The meeting was called to order by Mayor Crepeau at 8:00 p.m.

The Minutes of the Regular Council Meeting of Monday, Oct. 12, 1970,
were approved as submitted.

REPORT OF VILLAGE ATTORNEY VINCENT P. COURTNEY
Ordinance Re Pre-payments on Assessments - Second ReadIng
After Attorney Courtney read the proposed Ordinance In Its entirety,
It was moved by Councilman Herrick and seconded by CouncIlman
Henderson that the thIrd readIng be waived and AN ORDINANCE PERMITTING
PARTIAL PRE-PAYMENTS OF ASSESSMENT BEFORE CERTIFICATION OF THE
ASSESSMENT ROLL TO THE COUNTY AUDITOR be adopted as read Cattached).

ZonIng Ordinance Amendments - Second Draft
Attorney Courtney reviewed his letter. dated Oct. 26, 1970, re th e
proposed amendments to the Zoning Ordinance.
The Council referred the letter and draft of the Ordinance amend-
ments to the Planning Commission for recommendations to the CouncIl
at the Nov. 9, 1970 Council meeting.
Copies of letter and Ordinance draft have been sent to MIdwest
Planning & Research. Clerk Administrator Stromquist was requested
to provide copIes of the letter and Ordinance draft to the PlannIng
CommissIon members.
Sanltarv Sewer 14 - Soo LIne Railroad Easement
Attorney Courtney advised the Council that a License Agreement has
. been receIved from the Soo Line RaIlroad for a sewer lIne crossIng
between Cleveland Ave. and New BrIghton Rd. I .-
After dIscussIon, It was moved by Councilman Olmen and seconded by
CouncIlman HerrIck that the CouncIl formally ratify the execution
of the License Agreement, includIng the payment of SI35., motion
carried unanImously.
Attorney courtne~ was requested to write to the Soo Line Railroad
Co. expressing t e CouncIl's sent.lments re the agreement provls;lons.

Assessment Adjustment ReQuests
EngIneer Lund reported that several assessment adjustment requests
have been receIved and are under consIderation.
-. Attorney Courtney outlined t~e procedure to be followed by the Council
to effect adjustments to an assessment roll, after It has been
adopted; advising that a Supplemental Public Hearing must be held.

Clerk Administrato,- Stromquist advised that writi'en notices have
been sent to property owners In Water Imp. 68-3, advising them of
the Supplementary Public Hearing on Monday, Nov. 9, 1970, at 8:00 p.m.
The Council scheduled a Special Council meeting to be held on
Thursday, Oct. 29,1970 at 11:00 a.m. to consider Sanitary Sewer
assessment adjustment requests.
McDonald Lumber Co.. 4979 Highway 10, Mr. & Mrs. I. Giere, 4275
N. Hamllne Ave., and Mrs, Oswald Tschida, 1445 Floral Drive were
present and requested sewer assessment adjustments - San. Sewer Imp.
12 & 13.
Sanitary Sewer Improvement 12 - 13 - Sug~ested Change Order
Engineer Lund presented the estimated construction cost and plan
for proposed San. Sewer construction west of Lakeshore Place,
locating a sewer ~jne along the rear of the properties, providing
Immediate hookups, as had previously been requested.
Clerk Administrator Stromquist was requested to talk with the pro-
perty owners re gl-an"ring of free easements across rear yards vs
front hook-ups, and to advise the Counc! I.
Engineer Lund advised the Council that the estimated amount of final
construction cost of Project I, Sewer Imp. !2 and 13, wi II be
$54,673.85 below the contract amount. (Estimate attached.)
Sanitary Sewer Imp. 16 and Water lm~. 70-1
Engineer Lund advised the Council that the plans are ready for
San. Sewer Imp. 16 and Water Imp. 70-1, but the specifications are
not ready, to date.
Clerk Administrator Stromquist was requested to contact Hage Construction
Co. re Its construction time table; bid date to be scheduled by
the Council In accordance with the construction time table.
Sanitary Sewer Imp. 15 - Gideo Construction Co. - Estimate I
Engineer Lund presented, and recommended payment, of Estimate !,
Gldeo Construction Co., San. Sewer Imp, 15.
Water Imp. 68-3, Northern Contracting Co. - Estimate 7
Engineer Lund presented Estimate 7, Northern Contracting Co., and
recommended payment and reduction of retalnage to 5%.
Councilman Henderson moved approval of the 5% retention; seconded by
Councilman Olmen; motion carried unanimously.
Councilman Herrick moved approval of payment of Estimate 7 on Nov.
9, 1970; seconded by Councilman Olmen; motion carried unanimously.
Fairview and County Road F - Pondlng Water Problem
Councilman Herrick requested the status of the proposed correction
of the water problem at the Intersection of County Road F and
Falrvlew Ave. Maintenance Supervisor Beecher stated that the County
has agreed to do the grading, If Arden Hills will take care of the
blacktopping.
Engineer Lund was requested to try to expedite the project In an
effort to resolve the matter this week.
REPORT OF VILLAGE TREASURER WORTH G. READ
An oral report by Treasurer Read indicated that Village reserves
have been Improving each quarter; stating that over $50,000. has
~ been collected In Interest this year.

REPORT OF COUNCILMAN RONALD HERRICK - Parks and Recreation & Human Rights
Parks and Recreation Committee Report - Or, Robart BJorndahl
I. Charles Perry Park - The Parks and Recreation Committee Is dis-
appointed In the appearance of the "fill" portion of Charles Perry
Park, and Contractor Schutz has been notified to bring the area up
to "agreed-upon" standards. Dr. Bjorndahl stated that a "cat" was
operating there on Thursday and Friday, but was not there today.
He requested that the contractor be given another chance to comply
with his contract, before instigating any legal action.
Mayor Crepeau advised Dr. Bjorndahl that many complaints have been
received.
To alleviate the dumping problem, the cable Is to be re-Installed
and locked, to block the entrance. Only the contractor, Dick Schutz,
and Maintenance Supervisor Beecher are to have keys.
2. Ingerson Park - The basement structure at Ingerson Park Is recom-
mended to be caved-in and filled, Dr. Bjorndahl requested that any
excess fill be used for this purpose. Maintenance Supervisor Beecher
advised that some fill was dumped there today.
3. Valentine Park - Dr. Bjorndahl advised that if grading of the
park can be accomplished in the next week or two, the Parks and
Recreation Committee recommends that *oddlng of certain areas be
done this fall; recommending that Glen Beggin stake the areas for
sodding, Johnny Schultz grade the park and W. and G. Rehbein do the
SOdding.
4. Skating Rinks - Dr, Bjorndahl advised that the Parks and Recreation
Committee recommends that a part-tIme employee be hired to flood and
clean rinks; that he be a person responsible for the operation of fire
hyd rants (possibly a volunteer fireman); that he be available to work
from 9:00 p.m, to l i : 00 p. m ,
Councilman HerriCk requested that no action be taken re rink employees
until a I ater meet i ng, after he has talked with the Blue Line Club and
Mr. Wegleltoer.
REPORT OF COUNCILMAN E. GRAY HENDERSON - Finance & Municipal Land and
Buildings
Nazareth Hall Sewer Bi Illng Adjustment Request
Councilman Henderson advised that a request for a sewer rental rebate
has been received from the St. Paul Diocese for Nazareth Hal" after
a re-evaluatlon of the property was made by the County Assessor's
office.
After discussion, It was determined that the sewer billing be sent
as computed; Councilman Henderson was requested to Investigate the
request and determine the basis for revision, as requested.
Rosevllie State Bank - OffIcial Utility Fund Depository
Councilman Henderson moved adoption of the attached Resolution, ap-
pointing Rosevllle State Bank as the Official Village Depository for
Utility Funds, requiring remittance on a weekly basis, of all funds
In excess of $2,000.; seconded by Councilman Herrick; motion carried
unanimously.

Highway No, 10 Service Road
Mayor Crepeau reviewed a letter from the Minnesota Highway Department
dated Oct. 13, 1970, re the service road on Highway 10, north of Highway
96.

turn-around would possibly alleviate the traffic problems on the
service drive.
Clerk Administrator Stromquist was requested to pursue the matter with
the Minnesota Highway Department,
Sodding and Mai ~box Request
Mayor Crepeau advised the Counci i of a request from Mr, Winleke, 4175
Old Highway 10, to rep~ace a mailbox and complete the sodding ot his
property after the sewer construction,
The matters were referred to Maintenance Supervisor Beecher.
Assessment Instruction Meeting - Commissioner ot Taxation
Treasurer Read and Assistant Ramsey County Assessor Hans Prechtel
were authorized by the Counc i I to represent Arden HI lis at the Nov.
6, 1970 meeting at the County Board Room at 9:30 a.m.
Appointment of A~ng Mayor
It was moved by Counci Iman Herrick that Councilman Henderson be ~p_
pointed ActIng Mayor from Nov. 9, 1970 through Nov. 25, 1970; seconded
by Counei Iman Olmen; motion carried unanimously.
Vascar - Time Checking Device
Mayor Crepeau advised the Councl~ of a new time-checking device. Vascar.
tor Which matching funds are avai lable from the Safe Street Act Fund.
He explained that the device can be purchased for about $995.; after
purchase, the Village can apply for reimbursement of half of the
purchase price.
Bul !ding inspector - Letter of ~ i !'jnation
Mayor Crepeau advised the Coune i I that a "etter of resignation has been
received from Bu I 1 ding inspector Clay Kelley, to be effective at the
end of this year, or whenever a replacement can be made.
Clerk Administrator Stromquist was requested to send a copy of Mr,
Kelley's letter to the Planning Commission members,
Mayor Crepeau advised the Council that he would write to Mr. Ke I ! ey ,
thanking him for his service to the Village.
Burning Permits
Counc! Iman Herrick advised the Councl! of anappDrent discrepancy In
the Village Burning Ordinance re burning of Oak trees Infected with
Oak Wilt. He said that Fire Chief Ehlers has issued burning permits
for the burning of Oak Wi It trees in Arden Hi lis; that the Counc i I
had tOl-merly not permitted the burning of Oak Wilt trees,
Clerk Administrator Stromquist was requested to check the statutes and
advise the Council.

Ramsey County Ordi~e Re SoJid Waste Disposal
Clerk Administrator Stromquist advised the Council that some conflict
Is apparent between the ordinance recently adop ted by Ramsey County
and the Village Sanitary Landtll! Ordinance.
The ordinances were referred to the Planning Commission and Ordinance
Revle~1 CommIttee for recommendations to the Council.
