; motion carried. Case No. 68-10, Bethel ColleQe BulldlnQ Permit Requests Councilman Hollenhorst Informed the Council the representative for Bethel College could not appear tonight) but plans for three buildings were to be left here. The college has rearranged the site plan, re- vised plan submitted on Apri I II, 1968. Councliman Hollenhorst moved approval of the building permit requests for the three buildings, as shown on the revised site plan, dated April II, 1968 and to delay action on the sIte plan approval; seconded by Councilman Olmen; motion carried. Council Minutes - April 29, 1968 - continued Page six REPORT OF COUNCILMAN CREPEAU - Public Safety , Accident Prevention Award Councilman Crepeau reported that Arden Hills will be awarded the 1967 Meritorious Achievement Award; Sgt. Sexton will accept this at a banquet on May 14, 1968. Road SI~ns The Public Safety Committee Is reviewing the road signs In the Village. Clean-up Campaign Councilman Crepeau requested press coverage on the clean-up campaign, and commended the Public Works Dept. for the excellent job done on cleaning up Village property, REPORT OF COUNCILMAN HENDERSON - Civic Center and Finance Finance Committee Councilman Henderson Informed the Council that the committee Is anxious to receive the five-year financial plans from the Village committees. Clerk to send a copy of Flsca~ Agent Popovich's Water Study Report to Frank Stanton, Chairman of the Finance Committee. REPORT OF MAYOR BJORNDAHL- Parks and Recreation Proposed Airport Site Mayor Bjorndahl reported on a meeting held on April 15 with represen- tatives from adjoining Villages and the MAC regarding the proposed airport sites, He stated that most of them were much opposed to the Anoka site, but all seemed In agreement that the Ham Lake site was a good location. He believes the television antennae farms proposed for Shorevlew would eliminate plane traffic over this area. REPORT OF ADMINISTRATIVE CLERK LORRAINE STROMQUIST Speed Limits - County Roads Letter, dated April 19, 1968, from Ramsey County Engineer Deane Anklan stated that the speed limit on Stowe Avenue will be studied and action will be delayed regarding the speed limit study for Lexington Avenue near County Road D until they reconstruct that portion of Lexington Avenue to eliminate the curves. ~ Minnesota Handbook Supplement Referred to Clerk to consult with Individual Council members to determine how many supplements to this handbook are to be ordered) cost of supplement Is $2.00. DOQ and Sign Ordinance Violations Clerk reported that most of the violators to these two ordinances have compiled) however, there are II businesses who do not have all their signs licensed and about 15 known dog owners who stili have not licensed their dogs. Councilman Olmen moved that the names of the violators be referred to Village Attorney Courtney for action; seconded by Councilman Hoilenhorst) motion carried. _Ramsey County Parks Letter, dated April 17, 1968, received from Village Manager Richard Turnlund was read by Clerk Lorraine Stromquist. Attached to this ~etter was a Resolution passed by the Rosevllle Council r6Questlng Ramsey County to consider purchase of property west of Rice Street for a golf course. An attached map showed areas in Rosevllle and Shorevlew which would be suitable for an 88 hole golf course. Mr. Turnlund requested consideration from Arden Hills to pass a similar resolution. Street LI~ht Petition - Oak Avenue Petition, signed by six residents on Oak Avenue, requested a street light In the area of the cul-de-sac. Referred to the Public Works Committee to consIder the types of street lights available. Claims Councilman Crepeau moved, seconded by Councilman Hollenhorst, that the claims be paid as listed and submitted by Clerk Lorraine Stromquist; motion carried. NOW THEREFORE. BE IT RESOLVED, that effective ~ 1, 1968 full-time employees of the Public Works Dep rtment, which full-time employees are presently Fred Nixon and R, Wayne Brunette, shall receive a monthly salary of $615,00, based on an hourly wage of $3.5)..~er hour, which wage shall cover all services performed~the Village, including road maintenance, snow plowing or water or Sewer maintenance work. The Council has heretofore directed Banister Engineering Company, consulting engineers, 310 Snelling Avenue, Saint paul, Minnesota, to prepare a preliminary report as to the feasibility of a proposed improvement lying generally south of County Road E and east of Lake Johanna exclusive of the areas included in Water Improvements 67-1, 67-2 and 68-1 consisting of the con- struction of trunk and lateral water mains and necessary appurtenances, and the estimated cost thereof, and as to whethe~ such improvement should best be made as proposed or in connection with some other improvement. The preliminary report and cost estimate have been submitted by the engineers and considered by the Council and are hereby approved and directed to be placed on file in the office of the clerk. The improvement proposed to be made in the general manner set forth in the report is deSignat- ed as water Improvement No. 68-3. 2. The Council shall meet at the Little Theater in the Mounds View High School, 1900 W. County Road F, in said village, on May 23, 1968, at 8:00 o'cloCk p.m. for the purpose of holding a public hearing on the proposed improvement under and pursuant to the provisions of Minnesota Statutes, Chapter 429, as amended, and the clerk is hereby authorized and directed to cause notice of the time, place and purpose of that meeting to be published twice in the official newspaper, New Brighton Bulletin, which publications shall be a week apart, and the second publication shall be not less than three days before the date of the hearing.
