Roll Call Present: Mayor Henry J. Crepeau. Jr., Councilmen Stanley Olmen, John Hollenhorst, E. Gray Henderson and Ronald Herrick. Absent:' None. Also Present: Public Works Chairman Roger Reiling, Clerk Admin- Istrator lorralne Stromquist, Attorney Vincent P. Courtney, Treasurer Worth G. Aooroval of Minutes The Minutes of the Reguler Council Meeting of August 31, 1970, were approved as submitted. BUSINESS FROM THE FLOOR Human Rlahts Commission Announcement Mr. Jerome Wasley, Chairman of the Human Rights Commission, Invited all residents of Arden Hills to participate In a series of lectures and workshops, the first to be held on Monday, September 28, 1970, at the Arden Hills Branch of the Ramsey County library. The topic at the first session will be "Education Toward Humanization". Odd Fellows St. Paul lodae No.2 Mr. Charles Horton expressed the lodge's desire to construct a new lodge on Its property on lake Josephine, at an estimated cost of $80,000.00 to $100,000.00. Councilman Hollenhorst advised that the Planning Commission had determined, after a preliminary discussion, that "a lodge Is not a permitted use In a residential zone In Arden Hills": therefore the proposed lodge construction could not be considered. He explained that Attorney Courtney has expressed a different Interpretation of the ordinance In his letter of September 18, 1970, which would allow a non-conforming user to apply for Rezoning or a Special Use Permit, If he wishes to rebuild or expand. The Council, after consideration of both Interpretations, requested an expression from Planner Carl Dale and then further consideration by the Planning Commission, In order to determine the Intent of the ordinance, and the proper procedure to be followed by the applicant. Fill Comolalnt Mr. Richard Bartsch, 1814 West County Road F, advised the excess dirt from the sewer construction on County Road F has been dumped In the swamp on the north side of County Road F; stating that he considered this a poor use of clean fill, especially when so many residents desire clean fill. The matter was referred to Maintenance Supervisor Beecher and Engineer Lund to advise the contractors of appropriate locations for the dumping of excess clean fill. PUBLIC HEARING Sanitary Sewer Improvement No. 16 and Water ImDrovement 70-1 Mayor Crepeau opened the public hearing at 8:10 p.m. Attorney Courtney advised that the purpose of the hearing Is to determine the feasibility of constructing sanitary sewers and water main to serve the southeast corner of Hamllne Avenue and County Road F, a site on which an office building Is proposed by the Arthur Hage Construction Company. , , . Minutes of Regular Council Meeting September 14, 1970 Engineer Lund explained 2 routes to extend sanitary sewer service to this area, as outlined in his report dated August 10, 1970; recommending the second route because It provides a deeper sewer, requires a shorter length of sewer construction and serves more properties abutting the sewer location. He said the water main would be constructed along County Road F from the existing main at Fernwood Avenue and County Road F. The total construction cost was estimated at $31,480.00 for both projects. Engineer lund advised that the project Is feasible and recomMended that It proceed In accordance with the plan presented. Mr. Stephen Krannak, 1761 Fernwood Avenue. Rosevllle, owner of property north of County Road F from Fernwood to Hamllne Avenue. spoke In opposition to the projects; asking the size of the pro- perty to be served and the Intended construction proposed. En~lneer lund.stated that the proposed extension would serve the properties abutting County Road F; Including the approximate 1.3 acres site on which Arthur Hage Construction Company pro- poses to construct an office building. Mr. GeorQe Rellln~, 3411 Vivian Avenue, Shoreview, spoke in opposition to the extensions; stating that he is not Interested In It at all; he will not use it If it is put in; It will serve only people on this corner, and he will contest It In court, If necessary. Mr. Krannak, requested that the Council bond all contractors to guarantee the replacement of marking stakes removed by contractors during construction; property owners should be protected. Councilman Ronald Herrick, asked If there Is a way to serve the property In another way as long as the Reiling and Krannak pro- perty Is apparently adequat~ly served. EnQlneer Lund, said that the sewer can be extended from Hamllne Avenue and Amble Road, requiring 1,100 feet of sanitary sewer, which would provide a shallower connection at County Road F. He advised that he did not know the sewer requirements of the proposed building; the water main would have to be extended, as proposed, since this Is the only existing main north of 1-694. After determining there were no further questions or comments, Mayor Crepeau closed the public hearing at 8:37 p.m. It was moved by Councilman Hollenhorst that the matter be tabled until building plans and a construction schedule are available from Arthur Hage Construction Co., and a subsequent recommendation Is received from the Planning Commission; motion seconded by Councilman Olmen and carried unanimously. (Clerk Administrator to obtain the cost of the preparation of the Feasibility Report from Engineer lund.) REPORT OF ATTORNEY VINCENT P. COURTNEY , .. James Circle Blacktoppln~ ReQuest - James Johnston After review of Attorney Courtney's letter of September 14, 1970, the Council determined they have no objection to Mr. Johnston's negotiating with the Village contractor; requiring a bond to Insure the Village of payment of the project by Mr. Johnston; road to be constructed according to specifications prepared by Banister Engineering Company. (Clerk Administrator was requested to notify Mr. Johnston of the Council's decision, as outlined In the last paragraph of Attorney's 'letter of September 14, 1970.) -2- . . Inc. - licenses It was moved by Councilman Hollenhorst and seconded by Councilman Olmen that the On-Sale, Off-Sale and Sunday liquor Licenses be transferred to McGuire's Enterprises, Inc., from McGuires Inc.; transfers to be retroactive to May II, 1970; all other existing licenses to also be transferred as of May II, 1970. Motion carried unanimously. Public Safety Amended Proposal Attorney Courtney submitted an amended Public Safety Committee Proposal, reframlng the wording to assure that dlsgresslonary duties are not delegated, but retained by the Council. Copies of the proposal are to be distributed to the Public Safety Committee members and Council members for review. Phillip Sampson Property Attorney Courtney reviewed his letter of September 8, 1970, which was referred by the Council to the Parks and Recreation Committee for Its consideration and recommendations. U. S. Easement SS12-5 Attorney Courtney reviewed Attorney lynden's letter of September 12, 1970, advising that an easement Is needed by the Village over government property in the Round lake area. He advised that a 50-year grant for maintenance of the sewer, subject to flowage rights, can be obtained. After It was determined that Banister Engineering Co. has no objection to the Village agreeing to the clause, It was moved by Councilman Herrick and seconded by Councilman Henderson that the easement be approved as described; authorizing the Mayor and Clerk to execute the agreement. Motion carried unanimously. REPORT OF ENGINEER DONALD LUND Cost Estimate for Blacktop Curbing - Tiller lane Engineer lund advised that a cost estimate was prepared for a rolled curb on Tiller lane and was given to the residents for their decision. Mr. Melvin Koshlol & Mr. W. Haberstroh, residents of the area asked what Is going to be done on the questions presented on the petition which was presented to the Council on August 31, 1970. Engineer Lund advised that the w~rk has not been completed, an Inspection is scheduled for Tuesday, September 15, and the work will be completed when It Is known the type of curb desired. Mr. ~~ gave Engineer lund a sample of the bituminous surfacing from In front of his driveway, which he said was layed over wet clay. Because the cost of the ~olled curb was considered high at $2.15 per foot, Mr. Haberstroh advised that the petition was not circulated. McDonald and Associates, Estimate 15 Engineer Lund presented McDonald and Associates' Estimate No.5, Sanl~ary Sewer Inprovement 12 - 13, in the amount of $76,598.44, for payment. It was moved be approved; unanimously. by Councilman Henderson that payment of $76,598.44 seconded by Councilman Hollenhorst; motion carried , . -3- . Minutes of Regular Council Meeting September 14, i 970 Metro Area Sewer BllllnQ Engineer Lund presented copies of "Sewer Meter Readings" and "Water Consumption" for review by the Council (attached). He noted the apparent discrepancies In the report prepared by the Metropoi itan Sewer Board. Cierk Administrator was requested to send copies of the figures prepared by Banister Engineering Company, to Senator Robert Ashbach and to Metro Council, Community Services Director, Robert Nethercut, requesting their assistance in rectifying the apparent over-Charge to Arden Hi~ is; Engineer lund and Clerk Administrator were requested to prepare an appeal to the Metropolitan Sewer Board, from the Village Council. Sanitary Sewer Imorovements 12 and 13 Engineer Lund discussed with the Council certain aspects of the assessment roll for Sanitary Sewer 12 and 13, with Attorney Courtne,y enter i ng I nto the discuss ion. REPORT OF COUNCILMAN JOHN HOLlENHORST - Planning and Zoning Case No. 70-22. Theodore Hamm Brewina Comoany - Special Us~ Permit for a 30,OOO_Gallon Propane StoraQe Tank Councilman Hollenhorst moved that the Council comply with the Planning Commission recommendation to approve the Special Use Permit for a 30,000 gallon storage tank, as shown on the site plan, and subject to compliance with all other Village ordinance requirements; motion was seconded by Councilman Olmen and carried unanimously. Case No. 70-32, Skelly 011 Company - Variance Request Councilman Hollenhorst advised the Council that Skelly 011 Company has requested a 100 foot sign at its station on lexington Avenue and Red Fox Road, an 84 foot sign height variance. He explained that at the time the Special Use Permit for the station was under consideration, Skelly 011 Company was granted a 24 foot 2 Inch sign, incorporated as part of the bUilding. (Variance of 8 feet 2 Inches); Skelly agreed they would not request another sign height variance for this station. Councilman Hollenhorst advised that the Board of Appeals and Planning Commission have recommended denial of the request for the 100 foot sign, and moved that the Council concur with these recommendations; motion was seconded by Councilman Herrick and carried unanimously. Industrial Park Conditions - Report by Carl Dale Councilman Hollenhorst reviewed a report prepared by Carl Dale, Midwest Planning and Research, inc., and requested enforcement of ordinance regulations. It was determined by the Council that copies of the report be sent to the Industrial and business places, prior to a meeting scheduled on October 5, 1970, (time and place to be determined), at which time the grievances can be "aired". (Clerk Administrator was requested to prepare a tabulation of water and sewer rates charged In St. Paul, Shorevlew and Rosevllle; water and sewer billings for businesses and Industries In Arden Hills for 1969 and 1970 (to datel;for consideration at the meeting.) Proposed Additions to VlllaQe Hall and Public Works BuildlnQ (See Councilman Henderson's Report) t .. Fill Permit Application No. 70-6 - William Herrick. 1885 Noble Road ~as moved by Councl!man Holienhorst to concur with the PlannIng Commission's recommendation to approve Fill Permit No. 70-6. for -4- . (Councilman Herrick abstained from voting.) REPORT OF COUNCilMAN RONALD HERRICK - Human Rights and Parks and Recreation Oak Wilt Survey ResuP.t~ Councilman Herrick reviewed Dr. French's report of the Oak Wilt Survey, which Indicates that about 252 trees should be removed (234 Red Oaks). The crew did not find any cases of Dutch Elm disease In the Village. The report also indicated that 5 trees were not removed last year; these trees will be removed by the Village, and the cost of removal will be assessed against the properties. A copy of the report was requested by Mr. Richard Bartsch for use by the Arden Association to aid the Village in notifying the residents. Parks and Recreation The next Parks and Recreation Committee meeting is scheduled for Tuesday, September 15th. REPORT OF COUNCILMAN E. GRAY HENDERSON - Finance and Municipal Land and Buildings Proposed Additions to Vlllaqe Hall and Public Works BulldlnQ Councilman Hollenhorst advised the Council that, after holding a Public Hearing on September 8, 1970, the Planning Commission recommends that the Council approve the Special Use Permit to expand the Village Hall and Public Works Building, as shown on the drawings and as discussed; the size of the addition to the Public Works building to be revised, if so recommended by the Public Works Committee, to incijude storage of all vehicles of the Public Works Department. It was moved by Councilman Hollenhorst that the Council approve the Special Use Permit as recommended by the Planning Commission; motion was seconded by Councilman Henderson and carried unanimously. (The Public Works Committee was requested to determine the size requirements necessary to provide for ail Public Works' vehicles under one roof.) It was moved by Councilman Henderson that the Council authorize the construction. as proposed, subject to the recommendations of the Planning Commission; limiting the total expenditure for all costs to not exceed $75,000.00, including all appurtenances such as heating, air conditioning, decorating, additional ~fflce equipment (except'the bookkeeping machine), lighting etc.; funding to be provided In accordance with the attached proposal, subject to approval of Attorney Courtney. Th~ motion was seconded by Councilman Olmen and carried unanimously. (Clerk Administrator was requested to send a copy of the funding proposal to Attorney Courtney, and also request his opinion as to the legality of advertising for bids for design and construction by the same bidder, In an effort to save costs.) t - Collection of Sewer and Water Util 'ty Bills Councilman Henderson reviewed two cost proposals for the collection and processing of sewer and water utility bills, from the Northwestern National Bank of St. Paul and from Rosevllle State Bank. (attached) It was moved by Councilman Henderson that Roseville -State Bank be appointed, as per It's proposal; motion was seconded by Councilman Herrick and carried unanimously. Minutes of Regular Council Meeting September 14, 1970 REPORT OF COUNCILMAN STANLEY OLMEN - Public Works American Waterwo~ks Conference at Duluth Councilman Olmen moved that Public Works Supervisor Everett Beecher be authorized to attend the American Waterworks Conference at Duluth, September 30 through October 2, 1970; seconded by Councilman Hollenhorst; motion carried unanimously. Mr. Beecher was requested to prepare a report of the Conference, for Council review. (He was asked to provide Clerk Administrator with an application for registration.) REPORT OF MAYOR HENRY J. CREPEAU, JR. - General Government and Public Safety United Nations Day Mayor Crepeau read a proclamation, designating October 24, 1970, as United Nations Day in Arden Hills; the 25th Anniversary of the United Nations. Ramsey County Engineer - Letter Re Snowplowing Mayor Crepeau advised that Arden Hi I Is will utilize Its own department for snowplowing for another year and asked Clerk Administrator to so notify Ramsey County. Lake Johanna Volunteer Fire Department - Fund Request Mayor Crepeau read a letter from Mr. l. F. Nesler, lake Johanna Volunteer Fire Department, requesting tHat Arden Hills pay 33.9% of the cost of a new grass-fire rig; Arden Hills' share of cost Is $2,373.00. Councilman Hollenhorst moved that the Council authorize the pay- ment of $2,373.00, as requested; seconded by Councilman Henderson and carried unanimously. Sale and Storaoe of Explosives - Model Ordinance Mayor Crepeau advised that a model o~dinance governing the sale and storage of explosives has been received for consideration by Arden Hills. The ordinance was referred to Attorney Courtney for review and a feasibility report. Doo Control Proposal - Public Safety Committee Mayor C~epeau advIsed that the Public Safety Committee has recommended a Dog Control Proposal, providing for a regular patrol of the Village and 24-hour "on call" service; providing for all animal pIck-up (except skunks). The contract agreement was referred to Attorney Courtney for hIs opinion. Personnei Ordinance - Holldav Section Mayor Crepeau advised that the Ordinance Review Committee has submitted its findings re the holiday portion of the Federal Holiday Schedule. Copies were distributed to the Council for review. REPORT OF CLERK ADMINISTRATOR LORRAINE STROMQUIST , ~ Arden HII Is Branch library - Request for Waiver of Fee Clerk Administrator advised that the Ramsey County Library Board has requested that the sign permit and annuat license fee be waIved for Its sign at the Arden Hills Branch library. Councilman Henderson moved that the $5.00 permit fee and the annual $5.00 license fee be waived, as requested; seconded by Councilman Herrick and carried unanimously. -6- " , . ""-<--.-. ~. V' . . Read On the 13th of August, we discussed our bank's probable charge for performing lock box service for the Village of Arden Hills. I thought it might be helpful to you to list those charges in a letter so that you would have them in your file. I have assumed a round figure of 1,000 billings per quarter and then divided it equally over three months. I know, of course, that most of the receipts come in in the first month of the quarter, but I think in this way you can see what an average month might be. The charge for this service will be analyzed as we do all our commercial accounts; and if the collected balances are sufficient, then a certain portion of this cost will be covered...!ly an earnings credit.
