Approval of Minutes The Minutes of the Regular Councl I Meeting of June 8, 1970 were approved as submitted. BUSINESS FROM THE FLOOR Mr. John RysQaard and William Ruppel, Public Safety Committee After revIew of a letter to the Council from Mr. Rysgaard, the Council scheduled a discussion meeting with the Public Safety Committee to be held on Thursday, July 9, 1970 at 7:30 p.m. Mr. AI Care, Arthur W. Hage Construction Company. 893 West Highway 96 Mr. Care presented a preliminary plot plan and letter, dated June 17, 1970. requesting the Council to extend water service to the southeast corner of Hemline Avenue and County Road F. Mr. Care advised the Council that his company proposes an office building for this location. He also requested that the sanitary sewer be extended to serve this property. Engineer Lund was requested to prepare a feasibility report for the extension of water and sewer service to the site, after which the matter Is to be referred to the Planning Commission for recom- mendations to the Council. Dr. and Mrs, Edward Ca I ph, 1651 West County Road F Dr. and Mrs. Calph advised the Council of the damage to their property by Northdale Construction Company. After review of a letter from The Park Nurseries, Inc., dated June 22, 1970, Attorney Vincent P. Courtney was requested to send a copy of the letter to Northdale Construction Company. Engineer Lund to provide Attorney Courtney with a copy of the Northdale Contract. REPORT OF ATTORNEY VINCENT P. COURTNEY LeaQue of Women Voters Informational Brochure After review of Attorney Courtney's letter of June 19, 1970, and the Attorney General's opinion In letter of June 17, 1970, the Council requested Clerk Administrator Lorraine Stromquist to send copies of both letters re this matter to the League of Women Voters In explanation of the Council's denial of their request that the Vlliage subsidize the cost of the Informational brochure. Outdoor Burning Ordinance Attorney Courtney advised the Council that the ordinance, as adopted, does not provide for Issuance of permits by local authorities. A letter requesting authority be given to Arden HI lis to Issue such permits has been sent to the Minnesota Pollution Control Director. Mr. Tom Lynch, 3210 North Hamllne, asked If tree branches can be burned. Mayor Crepeau advised that the rubbish haulers wi II pick these up if cut Into three-foot lengths. . , . Minutes of Regular Coune! I Meeting -2- June 29, 1970 Attorney Courtney stated that much of the ordinance requires Interpretation by the Director. Mr. Robert Kerr, 3510 Siems Court, asked the term of the Village contract with the rubbish haulers. Mayor Crepeau advised that the contract Is between the haulers and each Individual property owner; the haulers are licensed by the Village for one-year periods. Pollee SQuad Car Lease Attorney Courtney reviewed the lease agreements presented by All Lease Company ($136.00 per month) and North Amer!can Leasing Company ($113.00 per month), advising that North American Leasing Company's bid is apparently the lower of the two; further advising that the Village should have the benefit of a new-car warranty and that the agreement be current I y dated. I twas moved by Councilman John Hoilenhorst that the Council authorize Attorney Courtney to negotiate an amended agreement with North American Leasing Company and to cancel the present lease agreement with All Lease Company as soon as legally possible; seconded by Counci Iman Stan Olmen and carried unanimously. ORDINANCE NO. 99, THE ZONING ORDINANCE, BY ADDING THERETO A PROVISION SETTING A MAXIMUM HEIGHT FOR GARAGE DOORS iN RESIDENTIAL DISTRICTS. It was moved by Counci Iman John Ho!lenhorst that the ordinance be Introduced by tl~te and referred to the Planning Cbmmisslon for review; motion was seconded by Councilman Stan ODmen and carried unanimously. REPORT OF ENGINEER DONALD LUND State Aid Street System Engineer Donald Lund advised the Council that because we now have a popuijatlon in excess of 5,000 a planned system of state aid streets should be designated, of existing and/or future roads for construction and maintenance, and presented a list he prepared for Council review. He advised the Council that the system can be revised annually if desired, but requested that a pUan be developed to be submitted with cost estimates to the state by August I, i970. The matter was referred to the Planning Commission to be reviewed at the July 7, 1970 meeting. . Time fxtension ReQuests- Construction Projects Engineer Donald Lund advised the Council that time extensions of approximately 60 days have, or wi II be received. from the five construction companies currently under contract with the Village. Several residents were present and advised the Council of their grievances re the water construction projects, citing "no progress, safety hazards, dirt, lack of activity, lack of consideration of the residents, etc.". It was requested by the Council that Engineer Donald Lund prepare a detaIled progress report for the next Councl I meeting and request that a member of each contracting company be present at the meeting. Be~1 and Keliey Engineer Lund advised that the relocation request is not feasible, and It was moved by Councilman Rona!d Herrick and seconded by Councilman E. Gray Henderson, that the Council deny the request. Minnesota Highway Department Plans for Turn Lanes and Guard Ralls between TH 35W and TH 6! The plans were referred to the Planning Commission for recommendation to the CouncI I. The matter of Inconspic\lous guard rails 00 Olel Highway 10 south of E2 was referred to Engineer Lund. lhey are considered II hazard whieh should be rectified. Sanltarv Sewer - aitz~lIrk Ski Shop The sewer connectIon to serve the Sitzmark Ski Shop was referred to .Engineer Donald Lund to determine responsibility of insta! lation cos ts . Gray Fox Road Improvement Engineer Lund advised that the sodding of the boulevard along Gray Fox Road was not inc~uded In the contract; advising that there Is adequate funding for toe sodding, and that Hamms Brewing Company has sodded their property to the street right-ot-way, requesting that the Village sod the boulevard portion. Engineer Lund was requestod to advise Hamms Brewing Company that the sodding ot the boulevard Is the responsibility of the property owner (O.dinance No. 99, Section IV E. Landscaping). Sanitarx Sewer Extension Request - Co~umbla Transit Company Engineer Donald Lund advised that the estimated cost of this sewe," extension is higher than previously presented. The 950 foot 8 Inch sewer line is estimated at $14,600.00, $~O,OOO of which can be assessed to the abutting properties. After discussion, the Council requested that Engineer Lund determine how far west and south the property can be assessed and set the date for Public Hearing on Monday, July 27, ij970 at 8:00 p.m. at ~e~lllage Hal I. ~ .d? _0- u..---a- ~. .~"7. Water Connections - East side of Lake Johanna Engineer Lund advised the Counclij that several hundred feet of water line is neces5ary to serve severa~ properties on the east side of Lake Johanna and requested the Councl !'s desires re these serv ices. After discussion of the pending Minnesota Highway Department plans for Highway 51. EngIneer Lund was requested to deisy the water services in this area un'o-il the highway matter is reso!ved. -3- . June 29, ~970 Minnesota Highway Department Pians - Highway 51 It was moved by Councilman John Ho!lenhorst that the Councl! concur with the recommendation of the Planning Commission to reject the layout plans submitted by the Minnesota Highway Department for Highway 51; seconded by Councilman Ronald Herrick; motion carried unanimousiy. Clerk Administrator Lorraine Stromquist was requested to notify Senator Robert Ashbach and Representative Richard (Dick) Andersen of the Council's action and request their assistance in future negotiations re plans for Highway 51 through Arden Hills. REPORT OF COUNCiLMAN JOHN HOLLENHORST - Planning and Zoning After review of the RESOLUTiON APPROVING SPECIAL USE PERMIT TO MiNNEOSTA BAPTIST C0Nf[RENCE TO CONSTRUCT AND MA6NTAIN A HEAD- QUARTERS BU!LDING AT COUNTY ROAD E2 ADJACENT TO AND ON THE EAST OF THE RAMSEY COUNTY LiBRARY, ARDEN HILLS BRANCH (attached). IT was moved by Counci Iman John Ho! lenhorst and seconded by Counc'Iman Stanley Oimen, that the resolution be adopted; motion carried unanimously. A copy of the resolution was given to representatives of Minnesota Baptist Conference. REPORT OF COUNCILMAN RONALD HERRICK - Parks and Recreation and Human RI ghi"s Perry Park l~ovement - Pro~ress Report Councilman Herrick advised the Councl I that filling of a portion of the park area is progressing as scheduled; the contractor Is covering the tll~ on a daily basis. BUrnl?~ of Village Buildin~ - 3255 North LeXington Avenue Councl man Herrick reported that the Lake Johanna Volunt~er Fire Department burned the house at 3255 No~th LexIngton Avenue and he commended the department on the tine job. Clerk Administrator Lorraine Stromquist was requested to write a "thank you" letter to Fire Chief Harry Ehlers, Lake Johanna Volunteer Fire Department. Human Rights Commission- Request for Names of Potentlat Naw Members COUncilman Herr'lek advised the Coune!! that names of potentia! members of the Human Rights Commission are requested and suqgests~ that the newspapers give the matter publicity. Violations Pending Councilman"Ronald herrick cited severaivio~atlons which are pending: a. Lean-to at Arden Automa1-i c - a temporary winter she iter. b. Horses - south of County Road E c. Tra! lers and junk cars - Dynacast property d. Fill and dumping areas - to ~hat extent nro these permitted? They also asked that a progress report be submitted by Mr. Kel ley, lIsting a!~ existing permits for such activities, to what point each has been done, and the extent of fi It, grading or whatever, that the permit allows. . Oftlce Hours Extended The Council requestei that hours be staggered for office personnel on Mondays, TUGS days and Thursdays. providing additional office hours (8:00 a.m. to 5:00 p.m.). REPORT OF COUNCILMAN E. GRAY HENDERSON - Finance and Munlclpa~ Lands and Bui Iding Councilman Henderson reported that the Final Audit tor [969 accounts has baen recoived. Minutes of Regular Counel I Meeting -5- June 29, 1970 REPORT OF COUNC~LMAN STANLEY OLMEN - Public Works Termination of Employees It was moved by Councilman Staniey O!men t~at because of the cut-back In Village expenditures and anticipated hiring of some services by outside contractors, the Public Works Department staff be reduced by two permanent employees; those having the least seniority, effective July 14, ~970. The motion was seconded by Councilman John Hollenhorst and carried unanimously. Maintenance Supervisor Everett Beecher was authorized to grant sufficient time off during the next two week period to allow these employees to seek ot~er employment. Lead Man Selection Basis - Public Works Department It was moved by Councilman Jo~n Hoilenhorst that a resolution be approved stipulating that the Council approves a procedure that a "Lead Man" be selected on the basis of merit and not on the basis of seniority; seconded by Councilman E. Gray Henderson; motion carried unanimously. Water Shut-Off Procedure Maintenance Supervisor Everett Beecher was requested to caution the construction contractors about unauthorized water s~ut-offs, and required him to notify residents In. advance of proposed shut- offs when t~ey become necessary. Mr. Roger Reiling, Chairman of Public Works Committee Mr. Roger Rei ling summarized a draft of a letter to the Council whiCh he had prepared, cl~ing mis-givlngs he had as Chairman of the Public Works Committee, and requested that the Council give some direction as to what Is expected of t~G Committee. After discussion. It was decided that the Council and the Public Works Committee schedule a joint meeting at which time the responsibilities of the Public Works Committee will be clarified and outlined. The Committee was requested by the Council to prepare a tentative budget proposal for 1971 for review as soon as possible. REPORT OF MAYOR HENRY J. Police Department - Sa~ary Adjustments It was moved by Councilman John Hal lenhorst that the Po!lce Department Salary Adjustments be approved as submitted and attached; the motloo was seconded by Councilman Ronald Herrick and carried unanimously, REPORT OF CLERK ADM1H1STRATOR LORRAINE STROMQUIST Service Station License Applications Clerk Administrator Lorra!ne Stromquist presented two service station license applications for approval: I. Solar Fuel Stop - 3130 Johanna Boulevard It was moved by Councllman Ronald Herrick that the licenses be granted as requested; seconded by Counei Iman Stanley Olmen; motion carried unanimously. . Clerk Administrator Lorraine Stromquist was requested to provide information to the Finance Committee listing the number of pro- perties already connected directly to the Roseville system, the date connected, date water was available to Arden Hills' residents in these areas, and amounts paid to the VilBage of Roseville. Apportionment Resolutions It was moved by Councilman Stanley Olmen that Sanitary Sewer Improvements I, 2 and 3, Water Improvements 67-' and 67-2 and Street Improvement 60-2 Apportionment Resolutions be approved as submitted. The motion was seconded by Councilman John Hollenhorst and carried unanimously. Blue Cross - Mil Group Insurance Rate Change After review of the proposed rate change, effective August i, 1970, it was moved by Councilman Ronald HerriCK and seconded by CouncIlman John Hol lenhorst that the rate increase be approved as submitted and attached; motio~ carried unanimously. Claims Clerk Administrator Lorraine Stromquist requested that two ad- ditional claims be considered for payment with the attached list of cI aims: I. Monthly auto lease payment to North American Leasing Company for$ii3.00. 2. Northdale Construction Company estimate in the amount of $79,940.24. It was moved by eounci Iman E. Gray Henderson that the claims be paid as presented (attached). The motion was seconded by Councilman Stanley Dimeo and carried unanimously. WHEREAS, pursuant to a resolution passed by the Village Council on December 8, 1969, Banister Engineering Company has prepared plans and specifications for Sanitary Sewer Improvement No. 14 and has presented such plans and specifications to the Council for approval. NOW, THEREFORE, BE IT RESOLVED BY THE VILLAGE COUNCIL OF ARDEN HILLS, MINNESOTA: 1. Such plans and specifications, copies of which are attached hereto, and made a part hereof, are hereby approved. ~ . '<It .. . 2.
