The meeting was called to order by Mayor Crepeau at 8:06 p.m.

Attorney Courtney revIewed a 1966 request for property dIvision,
Case No. 66-6, which had been granted approval by the Council on

Attorney Courtney submttted his letter, dated December 28, 1970, re
Special Use Permit Application, Case No. 70-36 - Odd Fellows.
The Clerk was requested to send copies of Attorney Courtney's letter
to each CouncIlman, for consideration at a later meeting when the
valIdIty of the application is ascertaIned.
McDonald and AssocIates - Sanitary Sewer Improvement 12-13
ApplIcation for Payment No.6
Attorney Courtney reviewed his letter, dated December 16, 1970, re
McDonald and Associates' request for a reduction of the retalnage
from 10%' to 2%.
After discussion and assurance from Engineer Lund that the 2% retalnage
wi II be sufficient to cover all clean-up work, It was moved by Counci 1_
man Henderson that Estimate No. 6, McDonald and Associates, Sanitary
Sewer improvement 12-13, Project !, be paid In the amount of $31,735.76,
reducing the retalnage to 2%, or $7,933.94. The motion was seconded
by Councilman Hollenhorst and carried unanimously.

he requests for fina payment from Northern Contracting Company,

I A letter from Mr. Norman E. Hendr I ckson " Banister Engineering
Company, dated December 18, 1970, and a letter from Mr. Robert E.
Grelllng, Area Engineer, Department of Housing and Urban Development,
dated December 22, 1970, were reviewed.
After discussion, Counci Iman Herrick moved approval of payment of
final estimates for Water Improvement 68-3 to Northern Contracting
Company, In the amount of $28,413.20, and for Water Improvement
68-2 to Northdale Contracting Company, in the amount of $60,850.81,
less $4500.00 to be withheld for damages claimed by resident, Dr.
Edward Calph; claim to be reviewed within .30 days for possible
reduction of withheld amount: motion seconded by Councilman Hender-
son and carried unanimously.
Dorothy Zehm was requested to cal I Dr. or Mrs. Calph to ver I fy the
$4500.00 damage claim.
Philip Sampson Plaque
After review of a copy of Attorney Courtney's retter to Attorney W.
Roy Johnson, dated December 22, 1970, re the Philip Sampson deed
and plaque, Counci Iman Herrick was req ues ted to see that the appro-
priate plaque is obtained and properly located on the property.
REPORT OF VILLAGE ENGINEER DONALD LUND
Lamett I and Sons, Inc. , Project 2, Sewer Improvement 12-13
Engineer Lund presented a Final Payment Request from Lamettl and
Sons, I nc., for Sewage LI ft Stlltions, Consolidated Sewer Improvement
No. 12-13, Project 2.
After review of the application for payment, No. 4, it was moved by
Councilman Hol Benhorst and seconded by Counci Iman Herrick that the
Final Payment to Lamettl and Sons, Inc. , Conso I ! dated Improvement
12-13, Project 2, be approved, i n the amount of $9,674.70, less
$200.00 to be withheld until black dirt and sod Is placed at the
concrete 11ft station site In the spring of 1971. The motion carried
unanimouSly. ,

RoseviUle State Bank - Official Depository
Upon the recommendation of Treasurer Worth G. Read, I t was, moved by
Councilman Henderson that Roseville State Bank be approved as an
officia8 "full-f~edged" depository for the Village of Arden Hills;
seconded by Counci Iman Ho!lenhorst. I~otjon carried unanimously.
REPORT OF COUNCULMAN JOHN HOLLENHORST - Planning and Zoning
Planninq Commission Appointments - 1971
It was moved by Councilman Hollenhorst that the ~ 97! Planning Commis-
sion be approved, as attached, seconded by Councilman Herrick. Motion
carried unanimously.
Dorothy Zehm was requested to notify the Planning Commission members
of the appointments.

Councilman Herrick moved that the rink attendants for the 8970-1971

I Jaycees Letter of Appreciation for Rink Flooding
Clerk was requested to write to Mr. Paul Ouderkirk, President of
the Arden Hills Jaycees, thanking the Jaycees for their help In
flooding skating rinks.
REPORT OF COUNCILMAN E. GRAY HENDERSON - Finance and Municipal Lands
and
Nazareth Ha II Sewer Rate
Councilman Henderson moved approval of a Sewer rate refund adjustment
to Nazareth Hall, retroactive to June 16, 1970, in the amount of
$436.84, for the period {rom June 16, 1970 to September 30, 1970,
seconded by Counci Iman Herrick. Motion carried unanimously.
W~ter Rate Ordinance Modification
"Cler-kAdmlnistrator'was requested to write to Mr. Eugene Colestock,
Dynacast Corporation, asking for the report'of recommendatl()ns he
offered to submit to the Council re water rates: copy of letter Is
to be sent to Mr. John Rysgaard, Mr. Joe Lambert, Mr. Cliff lurid,
Mr. R.,McNlesh, Mr. W. Read, Control Data Corporat I on, and to a II
Councilmen.
~ State Guarantee of Local Bond Issues - L.M.M.
After discussion of the proposed State Guarantee of LocaD Bond
Issues, and Short Term Financing, proposed by L.M.M., It was moved
by Councilman Henderson that the ballot be returned to the League,
voting disapproval of the State Guarantee of Local Bond Issues, and
approval of Short-Term Financing; adding "We also ask that the League
,Investigate the possibility of the use of Long Range dedicated State
of Minnesota funds for short-term Municipal financing." Motion was
seconded by Councilman Herrick and carried unanimously.

REPORT OF MAYOR HENRY J. CREPEAU, JR. - General Government and Public
Safety
~Iic Safety Committee Budget Request
Mayor Crepeau advised the Councl I of a "lag" In bi I ling ,from Skelly
Oil Company In 1970, resulting In charges In 1971 amounting to approxi-
mately $500.00 which should have been paid from the 1970 Public Safety
Budget.
After discussion, It was moved by Councilman Henderson that $500.00
be transferred from the 1970 General Fund Balance to the 1971 Pub II c
Safety Budget as follows:
4110-2420 Maintenance/Repairs, Police Cars 350.00
4110-3310 Gas and 011 50.00
4 r i 0-3420 TI res 100.00
The motion was sedonded by Councilman Hollenhorst and carried unani-
mously.
Architect Agreement - Horty, Elving and Associates
Councilman Hol~enhorst moved that the agreement with Horty, Elvlng
and Associates be approved, as submitted with a letter from Mr. Horty,

No. 6744, to the Geo. M. Hansen Company, until the Clerk checks for
a letter indicating a charge for this service. Motion was seconded
by Councilman Hollenhorst and carried unanimously.

VARIANCE REQUEST UNDER
ORDINANCE NO. 98
WHEREAS, the Council has noted a request dated December 14,
1970, by Robert J. McNiesh for a variance from the requirements
of Ordinance No. 98 with respect to a proposed division of their
property at 3447 Siems Court, Arden Hills, legally described as
Lots 17 and 18, Block 2, Arden Hills, Ramsey County, Minnesota,
and
WHEREAS , said division would result in a building lot,
being part of lot 18, containing approximately 11,200 square feet,

, less than the required lot size under the Zoning Ordinance, and

WHEREAS, the Council has further noted that a variance with
respect to the lot line between said Lots 17 and 18 had been
requested and granted by the Council on March 28, 1966, prior to
the passage of Ordinance No. 98 and prior to the present require-
,~ ment on lot size,
NOW THEREFORE ,IT IS HEREBY RESOLVED, as follows:
1. The Council finds, as provided in Section 13 of
. Ord. No. 98, that there are special circumstances

\. present here which would deprive the applicant of
the reasonable use of his land if Ord. No. 98 was
strictly enforced, that the proposed variance is

. necessary for the preservation and enjoyment of
a substantial property right of the applicant, and
that the granting of the proposed variance will not
be detrimental to the public welfare or injurious
to other property in the territory in which the
subject property is situated.
2. The variance from the requirements of Ord. No. 98
is hereby granted with respect to the division of
said Lots 17 and 18, Block 2, Arden Hills, into two
parcels described as follows:
Parcel 1 - All of Lot seventeen (17) and
that part of Lot eighteen (18), Block two
(2) in Arden Hills, Ramsey County, Min-
nesota, lying Northerly of a line described
as follows: Beginning at the Southeast
corner of said Lot 17; thence Westerly to
a point on the West line of Section 34, Town
30 N, Range 23 Wand 101.55 feet Southerly
(along said West line from the North line
of said Lot 17); thence continuing Westerly
along said line to Lake Johanna and there
terminating, according to the plat thereof
filed of record in the office of the Registrar
of Titles within and for said County.
