Read, Maintenance Supervisor Everett Beecher and Assistant Clerk Dor~thy Zehm. Approval of Minutes The Minutes of the Regular Council Meeting of Monday, Sept. 28, 1970 were approved as amended. Case 70-39 , Building Permit Request For An Office Building - Art Hage Construction Co. Mr. Al Kehr, representing Art Hage Construction Co., presented perllmlnary plans for an office building to be located on I 1/3 acres at the southeast corner of Hamline Ave. and County Road F. I After discussion of the proposed office bui Idlng and the consequent need for water and sewer service to the site, it was moved by Councilman Hoilenhorst that the water and sewer improvement be ordered and plans and specifications prepared, In accordance with the Banister Engineering report dated Aug. 10, 1970. Motion was seconded by Councilman Olmen and carried unanimously. Art Hage Construction Company's representative, Ai Kehr, agreed to submit a letter to the Council stating that the building will be constructed, as described, If water and sewer line extensions to the site are ordered. It was moved by Councilman Hollenhorst that the Building Permit for the office be approved subject to the approval of the Planning Commission of BUilding, Site, Landscape and Grading plans; motion was seconded by Councilman Olmen and carried unanimously. FISCAL AGENT PETER S. POPOVICH Schedule for Assessment Hearing After review of a letter from Banister Engineering Co., dated Oct. 9, 1970, Indicating required additions and changes to the assessment rolls for Consolidated Water Improvements 68-2 and 68-3, It was moved by Councilman Henderson that the attached Resolution be adopted, scheduling the Public Hearing on Monday, Nov. 9, 1970 at 8:00 p.m. Motion was seconded by Counci Iman Hollenhorst and carried unanimOUSly. (Fiscal Agent Popovich was requested to prepare the notice for publication.) Clerk Administrator Stromquist was requested to draft a letter to Banister Engineering Co. advising of costs to the Village resulting from these ommlsslons and changes, and requesting re- Imbursement. Bond Sale Calendar Fiscal Agent Popovich reviewed a worksheet which he prepared of present and proposed bond indebtedness, for consideration by the ..-. Council. Minutes of Reguiar Council Meeting October 12, 1970 BUSINESS FROM THE FLOOR Mr. Vernon Smith, Assessment Adjustment Request Mr. Vernon Smith, t!75 Edgewater Ave., requested an assessm0nt adjustment, requesting that the front footage charge be fl~ured on the short side of his property rather than the long side. The request, as well as several other assessment adjustment requests received by Clerk Administrator Stromquist, were referred to Engineer Lund for re-evaiuatlon and his report to the Council on Oct. 26, 1970. Mr. George Roscoe, 3171 N. Cleveland Ave. Mr. George Roscoe, operator of the Texaco station at County Road o and Cleveland Ave. expressed a desire to service ~nd sell snow- mob I I es in conjunction with the service station busIness. COURTNEY Maintenance of Boulevard Trees Attorney Courtney referred the Counct'1 to Vi Ilage Ordinance 104, AN ORDINANCE REGULATING THE PLANTING OF TREES IN BOULEVARD AREAS IN THE VILLAGE OF ARDEN HILLS, PROVIDING A PERMit PROCEDURE, ESTABLiSHING PLANTING, AND PROVIDING PENALTIES FOR VIOLATION. He stated that if additional reguiations or changes are recom- mended, this ordinance can be amended to Include them. Explosives - Ordinance Draft An ordinance draft re explosives was presented for consideration by the Counci I . Animal Control Agreement Attorney Courtney reviewed his letter of Sept. 28, 1970 re the Animal Control Agreement. His letter and the Agreement were referred to the Pub II c Safety Comm I ttee for study and recommendat Ions to the Counc i I . REPORT OF VILLAGE ENGINEER DONALD LUND (Absent) Clerk Administrator Stromquist distributed three letter reports to the Council, prepared by Engineer Lund re: I. Snelling Ave. Reconstruction. 2. Trunk Highway turn back from Minnesota Highway Department. 3. County Road F Utilities Study. After a brief discussion, all three letters were referred to the Public Works Committee and the Planning Commission for recom- . mendatlons to the Coun~ll. Special Use Permit Request - Mr. James Adams Mr. James Adams was present at the meeting. Counci ImanHollenhorst reviewed Attorney Courtney's letter of Oct. 6, 1970, and Planner Richard Shetler's memorandum and planning report, dated Oct. 6, 1970 (attached/. He then reviewed the Planning Commission's recommendations and moved that the Special Use Permit request be denied on the basis that "mobile home parks" is listed as a prohibited use in Ordinance 99; motion seconded 't. by Councilman Herrick and carried unanimously. Councilman Hollenhorst moved that Amendments to the Arden Hills Zoning Ordinance (Ordinance 99) be Introduced by title (attached); motion was seconded by Councilman Herrick and carried unanimOUSly. Attorney Courtney was requested to prepare the ordinance draft for Council consideration on Oct. 26, 1970. Valentine Park - Tree Planting Proposal Councilman Hollenhorst moved concurrence with the Planning Com- mission's recommendation to approve the Valentine Park Tree Planting Plan; motion was seconded by Councilman Herrick and carried .unanlmously. Plannlnq Commission Resignation Councilman Hollenhorst notified the Council of the resignation of Mr. James Plemmons from the Planning Commission; Mr. Plemmons Is moving to California. Mr. Hollenhorst requested that a letter be sent to Mr. Plemmons, thanking him for his services to the VI!lage. Planning Commission Meeting of Oct. 6, !970 Counc! Iman Hollenhorst briefly reviewed pending Planning Commission cases and the status of each. Clerk Administrator Stromquist was requested to send a letter and copy of Planner Report re Conditions of Industrial Park, dated Aug. 17, 1970, to each business place. REPORT OF COUNCILMAN RONALD HERRICK - Parks & Recreation and Human Rights Human Rights Commission Councilman Herrick advised the Councl I of a survey proposed by the Urban League, requesting participation by Arden Hills. It was moved by Councilman Herrick and seconded by Councilman Henderson that the Counci I supports the Arden HI lis Human Rights Commission and Its participation In the St. Paul Urban League Profile Survey; motion carried unanimously. REPORT OF COUNCILMAN E. GRAY HENDERSON - Finance & Municipal Administration Land & Buildings Bond Sale Calendar (See above report - Peter S. Popovich) Letter to Taxpayers Copies of a letter to Arden Hi lis Taxpayers, prepared by the Finance Committee, were distributed to the Council for app rova I . After review, the Council approved releasing the letter to the . newspapers for publication. Insurance Program Councilman Henderson advised that the Finance Committee recommends that a disinterested analysis of the Vii lage !nsurance Program be . made. and moved approval of the expenditure for the analysis not to exceed $500. REPORT OF COUNCiLMAN STANLEY OLMEN - Public Works Public Works Meeting Report - Roger Rei ling Chairman Roger Reiling reported the status of various Public Works matte rs : I. Public Works Building Addition - The Committee has determined that doubling the size of the present building will house a~ I trucks - New Brighton garage to be used only for off- season storage. Mr. Reiling requested that a Councilman meet with the Public Works Committee and the architect when ready to approve plans. 2. Impr-ovements - Complaint List - A copy of the list of complaints Is to be given to the Public Works Committee for use In determining status of complaints on the current water and sewer Improvements - ultimately to see that al~ complaints have been satisfied. 3. Time Table - Mr. Reiling advised that a Master Plan time table of job activities has been requested to be submitted by Mr. Beecher of Public Works Department. 4. Resignation from Public Works Committee - Mr. Rei ling advised that Mr. Jack Trump has resigned from the Public Works Committee, and requested that a letter be sent thanking him for his services. REPORT OF MAYOR HENRY J. CREPEAU, JR. - General Government & Public Safety Public Works and Village Hall Building Additions I Mayor Crepeau advised that several letters and estimates of costs of architectural fees have been received re the Construction Bulletin notice. The Counc j I requested Mayor Crepeau to contact Mr. Tom Horty re plan preparation and costs for both building additions. Application for Fund Reimbursement - VI ~Iage Hall Mayor Crepeau advised that Arden HI ils may qualify for partial reimbursement for the addition to the Village Hal!, from the Governor's Commission on Crime Prevention and Control. He advised that a Grant Application Is being prepared and will be submitted to the Commission by Oct. 15, 1970, tor reimbursement for the building addition. , Councilman Hollenhorst moved adoption of the Resolution (attached) authorizing Mayor Crepeau to act as agent for the Village of Arden Hills; authorizing him to sign for Arden HI lis re the fund reim- bursement application. Motion was seconded by Councilman Olmen and carried unanimously. Application for Fund Reimbursement - Pollee Officer TralninQ Motion ~as made by Councilman Hollenhorst. seconded by Councilman Olmen, that Mayor Crepeau be authorized, as agent representing the Arden Hills Council, to sign application to Minnesota Peace Officers Assn. for partial reimbursement for Arden Hi lis police officer training; motion passed unanimously. REPORT OF CLERK ADMINISTRATOR LORRAINE STROMQUIST Northern States Power Co. Letter Re Street Lighting, After review of the Council Minutes of Jan. 26, 1970, the letter from Northern States Power re cost of street lighting. as proposed, was referred to the Finance Committee and Street Lighting Com- mittee for their recommendations to the Council. DelinQuent Utility Accounts. A list of delinquent utility accounts was submitted to the Council for app rova i of certification to the County for collection with . taxes. EXtract of Minutes of Meeting of the Village Council Village of Arden Hills, county of Ramsey State of Minnesota Pursuant to due call and notice thereof, a regular meeting . of the Village COuncil of the village of Arden Hills, Ramsey < County, Minnesota, was duly held in the Village Hall in said village on Monday, the 12th day of October, 1970, at 8:00 o'clock p. m. The following members were present: Crepeau, Hollenhorst, Olmen, Henderson and Herrick and the following were absent: None Councilman Henderson introduced the following resolution and moved its adoption: RESOLUTION RELATING TO A HEARING ON REASSESSMENT AND SUPPLEMENTAL ASSESS- MENTS FOR CONSOLIDATED WATER IMPROVE- MENTS NOS. 68-2 AND 68-3 WHEREAS, a resolution was passed by the Village council of the Village of Arden Hills on the 27 day of Julv , 1970, directing the preparation of proposed assessments of the cost of Consolidated Water Improvements Nos. 68-2 and 68-3, and WHEREAS, the Council was notified on Auaust 10 , 1970 that such proposed assessment had been completed and filed for public inspection, and , WHEREAS, on A 110 II ~-t III 1970 the Village Council set a ~, , , date for a hearing on the original assessment and in accordance t with the Statute relating thereto duly called and held said hearing on the 28th day of September, 1970, and subsequent to said hearing said Village council adopted a resolution dated September 28, 1970 adopting said assessment. . , . WHEREAS, pursuant to M.S. 429.071 the Village Council may make supplementary assessments to correct omissions, errors or mistakes in the original assessment and WHEREAS, the Village Clerk Administrator of the Village of . Arden Hills has a list of all of the property owners in said village affected and the village engineer reports that several . parcels of property were inadvertently omitted and water services were omitted and formulas used were inadvertently applied and mistakes made, NOW THEREFORE BE IT RESOLVED BY THE VILLAGE COUNCIL OF THE VILLAGE OF ARDEN HILLS, MINNESOTA: 1. Pursuant to M.S. 429.071 in order to dispose of the matters above mentioned, a hearing shall be held on the 9th day of I~ovembe r , 1970, in the Village Hall at 8:00 o'clock p.m. to pass upon such proposed supplemental reassessment and at such time and place all persons owning property affected thereby will be 9iven an opportunity to be heard with reference thereto. 2. RESOLUTION PROVIDING FOR PUBLIC SALE OF $1,200, OOCbtPROVEMENT BONDS BE IT RESOLVED by the Village Council of the Village of Arden Hills, Minnesota, as follows: 1. It is hereby found and determined that it is necessary at the present time to issue and sell improvement bonds of the Village in the amount of $l,200,OqO, for the purpose of paying the cost of local improvementa instituted under Minnesota Statutes, Chapter 429, including the retirement of the Temporary Improvement Bonds, Series 1 and 2. 2. The Council shall meet at the time and place designated in the form of notice herein contained for the purpose of receiving, opening and acting upon sealed bids for the purchase of said bonds. The Village Clerk is hereby authorized and directed to cause notice of sale of said bonds to be published in the New Brighton Bulletin, the official newspaper of the Village, and in the Commercial West, a financial newspaper published at l1inneapolis, Minnesota, which notice shall be in SUbstantially the following form: . -1- . . VILLAGE OF ARDEN HILLS, RAMSEY COUNTY, MINNESOTA NOTICE IS HEREBY GIVEN that the Village Council of the Village of Arden Hills will meet in the Village Hall in said Village, on Monday, November 16,. 197D, at 8:00 o'clock P.M., to receive, open and consider sealed bids for the purchase of $1,200,000 Improvement Bonds of the Village to be dated as of November 1, 1970. The bonds will be issued in denomination of $5,000 each and numbered serially, will bear interest at a rate or rates designated by the successful bidder subject to the limitations stated below, payable May 1, 1971 and semiannually thereafter on November 1 and May 1 in each year, and will mature in order of serial numbers on November 1 in the following respective years and amounts: $70,000 1971 - 1985 50,000 1986 - 1988 The bonds maturing in the years 1971 through 1980 will not be subject to redemption before maturity. The bonds maturing in the years 1981 through 1988 will be each subject to redemption and pre- payment at the option of the Village Council in inverse order of their serial numbers on November 1, 1975, and any interest payment date thereafter, at par plus accrued interest to the redemption date plus a premium of 2% of the principal amount if prepaid on or before May 1, 198D, and without premium if prepaid on or after November 1, 1980. principal and interest will be made payable at a suitable bank in the United States designated by the successful bidder, subject to approval of the Village Council. The Village will furnish without cost to the purchaser and within 30 days after award of sale, the printed and executed bonds and the unqualified approving legal opinion of Messrs. Dorsey, Marquart, Windhorst, West & Halladay, of Minneapolis, Minnesota, and Messrs. Peterson & Popovich of St. Paul, Minnesota, and a certified transcript of proceedings authorizing the issue, including a certificate showing absence of litigation. The text of the legal opinion will be printed on the reverse side of each bond. Delivery will be made without cost to the purchaser at any point in the United States. Each bid must be unconditional except as to legality and absence of litigation, and must be accompanied by a cashier's or certified check or bank draft in the amount of $24,000, payable to the Village Treasurer, to be retained by the Village as liquidated damages if the bid is accepted and the bidder fails to comply therewith. Each bond must bear interest at a single uniform rate from date of issue until paid, expressed in a multiple of five hundredths (5/100) of 1% per annum, not exceeding the rate specified for any other bond having the same or a subsequent maturity, and not exceeding 7% per annum. Interest on each bond to maturity will be represented by a single set of coupons. The bid offering the lowest net interest cost will be deemed the most favorable. Interest cost will be computed as the dollar sum of all interest payable on the bonds to their stated maturities, less any cash premium over par or plus any discount below par at which the purchase price is bid. No bid of less than $1,180,000 plus accrued interest on $1,200,DOO at the coupon rates specified to the date of delivery will be considered. The right is reserved to reject any and all bids and to waive any informality in any bid, and to adjourn the sale if deemed necessary. Dated October 12, 1970. Section III.F .3. "Listing of Special Uses" Item a. "In Residential Districts" be amended by the omission of the phrase, "and other institutionsll . 2. Section IIl.D.19. "Prohibited Uses" be omitted in its entirety. 3. Section III.F.3. "Listing of Speciol Uses" Item a. "In Residential Districts" be amended by odding, "mobi Ie home parks". The Planning Commission would then be required to develop locational criteria and development standords. These would be quite similar to the existing "Apartment Policy". 4. Section 1I1.E. "Permitted Uses" be amended to reod: "No building or premises shall be devoted to uses other than those listed below, except as provided by this Ordinance for special uses and accessory uses". 5. Section III. F .3. "Listing of Special Uses" be amended by adding: tlNo building or premises shall be devoted to special uses other than those listed below." 6. Section 111.6. MOBILE HOME COURT (TRAILER PARK) STANDARDS I It has been noted that mony communities do not desire mobile home courts ond exclude .. I them by imposing very high standards or by failing to recogniz.e such use in their zoning provisions. Low-standord trailer parks are not a very desirable land use; however, a -., well-done development need not be a detriment to the community. One reasonable ~, Ii course of action is to require high standards of design CI1d development, but not so G high as to be arbitrory and unreasonable. .' ~ Standards regulating the design, development, and maintenance of trailer parks can be utilized by several methods including the following: :.'1 1. Enactment of a trai ler ordinance. 2. Inclusion of trai ler standards in the zoning ordinance. 3. Adoption of standards by resolution for use in judging the merits of mobi Ie home ,"' parks under provisions of a conditional use permit. 4. Utilization of different standards from time to time with no formal procedure but merely treating each case separately with the procedure dictated by circumstances. :ii It is suggested that No.1 or No.3 above would be most appropriate. The use of No.2 would be rather inflexible. The use of No.4 is rather arbitrary and on weak legal grounds. , The intent and purpose of mobile home parks standards is to help assure high quality v development equal to that found in other types of residential areas throughout the community. General Court- Requirements "' 1. Excellence of design, development, and maintenance is the desired objective. 2. Approved mobile home parks shall contain at least ten (10) fully developed coach . sites. , 3. All mobile home courts shall have at least ten (10) per cent of the land areas 'f, developed for recreational use (tennis courts, children's play equipment, , swimming pool, golf greens, etc.) developed and maintained at the owner/ # " operator's expense. r ~ " 4. All land areas shall be properly maintained; adequately drained; free from dust; ~ ~. clean and free from refuse, garbage, rubbish, or debris. ~. ~. i l' f~ ,. , ;:.~ 11 , . 5.5700-2 . 5. The requiremenh of a conditional use permit shall prevail over any and all other requirements, standards, or conditions. 6. A conditional or special use permit for a mobile home park may be reviewed once each year and revoked if development and maintenance is not in full .~ compl iance thereof. , J 7. A compact hedge, redwood fence, or landscaped area shall be installed around ~~ each mobi Ie home park and be maintained in first class conditian at all times I , as approved. < 1 1 8. Advertising shall be limited to one name plate not t~ exceed (25) square feet, with lighting, height and location as approved by the community and have a 15 foot set-back from the front lot line. 9. Each trailer park shall have an office for the use of the operator distinctly marked "OFFICE" and such marking shall be illuminated during all haurs of darkne ss . An adult caretaker must be on duty in or about the trailer park at all times. 10. The operator of every trai ler park shall maintain a registry in the office of the trai ler park showing: a. The name and address of each guest or permanent resident. b. The make, type, and license number of each trailer and automobile. 11. A map of the trai ler park shall be displayed at the trai ler park office and be illuminated during all hours of darkness. 12. The corners of each trailer site shall be clearly marked and each site shall be numbered. 13. The trailer park grounds shall be lighted as approved by the community from , ....-, sunset to sunrise. f~ All utility installation to site and individual trailer sites shall be as approved .~ 14. Each mobi Ie home park shall maintain a paved off-street parking lot for guests . of occupants in the amount of one (1) space for each three (3) coach sites and 1 located within 300 feet of the unit to be served. -. , , ;.. 22. Roadways (Public or Private) l ~ a. Shall be paved as approved by the community. b. All roads shall have a concrete (mountable, roll type) curb and gutter. c. Every structure shall be developed and mointained in a safe, approved, and substantial manner. The exterior of such structures shall be kept in good repair and shall be repainted or refinished when directed by the commun ity. 2. Trailers shall be prohibited that: a. Do not conform to the requirements of the Vehicle Code of the State. b. Are in an unsanitary condition or having an exterior in bad repair. c. Are structurally unsound and do not protect the inhabitants against all elements . 3. Periodic inspection by Health, Police, building inspector, and other public personnel, may be required. 4. No obstructi on shall be permitted that impedes the inspection of plumbing, electrical facilities, and related trailer equipment.
