MINUTES OF REGULAR COUNCIL MEETING Village of Arden Hills Monday - June 8, 1970 - 8:00 p.m. Call to Order The meeting was 8:00 p.m. Roll Call Present: Mayor Henry J. Crepeau, Jr., Councilmen Stanley Olmen, John Hollanhorst, E. Gray Henderson and Ronald HerrIck. Absent: None. Also Present: Clerk Administrator LorraIne Stromquist, Attorney Vincent P. Courtney, Engineer Donald Lund, MaIntenance Supervisor Everett Beecher, Building Inspector Clay Kelley (9;30 p.m.) and Assistant Clerk, AdministratIon Dorothy Zehm. called to order by Mayor Henry J. Crepeau, Jr., at Approval of Minutes The minutes of the Regular Council Meeting of May 25, 1970, were approved as submitted. BUSINESS FROM THE FLOOR None. REPORT OF VillAGE ATTORNEY VINCENT P. COURTNEY Draft of Proposed Burnina Ordinance Attorney Courtney read In Its entirety AN ORDINANCE REPEALING ORDINANCE NO.8, ADOPTING BY REFERENCE AIR POLLUTION CONTROL REGULATION 8, AND PROHIBITING OPEN BURNING IN ARDEN HILLS, AND IMPOSING PENALTIES FOR VIOLATION. It was moved by Councilman John Hollenhorst and seconded by Councilman Ronald Herrick that the rules be waived and that the Council adopt the ordinance as read; motion carried unanImously. Attorney Courtney was requested to report the Council's action to the Director of Minnesota Pollution Control Agency, enclosing a copy of the ordinance, as adopted. Proposed Auto Lease Attorney Courtney reviewed the provisions of the lease agreement and advIsed the CouncIl to obtain a second quotation for comparison. The matter was re-referred to the Public Safety Committee and Attorney Courtney for evaluation. Philip Sampson Property Attorney Courtney reported that, according to the Ramsey County Treasurer, $24.65 was levied agaInst the described property for payment In 1970. He further reported that EngIneer Donald Lund advises that no part of the sanitary sewer project was allocated to this property and that $405.00 was assessed for the water project. It was moved byCounciiman Ronald Herrick and seconded by Counctlman Stanley Olmen that the Council pay the taxes and assessments due and payable on the property In 1970; to abate the balance of the water assessments payable in succeeding years; closing costs to be paid by the VIllage of Arden Hills. The motion was carried unanimously. Attorney Courtney was requested to advise Mr. Sampson's attorney of the Council's actIon. Sanitary Sewer ACQUisition of Sanitary Sewer Easement 12-12 and Sanltarv Sewer Easement l2-4 After discussion of the negotiations, It was moved by Councilman E. Gray Henderson that the Council approve the Earnest Money Contract, as submitted, seconded by Councilman Stanley Olmen; motIon carried unanimously. --. . Minutes of Regular Counci I Meeting June 8, 1970 Minnesota Plumbin~ Code Attorney Courtney read AN ORDINANCE ADOPTING BY REFERENCE THE MINNESOTA PLUMBING CODE AND PROVIDING PENALTIES FOR ViOLATION THE~EOF. It was moved by Councilman Ronald Herrick that the third reading be waived and that the Counci J adopt the ordinance as read; seconded by Councilman John Holtenhorst, motion carried unanimously. Clerk Administrator Lorraine Stromquist was asked to prepare the ordinance for publication. REPORT OF VILLAGE ENGINEER DONALD LUND Columbia Transit Request for Sanitary Sewer Engineer Donald Lund advised the Councl I that a rough construction cost estimate, made some time ago for the extension of the sewer line to serve the Columbia Transit property on County Road F, was In the amount of $5,600.00. After discussion, the Counci I requested Engineer Lund to prepare a formal report; requesting that he advise Columbia Transit that sewer can be provided to serve their property. Sanitary Sewer Improvement No. 14 Engineer Donald Lund presented three alternate plans for the routing of a portion of Sanitary Sewer Improvement No. 14. After discussion and review of the three alternate plans, the Council determined Plan C to be the most feasible, requesting Engineer Lund to proceed with Plan C, as presented. Valentine Park - Parking of Water Construction Equipment Counci Iman Ronald Herrick Inquired as to how long gravel and sand wi II be stock-pi led and construction equipment wi II be parked on Valentine Pal"k. Engineer Lund advised that no permission has been granted to the contractor for the use of this park, as far as he knows, but he assured the Council If permission Is granted for this purpose, It would be needed for just a few days. Councilman Herrick advised that this would not present a problem if the equipment wi II be moved in a few days. Count Road F Water Construction Com laint - Mrs. Galus Harmon Mrs. Galus Harmon, 16 I .est County Road F, reported that Northdale Construction Company is disturbing private property beyond the street rlght-ot-way line, taking down trees unnecessarily, and driving equipment onto private property to turn around. Engineer Lund advised the Counci i that he met with Mrs. Harmon and the contractor, Northdaie Construction Company, advising the contractor to stay on the street right-of-way. Mrs. Harmon stated that this order is not being obeyed. Attorney Courtney advised that the contractor should not trespass onto private p~operty, no easements have been obTained in this area. The matte~ was referred to Engineer Don Lund. REPORT OF BUilDING iNSPECTOR CLAY KELLEY An oral report was given by Building Inspector Clay Kelley, citing several areas of filling in the VI liege. A written report dated June 5, 1970 was submitted by Mr. Kelley for review by fhe Council. After discussion, It was determined by the Counci~ that all fill and grading applications be submitted to the Council for approval~ . -2- . Minutes of Regular Councl I Meeting June 8, 1970 It was moved by Councliman John Hollenhorst that the filling and grading permit applications and ordinances be referred to the Planning Commission for revIew; seconded by Counci Iman Ronald Herrick; motion carried unanimously. Building Inspector Clay Kelley submitted an application to the Counci 1 from Mr. George Indykiewicz, requesting permission to continue his mining and excavating of land on the north and south sides of Highway 96, west of Highway 10. The application was referred to the Planning Commission for recommendations to the Council. REPORT OF COUNCILMAN JOHN HOLLENHORST - Planning and Zoning Case No. 70-13, Albert J. Hei", Jr. - Special Use Permit It was moved by Councilman John Hollenhorst.that the Special Use Permit be approved as recommended by the Planning Commission on June 2, 1970; seconded by Counci Iman Stanley Olmen; motion carried unanimously. Case No. 70-19. Minnesota Baptist Conference - Special Use Permit After review of the proposal by Minnesota Baptist Conference repre- sentatives and Architect Roger Johnson. and discussion by the Council, it was moved by Councilman John Hollenhorst that the Special Use Permit be approved as recommended by the Planning Commission on June 2, 1970, subject to a resolution including the fol lowing pro- visions: I. The Council does not feel that the aforesaid use of said property wil I, in any way, detract from the suburban residential characteristics of the area. 2. It should in no way be anticipated that future buildings of a commercial nature will be allowed along County Road E2. 3. If the property or building, subject to said Special Use Permit. should be sold In the future it shalt be sold only to another institutional or church affiliated group, with the provision that the Village Council review and approve the matter before any such safe of said property is made. Council action was tabled until the resolution is prepared for Councl I review on June 29, 1970. Case No. 68-12, W. C. Reeves - Special USe Permit Councilman John Hollenhorst reYlewed the proposal for the Councl I and moved that the Special Use Permit be approved, as recommended by the Planning Commission, in accordance with the revised plans presented on June 2, 1970; seconded by Councilman E. Gray Henderson; motion carried unanimously. Case No. 70-22. Hamms Brewlnq Company - SpeCial Use Permit Counci lman John Ho! lenhorst reported that a Public Hearing has been scheduled by the Planning Commission on July 7, 1970 re the outside gas tank on the Hamms Brewing Company site at 1300 Gray Fox Road. Ordinance No. 99, Service Station Proposed Amendment Councilman Hollenhorst advised the Counc~1 that the Planning Commission recommends that the present zoning be retained. Garage Door Height Ordinance Counci lman Hollenhorst advised the Council of the Planning Commission's recommendation of an eight foot (8 ft.) garage door height !Imitation in residential areas. The matter was referred to Attorney Courtney to prepare the ordinance draft. Landscape Plans Pending Completion: Case No. 69-1, Advanced Design Laborator~ The Counci I approved the fandscape plans, dated June 2, !970, as . recommended, by the Planning Commission. -3- . Minutes of Regular Counci I Meeting June 8, 1970 Case No. 66-16, Proto Sheet Metal Company The metter was referred to Attorney Courtney and Clay Kelley to enforce installation of landscaping at the Proto Sheet Metal Company site in accordance with approved landscape plans. Village Properties: I. Village Hail - The Council requested EngIneer Don Lund to up- date the landscape plans and prepare a cost estimate for Council review. 2. Water Tower - Engineer Don Lund and Public Works Supervisor Everett Beecher were requested to determine responsibility for the overflow and leakage of the water tower and consequent damage. to the landscaping of the water tower site. The site is to be seeded or sodded and maintaIned. 3. Booster Station - The Council requested that the property be graded and seeded or SOdded; Engineer Lund to prepare plans and cost estimate to Include driveway, and submit for bids. REPORT OF COUNC I LMAN RONALD I-lERR I CK - Parks and Recreat I on and Human RI ghts Valentine Park Improvement. Trench Project Matter tabled until June 29, 1970 Council meeting. Parks and Recreation Committee Appointment It was moved by Councilman Ronald Herrick and seconded by Councilman John Hollenhorst that the Council approve the appointment of Phillipa Lindquist to the Parks and'Recreation Committee; motion carried unanimously. Ingerson Park - House Destruction Councilman Herrick reported that the Parks and Recreation Committee recommends that the house on the Ingerson Park site be destroyed. The matter was referred to Attorney Courtney and Fire Chief Harry Ehlers to arrange for burning of the house. REPORT OF COUNCILMAN E. GRAY HENDERSON - Finance and Municipal Lands and Bu i I dings Census Report Clerk Administrator Lorraine Stromquist advised the Council ot a verbal report she received from Mrs. Freeman,Census Bureau, advising that Arde~ Hills now has a population of 5,662. After receipt of a written report, verifying the population figure as quoted, Clerk AdminIstrator Lorraine Stromquist was asked to request Attorney Courtney to proceed with the land transfer with New Brighton. CREPEAU, JR. - General Government and Public Safety Appointment of Legal Newspaper The appointment of the lege! newspaper for July I, through December 31, 1970 was tabled unti i the June 29, 1970 Counci I meeting. Clerk Administrator Lorraine Stromquist was requested -ro obtain circulation figures from the New Brighton Bulletin. ~msey County League Legislative Committee - Appointment of Representative Counci Iman Ronald Herrick and Mayor Henry J. Crepeau, Jr. wi II re- present Arden Hills at the Ramsey County League Legislative Committee meetings; daytime meetings by Councilman Herrick and evening meetings by Mayor Crepeau. . -4- . , .
