Pursuant to due call and notice thereof, a special meeting of the Village Council of the Village of Arden Hills, Minnesota, . was held at the Lake Johanna Elementary School in said Village on Tuesday, March 19, 1968, at 8:00 o'clock p.m. The following members were present; Mayor Bjorndahl and CouncilmenCrepeau,Olmen,and Henderson and the following \-ras absent: councilman Hollenhorst The Village Administrative Clerk presented an affidavit showing publication of notice of hearing on proposed water Improve- ment No. 68-1 in accordance with the resolution adopted February 12, 1968, which affidavit was examined and found to be satisfactory and was directed to be filed by the Clerk. The Village Administra- tive Clerk also exhibited a Certificate of Hailing Notice of Hear- ing to affected property owners, which certificate was examined and found to be satisfactory and was directed to be filed by the Clerk. The Hayor then directed the Clerk to read the description of the general nature and estimated cost of the proposed improve- ment and the area proposed to be assessed therefor, as stated in I. the published notice of hearing. After reading of the notice, all persons present were afforded opportunity to be heard, and . the names and addresses of the persons appearing and heard by the Council, and the substance of the views presented by them were as follows: . . . . 11r. John Drews, 1926 Stowe: Asked what the village policy would be on assessing corner lots. ~tr. Richard Jones, 1863 Glen Paul: Asked that the unit assessment be considered rather than front footage assessment. Also wanted to know where the water main would be located in the street. l:.r. Leo Elizer: 1863 Noble Road: Question re the proportion to be paid by general taxes and assessments. ~tr. Calvin Westpahl, 3264 West Lake Johanna Boulevard: Asked what his present share of previous water improvements is and how much more they would have to pay for future water improvements. Also asked if there was a possibility of having water rationing if the improv~aent is constructed, and wanted to know what the use charge would be. Inquired whether there would be any reduction in fire insurance rates. l~. E. J. Hall, 2009 West County Road U: His property is not included in the improvement. However, the Village of P~seville has a water main on County P~ad D and rur. Hall asked if he would be assessed by the Village of Arden Hills. Mr. Fay Kennedy, 3453 Lake Johanna Boulevard: If the improve- ment is ordered, Mr. Kennedy asked how soon he would be able to connect. }tr. Nonnan Sunnes, 3324 Lake Johanna Boulevard: Wanted to know if the location of the main had been selected on Lake Johanna Boulevard. Mr. Milton Morris, 3168 Shorewood urive: Wanted to know if the interest on unpaid assessments was based on interest rates that would have to be paid on bonds to finance the improvement. If the assessment interest is not sufficient, would that additional money be raised by general taxes. Mr. Ronald Wilmar, 1894 Stowe: Asked what percentage of the total frontage of the improvement is represented by the petition which had been presented to the Council. On the proposed front footage basis of assessment, how much money would be raised by assessments. Also wanted to know why Oak Avenue was not included in this improvement. . . . . . lib:. Ronald Herrick, 1860 Lake Lane~ Asked if the COuncil or Water Study Committee had extended any effort or made any plans to obtain state aid or federal funds for the improvement. Also wanted to know if other village funds could be transferred and used to pay for the improvement. Mr. Harry Ehlers, 3256 New Brighton Road: Commented on the faulty workmanship in water improvements which have already been constructed. ~ir. Carl Christensen, 3122 Shorewood Drive: or not it was compulsory to connect to the water mentioned that FHA requires an overhead tank and the village would have an elevated tank. l.sked whether system. Also wanted to know if ~ir. John Drews, 1926 Stowe (Spoke before): Asked if this was the first water improvement to serve a residential area. Also asked about problems Roseville was having with St. Paul in con- nection with water charges. Mr. Phil Pfeilsticker, 1431 Arden Place: Not included in the improvement, and wanted to know how his area could get water. Mr. Don Kostohryz, 1405 West Arden Place: Informed Mr. Pfeilsticker that a petition has been started in his area and asked if any engineering plans had been made for that portion of the village. Also asked if it wouldn't be cheaper to contract for that area along with the area under discussion at the hearing. Mr. Leonard Carlson, 2034 Stowe Avenue: Asked if the connection from the home to the main in the street could be done by the individual homeowner or if it would have to be done by a contractor. Mr. Morris Papenfuss, 1894 West County Road E: Asked if homeowners would be assessed with any additional charges if they didn't connect to the water systen. 1'1r. John Trump, 1871 Beckman: Asked about the water service connection standards. ~ir. Leo Elizer, 1863 Noble Road: (Spoke before) Asked if New Brighton had been considered as a source of water. A resolution adopted by the Arden Hills Jaycees in favor of the improvement was read. fir. John Drews, 1926 Stowe (Spoke before): Thought a larger area should be encompassed in the improvement. From the audience (No name given): Said he's not happy with constructing the improverr~nt piecemeal. Mr. Fay Kennedy, 3453 Lake Johanna Boulevard (Spoke before): In favor of the improvement. . . . . From the audience (No name given): Asked why the COuncil didn't plan the improvement for the entire village on its own initiative. Mr. Jerome TiImn, 1400 Cwmnings Lane: Suggested that his area be included in the improvement as soon as the petitions reach the Council. Mr. George Salitros, 3625 Hanlline Avenue: Question re- garding the feasibility of installing the main where it crosses Highway 51. Suggested a possible alternate route for the water main. From the audience (No name given): Asked how much more the improvement would cost now over what it would have been five years ago when proceedings were initiated by the Council and re- jected by the property owners. The Village Administrative Clerk indicated that telephone calls in favor of the improvement had been received from Mr. Joe Bussard, 4335 Highway 10, with property at 1420 Sandeen Road; t-1rs. l>iarus Schmidt, 1830 W. County Road E; Hr. Carl Langer, 3356 Lake Johanna Boulevard; Mr. J. Patrick Sexton, 3300 Lake Johanna Boulevard; Mr. E. H. Anderson, 3365 Lake Johanna Boulevard; and Hr. N. M. Dahlgren, 3352 Lake Johanna Boulevard. After a discussion of the views presented by persons appearing at the public hearing for Water Improvement No. 68-1 Counci:lman Crepeau then introduced the following ~ resolution and moved its adoption: RESOLUTION ORDERING WA'l'ER IUPROVEMENT NO. 68-1 UNDER AND PURSUANT TO ~~INNESOTA STATUTES, CHAPTER 429, AS Al~NDED. ~ ~ ~ BE IT RESOLVED by the Council of the Village of Arden Hills, ~1innesota, that in accordance with the provisions of Hinnesota Statutes, Chapter 429, as amended, the Council held a public hearing pursuant to published and mailed notice, on proposed Water Improvement No. 68-1 consisting of the construction of meter stations, feeder mains, lateral mains and appurtenances and water services, at a cost estimated presently to be approximately $647,000, all substantially in accordance with a preliminary engineering report which is now on file in the office of the Vil- lage Clerk, and having considered the views of all interested persons and being fully advised in the premises, the Council does hereby determine and order that said improvement shall be con- structed and financed, and special assessments shall be levied therefor, pursuant to said Minnesota Statutes, Chapter 429, as amended, and that the area proposed to be assessed for said improvement will consist of the property as described in the notice of hearing, or portion thereof, and that the village engineers are hereby directed to prepare and submit to the Council final plans and specifications for the construction of said improvement. The motion for the adoption of the foreqoing resolution was duly seconded by Councilman Olmen , and upon roll call vote being taken thereon, the following voted in favor thereof: All and the follcndng against: None whereupon said resolution was declared duly passed and adopted. .
