Bjorndahl, Councilmen H. Crepeau, S. Olmen, J. Hollenhorst, and E. G. Henderson. Absent - None Also Present - Treasurer W. Read. Attorney V. Courtney, Engineer D. Lund, Administrative Clerk L. Stromquist, and Accounting Clerk C. McNlesh. " APPROVAL OF MINUTES The minutes of the Regular Council meeting of February 26, 1966, were approved as corrected. KOSTOHRYZ VARIANCE REQUEST - Case No. 67-23 Gerald Frisch, attorney for D. Kostohryz, reported that protective covenants have been drawn up, but not finalized, for the lot between Mr. Kostohryz's buildIng lot and that of Dr. Blomquist. Robert Smith, attorney for A. Blomquist, stated that the protectl~e covenants were substantially satisfactory to Dr. Blomquist. Attorney V. Courtney advised the Council that ~rotect!ve covenants are not enforcible by the Village of Arden Hills. After some dis- cussion Councilman Hollenhorst stated that It appears all stlpula- tfons regarding protective covenants are being met and he moved that the Kostohryz variance be approved as submitted with Case No. 67-23, subject to properly executed copy of protective covenants being filed with the Village Clerk. Seconded by Councilman Crepeau, carried. Mr. Faltelsek asked the Council whether this variance approval would apply to changed building plans for the slte~ The Council said It would not !f the changes required addItional variances. Mr. Kostohryz saId he did not anticipate any material changes In the plans. The J.C.'s will make additional copies of the emblem for VIllage use. Mayor BJorndahl thanked the Arden Hills J.C.'s for their work on this proJect. \ ., REPORT OF ATTORNEY VINCENT COURTNEY ~_/ Boulevard Tree Ordinance The Council read the final draft of the boulevard tree ordinance. Councilman Hollenhorst moved approval of the second and final reading adopting an ordinance regulating the planting of trees In boulevard areas In the Village of Arden Hills, providing a permit procedure, establishing regulatIons for such plantIng, and providing penaltIes tor violation, as amended waiving the third readIng. Seconded by Councilman Crepeau, carrIed. Roseville - Arden Hills Water Contract Attorney Courtney discussed the status of the Rosevllle- Arden Hills water contract as amended. The Village Attorney expects to have the water contract In final form at the March 25, 1966 Council meeting. Notice for BIds - Van-type truck Councilman Olmen moved approval of specIfications and that the advertisement for bids for a van-type truck be pub61shed on March 14, 1966, sealed bids to be opened at 8:00 p.m. March 25, 1966. McNlesh was requested to review the specifications prepared by Attorney Courtney. The Council con- concurred with Chairman McNlesh's suggestion to send copies of the advertisement for bids and specifications to at least 2 representa- tives of each manufacturer. International Union of OperatlnQ EnQlneers. Local No. 49 Councilman Olmen moved acceptance of the International Union of Operating Engineers, Local No. 49, as bargaining agent for the full-time Public Works employees. Seconded by Councilman Crepeau, carried. Lake Johanna Outlet Attorney Courtney reported that he has contacted Rosevllle, New Brighton and Shorevlew concerning cooperation on the feasibility report for Improving the Lake Johanna outlet. Rosevllle has Indi- cated a willingness to participate, New BrIghton has not formally considered the matter, and Shorevlew Indicated they were not Interested In participating as per this plan. The Council requested Attorney Courtney to check with Engineer Deane Anklan on County participation. Matter continued to the Regular Council Meeting of March 25, 1968. James E. Johnson - Preliminary Subdivision Plan Attorney Courtner advised that Platting Ordinance No. 98 provides that the Council may authorize the Planning Commission to hold public hearings. It was noted that the Council hes authorized the Planning Commission to hold the hearIngs. The Village Attorney also advised that there Is no requirement for ownership reports until after the public hearing on a preliminary subdivision plan. The Notice of Public Hearing on Application for Approval of Preliminary Subdivision Plan will be published on March 14, 1968, public hearing scheduled for April 2, 1966 at 6:00 p.m. Skelly 011 Company - Special Use Permit The Notice of Public Hearing on Application for Special Use Permit will be pub! Ished on March 14, 1966, public hearing scheduled for April 2, 1968 at 8:00 p.m. before the Planning Commission. Workmen's Compensation CoveraQe Attorney Courtney discussed his letter of March II, 1968, concerning the effect of recent legislation on Workmen's Compensation coverage for elected officials and officials appointed on a yearly basis. Matter of coverage for appointed officials (I.e. Treasurer Read and Admin. Clerk Stromquist) and elected official deferred to the meeting of 3/25/66. Uniform BulldlnQ Code Revisions Councilman Hollenhorst requested Attorney Courtney to check the Build- Ing Code revisions recommended by the Planning Commission for legal wordIng. Ramsey County Library Board Request for Sewer and Water A request, dated March 4, 1966, from the Ramsey County Library Board for municipal water and sewer at the County Road E2 site, was re- viewed. Attorney Courtney advised that the Council can Initiate proceedings for an Improvement and discussed the deferred assessment basis of financing. Councilman Olmen moved that Banister Engineering Company be authorIzed to prepare a feasibility report on the extension of water and sewer service to the County Road E2 site, seconded by Councilman Henderson, card ed. Variance Procedure Attorney Courtney advised the Council that Board of Appeals recom- mendations on variances from the Sign Ordinance and Building Code can go directly to the Council; Planning Commission referral Is not man- datory. -2- . . , .. ... Page three - Council Meeting - March ii, 1968 - continued REPORT OF ENGINEER DONALD LUND Soil Boring Report Engineer Lund briefly discussed the Soil Boring Report completed by the Soil Exploration Company and reviewed the need for this type of report to permit proper design for the elevated tank. Northwestern Bell Telephone Request for Burled Cable Councilman Crepeau moved that the Northwestern Bell Telephone Co. request be granted to bury cable between Cleveland Avenue and Highway 35W at 14th Street North. Seconded by Councilman Hollenhorst, carried. Signs and Devices for Interstate Highway 35W Councilman Crepeau moved approval of the attached re~olutlon for State Highway plans for traffic signs and devices on Interstate Highway 35W. Seconded by Councilman Hollenhorst, carried. Resurfacing of Highway 10 and Highway 96 Councilman Crepeau moved approval of the attached resolution for resurfacing Highway 10, and requested the Highway Department to report on requested construction of left turn Banes along the westbound lane of Highway 10 at the cross-overs to the Big Ten Supper Club and Mobile Home Park. Seconded by Councilman Hollenhorst, carried. Councilman Crepeau moved approval of the attached resolution for resurfacing Highway 96 and the Highway Department report on requested construction of a cross-over between east and west bound lanes direct- ly opposite the entrance to the Village Hall Parking Lot, and on construction of a left turn lane on the west bound roadway plus a right turn lane on east bound roadway at the entrance to the parking lot. Seconded by Councilman Hollenhorst~ carried. The Council directed Administrative Clerk Stromquist to request the Highway Department to expedite Improved lighting and semaphores at the Intersection of HIghways 10 and 96. REPORT OF COUNCILMAN HOLLENHORST Zoning and Subdivision Ordinances Councilman Hollenhorst moved that the Administrative Clerk Stromquist be authorized to sell copies of the Zoning and Subdivision ordinances for SI.50 each; seconded by Councilman Olmen, carried. Ramsey County League Board Meeting Councilman Hollenhorst reported on the Board of Directors meeting of March 6, 1968. The principle Item of discussion concerned the Parks and Recreation Subcommittee. Mr. Ken Boss should be advised of Arden Hills Parks and Recreation Items to be correlated with County plans. Municipal Planning Act Councilman Hollenhorst stated that the Municipal Planning Act requires all Arden Hills Capital Improvements to be referred to the Planning Commission. REPORT OF COUNCILMAN H. CREPEAU Councilman Crepeau reported that two residents had called to compli- ment the Pollee Department on their efficient and courteous service. REPORT OF COUNCILMAN OLMEN The Council was advised that by March 15, 1966, all Village roads will be posted with 3-ton per axle load limits. ftEPORT OF COUNCILMAN HENDERSON The next me.etlng of the Finance Committee will be March 21, 1968. -3- . Mayor BJorndahl reported that residents are coop- erating nicely, the greater maJority of the trees have been removed. , Sports Arena MeetlnQ Mr. G. Buetow advised Mayor Bjorndahl that a meeting concerning the recently proposed Sports Arean will be held March 14, 1968 at the Mounds View Village Hall. All Interested parties are encouraged to attend. REPORT OF ADMINISTRATIVE CLERK STROMQUIST Carlton Drive Water Petition Clerk Stromquist presented a petition for water from residents on Carlton Drive. Council requested the Clerk to write Mr. Keith Ewy giving him the boundaries of the area development which Includes Carlton DrIve, and request that areas larger than one street petitIon for water. If possible. Pakoy Variance - Case No. 68-2 Mr. Eugene Pakoy's varIance request for an oversize garage was discussed. Administrative Clerk Stromquist read the Board of Appeals recommenda- tions for denial, dated 2-5-68. Councilman Crepeau moved conCUrrence with the Board of Appeals recommendation to deny the variance request. Seconded by Councilman Olmen, carried. The Council suggested that Mr. Pakoy work out revised plans acceptable to the Board of Appeals. Councilman Henderson moved that the Planning CommlsslQn Uniform Building Code section relating to garage size. Councilman Crepeau, carried. Metro-Salary Survey Meeting AdminIstrative Clerk Stromquist reported on the Minnesota League- Metro SectIon meeting of March I, 1968. The salary survey and report should be completed by July I, 1968. Councilman Crepeau requested that Councilmen be given copies of the report to assist In 1969 budget preparations. review the Seconded by Maior Street Plans of Ramsey County Letter of March 6, 1968 from the Ramsey County Engineer was referred to the Planning Commission and Public Works Committee. Amendments to Personnel Ordinance Councilman Crepeau moved that an Ordinance amending Ordinance No. 83, regarding personnel Administration, to permit discretionary sick leave and payment of health Insurance benefits be given Its second reading without any ree~ at this time., seconded by Councilman Olmen, carried. ..
