MINUTES OF THE REGULAR COUNCiL MEETING ViLLAGE OF ARDEN HILLS Monday - April 13, 1970 - 8:00 p.m. Call to Order and Rol I Call Mayor Crepeau called the-meetlng to order at 8:08 p.m. Present: Mayor Crepeau, Councilmen Olmen, Hollenhorst, Henderson and Herrick Absent: None Also Present: Clerk Administrator Lorraine Stromquist, Treasurer Worth G. Read, Attorney Vincent p. Courtney, Engineer Donald Lund, Building Inspector Clay Kelley, Maintenance Supervisor Everett Beecher and Deputy Clerk Florence M. Honan Approval of Minutes The Minutes of the Regular Council Meeting of March 30, 1970, were approved as amended. BUSINESS FROM THE FLOOR None. REPORT OF ATTORNEY VINCENT P. COURTNEY Public Works Bulldln~ Site Matter . Attorney Courtney's two letters, dated April 7 and April 13, 1970, were reviewed; copies of the April 7 letter were sent earlier to the Public Works and Finance Committees, Council members and also to Mr. Membrez, the realtor. Attorney Courtney had also prepared an earnest money contract, which was satisfactory to the seller with a few changes; however, he advised that he prefers the option approach on the matter. After considerable discussion, Councilman Olmen moved that Attorney Courtney be authorized to obtain an option contract until October 1970, at a minimum cost. After further discussion, Councilman Olmen withdrew the motion. Councilman Hollenhorst moved that the matter be tabled until the next Council meeting; seconded by Councilman Herrick; motion carried unanimously. Council requested Councilmen Herrick and Henderson to review material on the subject from the Public Works Committee; to obtain any ad- ditional pertinent Information and also to study other possible solutions to the maintenance needs; a report Is to be submitted at the next Council meeting. Ramsey County Ditch No. 12, Cost Apportionment Attorney Courtney reported that Engineer Lund's report of March 12, 1970, was referred to Shorevlew and Ramsey County. As suggested by Attorney Courtney, the Council requested the Clerk Administrator to arrange a meeting of engineering and administrative personnel during the week of April 20, between Arden Hills, Shorevlew and the Ramsey County Engineer's office. Proposed Revlsed Water Rate Ordinance Attorney Courtney reported that the draft of an ordinance revising Ordinance No. 103 and Its two amendments (nos. III and 119) has not been prepared as explained In his letter, dated April 13, 1970, which he reviewed with the Council. He will pursue the matter and report again to the Council at the next meeting. Proposed Pollution and BurnlnQ Control Ordinance Councilman Hollenhorst moved, seconded by Councilman Herr~ck, that "AN ORDINANCE REPEALING ORDINANCE NO.8, PROHIBITl.NG OUTSIDE BURNING IN THE VILLAGE EXCEPT AS PROVIDED HEREIN, AND IMPOSING PENALTIES FOR VIOLATION" be Introduced by title; motion carried unanimously. --. , { , . L ,", ~. . Minutes of Regular Council Meeting Apri I ~ 3, '970 The proposed ordinance was referred to the Public Safety Com- mittee. Clerk Administrator submitted State Pollution Control Agency material to Attorney Courtney, which, when returned, wi II be referred to the Public Safety Committee. Ordinance Drafts - Service Stations, Off Street Parking and Underground Utilities The Planning Commission recommends approval of the proposed service station ordinance, off street parking in resldentiai areas ordinance and the underground uti Ilties ordinance, subject to the approval of Attorney Courtney; ordinance drafts referred to Attorney Courtney. Proposed Amendment to Ordinance No. 95, Planning Co~mlsslon Alternates The Planning Commission's request to modify Ordinance No. 95 to permit the first alternate to vote when Bess than nine members are present was referred to Attorney Courtney. Continental 01 I Company The Continental 011 Company subject was tabled at their request. REPORT OF ENGINEER DONALD LUND Metro Sewer Board Request Engineer Lund informed the Council that the Metro Sewer Board has requested a set, In triplicate, of the sewer improvements now being constructed and also a copy of the Village's master sewer plan; If the master plan Is approved by the Board, It prob- ably will not be necessary to submit portion of the pian to them. The Council concurred with his suggestion to send sewer plans as constructed In addition to the proposed plans. Engineering Rate Agreement, General Services Engineer Lund submitted a written proposal, as attached. REPORT OF TREASURER WORTH G. READ Fi nances Mr. Read reported that money wil! be ava! lable to meet contractors' estimates as determined by Engineer Lund's last cost estimate report. REPORT OF BUILDING INSPECTOR CLAY KELLEY Northern States Power Company Matters Mr. Kelley reported that the appearance of the premises at the substation on Old Highway 10 meets Village specifications at the present time. Mr. Kelley recommended approval of the building plans for the proposed control house. REPORT OF COUNCILMAN JOHN HOLLENHORST - Planning and Zoning Case No. 70-1. Northern States Power Company. Control House Building Permit Councilman Ho!lenhorst moved, seconded by Councilman HerriCk, ap- proval of the Issuance of the building permit for the construction of a control house at 4100 North Fernwood Avenue, subject to the posting of the $5,000 landscape bond; motion carried unanimously. Street Light. Dellvlew and Glenvlew Avenues The Councl I agreed with Mr. Nick Dreis' recommendation not to re- move this light until the expiration of the present contract and, at that time, to replace It with a mercury vapor type light. Mr. Dreis wi II submit a report to Mrs. Stromquist prior to an agreement. . -2- , . Minutes of Regular Council Meeting Apri I D, t910 Case No. 69-34, Doo!-2j Ho~~ The Planning Commission recommended denial of this request to construct a rehabi litation center for reasons outlined in their minutes of Aprl I 7, ~970; however, the Counci I agreed with Counc 1 I ma.n Ho II enhors t' s sugges t i on to give Reverend Hartmark, the applicant, sufficient time to clarify the matters In a written report. Referred to Mrs. Stromquist. Case Nos.70-5C and 70-11, Continental 01 I Company Councilman Hollenhorst moved, seconded by Councilman Oimen, that the special use permit and variance requests of the Continental 01 I Company be tab Oed until the April 27. 1970, Counc! I meeti ng, as requested by Continental 011 Company In their letter, dated Apri I ~3, 1970; motion carried unanimously. Councilman Hollenhorst advised the COuncl I that the Planning CommiSSion had recommended denial. Case No. 70-6, David H. Carlson Councilman Hollenhorst moved approval of David Carlson's request for a five foot sideyard setback variance to allow the construction of a double garage at 3136 Rldgewood Road; seconded by Councilman Herrick; motion carried unanimously. Case No. 70-8. Harkins G06f Tees Councilman Hol!enhors~ moved, seconded by Councilman Olmen, ap- proval of Mr. Harold Kestner's request to al low construction of a 20 x 22 feet addition to the present building for use as an office; motion carried unanimously. ~ No. 69-23, St. Paul Book end Stationery Councilman Hollenhorst moved, seconded by Councilman Henderson, that the amended landscape plans, dated April 7, 1970, for the St. Pau I BOOk and Stat i onery, be app roved and the per for'mance bond be transferred to cover the amended plans; motion carried unanimously. Highway 5i, Preliminary Layout Plans The Councl I had received caples of the sub-committee's report regarding this preliminary plan by the Minnesota Highway Depart- ment for an Interchange at Highway 51 and Snelling Avenue. The Committee recommended to the Highway Department that they consider locating the proposed interchange at Lydia and Snelling Avenues. The Councl I agreed with Councilman Herrick's suggestion that the Council send a letter to Congressman Kerth, Senator Ashbach and Representative Andersen to Inform them of the Council's fee!lngs on the matter. Councilman HoGlenhorst wi Ii submit a proposed le'tter to Mrs. Stromquist. The Council referred the plans to the Public Works and Public Safety Committees. Pro~erty Valuat!on St~ Councilman Hoilenhorst advised that this Committee hes prepared a property valuation report which Treasurer Read will give to Mr. (rnest R. We~haven, Ramsey County Assessor. REPORT OF COUNCMLMAN STAN OLMEN - Public Works Public Works Committee M~etlnQ CounCilman O~men reported that the Committee met April 6, 1970: the minutes are not available at this time. The Committee recom- mends that if the Councl I approves the extension of Lake Lane, It be constructed to meet Village street standards. Employment Termination, P!mela Calander Councilman HerrIck moved, seconded by Councilman Henderson, ap- prClval of the resignation of Pamela Calander, effective April I, 1970; motion carried unanimously. Committee Mailing Lists Councilman Herrick informed the Councl I that he Is working On streamlining lists for Village reports and minutes and requested recommendations from the other Councilmen.
