BJorndahl, Councilmen H. Crepeau, S. Olmen, J. Hollenhorst, E. G. ~enderson. Absent - None. Also Present - Treasurer W. Read; Engineers D. Lund, R.. Short, N. APPROVAL OF MINUTES The Minutes of the Regular Council Meeting of January 29, 1968, were approved as submitted. REPORT OF ATTORNEY VINCENT P. COURTNEY (Attorney absent due to a death In his family) No report. REPORT OF BUILDING INSPECTOR CLAY KELLEY CDndemnatlons Inspector C. Kelley reported that the owners of properties at 3155 Lake Johanna Boulevard and 1624 Lake Johanna Boulevard were sentenced $100.00 each by Justice Barthany on January 24, 1968, after each pleaded guilty to the complaint of maintaining a nuisance In the Village of Arden Hills. The fines were suspended for ninety days at which time the buildings are to be demolished. Clay Kelley to Inspect the properties on April 24, 1968. If buildings are not demolished, the defendants are to be brought back to court for the Imposition of the sentence. Kostohrvz Excavation Mr. Kelley reported that he has a question on which he Is requesting clarification from Attorney Courtney, regarding what Is meant by "Isolated sefl-contalned property," In the Uniform Building Code. This question Is In relation to the excatlon In the rear yard of the Kostohryz property on Snelling Avenue. Canlf' Residence - Glenvlew Ave. and Glenvlew Ct. Mr. Kelley reported that the exterior of this residence Is now virtually complete. Work Is being done there every day and the owner expects to take occupancy In late spring of 1968. REPORT OF ENGINEERS DON LUND, ROGER SHORT AND NORM HENDRICKSON ", Water Improvement 68-1 Engineer N. Hendrickson and Engineer R. Short presented cost estImates for the water system for the southwest area of Arden Hills. Mr. Hen- drickson stated that a feeder line from Connelly Avenue and County Rd.E west along Lake Johanna Boulevard would be advisable and recommended that It be Included In the descrlpt~on of the area to be Included In Water Improvement 68-1. This feeder line would benefit Arden Hills In the event that a failure occurs In Rosevllle lines or tank servicing the south- west area of Arden ~llls. Arden Hills would then be able to serve this southwest area from the east side of the Village. The estimated cost of the entire water system for 68-1 Is $647,000.00, Including the feeder line from Connelly Ave. The feeder line alone Is estimated to cost $113,000.00. Mr. Short advised the Council to consult with Attorney Courtney and Peterson and Popovich regarding the possibility of dropping the feeder line portion from the description If this Is the desire of the Council. The Council approved Inlcudlng the feeder line In the description of Improvement 68-1 to be submitted to Peterson and Popovich by BanIster Engineering Co. Norm Hendrickson to submit a corrected map to Clerk Stromquist and the description of the area to be Included In Improve- ment 68-1. It was noted that persons along the feeder line would be able to hook up to water If they desire, and every property owner along the feeder line would be automatically assessed, It this area Is Included In the Im- provement description. -1- ~ .. - ~ , Minutes of Council Meeting - February !2, 1966 - continued Page two Mayor R. Bjorndahi presented a petition from residents on Shorewood Drive requesting water service to their area. (Included In 68-11 Clerk L. Stromquist was requested to Inform the County of the pro- posed water Improvement through the Ramsey County owned property along Lake Johanna Boulevard. , .~ 1t was moved by H. Crepeau and seconded by S. Olmen to approve the~ Kresolutlon setting the date for the public hearing for Water Improve- ment 68-1 on March 19, 1968, at 8:00 p.m., In the Lake Johanna Elemen- tary School; motion carried. REPORT OF COUNCILMAN JOHN HOLLENHORST Elevated Water Tank Councilman J. Hollenhorst reported that the Planning Commission had Indicated a preference for the hydro-pillar type water tank, but after being advised this type was only manufactured by one company, the members recommended the pedestal Spheroid type so that competitive bids could be submitted. Engineer N. Hendrickson was requested to write the bid specifications for the pedestal spheroid type of tank with alternate specifications for the hydro-pillar type. Kostohryz Variance - Case No. 67-23 Councilman Hollenhorst advised the Council that an agreement has not been reached between Mr. Kostohryz and Dr. Blomquist In regard to the lot to the north of the Blomquist property and to the south of the proposed building site of Mr. Kostohryz. He advised that Mr. Kostohryz now has offered to submit a set of restrictive covenants for this lot, to prevent future setback variance requests for this lot. Mr. Gerald Frisch, attorney for Mr. Kostohryz, explained these covenants would benefit all the property owners In Lot 5, Arden Hills, and would be a private agreement among the property owners of Block 5. Dr. Blomquist, 3521 North SnellIng Avenue, stated that the esthetic appearance of the proposed varIance request stili prevails, and the homes built along the street previously, were built with confidence that the Village Ordinance would be adhered to. He requested that he be given a copy of the restrictive covenants proposed to be placed on this lot by Mr. Kostohryz so his attorney might review them. He also stated that It Is difficult for him to see that thIs agreement would be more restrictive and/or more binding than the Village ordinances. He said that basically his desire Is that a buffer zone between his property and that of the Kostohryz building site be established to minimize the extensive variance requested by Mr. Kostohryz. Attorney Frisch requested that the Council approve the variance request subject to the epproval by Attorney Courtney of the restrictive coven- ants to be submitted for the lot to the south of the Kostohryz building sIte. Mayor Bjorndahl advised Mr. Frisch that the variance request Is exten- sive and the Council will want to discuss the matter with Attorney Courtney and be on firm ground before considering the granting of a variance of this extent. He stated that the Council also has an obli- gation to protect property owners who have built In the area previously. Attorney Frisch was requested to prepare the restrictive covenants he proposes and submit them to Attorney Courtney with a copy to Dr. Blomquist and a copy to the Council for consideration. Dr. Blomquist stated that his original objection Is stili pertinent, and he stated that even though Council had requested Mr. Kostohryz to submit alternate plans, only one plan has been submitted. Mr5.Alvln Faltelsek, 3515 North Snelling, asked if the restrictive covenants proposed would affect other lots In Block 5. Mr. Frisch explained that they would not. -2- .. - Minutes of Council Meeting - February 12, 1968 - continued Page three Mr. Alvin Falteisek asked If a variance request Is challenged by neighbors after the covenants are placed on thIs lot. will their only recourse be through a court of law? Mr. Frisch said that this Is correct. The Council can only govern through the Village ordinances; these covenants would be a private agreement. Boulevard Tree Ordinance Councilman J. Hollenhorst reported thet the Planning Commission recommends approval of the Boulevard Tree Ordinance as amended by the Parks and Recreation Committee, and requested It be submitted to Attorney Courtney to prepare the final draft. Sitzmark Ski Shop (Case No. 68-1) Councilman Hollenhorst advised that William Wegleltner has applied for a special use permit for a Ski-Golf Shop combined with his residence, to be located on County Road E adjacent to the east side of Harkins Driving Tees. He stated that the Planning Commission Is tentatively In favor of this combined usage, but deferred making any recommendations to Council untIl they have the opportunity ot reviewing a preliminary subdivision plan for the C. G. Rein property In the County Road E and Lexington area. PakovVarlance Request - Case No. 68-2 Councilman Hollenhorst reported that 750 square feet Is the maximum size allowed, under the Uniform Building Code, for a private garage. Attorney Courtney requested to determine who rules on Building Code variance requests and also on requests for departures from building materials designated In the Building Code. Site Plan Noncompliance Councilman Hollenhorst advised the Council that the site plan agree- ments have not been compiled with by Roberts Construction Co. for their four warehouses In the Industrial park, or by Proto Sheet Metal on Connelly Avenue. Building Inspector C. Kelley advised that the Planning Commission had requested that he not Issue a certificate of occupancy for the new Roberts warehouse, located to the .est of Gould and Company In the Industrial park, until the site plan for the other tour warehouses has been compiled with;. no certificate of occupancy has been Issued to date. Mr. Kelley reported that Proto Sheet Metal Company has partially compiled wIth their agreement by putting In about 6' of sodded area where they agreed to about 11'. He said Mr. Clough has assured him that the balance will be put In as soon as possible In the spring. Clerk Stromquist was requested to draft a letter to Roberts Construction Company and to Proto Sheet Metal Company, advising them of their site plan agreements; letters to be delivered by Building Inspector C. Kelley. Renewal of Contract with Midwest Plannln~ and Research Co., Inc. Mr. J. Hollenhorst reported that the Planning Commission reviewed the contract and recommends approval of the contract, as submitted, with Midwest Planning and Research Co., Inc. for 1968. He stated It Is essentially the same as the 1967 contract, costing the same amount of money, with restrictions as to hours spent on Individual reports and limiting their attendance at meetings to one a month. Councilman Hollenhorst moved approval of the contract, subject to approval of Attorney Courtney; seconded by H. Crepeau; motion carried. REPORT OF COUNCILMAN HENRY J. CREPEAU JR. Civil Defense Director Councl'mSn H. Crepeau stated that Mr. Victor Weber has resigned as Civil Defense Director for Arden Hills. Mr. Crepeau moved that Mr. Roger Reiling be appointed the new Civil Defense Director for Arden Hills for 1968; motion seconded by J. Hollenhorst; motion carried. Mayor R. Bjorndahl administered the oath of office to Mr. Reiling. Crepeau moved approval of the lighting plans for 35W and County Road i, as submitted; seconded by Councilman S. Olmen; motion carried. License Applications T~xaco Service station license applications - matter tabled until later date. . County Board Plans - County Road D and Lexlnqton Avenue Councilman crepeau advised the Council that the County Board Is again considering plans for the County Road D and Lexington Ave. area, abutting the Arden Hills south boundary. He said Arden Hllis owns half of County Road D at this point. The County has requested that Arden Hills comment on the County plans for the area south of County Road D before their next meeting of February 19th, If possible. Clerk L. Stromquist to request a copy of this proposed plan from Mr. Swan. REPORT OF COUNCILMAN E. G. HENDERSON Councilman Henderson reported that a Finance Committee meeting has been scheduled by Chairman F. Stanton for Tuesday, February 20, 1968. No report at this time. REPORT OF COUNCILMAN STAN OLMEN Rosevllie - Arden Hills Joint Public WorkS Meetlnq Councilman S. Olmen reported that an Informal Joint luncheon meeting of the Arden Hills Public Works Committee members and Mayor R. Bjorndahl with Mr. Sherm Goldberg and Mr. Roger Klobar of the Rosevllle Department of Public Works was held on February 7th. He said that equipment and manpower were discussed and public works In general. He advised that Rosevllle contracts for ail their major water and sewer work as well as repairs. They do own a backhoe whIch they use on occasion. Rosevllle offered their assistance to Arden Hills and were very cooper- ative. No notes were taken at the meeting. Council-Public Works Joint Meetlnq Councilman S. Olmen reported that the Council and PublIc Works Committee hald a joint meeting on Monday, February 5, 1966 at which time It was generally agreed that the Village of Arden Hills should go Into a Village-owned maintenance system, effectuating this system by April I, 1968. REPORT OF MAYOR ROBERT BJORNOAHL ", Environmental Science Center Mayor Bjorndahl reviewed a letter, da~ed 1/25/66. from Environmental Science Center, advising of their meetings, the first of which Is tonight. Mayor Bjorndahl requested copies of this letter be sent to the Council members and to the chairmen of the Planning Commission, Parks and Recreation Committee and Public Works Committee. Future meetings wIll be March 7th - Hopkins High School, April 14 - St. Louis High School, etc. He said he felt these meetIngs would be very bene- ficial and requested representation from Arden Hills, If possible. Ramsey County Leaque of MunicIpalities By resolution, Councilman J. Hollenhorst was designated as the Arden Hills representative and Mayor Robert BJorndahl as the alternate representative to the Ramsey County League of Municipalities. Anoka-Ramsey State Junior Colleoe Mayor Bjorndahl read a letter, dated 2/2/68. from Anoka-Ramsey State Junior College. Inviting the Arden Kills Council to attend an open house between I :30 and 4:30 p.m. on Sunday, February 18, 1968. N.S.P. L~ndDedlcatlon Mayor R. BJorndahl reported that Mr. Jim Owens, Vice Prosldent and Manager of t~e St. Paul Division of Northern States Pownr Com~~~y, ~adlcat0d land undor the power lines to Arden Hi~ls, at a mooting -4- "',~ ' " .' The meeting was attended by Mr. Gerald McCauley, Pedestrian Trail Committee Chairman; Mr. Hunce Lagerstrom, Parks and Recreation Committee Chairman; as well as repre- sentation by the Village Council and Pollee Department. Because of a complaint of snowmobiles on the trail, Clerk Stromquist was requested to order a sign prohibiting motorized vehicles on the trail - the sign is to be located In the vicinity of the Keith Boyer residence, 1880 West County Road E. REPORT OF ADMINISTRATIVE CLERK LORRAINE STROMQUIST . LI censes - 1968 SIQns - matter tabled until report received from Attorney Courtney clarifying one type of sign which owner believes to be permitted without a license, under the ordlnanc~. DOQ Licenses - About 83 dog licenses have not been renewed for 1968. Clerk's office has phoned all residents who licensed dogs In 1967 but have not licensed them In 1968. Some of those called no longer have dogs, many renewed their licenses after the phone reminder, some were not available on the first call. Clerk was reqyested to continue this procedure for the next two weeks and report to Council at the next meeting. Business Places - All Business Places are licensed for 1968. Sewer Connection Time Extension Arden Lumber Mart would like to connect to water and sewer at the same time and request they be granted a time extension until May 15, 1968 to complete these connections. Councilman J. Hollenhorst moved that Arden Lumber Mart be granted this extension of time, until May 15, 1968, to connect to the sewer; seconded by Councilman S. Olmen; motlon carried. Bethel Colleae Sewer CharQes Bethel College reports they were billed for sewer rental for the months of May and June In the amount of $231.44 (2 month charge), but the bulldl.lgS were not ready for occupancy until late July or August I, 1967. They request a refund or credit In the mount of $231.44 for these two months. H. Crepeau moved the two-month charge of $231.44 be abated from Bethel sewer charges; seconded by G. Henderson; motion carried. License Requests License applications to sell cigarettes and soft drinks at the Standard Service station at County Road E and Highway 51 have been received. Councilman H. Crepeau moved these licenses be granted; seconded by Councilman Hollenhorst; motion carried. - Penalty CharQes - Water BllllnQ Clerk L. Stromquist advised that the ordinance requIres that a $1.00 penalty charge be added to water bills If payment Is not made by the 30th of the month In which billing Is made. (Billing date Is the 5th of the month.) She explained that bills are collectible by levying with the property taxes If not paid quarterly. Councilman H. Crepeau moved that penalty charges b,e made, as directed by ordinance, for both water and sewer bills; seconded by Councilman J. Hollenhorst; motion carried. The Council bas heretofore directed Banister Engineering Company, consulting engineers, 310 Snelling Avenue, Saint paul, Minnesota, to prepare a preliminary report as to tbe feasibility of a proposed :I.IIlprovement cons1sting of tbe construction of met:er stations, feeder mains, lateral mains and appurtenances and water services, and tbe estimaCed cost: thereof, and as to wbether sucb improvement sbould best be made as proposed or in connection witb SOllIe other improvement.
