Crepeau, Jr. at 8:05 p.m. Roll Call Present: Mayor Crepeau, CouncIlmen Olmen, Hollenhorst, Henderson and Herr'ick Absent: None Also Present: Clerk Administrator Lorraine Stromquist, Treasurer Worth G. Honan Approval of Minutes The Minutes of the Regular Council Meeting of July 13, 1970 were approved as amended. BUSINESS FROM THE FLOOR ContInental 011 Company Proposal Attorney John Daubney and a representative from ContInental 011 Company appeared to discuss the Planning Commission's negative recommendations to the Council regarding their requests for a Special Use Permit and three variances to permit the construction of a Conoco Service Station (Automobile Diagnostic Center) on a 200' x 200' parcel of land located at the northwest corner of Lexington Avenue and Red Fox Road. Councilman Herrick informed the applicants of the three member Community Development Committee and suggested they request Its assistance in planning use for the property. Councilman Hollenhorst moved, seconded by Councilman Herrick, that the Council table the matter until the applicant requests reconsideration; motion carrIed unanimously. Water Improvement 68-2, Restoration Complaint Mr, James Ross, 4029 Falrvlew Avenue, complained that the contractor Is replacing the curb in a very haphazard manner. Mayor Crepeau Informed him that the Village Engineer and Maintenance Supervisor will continually check the project to assure a satisfactory Job. Dralna e Problem Fairview Avenue and Count Road F Mr. Ross also mentioned the problems cause by the depression In the road at this corner. Matter referred to Councilman Olmen to contact Ramsey County as the depression Is In the county right-of-way. REPORT OF ATTORNEY VINCENT P. COURTNEY Sanitary Sewer Improvement 12 and 13, Condemnations 12-1 and 12-~ Attorney Courtney reviewed Attorney Lyrlden's letter, dated July 20, 1970, regarding these condemnations. Councilman Hollenhorst moved approval of payments to the commissioners and to Mr. Waldoch, when the award is finalized, as set forth in Attorney Lynden's letter (attached); seconded by Councilman Henderson; motion carried unanimously. Garage Door Height Ordinance, Final Reading Councilman Holienhorst moved that AN ORDINANCE AMENDING ORDINANCE 99, THE ZONING ORDINANCE, BY ADDING THERETO A PROVISION SETTING A MAXIMUM HEIGHT FOR GARAGE DOORS IN RESIDENTIAL DISTRICTS be given Its final reading and adopted; seconded by Councilman Henderson; voting In favor: Mayor Crepeau, Councilmen Olmen, Holienhorst and Henderson; opposed: Councilman Herrick; motion carried. , t 'f . Minutes of Regular Coullei I Meeting July 27, 1970 Accounting Machine, Bid Date Set Councilman Herrick moved approval of the specifications for an accounting machine, sUbJect to minor changes, as submitted by Attorney Courtney; authorized the advertisement of bids and setting the bid date as August 10, 1970 at 2:00 p.m. at the Village Hall, and authorizing Clerk Administrator Lorraine Stromquist to open and tabulate the bids for Council consideration at the Regular Councl I Meeting of August 10, 1970; seconded by Councilman Henderson; motion carried unanimously. Notification of Attorney Courtney's Vacation , Attorney Courtney Informed the Council that he will be vacationing, and therefore, will not be present at the August 10 Council meeting; however, he will submit a written report and offered the services of Attorney Lynden for this meeting. The Council felt the written report will be sufficient. REPORT OF VILLAGE ENGINEER DONALD LUND Sitzmark Ski Shop - Sewer Installation William Wegleltner, owner ot the Sitzmark Ski Shop, was present and Informed the Council that he had obtained three bids, as requested, for the Installation of sewer service by augarlng under County Road E for his building under construction; the lowest bid was $2,46S for 4" service. Engineer Lund reported that had the sewer been included in the Im- provement In 1961, the cost would have been $SSS for 60' of 6" service. After some discussion, Councilman Olmon moved, seconded by Councilman Henderson. that the Village reimburse Mr. Wegleltner one-half the cost ($I,232.S0) of the sewer construction cost; motion carried unanimously. Charles Perry Park. Proposed Development Richard Schutz. contractor, and Sue Covnlck. Midwest Planning & Research, presented proposed plans for developing the Charles Perry Park. Mr. Schutz requests permission to dump fill at the park site. If permission Is granted, he proposes to create recreational and parking, areas as shown on the plan presented. After considerable discussion, the Council requested Attorney Courtney to furnish an opinion regarding the mining portion of Ordinance No. 99, as to legal meaning of site as used in the ordinance. Councilman Herrick moved that the plans be submitted to the Planning Commission at the Aunust 4 meeting and a public hearing be held by the Council on August 10, 1970 (Regular Council Meeting) at 8:00 p.m. at the Village Hall; seconded by Councilman Hollenhorst; motion carried unanimously. Sanitary Sewer No. 14 Bids Engineer Lund reported thaT 12 bids had been received on Friday, July 24, for Sanitary Sewer No. 14. As recommended by Engineer Lund, Councilman Olmen moved that the bid be awarded to Dunkley Surfacing, Inc., 37S6 Grand Street N. E.. Mpls.. Minn. SS421, for the bid amount of $123.344; seconded by Counci Iman Henderson; motion carried unanl mous Iy. a.4fl--- ~ ~_ _ Sanitary Sewer No. 15 Councilman Olmen moved approval of the plans and specifications for Sanitary Sewer Improvement No. IS, as per attached resolution. as prepared and submitted by Engineer Donald Lund, subject to the Inclusion of three cuts for service for the Houle property; authorized the advertisement of bids and setting the date for the public hearing for August 10, 1970 at 8:00 p.m. at the Village Hall; seconded by Councilman Hollenhorst; motion carried unanimously. e - 2 - . Minutastof R1egular Counci I Meeting July 27, 1970 Council requested Engineer Lund to obtain comparative figures from New Brighton for the sewer connection for the Co~umbla Transit Company garage, and to consult with Dr. Houle regarding the number of services he would like and the matter of easements for consideration of constructing the sewer along the north side of County Road F, instead of the south side as shown on the plans. The aforesaid Information is to be available at the public hearing. Assessment Roils, Municipal Improvements Councilman Olmen moved, seconded by Councilman Herrick. to direct Banister Engineering Company to prepare assessment rolls for the following Improvements: Water Improvement 68-2 and 68-3, Gray Fox Road, Red Fox Road. Sanitary Sewer 12 and 13, Sanitary Sewer 14, and Sanitary Sewer 15, as per attached resolution; motion carried unanimously. Feasibility Report, Utilities to Hamline and County Road F Engineer Lund Informed the Council that this report will be presented at the August 10 Council meeting. Water Improvement 68-2, and 68-3, Progress Report Engineer Lund advised that bituminous work is being done In these improvement areas. and corrective action Is being taken where necessary. Water Service Problem, 3171 N. Lexington Avenue Engineer Lund Informed the Council that Mr. and Mrs. Neamy, 3171 N. Lexington, feel the planned location for their water service should be changed to extend to their property line. However, Engineer Lund explained that this is not possible without damage to their property plus an easement. The Council determined to have the service constructed as per the plans. ~itary Sewer 12 and 13, Ramsey County Street Cuts Engineer Lund Informed the Council that Ramsey County prohibits open cuts In county roads which have been resurfaced with th,e last two years; services must be augered, unless the Village agrees to place a I~ bftuminous overlay on the road next spring. This would add about $185 to the cost of each service, which is considerably less than augerlng. The Counel I agreed to resurface the effected portion of Hamllne Avenue and authorized Engineer Lund to so inform Ramsey County. ' Drainage Problem - 1429 Skiles Lane Mrs. John Sullivan, 1429 Ski les Lane, requested a solution to their drainage problem. Engineer Lund offered two suggestions: I) install a 60 foot culvert for about $800 before the contractor resurfaces the road; 2) keep the road lower than the driveway and direct the water away from the property. The Council agreed to the second recommendation. Sanltar Sewer 12 and 13 Estimate No.4 The Council determined that McDona d and Associates' Estimate No.4 will be considered on August 10, 1970. REPORT OF VILLAGE TREASURER WORTH G. READ Treasurers Monthly Report Mr. Read informed the Council that ~o date no funds have been received from HUD; the Council requested Mrs. Stromquist to draft a letter to Representative Karth asking for assistance in obtaining funds which are due to the Village. GRAY HENDERSON - Municipal Lands & ~uildlngs and Fjni;)o(:e Series I and 2. 1968 Improvement Bonds Councilman Henderson requested Mrs. Stromquist to confer with Fiscal Agent Peter S. Popovich regarding refinancing for temporary Improvement bonds of 1968.Sorlos J and 2. Mayor Crepeau requested the Finance Committee study the matter and obtain another fiscal agent's opinion regarding such financing on both a temporary and permanent basis. Mayor Crepeau agreed with Dr. Woodburn's recommendation to obtain an architect's feasibility report on the addition; matter referred to Mrs. Stromq~ist to contact Tom Horty and request that he prepare a plan and report. 1969 Audit Report Councilman Henderson read the recommendations of the George M. Hansen Company regarding !969 Village Audit Report; the items were discussed by the Council and requested that copies of the report be sent to the Justices of the Peace. REPORT OF COUNCILMAN STAN OLMEN - Public Works None. REPORT OF MAYOR HENRY J. CREPEAU, JR. - General Government & PublIc !.lafety Appointment of LeQa~ Newspaper , Councilman Hoilenhorst moved that the New Brighton Bulletin be appointed as the Arden Hills legal newspaper until December 31. 1970; seconded by Councilman Henderson; voting in favor: Councilmen Olmen. Holtenhorst, Henderson; opposed: Councilman Herrick. Motion carried. Public Safety Committee Report Mayor Crepeau requested Mrs. Stromquist to distribute the revised public safety commission proposal to the Council. MINNESOTA 55101 July 20, 1970 Mrs. Lorraine Stromquist Clerk-Administrator Village of Arden Hills 14S0 West Highway 96 Arden Hills, Minnesota 55112 Re: Village of Arden Hills, Sanitary sewer improvements 12 and 13; Condemnation of 12-1 and 12-3 Dear Mrs. stromquist: The above-entitled matter was heard by the three commissioners appointed by the District Court of Ramsey County, Minnesota, on the 3rd day of June, 1970. At the hearing Mr. Donald Lund of Banister Engineering testified as to the engineering needs and the geographical lay-out of the sanitary sewer and the amount of property taken. We did not present the testimony of an expert witness as to the damages which would result from the taking of the land as we felt this testimony would be unnecessary and superfluous in view of the fact that the chairman of the commission was Mr. Joseph Bettendorf, who has testified for and has done appraisal work for the Village on numerous occasions, and the other two commissioners were both competent and fair appraisers. The respondents--Josephine Waldoch and Edward and Rose Waldoch-- did not personally appear at this hearing. Appearing for and on behalf of them was L. H. Mikeworth, their attorney. He likewise did not adduce any expert testimony as to damages. In fact, he did not take testimony from any witness. Thus, the only witness who testified was Mr. Donald Lund. Because there was no testimony as to what the amount of the award should be, the hearing was mainly devoted to ascertaining the sizes of the strips of land to be taken for these permanent and temporary sewer easements. The commissioners were concerned about the segment of easement 12-3 which runs in an easterly-westerly direction for it left a 2S'xlSO' strip of land immediately to the south thereof with the effect that when Mrs. Waldoch plats her property for single family dwellings, one lot would be potentially ruined. One of the commissioners remarked that it was too bad that this segment of the sewer system could not have been routed , 'I , Mrs. Stromquist 12-1 and 12-3 July 20, 1970 Page 2 along the north boundary line of the improved lots which front on the frontage road facing Highway #10. Mr. Lund advised the commissioners that Banister Engineering had considered this but found it to be impractical. Prior to this hearing and on May 12th, 1970, the commissioners, Donald Lund and I viewed the condemnation sites. At that time we discovered that the portion of Mrs. Waldoch's property en- compassed by 12-3 had sod on it which obviously had been laid by the owners of the improved lots which face on the frontage road. We also noticed that only one tree would be affected by the construction of 12-3. At the hearing, the commissioners asked Mr. Lund what was to be done about restoring the property affected by 12-3 to its original condition. Mr. Lund advised the commissioners that the ground and grade would be restored to its original condition. The commissioners then queried about what was to be done with respect to the sod. I pointed out that the sod had not been laid by Mrs. Waldoch but by the abutting property owners. Thus, Mrs. Waldoch was merely a beneficiary thereof. The commissioners took the position that it did not make any difference who laid the sod; the sod was going to be removed in the construction; and it would either have to be replaced or Mrs. Waldoch would have to be re- imbursed therefor. I frank~y had to agree with them but never- the~ess wanted to make a point. Upon the advice of Mr. Lund, I agreed with Mr. Mikeworth that the award should include a reimbursement to Mrs. Waldoch for re- sodding. The testimony of was uneventful. are involved. Don Lund and the discussion with respect to 12-1 This is undeveloped property, and no sod and trees Subsequent to the hearing, at Mr. Courtney's suggestion I had Mr. George Membrez inspect the condemnation sites and render an estimate of the value of the damages to the property involved in this con- demnation. His estimate was received on June 20th, 1970, and con- tained the following figures: Easement 12-1 (Commercial Property): Permanent 110'x30' -- 3300 sq. ft. Construction l40'x30' -- 4200 sq. ft. $220.00 84.00 $304.00 , c. , Mrs. stromquist 12-1 and 12-3 July 20, 1970 Page 3 Easement 12-3 (R-2 Classification): Permanent 705'x30' - 21,150 sq. ft. Construction 740'x30' - 22,200 sq. ft. $444.00 154.00 $598.00 Resodding 555'x60'- 33,300 sq. ft. or 3,700 sq. yd. at .55 $2,035.00 Thus, Mr. Membrez's total estimate for the two easements, including resodding, came to $2,937.00. On July 2, 1970, Mr. Bettendorf called to advise that the commissioners had made a preliminary determination as to the amount of the award but were concerned that the amount to be awarded Mrs. Waldoch for the resodding of 12-3 would exceed the actual damages awarded therefor. The figures he mentioned in his telephone conversation were $225.00 for the 12-1 permanent and temporary easements and $~50.00 for the 12-3 permanent and temporary easements. He said that the latter figure was high because the east-west segment of 12-3 isolated or cut off a 25'x150' strip, which, I mentioned above, the commissioners were concerned about at the hearing. He was concerned that the award for resodding would exceed $2,000.00 and wanted me to find out whether the Village would be willing to resod itself or else seed and mulch the area encompassed by the easement, or, if the Village were not willing to do this, to find out what the actual area was, in square yards, that needed to be resodded. I called Don Lund about my telephone conversation with Mr. Bettendorf. Mr. Lund advised, and I fully agree with his advice, that it would be economically unwise for the Village to resod itself for he had gotten, a bid for resodding the actual area that needed to be resodded, 2,380 sq.yd., (smaller than the area that Membrez had used in his estimate by 1,320 sq. yd.} of $ .70 per sq. yd., i.e., a total of $1,666.00. Thus, I called Mr., Bettendorf back and told him that the Village would prefer having their award include reimbursement for the resodding. I gave him the actual area that would have to be resodded, 2,380 sq. yd., an area 1/3 less than the original area the commissioners were going to use in computing the sod reimsursement aspect of the award. On July 16th, 1970, the commissioners filed their report. An executed copy of the Report is enclosed herewith for your information and file. I was very pleased and surprised by the amounts they awarded the Waldochs. They awarded Mrs. WaldOCh, for easement 12-3 and the sod replacernent,$1,550.00~ in short, they only allowed Mrs. Waldoch $300.00 for the sod replacement rather than the $1,428.00 (2,380 sq. yd. x $ .60 =$1,428.00) that I had expected them to include in the award for sod replacement. They awarded Mr. and Mrs. Edward Waldoch $225.00 for the taking of easement 12-1. " ~ . Mrs. Stromquist 12-1 and 12-3 July 20, 1970 Page 4 In view of Mr. Membrez's estimate and my confidental discussion with Mr. Bettendorf, I consider the awards to be extremely reason- able and would strongly recommend the Village not appeal them. This matter and my recommendation in regard thereto should be placed on the agenda for the next Village council meeting. Should the Council not heed my recommendation and decide to appeal this matter, you are hereby advised that the Village has 40 days from the date of filing, i.e., July 16th, 1970, in which to file an appeal. Therefore, a determination must of necessity be made at the next council meeting. j i One other item that should be placed on the agenda along with the foregoing is the matter of compensation of the commissioners. As you will note, from the last page of the Report, each of the commissioners spent a total of 7 days in the contemplation, review, consideration ~nd hearing of this condemnation proceeding, and, pursuant to the District Court's Order appointi~gthese commissioners which set their fee at $50.00 per day, each of them is entitled to compensation from the Village in the amount of $350.00. I recommend that the Council authorize the Village offic\;!rs to issue drafts in the amount of/$350.00 payable to the order of each commissioner, the names of whom are on the last page of the Report. If the Council does authorize payment, woula you kindly forward the three drafts to me, and I will see that the commissioners are paid. This letter had been lengthy because I wanted fully to explain what has transpired in this condemnation proceeding and fully to apprise you as to what the present posture thereof is. Hollenhorst, Henderson end Herrick and the following were absent: None Councll..n OloA and moved its adoption: RESOLUTION APPROVING ENGINEERS' PRE- LIMINARY REPORT AND ?ROVIDING FOR PUBLIC HEARING ON SANU'ARY SIDlER IMPROVEMml'1. 110. 15. introduced the following resolution BE IT RESOLVED by the Council of the Village of Arden Hills as follows: 1. By resolution adopted June 6, 1970, the Council has directed Banister Engineering Company to prepare a preliminary report as to the feasibility of a proposed 1mprovement consist- ing of the construction of approximately 950 fGet of oanitary Sewer~ and manholes and other appurtenances and the restoration of sodded areas, generally in the area adjacent to County Road F from 400 feet east of the center of Section 28 to approximately 600 feet west of the center of Section 28. Banister Engineering . . was also direoted to include in the report the estimated cost of the proposed tmprovement and as to whether such tmprovement should best be made as proposed or in connection with some other improve- ment. The preltminary report and cost estimate have been submitted by the engineers and considered by the Council and are hereby ap- proved and directed to be placed on file in the office of the Village Clerk Administrator. The improvement proposed to be made in the general manner set forth in the report is designated as Sanitary sewer Improvement No. 15. 2.
