PUBLI C HEAR I NGS Mayor Crepeau Gpened the Public Hearing for Water Improvements 68-2 & 68-3, San. Sewer Improvements 12-13, 14 & 15, Red Fox and Grey Fox Road at 8:15 p.m., requesting Engineers Lund and Hendrickson to explain each Improvement, and Fiscal Agent Peter Popovich to explain the fiscal aspects of each Improvement. After each improvement presentation, Mayor Crepeau opened the hearing to comments and questions from the floor. (Minutes attached.) Mayor Crepeau closed the Public Hearings at 10:05 p.m., after It was determined there were no further questions or comments. It was moved by Councilman Hollenhorst that the assessment rolls for Water Improvements 68-2 & 68-3, San. Sewer Improvements 12-13, 14 and is, Red Fox Road and Grey Fox Road be approved, as pur attached resolution, as submItted; seconded by Councilman Olmen and carried unanimously. It was moved by Councilman .t1~rlOl, seconded by Councilman Olmen that property owners In all the Improvements, subject to the Sept. 28, 1970 hearings, be allowed to pay either 100$ or 50$ of their total assessment at the Village office until Oct. 28, 1970, without Interest, and If 50$ of the assessment Is paid the balance will be certified to the County to be collected In annual Installments for a 20 year period plus 7$ Interest for San. Sewer and Water Improvements and for a 10 year period plus 7$ Interest for Red Fox Road & Grey Fox Road Improvements; motion carried unanimously. BUSINESS FROM THE FLOOR None. REPORT OF VILLAGE ATTORNEY VINCENT P. COURTNEY Animal Control AQreement Tabled until next Counc II meeting. Model Ordinance Re Explosives Tabled until next Counc II meeting. REPORT OF ENGINEER DONALD LUND . Metro Sewer Board - 1971 CharQes Engineer Lund advised that he has written to the Metro Sewer Board re the 1971 charges for Arden HII!s, as requested, but said he has not received a reply as yet. ,IA - --- ~ , ' , . Minutes of Regular Council Meeting September 28, 1970 (Councilman Henderson circulated an article from the St. Paul Pioneer Press captioned, "Sewer Rates Explosive Issue". Clerk Administrator Stromquist was requested to make copies for the Council members.) State Aid Street System Engineer Lund discussed his letter of Sept. 22, 1970 re suggested street changes recommended by District State Aid Engineer, John Bergford. The letter and accompanying map were referred to the Public Works Committee; requesting that the Committee meet with Engineer Lund and cooperatively prepare their recommendations to the Council. Northern Contractlnq Co. - Estimate 6 Engineer Lund presented Northern Contracting Company's Estimate 6, in the amount of $32,875.64, for approval of payment. (See Claims - Report of Clerk Administrator.) ProQress Report - San. Sewer Imp. 12-13 Engineer Lund reported that 11ft station parts, lost during the strike in Chicago, have been re-ordered and are expected by mid-October. Operation of the system is necessarily delayed until these parts arrive. ProQress Report - AI I Current Improvements Mayor Crepeau requested a progress report on the other Improvement projects. Engineer Hendrickson advised that completion schedules are slow compared to the Engineer's expectations, but clean-up Is in progress and where completed, "looks good". REPORT OF TREASURER WORTH G. READ A brief oral report re current anticipated Interest rates was given by Treasurer Worth G. Read. REPORT OF COUNCilMAN JOHN HOLLENHORST - Planning and Zoning None. REPORT OF COUNCiLMAN RONALD HERRICK - Parks & Recreation and Human Rights Valentine Park - PlantlnQ Proposal Councilman Herrick advised that 6 bids have been received for tree planting In Valentine Park; tho Rose Hili Nursery bid, in the amount of $1,297, is recommended by the Parks and Recreation Committee for Council approval. Councilman Herrick explained that the proposed planting Is a part of the total concept plan and a budgeted item, a nd moved Council approval, as recommended by the Parks & Recreation Committee, subject to approval by the Planning Commission. The motion was seconded by Councilman Henderson and carried. (4 voting In favor of the motion and I in opposition - Hollenhorst.) Phillip Sampson - Plaque Proposal Councilman Herrick read the proposed Inscription for a com- memorative plaque, In honor of Mrs. Phillip Sampson, to be located In the park recently donated to Arden Hills by Mr. Sampson. Councilman Herrick moved approval of the plaque, as proposed; seconded by Councilman Hollenhorst; carried unanimously. REPORT OF COUNCILMAN E. GRAY HENDERSON - Finance & Municipal Land . and Buildings 1971 Proposed Budget and Tax Levy . Bond Sale Calendar Pending receipt of addltlona! detailed computations f rom the VlI~age Administrative Office, Fiscal Agent Peter Popovich advised that the bond sale calendar be delayed unt i I Oct. 12, 1970. Maintenance of Bouijevard Trees After reporting that a dstermi nation from the Public Works Committee has not been submitted, Counci Iman Olmen stated his opinion is that the adjacent property owner should maintain bou leva rd trees, not the Village; assessing the property owner for maintenance If the property owner fails to comply. I t ~Ias moved by Councilman Hollenhorst that the matter be referred to Attorney Courtney to determine how to enforce the maintenance of boulevard trees by the property owners; motion was seconded by Councilman Olmeo and carried unanimously. Use 0" Sand & Salt on Vil!aqe Streets Councilman Olmen advised that the Public Works Committee has determined that salt must be mixed with sand to properly control icy conditions on Village streets. Public Works Building Addition CouncilmanOlmen estimated that a 40' x 75' addition wi II probably be needed In order to house ail equipment under one roof. He said he has not received a recommendation from the Public Works Committee and will schedule a special meet I ng i n an effort to determine the recommended size before the Council meeting of Oct. 12, 1970. Clerk Administrator Stromquist was asked to request Attorney Courtney's opinion of advertising for bids for design and construction by the same bidder. Monthlv Budqet Request Councilman Olmen requested that MaIntenance Sup~rvlsor Beecher be added to the list of those receiving copies of the monthly budget report. REPORT OF MAYOR HENRY J. CREPEAU, JR. - General Government & Public Safety Public Safety Procedure & ResDonsibi lltles It was moved by Councilman Herrick and seconded by Councilman Hollenhorst that the proposal regulating Public Safety procedures and responsibilities be approved as attached. Motion carried unanimously. Squad Car - Advertisement for Bids Mayor Crepeau requested authorization for Arden Hills to join St. Paul and other villages In advel-tlsing for bids for squad cars; thereby enabling the Village to possibly obtain a squad car at a reduced cost. It was moved by Councilman Herrick that the authorization be granted, as proposed; should the bids prove unsatisfactory, bids be requested from at least 3 Fo rd dealers. Motion was seconded by Councilman Hollenhorst and carried unanimously. Metro Area LeQlslatlve MeetlnQ . Mayor Crepeau requested representation at the Oct. Minutes of Regular Council September 28, 1970 Mee'r I n9 Resiqnatlon - Pollee Chief Victor Weber Mayor Crepeau informed the Council that a letTer of resignation has been rece!ved from Pollee Chief Victor Weber. Mayor Crepeau stated the Mr. Weber has served Arden Hills I n the capacity of Po! ice Chief for the past ~6 years; ill health i n recent years has made It difficult for Mr. Weber to continue this work and prompted his resignation aT this time. Mallor Crepeau advised that he wi Ii 'i/rl tEl 1'0 Mr. Weber, accepting his resignation and thanking him for his many years of service to the Village. REPORT OF CLERK ADMINISTRATOR LORRAINE STROMQUIST ADDI icatlons for Rubbish Hauler Licenses Clerk Administrator Stromquist presented 2 applications for Rubbish Hauler License for approval: Haul-A-Way System, I nc. Walters Disposal Service, Inc. Mrs. Stromquist advised that a "schedule of fees" has not been included with the applications, but have been requested from both applicants. It was moved by Councilman Holnenhorst that the I I censes be approved, subject to recelp'j' of the required fee schedules and subject to approva~ by Health Officer Robert Dunn; motion was seconded by Councilmen Herrick and carried unanimously. STatus Report, HUD Requisition 3 Clerk Administrator Stromquist advised that HUD Requisition 3, In the amount of $63,600,was approved on September 23, 1970, and should be credited to the Village account by Sept. 28, 1970. Treasurer Worth Read was requested to see if the account has been credited as described. GeorQe M. Hansen Co. Letter Clerk Administrator Stromquist informed The Council that a letter from George M. Hansen Co. has been received re the Village audit of 1970 records. After discussion of the Finance Committee's recommendation to rotate audit service, It was determined that George M. Hansen Co. be Invited to meet with the Finance Committee. Clerk Administrator Stromquist was requested to contact several other aud.itlng firms re cost of audit services to the Village. Claims After review of the claims, it was moved by Councilman Herrick that the cI a I ms be paid as presented (attached); withholding payment to Brighton 011 Co. and Joe's Service until It Is determined that they are correctly charged to the proper account. Extract of Minutes of Meeting of Village Council Village of Arden Hills Ramsey County, Minnesota Held September 28, 1970 Pursuant to due call and notice thereof a regular meeting of the Village Council of the Village of Arden Hills, Minnesota, was duly held in the Village Hall in said village on ~bnday, the 28th day of September, 1970, at 8:00 o'clock p. m. The following members were present: Mayor crepeau and councilmen Bollenhorst, Olmen, Henderson and Herrick and the following was absent: None. Also in attendance were: Mrs. Lorraine Strouquist, Village Clerk Administrator, Don Lund and Norm Blndrickson of Banister Engineering company, and Peter S. Popovich of Peterson & Popovich. The Village Clerk Administrator presented an affidavit show- ing publication of notice of hearing on the proposed assessment for Consolidated water lmprovements Nos. 68-2 and 68-3 in the New Brighton Bulletin on September 10, 1970, which affidavit was examined, found satisfactory, and ordered placed on file. The Clerk Administrator also exhibited a Certificate of Mailing Notice of Hearing to all affected property owners. The Mayor announced that the meeting was open for the con- sideration of objections, if any, to said proposed assessment. All persons present were then given an opportunity to present . . , , . . oral objections, and all written objections theretofore filed with the Village Clerk Administrator were presented and considered, and all such objections were tabulated as follows: Name Propertv Nature of Ob1ections MR. RALPH J. PERRY, 3670 New Brighton Road. Asked what the $1.00 trunk charge was for. MR. MARK SOLSTAD, representing Bethel COllege and Seminary. Most of the land of the Seminary that is included in the improvement is swamp and they have no intention of developing it in the foreseeable future. 'l!l.ere would be no benefit. Also said that under a previous water improvement they are paying approximately $30,000 of assess- ments. H!I asked that the current assessment be deferred until such a time as that area is developed. Mr. Lund from Banister Engineering indicated that the COllege was not being charged for 100~ of the acreage because some of the land is low. MR. WILLIAM SMI'!'H. attorney-at-law, St. Paul: 8IJl said the owners of the property he represents are listed in the assessment roll as Royal Investment COmpany, but that there has been a transfer of title since the time the roll was prepared. 'l!l.e property, close to the Bethel OOllege property, consists of approximately 130 acres. 'l!l.ey object to the amount of the assessment and also request the COuncil to defer the payment of the assessment on the basis that it is undeveloped, unplatted, and because there are no present plans for its development, no benefit would accrue at this time by virtue of the installation of water. MAYOR CREPEAU announced that a communication had been received from Mr. and Mrs. Arne Bevin, 3470 Siems Court, Objecting to their assessment. 'l!l.ey have a pie shaped lot with 57 feet on the front and 120 feet on the rear. '!'he average is 88 1/2 feet which is 11 1/2 feet less than the 100 feet for which they have been assessed. MAYOR CREPEAU also announced that a second communication had been received from Mr. Bradford Lemberg, 1401 Skiles Lane, in which he Objected to the type of work that has been done. MR. LAWRENCE KINPORrS, 1645 Valentine Avenue. Obj ected to the amount of his assessment. 8IJl has a single large lot with no possi- bility of putting another house on it. 81s assessment is anywhere from 50~ to double his neighbors' and his house value is not equal - 2 - , ~ : '. . to the ne1ghbors' houses. Vlhen sewers were constructed, he was g1ven an assessment equal to one of the ne1ghbors' and he asked for that cons1derat1on 1n connect1on w1th the water assessment. MR. Councilman RoI1Anhorst. then introduced the following resolution and moved its adoption: RESOLUTION ADOPTING AND CONFIRMING ASSESSMENTS FOR CONSOLIDATED WATBR IMPRClVEMIDI'rS NOS. 68-2 and 68-3 BE IT RESOLVED by the Village Council of the Village of Arden Hills, Minnesota, as follows: 1. The amount pror,er and necessary to be specialtl. assessed at this time for eonaol dated 'ltater IIllprovementa Nos. -2 and 68-3 against every assessable lot, piece or parcel of land affected thereby has been duly calculated upon the basis of benefits, without regard to cash valuation, in accordance with the provisions of Minnesota Statutes, Chapter 429, as amended, and notice has been dUly mailed and published, as required by law, that this Council would meet to hear, consider and pass upon all objections, if any, and said proposed assessment has at all times since its filing been open for public inspection, and an opportunity has been given to all interested persons to present their objections, if any, to such proposed assessments. 2. This Council, having heard and considered all objections so presented, and being fUlly advised in the'premises, finds that each of the lots, pieces and parcels of land enumerated in the proposed assessment was and is specially benefited by the con- struction of said improvement in not less than the amount of the assessment set opposite the description of each such lot, piece and parcel of land, respectively, and such amount so set out is hereby levied against each of the respective lots, pieces and parcels of land therein. 3. The proposed assessments are hereby adopted and con- firmed as the proper special assessments for each of said lots, pieces and parcels of land respectively, and the assessment against each parcel, together with interest at the rate of 7% per annum accruing on the full amount thereof from time to time unpaid, shall be a lien concurrent with general taxes upon such parcel and all thereof. The total amount of each such assess- ment shall be payable in equal annual principal installments extending over a period of twenty (20) years, the first of said installments, together with interest on the entire assess- ment from the date hereof to December 31, 1971, to be payable with general taxes for the year 1970, collectible in 1971, and one of each of the remaining installments, together with one - 3 - t .. . year's interest on that and all other unpaid installments, to be payable with general taxes for each consecutive year thereafter until the entire assessment is paid. 4. Prior to certification of the assessment to the county Audi- -tor, the owner of any lot, piece or parcel of land assessed hereby may at any time pay the whole or 50% of such assessment, with interest to the date of payment, to the Village Treasurer, but no interest shall be charged if such payment is made within 30 days after the date of this resolution. 5. The Village Clerk Administrator shall, as soon as may be, prepare and transmit to the county Auditor a certified duplicate of the assessment roll, with each installment and interest on each un- paid assessment or portion thereof unpaid set forth separately, to be extended upon the proper tax lists of the county, and the County Auditor shall thereafter collect said assessments in the manner pro- vided by law. The motion for the adoption of the foregoing resolution was duly seconded by Councilman Olmen, and upon vote being taken thereon, the following voted in favor thereof: All and the fOllowing voted against the same: None whereupon said resolution was declared duly passed and adopted. - 4 - . ~ . RICHARD DE WITT, 4651 Highway 10: Asked what the comple- tion date of the project is and had a question about blacktop on a service lane. MR. K. R. Me CLUNG, 4370 North snelling: Asked if any con- sideration had been given to extending water mains to the area. Suggested that the Council dalay water in the area since assessments for both water and sewer at approximately the same time would cause prOblems for many people because so much of the area is undeveloped. MR. RICHARD DE WITT, 4651 Highway 10: Asked if connections to the sewer would be made this year or next spring. Also asked if he would be notified when the connection could be made. MR. EARL W. It is the intent of; the Arden llills Council to setfortlL herein the functions and powers of the Public Safety Committee and recommended proceduresf;or its operation. TheCouneil notes that the Committee haseXi.sted in Arden Hills for someyears,w:i.thi.ts. members nominated by the Mayor and approved by the Council. Each member of; the Commi.ttees,hall be assigned an ~l- ,. . . . . area of responsibility dealing with one or more functions of the department and itsha:ll be hi:s:respons:ibilityto acquaint himself with all facets of fUs:functionas to allow him the ultimate in judgment in his actions and presentation to the Committee of in- formation for Committee action. PERSONNEL .' All employees of the police department shall berespon- sible to the Committee and shall report directly to the person des- ignated by the Committee for all work assignments. The person designated by the Committee as the senior police officer shall be responsible for the development of a work assignment sched- uleto utilize the maximum ofefficiericy in manpower, eliminate non-productive and overlapping work, and properly provide for the protection of life and property of the Village. Any changes in this prepared schedule shall be made by the assignment officer. The as"" signmerit officer shall furnish a copy of the current work schedule to the Comm.itteefor its: report. The Committee shall prepare a complete set of rules and regulations as to hOurs of work, rotation of assignments, use and Care. of Village property, daily log procedures: and such other records as maybe deemed necessary for the operation of the department. The operating personnel shall complete these records in the manner prescribed and submit them to their superior as directed by the Committee for referral to the Committee for review and tabulation. The COmmittee shall meet wi.th thedepartmentasa whcileat such times as it shall prescribe to review and recommend changes in working rules, wageS: and benefits. The Cbmmitteesfrall from time to time revi.ew the personnel classifications:,recommen:d such changes or promotions as it deems warranted or necessary for the maintenance of the depart- ment,and in general makesuchrecommeridations-to the Council re~ garding pers:onnel as: it deems fit, including recommendations regard- ing anything which may require bargaining by the Council. GRIEVANCES. Employee grievances in the area of workassignmerit, wages, benefits or otherwise should properly be dis:cussed first with his immediate superior and, if not resolved onthatleveI,within 72 hours, ,the superior shall noti.:fy the Committee member responsible for personnel relations and obtain his review of the matter. If the: matter is not concluded wi.thin 72 hours thereafter on that level, ' it shall be referred to the Committee as a whole. Committee recommend a- tionsshall be promptly referred to the Council in matters requir- ing Council determination. It is the thought of the Council that handling grievances in this manner will promote a more efficient and harmonious police operation. PURCHASING. The: Chairman of the Committee shall appoint one member . responsible for the approval of all purchase requests. Requests . for purchases shall originate wi.ththe designated requisition order .. being furnished to the committee member detailing the item requested, the: purpose of its: ,use and need. It shall be the responsibility of the committee member in charge of purchasing to keep a current balance of each accOunt, together wi.tha projection as to the needs of same for the balance of the year in order to place priorities on requests for equipment and supplies. Upon approval, the proper purchase order shall be issued for the item or itemS" requested. Fi- nal purchase orders shall beapprOVe\the Committee before referral to the Council. by -2_ . . . VEHICLES. The Committee shall establish rules of conduct, care and responslbll ity for the operation of all vehicles, together with a maintenance schedule Including appropriate forms for re- porting to the Committee. The Committee shal I determine a pol icy of gasol ine and oi I purchasing as wel I as vehicle mainten- ance and shal I secure purchase and service contracts for this purpose. ANIMAL CONTROL. The Committee shall review the current animal control contracts, as well as the VI I lage needs and recommend such revisions as It deems in the best Interest of the Village and its residents. The cost of animal control shal I be included in the operating budget. FIRE PROTECTION. The Committee shall review the current fire pro- tection contract with the lake Johanna Fire Department, as well as assisting In a long range plan to Insure continued and adequate protection consistent with the development of property within the Village, Including financial planning to provide for the orderly and economical acquisition of such equipment as necessary to In- sure the above.
