The meeting was called to order by Mayor Crepeau at 8:02 p.m.
Roll Call
Present: Mayor Henry Crepeau, Jr.. Councilmen Stanley Olmen. E.
Gray Henderson, Ronald Herrick
Absent: Councilman John Hollenhorst
Also Present: Clerk Administrator Lorraine Stromquist. Attorney
Vincent P. Courtney, Treasurer Worth G. Read. Engineer
Donald Lund, Public Works Supervisor Everett Beecher

ADDroval of Minutes
The Minutes of the Regular Councl I Meeting of August 10, 1970 were
approved as amended.
HEARING
Revocat I on of Ll cense for McGu Ire's Ll Quors. I nc.
Mayor Crepeau opened the hearing at 8:05 p.m.
Attorney Courtney explained that the third quarterly Installment
of the On-S~Ie liquor license fee, due July I. 1970, has not been
paid and thatMcGulre's Liquors, Inc. have been notified of the
hearing by certified mall.
McGuire's Liquors, inc. was not represented at the hearing.
After It was determined that there has been no response to the
letter and that the ilcense fee remains unpaid, It was moved by
Councl Iman Hend~rson and seconded by Councilman Herrick that the
Council proceed with suspension of the On-Sale Liquor license; the
effective date to be determined by Attorney Courtney.
Councilman Herrick moved that the motion be amended authorizing
Attorney Courtney to aid In the preparation of a new application
to be ready for approval at the time the present license Is revoked.
The motion o~ the amendment was seconded by CouncIlman Henderson
and carried unanimously. The original motion carried unanimously.
Mayor Crepeau closed the hearing at 8:12 p.m.
BUSINESS FROM THE FLOOR
Mr. James E. Johnson, Grand Rapids, Minnesota, owner of Valentine
lake View Plat No. 2, requested Council permission to negotiate
the blacktopping of James Circle with the bituminous contractor
currently engaged by the Village to blacktop Flor~1 Drive; requesting
that the cost of the I~provement be assessed to the remaining
unsold lots.
After discussion. the Councl I granted Mr. Johnson permission to
make his own errengements with a contractor; advising that James
Circle be constructed according to specifications prepared by
Engineer lund. Mr. Johnson was requested to contact Attorney
Courtney when an agreement with a contractor hes been made, to
determine the feasibility of spreading the cost by assessing the
remaining unsold lots.
Mr. John Schmidt. 1200 Tiller Lane. presented a petition Ilst-lng
ten (10) defects remaining In the Installation and clean-up of
the wafer Installation In the Tiller lane,Carlton Drive area.

Minutes of Regular Council Meeting
August 31, 1970
Mayor Crepeau advised that two letters have also been received
citing dissatisfaction with clean-up work.
Engineer Lund advised what will be done by the contractors and
explained that the contractors are not finished with clean-up In
this area. He advised that the project will not be accepted until
the clean-up is deemed satisfactory by Banister Engineering Company.
Several residents spoke, citing their grievances. which Engineer
Lund noted. He advised that he will Investigate the situation
and see that unacceptable conditions are corrected.
Mr. Dick Bur~ess, 4647 North Highway 10, requested that the traffic
situation on the service drive north of Highway 96 and west of
Highway 10 be rectified. He stated that from 200 to 300 cars
travel this "No Thoroughfare" each day. traveling at high speeds
In spite of the "15 mph" signs.
Mayor Crepeau advised Mr. Burgess that this Is a State road; the
Village has, and wi II continue to patrol It; that the Vi Ilage will
request that the State study the situation.
REPORT OF ATTORNEY VINCENT P. COURTNEY
Sanitary Sewer Improvements 14 and 15
Attorney Courtney advised that, in his absence, Attorney James
Lynden reviewed the Conformed Contracts submitted by Dunkley
Surfacing (SS. Impr. 14) and by Gldeo Construction Company (SS.
Impr. 15) and has found them to be In proper form.
Attorney Courtney stated that the obtaining of easements In the
area south of Thom Drive has been difficult; waivers have not
been obtained from three properties; Chvestulk, Senske and Rasmussen.
(Mr. Chvestuik wi I' grant an easement for $950.00,)
After discussion. It was moved by Councilman Henderson that the
Conformed Contracts for Sanitary Sewer Improvement 14 and 15 be
approved. subject to possible change orders In Sanitary Sewer
Improvement 14; authorizing the contracts be executed by the Mayor
and Clerk Administrator; seconded by Councllman Olmen. Motion
carried unanimously.
Sanitary Sewer Improvement No.6
Attorney Courtney advised that the assessment has not been abated
on the Village-owned water tower property.
It was moved by Councilman Henderson and seconded by Cou~cl Iman
Herrick that the resolution, as attached, be adopted. Motion
carried unanimously.
Sanitary Sewer Improvement No. 13 - Lesley Nordin Easement
Attorney Courtney reviewed Attorney Lynden's letter of August 22,
1970, advising that Mr. Lesley Nordin will give an easement through
his property for Sanitary Sewer Improvement 13 If the Village
will agree not to extend Floral Drive through his property.
After discussion, the Councifi agraed unanimously that the Village
will not extend Floral Drive west through the Nordin property as
long as Lesley Nordin owns the property.
Sanitary Sewer Improvement No. 13 - Northern States Power Consent
A~reement
It was moved by Councilman Henderson and seconded by Councilman
Olmen that the Consent Agreement be accepted. as attached. Motion
carried unanimously.

REPORT OF ENGINEER DONALD LUND
EngIneer Lund reviewed a letter from the Ramsey County Land
Commissioner, dated August 13, 1970. whIch advises of a tax
forfeited lot on Arden Place at Skiles Lane near Snelling Avenue.
Mr. Lund stated that the lot is a very difficult building site,
in his opinion, because of the severe drop from the street level.
Councilman Herrick was asked to look It over for park purposes.
No Council action was taken.
Sanitary Sewer and Municipal Water Service Extension to County Road
F and Hamllne Avenue
It was moved by Councilman Herrick and seconded by Councilman
Henderson that a Public HearIng. as per attached resolutIon. be
scheduled on Monday, September 14, 1970 at 8:00 p.m. at the VIllage
Hall to consider the feasibility of providIng Sanitary Sewer and
Municipal Water to County Road F and Hamllne Avenue. MotIon
carried unanimously.
Storm Sewer Meeting - Shorevlew and Arden Hills
Engineer Lund advised that he met with Shorevlew's Clerk Administrator
and Engineers on August 25. 1970 re draInage to County Ditch '12;.
advising that Shorevlew has authorized a study and a report wIll
be forthcoming.

Regular Monthlv Report
Treasurer Read advised the Councl! that HUD Requisitions I and 2
and Ramsey County August tax settlement checks have been deposited
In the Village accounts, all of which have been re-Invested.
REPORT OF COUNCILMAN JOHN HOLLENHORST - Planning and Zoning
(Absent)
Pro osed Additions to the Villa e Hal! and PublIc Works Bulldln
Mayor Crepeau announced that, at the request of the Councl, he
Planning Commission has scheduled a Public HearIng on Tuesday,
September 8, 1970, at 8:00 p.m. at the Village Hall, on the Special
Use Permit proposals for addItions to the Village Hall and PublIc
Works Building.

RIghts
Parks and Recreation
None.
Human Rights
CouncIlman HerrIck announced that the Human Rights CommIssion
has scheduled a program at the Arden Hills Branch of the Ramsey
County Library on September 28, 1970; detal Is of the program wIll
be announced at the next Council meetIng.
Ramsev County Water Rates
CouncIlman Herrick advIsed that the Ramsey County Water Rates Report
has been receIved and copies are available for revIew.
It was moved by Councilman Herrick that $176.80 be sent to the
League of Municipalities to cover Arden Hi 115' share of the cost
of this study. The motion was seconded by Councilman Henderson
and carried unanImously.

and Buildings

Finance Committee
Councilman Henderson advIsed that a preliminary study of the 1971
Budget has been made and the Committee compliments the Clerk
Administrator on the new foremat which they consider to be excellent.

REPORT OF COUNCILMAN STANLEY OLMEN - Public Works
No report.
Salt/Sand Proposal
Councilman Herrick requested that the Village abstain from the use
of salt on the streets this winter.
The matter was referred to the Public Works Committee for con-
sideration and Its report to the Counci I.
Sou I evard Trees
Councilman Herrick requested that the responsibility for boulevard
trees be made the obligation of the property owner.
The matter was referred to the Public Works Committee for study
and its recommendations to the Councl I.

Safety
Public Safety Committee
The amended Public Safety Committee proposal. dated August 18,
1970. was reviewed and approved by the Council for referral to
Attorney Courtney to prepare In final form.
REPORT OF CLERK ADMINISTRATOR LORRAINE STROMQUIST
Requests for Minutes (Planning Commission and Council)
I. Arden Association
The Arden Association was authorized by the Council to receive
Council and Planning CommisSion Minutes (sta~ped "not yet
approved...") and meeting agendas.
2. Northern States Power Company
After discussion, It was moved by Councilman Henderson and
seconded by Councilman Herrick that a $12.00 annual charge
be made for copies of either Planning Commission 01" Council
Minutes, except to those authorized by the Counci I to receive
them. Motion carried unanimously. (Northern States Power
Company to be notified of the Council action.>
Fiscal Consultant Proposal. Bond Refinancing
The Council asked that copies of a letter dated August 31, 1970
from Peter S. Popovich, containing a proposal for refinancing
. Temporary Bond Issues Series I and 2 be distributed to all Council
and Finance Committee members.
. Sewer Charges - Letter from Senator Robert Ashbach
A letter from Senator Robert Ashbach was reviewed by the Council
and referred to Banister Engineering.
Mrs. Stromquist was requested to !nform Senator Ashbach that the
requeste~ Information will be forwarded as soon as Banister
Engineering can complete the necessary tests.
Claims
It was moved by Councilman Henderson that the claims be paid as
submitted (attached); seconded by Councilman Herrick and carried
unanimously.

CONSENT AND AGREEMENT
WHEREAS the Village of Arden Hills, a municipal corporation,
hereinafter called "Village", is the fee owner of, and is constructing a
sanitary sewer improvement over the North 50 feet of the West 280 feet of
the SE l/4 of the SW l/4 of Section 22, Township 30, Range 23, and
WHEREAS Northern States Power Corrl'pany is the owner of and is
occupying an easement for electric transmission line purposes over the North
50 feet of the West 280 feet of the SE 1/4 of the SW l/4 of Section 22, Township
30, Range 23. Said easement is recorded as Document No. 1303817 in Book 316
of Misc., page 429, Register of Deeds, Ramsey County, Minnesota; and
WHEREAS it is undetermined whether or to what extent the sewer
construction by the Village will affect the easement rights of Northern States
Power Company, above described.
NOW, THEREFORE, in consideration of the covenants and agreements
of the parties hereinafter stated:
1. NSP hereby consents to the construction and maintenance by the
Village, its successors and assigns, of said sanitary sewer easement over
and across the above described easement owned and occupied by NSP, and further
consents that NSP shall not be entitled to any damages in lieu of condeItllllition
as a result of this construction and occupancy of said property.
2. In consideration of the consent of NSP, above stated, the
Village covenants and agrees that it will reimburse NSP for the actual cost
and expense of any alteration, relocation, protection or supervision of its electric

transmission lines and facilities upon or affecting said premises, if any,
necessitated by the location, construction, or maintenance of said sanitary
sewer system, and will further indemnify and hold harmless said NSP from
any loss or damage to person or property occasioned by or occurring in the
course of the location, construction, and maintenance of said sanitary sewer
system for which said Village could be liable but for the foregoing consent
of NSP.
