Call to Order The meeting was called to order by Acting Mayor E. Gray Henderson at 8:00 p.m. Roil Ca II Present: Acting Mayor E. Crepeau, Jr. and Councilman John Hoilenhorst Also Present: Clerk Administrator Lorraine Stromquist, Attorney Vincent P. Courtney, Fiscal Agent Peter Popovich, Treasurer Worth G. Read, Engineer Norman Hendrickson, Maintenance Supervisor Everett Beecher and Assistant Clerk Dorothy Zehm Approval of Minutes The Minutes of the Regular Council Meeting of Oct. 26, 1970 were approved as submitted. The Minutes of the Special Council Meeting of Oct. 29, 1970 were approved as corrected. The Minutes of the Special Council Meeting of Nov. 5, 1970 were approved as submitted. Supplemental Assessment Hearing - Consolidated Water Imp. 68-2 and 68-3 Acting Mayor Henderson opened the Supplemental Assessment Hearing at 8:00 p.m. Engineer Hendrickson presented the list of properties and the pro- posed assessment for each. (Minutes attached) After hearing all comments from property owners that were present, and after reading all adjustment requests received by phone and/or letter, it was moved by Councilman Olmen that the Supplemental Assessment Hearing be adjourned and Council action postponed until Tuesday, Nov. 10, 1970 at 5:00 p.m. at the Village Hall. The Supplemental Assessment Hearing adjourned at 9:35 p.m. BUSINESS FROM THE FLOOR Mr. Jose h Kahnke 1541 Ed ewater Ave., requested Council consideration of des gnated areas in the Ilage for compost locations for leaves and grass clippings, other than the swamp areas now being used by many resIdents which he claims Increases the draInage of nutrients I nto the I a ke $ . Mr. Kahnke was advised that dumping of any kind, leaves and grass Included, Is not permitted In Arden Hills; that a method of leaf disposal, other than the present bagging of leaves, wl~1 ~e studied by the Council. REPORT OF VILLAGE ATTORNEY VINCENT P. COURTNEY New BrlQhton - Ard~n HI lis Land Trade Attorney Courtney advised that he and New Brighton Attorney Copeland are currently preparing Informational reports needed by both Villages, before preparation of a Resolution later this month. He said that Dec. 31, 1970 Is recommended as the tax cut-off date. Attorney Courtney advised that a tax and assessment search will be made to ~ determine delinquent taxes and assessments, and requested that the zoning of the area, to be traded to Arden Hills, be referred to the Planning Commission for Its recommendations to the CouncIl In early December. . - ... REPORT OF COUNCILMAN JOHN HOLLENHORST - Planning and Zoning (absent) Report of the Planning Commission meeting of Nov. 2, 1970 will be g1ven at the Nov. 30, 19.70 Council meeting. REPORT OF COUNCULMAN RONALD HERRICK - Parks and Recreation & Human HI ghts , Charles Perry Park Councilman Herrick reported that the appearance of the fill and gardlng project In Charles Perry Park has Improved, and Attorney Norkows k I , Federa! Cartridge Corp., Is apparently satisfied with the cover provided for the gas main which runs through the area. Skatln!l Rinks CouncIlman Herrick advised that skating rinks will be maintained this year, In the same locations as last year; requesting that the newspapers and the Arden Association publish this Information. Burning Permits Councilman Herrick advised that Fire Chief Ehl.rs has agreed not to 1ssue burning permits for leaves or trees until authorized to do so by the Arden Hills Council. Lake Lane Tax-Forfeited Pro~2!~ Clerk Administrator Stromquist was requested to obtain the deeds for the two parcels of tax-forfeited land on Lake Lane. Park Equipment MaIntenance Supervisor Beecher was requested to store summer play- ground equipment as soon as possible. Mr.. Beecher stated that adequate storage space will not be available until the addition to the Public Works building Is completed. Du I uth Water Conference Report MaIntenance Supervisor Beecher advised the Cou~11 that he I s pre- paring his report of the water conference, but It Is not complete at this tIme. II UtIli tv Ad1-ustment' Reques t Councilman Henderson requested that his report re the Nazareth Hall request for a utility charges adjustment be deferred until the Nov. 30,1970 Council meeting; stating that he would like to confer with the County Assessor and Deputy Clerk Florence Honan before submittIng his report. . Minutes of Regular Council Meeting November 9, 1970 REPORT OF CLERK ADM!NiSTRATOR LORRAINE STROMQUIST Arthur Hags Construction Co. - Construction ScheduUa Clerk Administrator Stromquist reported that Art Hage Construction Co. has advised they anticipate construction of the office building at County Road F and Hamllne AVe. Bnd will advlso the Council by letter as to when sewer and water services will be needed. San. Sewer Imp. 12 - 13 Easements Clerk Administrator Stromquist reported that Attorney James Lynden Is securing San. Sewer Imp. 12 - 13 easements. She was requested by the Council to inquire as to why it takes so long to obtain easements and report to the Council at the Specla! Councl I meeting on Nov. 10, !970. Extract of Minutes of Meeting Village Council Village of Arden Hills R~$ey County, Minnesota ~eld November 9, 1970 Pursuant to due call and notice thereof a regular meeting of the Village Council of the Village of Arden Hills, Minnesota, was duly held at the Village Hall in said Village on Monday, the 9th day of November, 1970, at 8iOO o'clock p. m. The following members were present: Acting Mayor Henderson and Councilmen Olmen and Herrick, and the following were absent: Mayor Crepeau and Councilman Hollenhorst. Also in attendance were: Clerk Administrator Lorraine Stromquist: Village Attorney Vincent Courtney: Village Treasurer WOrth Read: Norman Hendrickson from Banister Engineering Company, Village consulting engineers: and Peter S. Popovich of Peterson & Popovich, Village bond consultants. The Village Clerk Administrator presented an affidavit showing publication of notice of hearing on the proposed supplemental reassessment of original assessments for Consolidated Water Improve- ments Nos. 68-2 and 68-3 in the New Brighton Bulletin on October 21, . 1970 in accordance with the resolution adopted October 12, 1970, ~ which affidavit was examined, found satisfactory and ordered placed t on file. The Village Clerk Administrator also exhibited an affidavit of mailing notice to affected property owners. ~,~- . . . The Mayor announced that the meeting was open for the consideration of objections to proposed supplemental assessments and reassessments of previous assessments in respect to Consolidated Water Improvements Nos. 68-6 and 68-3, said original hearing being held September 28, 1970, and said assessment roll being adopted September 28, 1970, and certified to the County Auditor on October 28, 1970. All persons present were then given an opportunity to present oral objections, and all written objections theretofore filed with the Village Clerk Administrator were presented and considered, and all such objections were tabulated as follows: MR. WILIJiRD. J . NEAMY, 3171 Lexington Avenue: Felt that he should have been assessed for only 80 feet, as was done on the sewer assessment, rather than 160 feet. He also asked, if he is assessed for 160 feet, if part of it could be deferred since he's living on a pension and doesn't have the money to pay the assessment. MR. BERNHARD W. LE VANDER, 3550 Siems Court: Has been assessed for three connections and asked that this be reduced to two. He owns three lots. His house is located in the center and, in expanding his home a few years ago, the house is now so close to one of the side lots that it is an unbuildable lot. MR. S.. G. CORTELYOU, 1548 W=st Arden place: HaS a badly skewed lot and felt that the front footage figure used in determining his assessment was too high. MR. GEORGE URAM, 1770 Gramsie: Lives on the corner of Gramsie ~ and Dellview. He was assessed 125 feet on Dellview and 15 on Gramsie. t Thought he Should be assessed only for the 90 feet he owns on Gramsie plus 15 feet on Dellview. MR. JAMES SHERMAN, 3946 Dellview: OWns an odd shaped lot with 72 feet on the street and has been assessed for 120 feet. Believes the assessment is excessive and asked for an explanation of the basis of 120 feet front footage. Mr. Albert M. Olen, 3270 North Hamline: Asked if he had been assessed or should be assessed on Hamline Avenue. was informed that his .front footage assessment would be reduced. . . . DR. ROBERT DUNN, 3413 North Snelling: Asked why he had been assessed for both frontage and acreage. MRS. ED CALPH, 1651 west County Road F: Complained about some of the construction work not being finished. MR. BERNHARD W. LE VANDER, Attorney-at-LaW, representing Mounds View School District No. 621: Said that school property should be treated as residential property and should be assessed at $5 a front foot rather than the proposed $7.50 a front foot which is the commercial property assessment. MRS. TRUDY HARMON, 1661 west County Road F: Comments about the unfinished construction work on county Road F. MR. JAMES SHERMAN, 3946 Dellview: After the Council reviews his assessment, asked if they would advise what they used as a set back line. In comparing his lot size and assessment with another lot in the Village, asked if the Council would also advise what has been used as the set back line on the other lot. Communications were received from the following: MR. R. C. THRASHER, 3200 Lake Lane: He has 48 feet on Shore- line Lane and 35 feet on Lake Lane for a total of 83 feet for which he was assessed. He objected because he said he had been told he would be assessed as a corner lot with a 15 foot assessment on the side. MR. VERNON SMITH, 1175 Edgewater: owns three 50-foot lots. He was charged for 150 feet frontage plus 15 feet on the side for a corner lot. He said the lots drop off sharply toward the lake and he feels the assessment is too high for this particular piece of property. MR. ARNIE HOVIN, 3470 Siems Court: Mr. Hovin submitted a plat that shows a frontage of 120 feet with a rear width of 57 feet and the lot is skewed. He was assessed for 100 feet which is the same as the sanitary sewer assessment. He claims the average is 88 1/2 feet and he feels he is entitled to an adjustment to 88 1/2 feet. . MR. WILLIAM BACHMAN, 3187 Lexington Avenue: HaS 80 feet on Lexington but his lot extends to Lake Josephine. He felt that he . should be assessed for only 80 feet rather than 160 feet. MR. LAWRENCE KINPORTS, 1645 Valentine: Objected to his assess- ment and asked that it be adjusted. The engineer indicated that the frontage used for this assessment is different from that used for the sanitary sewer assessment. The sanitary sewer wasn't constructed on old Snelling Avenue but on the back of his lot between his lot and the neighbor immediately to the west. The water main goes not only on old Snelling Avenue but on valentine Avenue so he was assessed the width of his lot on Snelling which is 200 feet plus 15 feet on . . the side. His lot is over 200 feet deep and he was charged for the additional 40 feet which is in excess of the 200 foot lot depth on valentine so he has a total of 255 feet. Mr. Hendrickson, village consulting engineer, indicated that properties belonging to Mr. Worth Read, 3162 North Hamline, and Mr. Mertin Stenberg, 1415 Glenhill Road, were not assessed under water Improvement 67-1 but at the time they connected, they paid a cash connection charge equivalent to what the assessment would have been. They have now been included in the assessment for Im- provement 68-3, but,since they have already paid, this assessment should be deleted. Councilman Olmen moved that the hearing be adjourned and con- tinued to 5:00 o'clock p. m., Tuesday, November 10, 1970. The motion was seconded by Councilman Herrick and carried. . .
