Crepeau, Jr. Roll Call Present: Mayor Henry J. Crepeau, Jr., Councilmen Olmen, Hoilenhorst, Henderson and Herrick Absent: None Also Present: Planning Commission Chairman Larry McGough, Fire Chief Harry Ehlers, Clerk Administrator Lorraine Stromquist, Treasurer Worth G. Read, Attorney Vincent P. Courtney, Engineer Donald Lund, Public Works Supervisor Everett Beecher, and Assistant Clerk, Administration Dorothy Zehm Ap~roval of Minutes The Minutes of the Regular Council Meeting of January 26, 1970 were approved as presented. Fire Chief Harry Ehlers reported that the Pollution Control Commission met with three of the garbage and rubbish haulers, presently licensed in the Vll-lage, advising that they definitely will be able to handle a "complete pick-up" service for Arden Hills - garbage, rubbish, leaves, grass clippings, etc. He explained that this service would not, of course, Include the removal of old refrigerators, building materials, etc. These Items would be contracted for seperately, as ~hey are under the present system. Mr. Ehlers explained that: 1. landfill problems are anticipated In the future, as present areas are filled, probably causing an Increase In rates to compensate for additional travel expense. 2. a system of "liners" will probably be instigated to alleviate the additional haul ing. 3. curb pick-up of bags of leaves and grass clippings may be requested, but curb pick-up would not be required for garbage and other trash cans. Minnesota Fire Code Mr. Ehlers recommended that Arden Hills consider the eventual appointment of a FIre Marshall and the probable future adoption of the Minnesota Fire Code. The Council referred the fire code to the Planning Commission for study and recommendations to the Counc II. REPORT OF VILLAGE ATTORNEY VINCENT P. COURTNEY Acquisition of Tax-Forfeited land A Resolution Autll.or"izing A..QE.' ication By The _Vi Ilage Of Arden Hills For Conveyance or Ta~-Forfelted Lands, and a Resolution Re Tax- Forfeited Lands, certifying the c~assificatlon of the land as non-conservation land and authorizing tiling of a certified copy of the Resolution with the Office of the Land Commissioner, were read by Attorney Courtney. Councilman Hollenhorst moved approval of both resolutions, authorizing execution by the Mayor and Clerk Administrator; motion was seconded by Counci Iman Herrick and carried unanimously_ .- ....~ ~.~ ~~ . Regular Cou~cil Meeting Minutes - 2 - February 9, 1970 Clerk Administrator was requested to obtain the necessary number of forms to be completed and filed with the Office of Land Commissioner; attaching a certificate, signed by the Clerk Administrator, to each copy of the Resolution. Benta! Agreement - C & S Manufacturing Company Attorney Courtney read his draft, dated 2/9/70, of an agreement re leasing C & S property at southeast corner of County Road 0 and Cleveland, Rosevll"e. It was moved by Councilman Olmen that the Council approve the agreement as presented, motion was seconded by Councilman Henderson and carried unanimously. The Council requested that the Public Works Committee determine, at their next meeting, the period of time the building will be needed and submit Its recommendation to the Council on February 23, 1970. New Brighton - Arden Hills Property Exchange Agreement Attorney Courtney read his draft of an Aqre~ment Between Vlllaqes 9f Arden HII Is and N~w Brighton Re Proposed Prop~rty Exchange, a copy of which was sent to Mr. Robert Schaefer, Village Manager of New Brighton. Councilman Herrick moved that the Council accept the agreement, as drafted by Attorney Courtney; motion was seconded by Councilman Hollenhorst and carried unanimously. Clerk Admln!strator Lorraine Stromquist was requested to notify Mr. Schaefer of the agreement approval by the Arden Hills Council for possible consideration by the New Brighton Council on February 10. League of Women Voters Ha~pbook Attorney Courtney advised that, after review of the "League's" 1964 edition of the Handbook, he has determined that If the 1970 edition is basad on this foremat, the Village could authorize the expenditure, up to 5200.00, of the cost of mailing by actually mai ling the books from the Village office, but a donation cannot be authorized to the League of Women Voters to help defray costs of publication of the handbook. It was moved by Councilman Hollenhorst that the Council authorize the cost of mailing the handbooks, up to 5200.00, after review and approval of the handbook by the Council; requesting that Attorney Courtney prepare the resolution; motion was seconded by Counci Iman Herrick and carried unanimously. Clerk Administrator Lorraine Stromquist was requested to obtain a "bu'~ mailing permit" for the Village to be used for this and subsequent Village mailings. Attorney Vincent Courtney advised the Council of ' the various Minnesota Statute provisions re the Lake Region Hockey Association lighting request and, after some discussion, Councilman Herrick reouested that the matter be tabled untli he can talk with re~resentatlves of the Lake Region Hockey Association, after which he wiil contact Attorney Courtney. REPORT OF ENGINEER DONALD LUND Sanlta~Sewer Improvement 13 - Assessment Re Alternate Routing of ?anltary Sewer Line Engineer Donald Lund advised the Council ,of correspondence from Mr. William A. Feyereisen, dated February 9, 1970, requesting preparation of a preliminary assessment for both routlngs of the sewer line, Offering a waiver of trespass when the best location of thasowe. line Is determined. Attorney Courtney advised that . . . , . . . Regular Counci I Meeting Minutes - 3 - February 9, 1970 assessments are based on the service to the property, either on an acreage basis or front foot basis, according to ordinance. Mr. Lund advised that the contractor will be ready to work In this area very soon; so the routing should be determined. Because the re-routlng of the line wil I benefit the property owners. and increase the construction cost, Mr. Lund was re- quested to explain this to the property owners, requesting that they pay the cost of re-routing the line, granting a free easement to the Village. instead of a waiver of trespass. County Ditch No. 12 Plans Engineer Lund advised that the plans are not ready for tonight's meeting, but will be mailed as soon as they are available. Discussion of the plans was postponed until the February 23rd Council meeting. . Preliminary Layout Plans No.6 - Hiway at From Brooks Avenue to Hamline Avenue Engineer Don Lund presented preliminary plans and resolutions relating to the proposed location and construction of Highway 51 from Brooks Avenue in Rosevllle to Hamllne Avenue in Arden Hills. After a brief review of the plans by the Council. the plans were referred to the Planning Commission for study and Its recommenda- tions to the Council, requesting that Mr. McFadden be Invited to the Planning Commission meeting to explain the proposed plans. Sewaqe Meter Reactivation Engineer Lund advised that the sewage meters between Rosevllle and Arden Hills have been reactivated and are functioning properly; consequently Roseville billings will be based on actual flowage from February 2, 1970. the date they were re-actlvated. REPORT OF COUNCILMAN HOLLENHORST Report of Planning ComrnlssL~n Meeting - Chairman Larry McGouqh Case 70-3, Lexington Avenue Improvement Proposal Mr. McGough advIsed that the Planning Commission recommends approval of the proposal as presented by Mr. Floyd Snyker, dated 2/2/70. Councilman Henderson moved that the Council approve the pre- liminary plans dated February 2. 1970. as presented; subject to review of final pians In conjunction with State Plans for the intersection of 694 and Lexington Avenue, before con- struction; motion was seconded by Councilman Herrick and carried unanimously. Case 70-2, Variances A, .B and C Mr. McGough reviewed the Board of Appeals' recommendations on the three variances, in which they recommended approving variances A, the oversized garage and C, the second driveway to the property; denying variance B. parking of the '-ton truck. He advised that the Planning Commission recommends denial of all three variances. It was moved by Councilman Hollenhorst that the Council concur with the Planning Commission's recommendation to deny all three variances; the motion was seconded by Councilman Henderson and carried unanimously. Fill and GradlnR Mr. McGough advi~ed that 1. the Planning Commission requests that It be determined whether natural drainage Is being obstructed by the filling of the pond on the west side of Highway 10. south of the Soo Lind Railroad tracks. before a permit for fill Is Issued. and 2. that all filled areas be graded and covered with top soli. . Regular Council Meeting Minutes - 4 - February 9, 1970 Fill and grading violations were referred to the Poi Ice Department and Building Inspector Clay Kel ley to coordinate thelr efforts to correct all landflllln9 violations. The Administrative Office, Building Inspector and Pollee Department were requested to keep each other advised of areas being filled. Fisher Construction Compa!lY. - Request for Village Areas Needing Fill Clerk Administrator Lorraine Stromquist reported to the Council that she received a telephone request from Fisher Construction Company on February 9, advising that they are looking for low areas in which to dump landfill material, asking If Arden Hills Is Interested in 11 II ing any low areas. Matter was referred to Parks and Recreation to determine if the Park areas require fll I material. . Uniform Building Code The matter of adoption of a revised building code for Arden Hills was referred to the Planning Commission to study the 1970 editions of the Minnesota and Uniform Building Codes and submit Its recom- mendations to the Council. REPORT OF COUNCiLMAN RONALD HERRICK Parks and Recreation Committee Councilman Herrick advIsed that the Parks and Recreation Committee will hold Its next meeting on Tuesday, February 17. Human Riqhts Commission Councilman Herrick advised that the Human Rights Commission held Its first meeting of 1970 on February 2nd and has scheduled an additional February 18th meeting. He said he has two pieces of literature, "Open Housing - Fact or Fiction" and "What the White Woman Can Do" for distribution. No Council action to be taken at tonight's meeting. REPORT OF COUNCILMAN E. GRAY HENDERSON Councilman Henderson advised that the preliminary Capital Improvement and Debt Study for the Vii lage of Arden Hills has been comp'eted and received from Peterson and Popovich and will be studied by the Finance Committee on Thursday, February 12th. Mr. Henderson also advised that he is working on the operating expenses of the Watsr Util ity Fund, which he anticipates wil I be ready for study at that meeting also. REPORT OF COUNCILMAN STANLEY OLMEN Councilman Olmenadvised the Council that the Public Works Committee wll I hold its next meeting on Wednesday, February 11~h. No report at this time. Mr. Everett Beecher, Public Works Supervisor, advised that the new truck has arrived and is in fine working condition except fo~ a few minor repairs w~ich will be taken car of as soon as parts are avatlable. REPORT OF MAYOR HENRY J. CREPEAU, JR. fulpointment 0'1 Vlllaqe Forester Mayor Crepeau recommended appointment of Councilman Ronald HerrIck as the Village Forester for 1970. Councilman Hollenhorst moved the appointment be approved as recommended, seconded by Councilman Henderson, carried unanimously. Metropcl itan.Sectlon MeetLllL- February 19, 1970 The Council requested that Fire Chief Harry Ehlers be requested to attend this meeting, at 8:00 p.m., at the Richfield City Hal I, representing Arden HII is; anyone else wishing to attend was also urged to do so. . ~ ' ..... . Regular Counci I Meeting Minutes .. 5 - February 9, 1970 Leased 1969 Ford Station Wa~ Mayor Crepeau advised that this wagon, now leased by the Arden Hills Pol ice Department, can bo purchased for $2161.00. The matter w~s referred to the Public Safety Committee for its recommendations to the Council. REPORT OF CLERK ADMINISTRATOR LORRAINE STROMQUIST N.S.P. Adjusted Rate Pro~ram Clerk Administrator Lorraine Stromquist advised that a letter, dated January 28, 1970, regarding adjusted electric power rates has been received, and copies made for each Councilman. The matter was referred to the Public Works Committee for its report to the Council. Copies of past correspondence re this matter were requested to be sent to Councilman J. Hollenhorst and the Public Works Committee by the Clerk Administrator. ~2!l1onmant of Assessm~nt Resolution - Sanitary Sewer lmorovements 3 and 7 Clerk Administrator Lorraine Stromquist advised that the resolu- tions appear to be In order and recommended approval by the Council as submitted. It was moved by Councilman Henderson that the Res~utlons ReJatln~to Apport!on~ent of Assessments RelatinQ to Sanitary Sewer Improvements 3 and 7 be approved as recommended; seconded by Councilman Hollenhorst; motion carried unanimously. ~taurant License Renew~i Application - Civil Defense Training Center Councilman Hollenhorst moved that the Council approve the renewal of the Civil Defense Training Center license to operate a restaurant; seconded by Councilman Herrick and carried unanimously. Outstanding Licenses _~970 Vend I nq Mach i ne and S i~.!L Licenses It was moved by Councilman Herrick that the outstanding vending machine and sign licenses be referred to the Police Oepartment, to order removal of machines or signs or compliance with the licensing regulations; motion was seconded by Councilman Hollenhorst and carried unanlmous~y. The Council advised Clerk Administrator Stromquist that, until further notice, this wi I I be the standard order of procedure, If I icenses are not obtained by February 1st each year. Q2.a. L i cense~ The Council requested that a follow-up letter, and another application be sent to those who have not compIled with the dog licensing requirements, asking that they advise if they still have a dog, and I t so, to I icense it now. The doo license ordinance was referred to the Ordinance Review Committee for possible amendment to include a penalty clause after February 1st and also to study the reasoning for the higher lice~se fee for female dogs. Ordinance Review Committee Clark Administrator Lorraine Stromquist advised that the Ordinance Review Committee has set the 1st Thursday of each month as Its regular meeting date, and are currently studying the Plumbing Code. 1970 Census Seminar Clerk Administrator Stromquist advised the Council of a forth- coming Metropolitan Council meeting to be held on March 13, 1970 at the St. Paul Hotel - 8:00 a.m. until 4:00 p.m. to advise of uses which can be made of census figures over the next ten years. . ~ . Dorothy Zehm. requesting they report information from the meeting to the Finance Committee. Anti Crllf3Funds Mrs. Stromquist advised she had received a letter. In answer to her latter to Mr. Barr~tte re funds for crime control and prevention, and had placed a call to Mr. Westerlund in an effort to determine procedures to be followed in applying for funds. Mrs. Stromquist was requested to pursue the matter and schedule a meeting with Mr. Barr~tte or Mr. Westerlund and the Council to explain how to make appl1cation for funds and what mayor may not be included. ~diournment The meeting adjourned at 10:29 p.m. S Lorraine Stromquist Clerk Administrator pee .
