HomeMy WebLinkAboutCCWS 09-26-2005 . ~ . ~~HILLS Approved: October 11, 2005 eITY OF ARDEN HILLS, MINNESOTA eITY eOUNeIL WORK SESSION MEETING SEPTEMBER 26, 2005, 8:47 P.M. eITY HALL eOUNeIL eHAMBERS, 1245 WEST HIGHWAY 96 CALL TO ORDER Mayor Aplikowski called the meeting to order at 8:47 p.m. Present: Mayor Beverly Aplikowski, Councilmembers David Grant, Gregg Larson, and Brenda Holden. Absent: Councilmember Lois Rem (excused). Staff Present: City Administrator, Michelle Wolfe; City Attorney, Jerry Filla; and Recording Secretary, Kathleen Altman. RESIDENTIAL eODE ENFOReEMENT ISSUES - 3150 HAMLINE AVENUE . AND 1415 GLENHILL Ms. Wolfe stated city staff has been involved with several Code violations at the above property for the past five years. While most of the violations are not safety related, one of the violations relates to a storage building on a vacant lot. Staff has inspected the building from the exterior and has deemed it to be an unsafe structure and a hazard to the public. Staff has sent the owner of the property numerous letters regarding the violations. These letters have resulted in little action taken by the owner to resolve these issues. She stated they needed to inform Council at this time because this would be going to Court in the future. Mr. Filla stated this had gone through the Court system last year and it was a slow process. He indicated in July of this year, the property owner had plead guilty to some of the violations at which time the Court ordered a statutory review in July, 2006. He stated the next step was for the City to make a Motion and request the Court to impose a sentence. Mayor Aplikowski stated some of the complications came about when there was a verbal discussion between herself, the resident and City staff. She stated she wanted to see something done and if abatement was the way to do this, then they needed to abate the property. . eouncilmember Holden asked if she did not allow the City on her property to clean it up, what happened next. Mr. Filla replied if there was a public safety issue, the City had the right to go on the property. He noted there were options thc City had. He recommended this go back before the Judge and let him make a decision. eouncilmember Larson stated as the City aged, code enforcement would become more important in order to maintain property values. He stated he believed they should continue down the course they were going. Mayor Aplikowski statcd she was comfortable moving forward at this point. eouncilmember Grant stated if they had code enforcement and they did not enforce the Code, then they did not have code enforcement.
