The meeting was called to order by Mayor Crepeau, Jr. at 8:02
p.m.
Roll Call
Present: Mayor Henry J. Crepeau, Jr., Councilmen Stanley Olmen,
John Hollenhorst, E, Gray Henderson and Ronald Herrick.
Absent: None

Approval of MInutes
The Minutes of the Regula~ Council meeting of November 30, 1970
were approved as submitted.

Mr. Robert Tagtow, 1737 Crystal Ave. , recommended passage by the
Village of an ordinance prohibiting the sale of non-returnable
or disposable beverage contalnersJ stating that he favors legislation
banning the purchase of non-returnable over the other' alternatives
to re-cycle them or to request buying of returnable containers.
Mr. Joe Bussard, 4335 N. Hlghway 10, recOmmended passage as ~
State law rather than as a Village ordinance.

After review of the sample ordinance, submitted by Mr, Tagtow,
the matter was referred to the Ordinance Review Committee, the
Planning Commission 'and the Arden Hills Jaycees for their recom-
mendation to the Council.

REPORT OF VILLAGE ATTORNEY VINCENT p. COURTNEY
, Liquor License Renewals
" Attorney Courtney advised the Council of a few minor corrections
to be made on the four liquor applications submitted to him for
review. He advised that the Surety Bond for On-Sale Liquor for
the Big Ten Supper Club has not been received to date, and th Is
license should be withheld until the bond Is received and'revlewed.
It was moved by Councilman Herrick that the liquor licenses as
listed below, be approved as recommended by Attorney Courtney,
withholding the Big Ten Supper Club On-Sale Liquor License until
the Surety Bond Is received in proper form:

. Architect Agreement - Horty, Eivln~ and Associates
Attorney Courtney reviewed his letter to the Council, dated
December 9, 1970.
After discussion, It was determ)ned by the Councl I to table
consideration of the architect's fees until the construction
cost estimates are submitted by Mr, Horty; consideration of al I .'
fees and costs will be considered at that time.
Nazareth Ha i i Sanitary Sewer Charges
Attorney Courtney reviewed his letter of December 14, 1970 re the
Nazareth Ha II request for a sewer charge adjustment, noting that
either the date of notification of the re-evaluatlon from the
Ramsey County Assessor's office or Jan. 2, 1970 could be con-
sidered as the effective date for retroactive reduction.
The Council referred the matter to Councilman Henderson. for
study and his recommendation to the Council.
Arden HI lis - New Brl~hton Land Transfer land transfer
Attorney Courtney reported on the progress of the
with New Brighton; stating that the agreement, a,s approved by
ArdenHltls, is also agreeable to New Brighton and, after
execution of the agreement by both villages, the agreement will
be submitted to the Municipal Commission for approval.
Philip Sampson Deed Better to the Council, dated Dec.
Attorney Courtney reviewed his
14, 1970 re the Philip Sampson land Deed, and requested that a
V III age check, In the amount of $71.05 be drawn to be submitted
with the deed In order that the deed be executed this year.
Clerk Administrator Stromquist was requested to draw the check,
as out II ned In Attorney Courtney's letter.
Attorney Courtney advised the Council that he has requested
Engineer Lund to check the lega! description for accuracy; Mr.
Lund I s to ca I I Attorney Courtney re his findings.
Soo Line Railroad Agreemen~ Re Granting Permission to Arden Hills
to Cross the Soo Line Tracks
.Attorney Courtney advised the Council that the Soo line has agreed
to accept the changes In the agreement suggested In his letter
dated Nov. 30, 1970. The Counc I I accepted the changes, as out-
lined, and requested Clerk Administrator Stromquist to write to
the Soo Line advising of the Council's action.
Zoning Ordinance Amendment
It was moved by Councilman Hollenhorst and seconded by Councilman
Herrick that AN ORDINANCE AMENDING ORDINANCE NO. 99, THE ZONING
ORDINANCE, BY STRIKING PROHIBITED USES AND AMENDING PROVISIONS
RE SPECIAL USES AND ACCESSARY USES, be adopted as submitted and
attached. motion carried unanimously,
REPORT OF VilLAGE ENGINEER DONALD LUND

McDonald & Associates. San. Sewer 12 - 13 - Application for Payment
No.6
Engineer lund's recommendation to approve payment of McDonald &
Associates' Estimate 6, San. Sewer Imp. 82 - 13, In the amount of
$73,187.39, reducing the retalnage of 2~, was reviewed and discussed.
The matter was referred to Attorney Courtney to check the contract
re retalnage reduction provisions and to notify Clerk Administrator
Stromquist of his findings.
Councilman Hollenhorst moved that Estimate No.6, San. Sewer 12 - 13,
be authorized for payment, retaining the legal retalnage; a punch
list of estimated cost of remaining work to be submitted by the
contractor; a list of claims re the Improvement to be obtained by

league of Minnesota Municipalities legislative Study Re State
Gua~antee of local Bond Issues
Treasurer Worth Read described the proposed State Guarantee of
local Bond Issues as p~cposed In the legislative study, ~ecom-
mending that Arden Hi lis approve the 2 ~esolutlons 're State
Guarantee of local Bond Issues and Short Te~m Financing. He
stated that he fee!s this legl~iation 15 a step in the right
direction and the VII~age would retain the option of partici-
pating In the prog~am.
Mr, Read said that bankers are opposed to the legislation and
fiscal agents and others affiliated with the sale of bonds are
In favor of the legislation, which would make It easier to sell
bonds.
Afte~ discussion, the matter was tabled by the Council until Dec.
28, 1970, and ~eferred to the Finance Committee for Its ~ecom-
mendatlon to the Council

Case 70-36, Special Use Pe~mlt, I.O.O.F.
Councilman Holienhorst reviewed a lette~ from Mr. Edward J.
Sheperd, a member of St. Paul lodge No.2, I.O.O,F. , In which
questions were raised re the validity of the application for the
Special Use Permit,
Mr. Robert Beck, Secretary to the Trustees, and the President
of the Lodge were present and were given a copy of the letter.
It was moved by Councilman Hoilenhorst that Mr. Sheperd's letter
and Midwest Planning's Report, Including a draft of the Special
Use Permit, be referred to Attorney Courtney; the lodge's
attorney Is to contact Attorney Courtney; motion was seconded
by Councilman Herrick and carried unanimously.
The matter was tabled by the Council until the validity of the
application Is ascertained.
Case 70-30, PreUlmlhary Plat - Bussard Addition
Councn Iman Hollenhorst moved that a Public Hearing be scheduled
and held by the Planning Commission re the Preliminary Plat for
Bussard Addition, seconded by Councilman HerrlckJ motion carried -
unanimously.
The 'amended plat was referred to the Public Works Committee for
Its recommendations to the Council prior to the date scheduled
for the PublIc Hearing.

Public Works CommIttee.)

Councilman Ho lenhorst moved approval of the Issuance 0 the

Case 70-31, Underground utilities Ordinance
Councilman Hollenhorst moved that the amended draft of AN ORDINANCE
PROVIDING FOR THE UNDERGROUND INSTALLATION OF UTILITY DISTRIBUTION
LINES AND PROVIDING FOR VIOLATIONS, be referred to Attorney Courtney
to prepare a final draft; seconded by COUllcl Iman Herrick; motion
carried unanimously.

Rezoning of Annexed Area
The Councl! authorized the Plan~lng Commission to schedule and
hold a Public Hearing re the rezoning of the area to be annexed
to Arden Hills from New Brighton.
Clerk Administrator Stromquist was asked to request Engineer
Lund to prepare the legal description of the areas to be rezoned,
as outlined In Planner Report dated Dec. I, 1910, and recommended
by the Planning Commission; to order the Ownership Report If
cost does not exceed $50.; (Ownership Report to be delayed
until approval of the land trade by the Municipal Commission,
If cost of Ownership Report exceeds $50.)

Proposed Re-Construction of Snelling Avenue
Councilman Hoilenhorst moved that the Council concur with the
Planning Commission's recommendation agatnstthe County proposal
for the re-constructlon of Snelling Ave., except to square off
the Intersection at County Rd. E and Snelling Ave.; Install
four-way stop signs; Install warning lights from the East and
South. The motion was seconded by Councilman Henderson and
carried unanimously.

Human Rights Commission Meeting
Minutes of the meeting were distributed to the Council members.

Mounds View School District Recreation Department Request for Ice
Rink Schedule Use
It was moved by Councilman Herrick that the Mounds View Recreation
Department's request for use of the Highway Rink (Hwy 51 and County
Rd. E) and Valentine Rink (County Rd. F and Old Hwy 10) be ap-
proved as follows:
Highway Rink - 11:00 a.m. to 12:00 noon Saturdays
Valentine Rink - 3:30 to 4:00 p,m. Saturdays
from Jan. 9, 1911 thru Feb. 13, 1971. The motion was seconded
by Councilman Hollenhorst and carried unanlmoust~~
Clerk Administrator Stromquist was requested to advise Mr. Harmon,
Mounds View Recreation Dlrecto'r, of the Council's ,action.
Star - Tribune Request for Use of Charles Perry Park
Councilman Herrick advised the Council that the Star - Tribune
has requested to bring 5 snowmobiles and 30 boys to perry Park
to snowmobile, as an award for thel~ carriers. The matter was
referred to Maintenance Supervisor Beecher to Indicate the
boundaries of the park and to notify Star - Tribune to contact
" the Arden Hills Police Department re the time they wish to use
the park and to bbtaln tules for operation of snowmobiles.
Parks and Recreation Committee Bud~et Request
It was moved by Councilman Herrick that the Parks and Recreation
Committee request to carryover Into 1971 Parks and Recreation
Fund any balance remaining In the 1910 Parks and Recreation Fund,
r~ for use In the completion of Charles Perry Park, as proposed;

. Open Fire to Break Frost Requests
Clerk Administrator Stromquist reported that several requests
for "fires to break frost" have been received from various con-
struction contractors.
Mr. Norman Ecklund, Lakeland Clvlsion, N. S. P., presented a
copy of a letter to N. S. P. from the State of MInnesota Pollution
Control Agency.
,After discussion, It was moved by Councilman Ho!lenhorst that
the letter to N. S. P. from Pollution Control Agency be referred
to Fire Chief Harry Ehlers: authorizing Fire Chief Ehlers to
work with the P. C. A. In the discretionary Issuance of permits
for ground thawing fires In the Vi Ilage of Arden Hills; seconded
by Councilman Olmen: motion carried (4 voting In favor of the
motion and I In opposition Herrick.>
Clerk Administrator Stromquist was requested to write to the
Pollution Control Agency to verify the Council's Interpretation of
the open burning permitted exception re open burning relating
to ground thawing, as stipulated In P. C. 'A, 's letter to N.S.P.,
as a "blanket exception" for all contractors desiring to thaw
ground for repair, Installation or construction purposes.
Report of Open Burning
Clerk AdminIstrator Stromquist advised the Council that open
burning on the Twin City Arsenal grounds has been reported i'o
the Village office.
The matter was referred to Lieutenant Sexton to notify Major
Slsterman of the ordinance banning open burning.

WHEREAS, the Village of Arden Hills, Minnesota, has received
. numerous reports of accIdents and near accidents at the Inter-

~ot. , damage and possible Injury or death, and

WHEREAS, many of these accidents and near accidents are
caused by confusIon regarding right-of-way on the southwest curve.
NOW, THEREFORE, BE IT RESOLVED by the Village Council of the
Village of Arden HII Is, Minnesota, that a study be conducted by
Ramsey County to determine means to eliminate or reduce these
dangerous conditions.
, BE IT FURTHER RESOLVED that the County take Immediate steps
, to blockade the curve to require traffic to Intersect at a right

State of Minnesota
Pursuant to due call and notice thereof, a regular meeting
of the Village Council of the Village of Arden Hills, Ramsey
County, Minnesota, was duly held in the Village Hall at 1450 West
Highway 96, St. Paul, Minnesota, on Monday, the 14 day of
December, 1970, at 8:00 o'clock P.M.
The following members were present: Crepeau, 01 men, Henderson,
Hollenhorst and Herrick

RESOLUTION RELATING TO APPORTIONMENT
OF ASSESSMENTS RELATING TO
SANITARY SEWER IMPROVEMENT NO. 1
BE IT RESOLVED by the Village Council of the Village of
Arden Hills, Minnesota, as follows:
WHEREAS, the assessment roll for Sanitary Sewer Improvement
No.1, as last finally amended and adopted on September 9, 1960,

was filed and certified to the County Auditor of Ramsey County

on October 26, 1960, for the purpose of including installments

thereof to be collected along with real estate taxes commencing
in 1961; and
WHEREAS, a hearing on supplemental assessments, reassess-
ments and apportionments of previous assessments in respect to
Sanitary Sewer Improvement No. 1 was held on August 3, 1961, at
which time assessments for Sanitary Sewer Improvement No. 1 were
, amended as provided by said resolution of said date and certified
. and filed in the office of the County Auditor of Ramsey County on
September 8, 1961; and

WHEREAS, since that date a number of parcels of property
. contained within said assessment roll as amended have been
divided and conveyed by previous property owners; and
WHEREAS, the County Auditor of Ramsey County requires that
apportionment of the original assessment against each original
tract where it has later been divided, sold or conveyed, be made
by the Village Council of the Village of Arden Hills, in order
that the proper assessment can be extended by the County Auditor
against each parcel of property thereafter, commencing with an
assessment to be collected in the year 1963 and thereafter;
NOW, THEREFORE, the Village Council of the Village of Arden
Hills does hereby make the following apportionment of original
assessments as contained in said assessment roll of September 9,
1960, and as amended as of August 3, 1961, against the following
described properties:

Pursuant to due call and notice thereof, a regular meeting
of the Village Council of the Village bf Arden Hills, Ramsey
County, Minnesota, was duly held in the village Hall at 1450
West Highway 96, St. Paul, Minnesota, On Monday, the 14 day
of December, 1970, at 8:00 o'clock P.M.
The following members were present: Crepeau, Olmen, Henderson,
Ho II enhorst and Herrick
and the fallowing were absent: None

RESOLUTION RELATING TO APPORTIONMENT
OF ASSESSMENTS RELATING TO
SANITARY SEWER IMPROVEMENT NO. 3
BE IT RESOLVED by the Village Council of the Village of Arden
Hills, Minnesota, as follows:
WHEREAS, the assessment roll for Sanitary Sewer Improvement
No. 3 as last finally amended and adopted on October 12, 1961,
was filed and certified to the County Auditor of Ramsey County
on November 17, 1961, for the purpose of including installments
thereof to be collected along with real estate taxes commencing
in 1962, and
WHEREAS, a hearing on supplemental assessments, reassessments
and apportionment of previous assessments in respect to Sanitary
t Sewer Improvement No. 3 was held on July 16, 1962, at which time
, assessments for Sanitary Sewer Improvement No. 3 were amended as
provided by said resolution of said date and certified and filed
in the office of the County Auditor of Ramsey County on October 3,
1962, and

WHEREAS, since that date a number of parcels of property
. contained within said assessment roll as amended, have been
divided and conveyed by previous property owners: and
WHEREAS, the county Auditor of Ramsey County requires that
apportionment of the original assessment against each original
tract where it has later been divided, sold or conveyed, be made
by the Village Council of the Village of Arden Hills, in order
that the proper assessment can be extended by the County Auditor
against each parcel of property thereafter, commencing with an
assessment to be collected in the year 1963 and thereafter,
NOW, THEREFORE, the Village Council of the Village of Arden
Hills does hereby make the following apportionment of original
assessments as contained in said assessment roll of October 12,
1961, and as amended as of July 16, 1962, against the following
described properties.
