Crepeau opened the ubi c Hearing at 8:07 p.m. and requested that the hearing proceed according to the distributed format. Mrs. Schutz explained that her son, Mr. Richard Schutz, Is In reserve training at Camp McCoy for two weeks; consequently he cannot attend the hearing tonight. She offered to relay any messages to her son If this Is desired. Mr. Charles Stoddard, 1666 Oak Avenue, briefly described the proposed park plan as It was presented to the Planning Commission by Contractor Richard Schutz. He reported that the Planning Commission recom- mendation Is that the Council delay Its decision on the new proposal (Plan 12) for further study and maintain the original proposal (Plan #1). Mr. Larrv Brodie. 1741 Venus Avenue, also representing the Planning Commission, stated that the additional fl II proposed would reduce a valuable water retention area; the extra estimated 100,000 cubic yards of fil" If permitted, gives the Village much more, In com- parison, than was originally granted under the first proposal; the plan presented had a number of admitted Inconsistencies which did not present a firm description of the proposal. Or. Robert BJorndahl, 3183 N. Lexington Avenue, Chairman of the Parks and Recreation Committee, stated that the parks committee would like to see further study of the proposal before a decision Is made. He said Mr. Schutz has presented a proposal which we can accept or reject but the Village should get his specific written proposal before making any decisions. COuncilman Ronald Herrick described the present filling operation In preparation of ball diamond sites on the western plateau portion of the park and then described the proposal forcthe lower eastern portion of the park which would contain picnic areas, parking, a pond and well-defined creek etc., explaining that If this second plan Is permitted the entire park area, Including the western area, would be completed with grass, trees, completed ball diamonds with backstops, benches etc. The following spoke In opposition to the proposal: Mrs. Lillian Michael, 1454 Skiles Lane, representing the Arden Hills League of Women Voters. Desire the natural area to be left as It Is. 2. Poor fill already dumped in the park; request It be removed. 3. A valuable place to dump; requested re-negotiatlon of the original proposal at more favorable terms for the Village. 4. The area Is beautiful and fascinating. There are only a few acres left that provide natural habitat for waterfowl. 5. Desire preservation of our natura! environment. 6, Ordinance regulations prohibiting this type of land-fill should be considered. 7. Improvement of other parks, such as Valentine Park, Is needed first. It needs fill, and the water contractor should be requested to remove his equipment and stock piles of dirt from the park. 8. Many people enjoy the natural area 365 days a year. Ball fields are used by only a few and foroniy a few months a year. Opposed to destroying beautiful natural areas for ball fields. 9. How will requests for filling of other areas be handled If this fll i is permitted? 10. Filling this area may affect other villages In the Rice Creak Water Shed; therefore any disturbance of the natural water shed Should be carefully considered to prevent flooding elsewhere. II. Landfill Is lucrative, permitting this fill will set precedent for future requests. Statements and Comments favoring the ~ro~osai: I. Arden Hills has no ball fields or other developed recreation areas for 13 to 18 year olds. 2~ Valentine Park Is not large enough for teen-age recreation and must be Improved for use by younger chi Idren, before It can be used. 3. Scho.ol facilities are not maintained in the summer and cannot be privately maintained. 4. Surrounding villages provide parks tor ball teams, including Arden Hills teams. Arden Hills provides no ball diamonds. 5. Valentine Park needs to be Improved. Only five ball games have been played there this sesson. 6. The proposed plan would direct the flow of water, not obstruct It. . 7. The park Is not large enough, In ItseH, to retain waterfowl and wild life when the surrounding acreage, not owned by the . Mrs. Larson's statement is atTached. Mayor Henry Crepeau, advised the residents of a proposed ordinance amendment now under consideration re Land Reclamation, which e read I n part. Mayor Crepeau read a letter from former Arden Hi I E. Nethercut, stating his concern for the p wet lands, pointing out that if the Village fills It may be difficult to protect other wet lands. Mayor Crepeau closed the Public Hearing at 9:58 p.m., after It was determ I ned there w~re no further quest Ions or comments. ayor Robert n of the its property, It was moved by Councilman John Hollenhorst that the proposal for the extended development of the park (Plan 12) be denied and the original proposal (Plan II) be re-negotiated with the contractor. The motion was seconded by Councilman E. Gray Henderson and carried unanimously. (Councilman Ronald Herrick was requested to re- negotiate the original contract.) Five minute recess between hearings. Sanitary Sewer Improvement No. 15 Mayor Henry Crepeau opened the Public Hearing at 10:05 p.m. Engineer Donald Lund described the proposed sewer project, extending sanitary sewer west along County Road F to Columbia Transit Company, a distance of approximately 1000 feet at an estimated cost of $14,650.00. Questions and Comments From the rloor Mr. Richard Bartsch, 1814 County Road F, asked If the extension would be on the SOUTh side of County Road F. Engineer Lund: Yes, that Is the proposal. Mr. Bartsch: The north side of County Road Company Is not platted, as far as I know. charge be assessed? Mayor Crepeau: Affadavits of publication have been received from the New Brighton Bulletin and mailed notices of the hearing were sent to all property owners served by the extension. Mr. Bartsch: If property on the north side of County Road F Is being sold, who Is responsible for the assessment? Mayor Crepeau: The fee owner Is responsible. Councilman John Hoilenhorst asked Englneer Lund if it is feasible for Columbia Transit Company to connect to the same sewer line serving Mounds View High School, -3- - ................, .,," ,'" . Minutes of Regular Council Meeting August 10, 1970 . En~lneer Lund advised that the school owns the sewer line which is connected to New Brighton. Plans for the sewer have not been studIed, but New Brighton Manager and the engineer stated that the nursing home In New BrIghton was recently connected to the Mounds View High School sewer line, and they questioned the capacity for additional connectIons. The Public Hearing was closed at 10:25 p.m. after determining there were no further comments or questions. It was moved by Councilman Ronald Herrick that the Resoiut1on, as attached, ordering Sanitary Sewer improvement No. 15 be adopted; seconded by Councilman E. Gray Henderson; motion carried unanimously. * * * * * * * * * * * * BUS!NESS FROM THE FLOOR None. REPORT OF VILLAGE ATTORNEY VINCENT P. COURTNEY (absent) McGuire's Liquor Licens~ Mayor Crepeau read a letter from Attorney Courtney, dated August 7, 1970, re McGuire's On-sale LIquor LIcense, and suggested the prepared notice be mailed to McGuire's. Motion was made by Counci Iman Hol lenhorst, seconded by Counci Iman Herrick, that action be started to revoke the On-sale Liquor License held by McGuire's Liquors, Inc., because the third quarter license fee due July I, 1970 is unpaid. A hearing before the Counci I was set for Monday, August 31, 1970 at the Arden Hi lis Vi Ilage Hall at 8:00 p.m. Notice to be mai led by Clerk Administrator. Motion carried. REPORT OF ENGINEER DONALD LUND Sanitary Sewer improvement No. 15 - Tabulation of Bids Engineer Lund advised the Council that five bids were received. The low bidder was Gideo Construction, Brooklyn Park, Minnesota, at $15,932.00, and recommended acceptance of this bid. (Bid tabulation is attached.) Counci Iman John Hollenhorst moved adoption of the Resolution, as attached, ordering Sanitary Sewer Improvement No. 15, awarding ,the contract to Gideo Construction Company; motion seconded by Council- man E. Gray Henderson and carried unanimously. Feas!bi lity of Sewer and Water Extension to County Road F and Hamllne Avenue Engineer Donald Lund described two possible routes for the sewer extension, recommending that the route along County Road F, estlmated at a cost of $16,600.00. He estimated the cost of the water service at $14,880.00 (Total estimated construction cost - $31,480.00; project cost of $35,000.00). It was moved by Councilman John Hoilenhorst that the feasibility report be approved as submitted, as per attached Resolution; seconded by Counci Iman E. Gray Henderson. Motion carried unanimously. Clerk Administrator Lorraine Stromquist was requested to notify Hage Construction Company that sewer and water wi II be avai lable to the site, and to determine if they desire to proceed with their proposal, before plans and specifications are ordered and date of Public Hearing is scheduled. I Estimate No.5, Northern Contractin~ Compan~ Engineer Lund explained that the project is more than 50% complete, and reduction of retainage to 5% has been requested on payment of Estimate No.5 in the amount of $41,314.86. ,. -4- . Minutes of'Reguiar Council Meeting August 10. 1970 REPORT OF COUNCILMAN RONALD HERRICK - Parks and Recreation & Human Rights Human RiQhts Committee Councilman Ronald Herrick reported that the Human Rights Committee is holding its meeting tonight. Parks and Recreation Committee Councilman Ronald Herrick reported that the six picnic tables have been received and two have been assembled and located In Ingerson Park. He reported that the Parks and Recreation Committee will hold Its next meeting on Tuesday, August II, 1970. Li~tle Lakes little league Counci Iman Herrick advised that a letter from the little Lakes Little League has been received, requesting the contracted payment. He said that the amount of the payment will be determined at the Parks and Recreation meeting Tuesday night. and he requested authorization of payment. The Counci I referred the matter to the Parks and Recreation Committee for determination of amount of the payment. Councilman Ronald Herrick was requested to advise Clerk Administrator Lorraine Stromquist of the amount; Council members are to be polled for authorization of payment. REPORT OF COUNCILMAN E. GRAY HENDERSON - Finance'" Munlcip<ll Lands and Buildings I I Finance Committee Councilman E. Gray Henderson reported that Mr. Robert E. Nethercut has been appointed as Vice Chairman of the Finance Committee and Itemized the various matters currently under consideration by the Committee; advising that the next Finance Committee meeting will be held On Wednesday, August 12. 1970. Water Study Sub-committee Report - Mr. Robert McNlesh Copies of sub-committee Water Study reports, were distrIbuted to the Council, and Mr. Robert McNiesh presented the recommendation of the Water Sub-Committee tor Council approval. After discussion, it was determined that an evening meeting be scheduled with industrial and commercial water consumers to advise them of the proposed adjusted water ,-atas. Mr. McNiesh agreed to present the Water sub-Committee recommendations to the group. Mayor Henry Crepeau will schedule the meeting as soon as possible. 19,71 Budget Study The proposed 1971 Budget was referred to the Finance Committee for study and its recommendations to the Council. Village Hall - Proposed Addition Copies of plans tor the proposed addition to the Vi Ilage Hal I. pre- pared by Architect Tom Horty, were distributed to the Council. Clerk Ad~inlstrator Lorraine Stromquist was requested to review the pians; refer the p!<lns to the Planning Commission with any recommended ch;anges; requesting that the Planning Commission review the plans as sOOn as possible. holding a special meeting if this can be arranged':1 'Trinity Lutheran Church - Sanitary Sewer Charges Councilman E. Gray Henderson recommends that sanitary sewer charges for Trinity Lutheran Church be based on th. first quarter water usage of 1970; abating excess charges paid the last three quarters. It was moved by Councilman John Hollenhorst that the Council concur with the recommendation; seconded by Counc! Iman E. Gray Henderson; motion carried unanimously. I -6- . Minutes of Regular Council Meeting August 10, 1970 REPORT OF COUNCILMAN STANLEY OLMEN - Public Works (absent) Ed ewater Avenue - Street 1m rovement Pro osal Maintenance Supervisor verett Beecher reported that Edgewater Avenue In Arden Hills '3, .is in need of an overlay from Asbury Avenue to Rldgewood Road; explaining that the ditches are settling and water Is ponding and residents are requesting that the situation be corrected. After discussion, the Council determined that the Improvement of the street be delayed until 1971, at which time State Aid road and bridge funds may be aval lable to Arden Hills for the purpose. (Clerk Administrator Lorraine Stromquist was requested to notify the residents of the Council action. Names of residents to be notified are to be obtained from Mr. Beecher.> REPORT OF MAYOR HENRY J. CREPEAU, JR. - General Government & Public Safety Outdoor Burning Ordinance - Letter to Residents Copies of a suggested informational letter to the residents of Arden Hills, explaining the recently passed ordinance prohibiting outdoor burning in the Village, were distributed for Counci I consideration. It was moved by Councilman Ronald Herrick that the letter be sent, as presented, enclosing a copy of the ordinance; motiOn was seconded . by Councilman John Hollenhorst and carried unanimously. Status of HUD Fund Requisitions Mayor Henry Crepeau reported that Mr. Bob Hess telephoned the Village Hall and advised Clerk Administrator Lorraine Stromquist that the HUD funds under WS-MINN-9i, Village of Arden Hills should be received by the Village within two weeks (August 20, 1970>, in the amount of $228,500.00. ' Public Safet Commission Pro osa~ A ter review of the amended Pub ic Safety Commission proposal sub- mitted to the Councli by the Public Safety Committee, the matter was de.ferred until the next Counci I meeting. The Public Safety Com- mittee was requested to compare the amended proposal with the original proposal to determine tha'r all recommended changes are included. Thank You Letter - Family of Dr. John Farkas Clerk Administrator Lorraine Stromquist was requested to send a "Thank You" letter to the family of Dr. John Farkas, expressing the Councllts appreciation of service rendered to the VII!age by Dr. Farkas as Public Health Officer over the past seven years. Appointment of Public Health Officer It was moved by Councilman Ronald Herrick that Dr. Robert Dunn, 3412 North Snelling Avenue be appointed as Public Health Officer; motion was seconded by Counci'man John Hollenhorst and carried unanimously. REPORT OF CLERK ADMINISTRATOR LORRAiNE STROMQUIST I, Electronic Accounting Machine - Tabulation of Bids _ Clerk Administrator Lorraine Stromquist advised that two bIds were received: Burroughs submitting the apparent low bl? at $7,300.00; National Cash Register bidding $8,860.00. (Tabulation aTtached.> Mrs. Stromquist advised that several discrepencies were noted In the Burroughs bid, as per attached list and recommends purchase of the NCR machine in the amount of $8,860.00. After discussion and review of the bids, it was moved by Councilman John Hollenhorst that the Council approve the purchase of the NCR model 395 accounting machine as recommended by Clerk Administrator. Shoreview - Arden Hi ~Is Storm Sewer Meetina The Council authorized Engineer Donald Lund to represent Arden Hills at a meeting with Shoreview re methods of apportioning costs of border line storm sewers serving Arden Hi lis, Shoreview and Ramsey County. REPORT OF COUNCILMAN JOHN HOLLENHORST - Planning and Zoning Case No. 70-22, Theodore Hamm Brewin9 Company - Special Use Permit Counci ~man Hollenhorst advised the Counci I that the Planning Com- mission has requested additional information before making its recommendation to the Counci I on the Theodore Hamm Brewing Company request for a Special Use Permit for a 30,000 gallon propane storage tank. Continental Can Corporation - Noise Complaint Councilman John Hollenhorst advised that the manager of Continental Can Corporation has determined the cause of the noise and will rectify the matter. ..l-~~ Case No. 70-29 W. Evening Hours and Dates for Voter Registration Clerk Administrator Lorraine Stromquist advised the Council that the Village Hall will be open for Voter Registration on Friday, August 21; Monday, August 24 and Tuesday, August 25, prior to the close of voter registration for the Primary Election of September 15, 1970; explaining that members of the Arden Hil is League of Women Voters have volunteered to register voters on these three evenings from 4:30 to 9:00 p.m. (Notice ot these dated and times are to be published in the newspapers. ) HUD Re*uisitlon No.3 Clerk dminlstrator Lorraine Stromquist requested authorization to submit HUD Requisition No.3 in the amount of $63,600.00, to the HUD oft I ce. it was moved by Counci Iman Ronald Herrick and seconded by Councilman E. (f~ .;fek~ . . ... - '~ August 10, 1970 I am Donna Larsen of the League of Women Voters Rice Creek Watershed Inter-League Study Committee, and I wish to express our concern that Arden Hills should consider any effects that its pork plan will have on the total Rice Creek Watershed. I represent nine local Leagues of Women Voters (Arden Hills, Blaine, Fridley, New Brighton, Roseville, Shoreview, St. Anthony, St. Paul, and White Bear Lake) all of whom represent areas which either drain into or use waters from Rice Creek. For over two years the Rice Creek Inter-League Study Committee has been meeting and compiling information on water reS01ITCeS, development, and water problems of Rice Creek. The wo.tershed includes the area outlined in red on this map. Forest lake is at the northern end, White Bear Lake at the east, Fridley at the west where the creek drains into the Mississippi River, and here is Arden Hills. This is the Lino Lakes area that is being considered by the Metropolitan Council for a metro- politan park. The Metropolitan Council Park Reserve Board considers Lino LaJees and the Rice Creek Watershed as one of three top priority areas in the metro area for preservation through parks and open space. Decisions made in any of the 27 villages within the watershed--even if it concerns only a small part of it--may have a pronounced effect on another part of the watershed downstream. For instance, we feel that Arden Hills should consider whether its park plans would change the ability of the surface to hold water so that the possibility of flooding downstream is hot increased. Long Lake receives the w1ters from Rice Creek and the w~ters from the Lake Johanna drainage area--parts of New Brighton, Roseville, Shoreview and Arden Hills. This area includes over 7,000 acrea. Much water converges,at Long Lake when the amount of surface run-off upstream is increased. I understand that Arden Bills is aware (through experience) that the decisions b,' one community regarding water drainage can have a great impact on another community's water problems. Another important consideration is the current action of the Ramsey, Anoka, and Washington 60unty Commissioners. Parts of each of these counties lie within the Rice Creek Watershed. The commissioners have joined together to study the resources and problems within the watershed; and their action may result in the formation of a watershed district. If a w~tershed district is formed, the district managers will cooperate in a study to develop an overall plan for w1ter resource management within the boundaries of the Rice Creek Watershed. The district would have power and resources to carry out projects according to its plan and priorities. We also feel that consideration should be given to the effect on wildlife in the area and to the fact that the wetland cannot be recreated once it is altered. Considering all these factors and the possible effects on other communities, we feel it is important that decisions concerning the park be delayed until cooperative, overall plans for the w1tershed have been worked out. Councilman John Hol lenhorst asked Engineer Lund if it is feasible for Columbia Transit Company to connect to the same sewer line serving Mounds View High School. ~ngineer Lund advised that the school owns the sewer line which is connected to New Brighton. Plans for the sewer have not been studied, but New Brighton Ma~ager and the engineer stated that the nursing home in New Brighton was recently connected to the Mounds View High School sewer line, and they questioned the capacity for additional connections. - 2 - . The Burroughs bid bond lists a different machine from the machine on their bid. 2. The Burroughs bid was not signed. 3. The Burroughs bid contained an error in subtsaction; however, the bidder agreed orally to honor the mistake. 4. The Burroughs maintenance contract Is quoted as $749.00 a year and the National Cash $594.00 a year. If this difference continues, a $1,250 saving would be realized with National Cash #395 in an eight-year period. 5. It is assumed that the Burroughs bid includes instructions for programing; however, the bid makes no mention of this. 6. The NCR guarantees 30 day delivery after order; Burroughs states no date. 7. NCR guarantees to carry the maintenance contract for at least eight years; no such guarantee Is given by Burroughs. 8. In the Geo. M. Hansen report (Village Auditor) it states that the Burroughs 3208 was discontinued, because of maintenance trouble with the box printer, so was not recommended by the salesman. The unit proposed also has a box printer.
