Approved: January 8, 2025 CITY OF ARDEN HILLS, MINNESOTA PLANNING COMMISSION WEDNESDAY, DECEMBER 4, 2024 6:30 P.M. - ARDEN HILLS CITY HALL CALL TO ORDER/ROLL CALL Pursuant to due call and notice thereof, Chair Kurtis Weber called to order the regular Planning Commission meeting at 6:30 p.m. ROLL CALL Present were: Chair Kurtis Weber, Commissioners Brad Bjorklund, Shelley Blilie, Joshua Collins, Stephen Erler, Arlene Mitchell, and Jonathan Wicklund. Absent: None. Also present were: Interim City Administrator Jessica Jagoe, Consultant Planner T.J. Hofer, and Councilmember Emily Rousseau. APPROVAL OF AGENDA – DECEMBER 4, 2024 Commissioner Erler moved, seconded by Commissioner Bjorklund, to approve the December 4, 2024, agenda as presented. The motion carried unanimously (7-0). APPROVAL OF MINUTES November 6, 2024 – Planning Commission Regular Meeting Commissioner Wicklund moved, seconded by Commissioner Bjorklund, to approve the November 6, 2024, Planning Commission Regular Meeting as presented. The motion carried unanimously (7-0). PLANNING CASES A. Planning Case 24-018 – 1700 Highway 96 W. – Master and Final Planned Unit Development, Final Plat, Site Plan Review, Conditional Use Permit, and Easement Vacation – Public Hearing Consultant Planner Hofer stated the Applicant has submitted a land use application for a Master Planned Unit Development (PUD), Final Planned Unit Development, Conditional Use ARDEN HILLS PLANNING COMMISSION – December 4, 2024 2 Permit, Site Plan Review, Final Plat, and Easement Vacation to subdivide and develop an approximately 41.10 acre property that currently contains a place of worship at 1700 Highway 96 West. North Heights Lutheran Church currently owns the Subject Property and contains a single structure that acts as a House of Worship. The property currently has split zoning with a majority of the site zoned R-1 Single Family Residential District and the northwest of the parcel zoned B- 1 Limited Business District. The Subject Property is also within the Shoreland Overlay District based on its proximity to Round Lake. Consultant Planner Hofer reported the proposed changes to the site would subdivide the property into two conforming lots, to facilitate construction of a 162,819 square foot, 119-unit multiple family dwelling, and construct additional parking for the existing house of worship. The proposed PUD would be exclusive to the proposed Lot 1, Block 1. The Applicant made an application for Preliminary Plat and Rezoning on July 17, 2024. The Preliminary Plat and Rezoning (PC 24-015) was reviewed by the Planning Commission on August 7, 2024, and the City Council on September 11, 2024. The City Council approved the Preliminary Plat at the September meeting but tabled the Rezoning on based on the need to review the land use application concurrently with the rezoning request. The Preliminary Plat was approved with the following conditions: 1. The Applicant shall submit to the City a land use application for Final Plat within three (3) months after the date of approval of the Preliminary Plat 2. The Applicant shall work with the Rice Creek Watershed District to review future modifications to vacate existing drainage and utility easements as well as proposed newly dedicated drainage and utility easements prior to the submittal of the Final Plat application. Modifications and newly dedicated easements shall be to the satisfaction of RCWD and the City. Consultant Planner Hofer explained the three-month deadline for the submittal for the final plat based on the above condition was December 9, 2024. Based on this date, the City extended the review of the rezoning in PC 24-015 to November 12, 2024. The Applicant initially made an application for Master Planned Unit Development (PUD), Final Planned Unit Development, Conditional Use Permit (CUP), and Site Plan Review in October of 2024, but the application was deemed incomplete. The Applicant applied again on November 4, 2024, with the addition of an application for Final Plat and Easement Vacation, and the application was deemed complete. Due to the meeting schedule of the City, the Applicant has also submitted a waiver for their rights to a timely review as required by Minnesota State Statute §15.99, for the Final Plat and Rezoning applications, until January 13, 2025. The Subject Property has access from County Highway 96 to the north and Snelling Avenue North to the east. Properties around the parcel are zoned R-1 Single Family Residential District and POS Parks and Open Space District and are used for residential uses and houses of worship. Consultant Planner Hofer reviewed the history of the subject property, the Plan Evaluation and provided the Findings of Fact for review: 1. The property located at 1700 Highway 96 West is designated for High Density Residential uses on the 2040 Comprehensive Plan. 2. New building construction or site modification identified requires the submittal of a Site Plan Review application prior to construction. ARDEN HILLS PLANNING COMMISSION – December 4, 2024 3 3. For proposals for new construction, redevelopment of a site, and significant modifications to existing sites a PUD is required 4. The PUD process allows for flexibility within the City’s regulations through a negotiated process with a Developer. 5. The Applicant has proposed a Site Plan Review, Master and Final Planned Unit Development, Conditional Use Permit, Final Plat, and Vacation in order to construct a 119-unit age-restricted apartment. 6. The Applicant has proposed a Master and Final Planned Unit Development for the development of one approximate 162,819 square foot multiple family dwelling on the Subject Property. 7. The Applicant has proposed additional improvements to the proposed Lot 2, Block 1, to construct additional parking and install landscaping for the existing house of worship use. 8. The Master and Final Planned Unit Development generally conforms to the requirements of the City Zoning Code and design standards. 9. Where the plan is not in conformance with the City Code, the Applicant has requested flexibility. 10. Flexibility through the PUD process has been requested in the following areas: density, floor area ratio, and building height. 11. A public hearing for a Master Planned Unit Development, Final Planned Unit Development, and Conditional Use Permit request is required before the request can be brought before the City Council. Consultant Planner Hofer stated options for the application, including approval of Planning Case 24-018 for a Master Planned Unit Development, Final Planned Unit Development, Conditional Use Permit, Site Plan Review, Final Plat, and Easement Vacation for a Multiple Family Dwelling at 1700 Highway 96, based on the findings of fact and the submitted plans, as amended by the conditions in the December 4, 2024 Report to the Planning Commission: 1. The project shall be completed in accordance with the submitted plans as amended by the conditions of approval. Any significant changes to these plans, as determined by the Community Development Director, shall require review and approval by the Planning Commission and City Council. 2. The Conditional Use Permit and Master Planned Unit Development and Final Planned Unit Development shall expire one year from the date of City Council approval unless a building permit has been requested or a time extension has been granted by the City Council. The City Council may extend the expiration date of such approval upon written application by the person to whom the approval was granted. 3. A violation of any condition set forth in the permit shall be a violation of this Code and shall be cause for revocation of the permit. 4. Prior to the release of the Final Plat for recording, the Applicant shall enter into a Development Agreement. 5. The Final Plat shall be recorded prior to the issuance of a building permit. 6. A Master and Final PUD Development Agreement shall be prepared by the City Attorney and subject to City Council approval for the Development. The Master and Final PUD Development Agreement shall be fully executed prior to the issuance of building permits. Prior to the issuance of a building permit, a landscape financial security equal to 125% of the cost of the landscaping to be installed on the site shall be submitted. The Applicant must submit a detailed cost estimate for the landscaping so staff can determine the final ARDEN HILLS PLANNING COMMISSION – December 4, 2024 4 amount. Landscape financial security shall be held for two full growing seasons. For any landscaping that is not in accordance with the approved landscaping plan at the end of two growing seasons, the Developer shall replace the material to the satisfaction of the City before the guarantee is released. Where this is not done, the City, at its sole discretion, may use the proceeds of the performance guarantee to accomplish performance. 7. A Grading and Erosion permit shall be obtained from the city’s Engineering Division prior to commencing any grading, land disturbance or utility activities. The Applicant shall be responsible for obtaining any permits necessary from other agencies, including but not limited to, MPCA, Rice Creek Watershed District, MnDOT and Ramsey County (i.e., ROW or access) prior to the start of any site activities. 8. The final plans shall be subject to approval by the City Engineer, Building Official, and Fire Marshal prior to the issuance of a grading and erosion control permit and shall be consistent with the memorandum from the City Engineer. 9. Prior to issuance of a building permit, the final plans shall show markings and signage to identify access off the site onto County Highway 96 as “Left Turn Only” with signage showing “No Right Turn.” 10. Final landscaping plans shall be revised to relocated trees outside of any drainage and utility easements and shown with trees with a minimum caliper inch of 2.5 inches. 11. Final grading, drainage, utility, and site plans shall be subject to approval by the Public Works Director, City Engineer, and Community Development Director prior to the issuance of a grading and erosion control permit or other development permits. 12. Upon completion of grading and utility work on the site, a grading as-built and utility as- built shall be provided to the City for review. 13. Heavy duty silt fence and adequate erosion control around the entire construction site shall be required and maintained by the Developer during construction to ensure that sediment and storm water does not leave the project site. 14. The Applicant shall be responsible for protecting the proposed on-site storm sewer infrastructure and components and any existing storm sewer from exposure to any and all stormwater runoff, sediments and debris during all construction activities. Temporary stormwater facilities shall be installed to protect the quality aspect of the proposed and existing stormwater facilities prior to and during construction activities. Maintenance of any and all temporary stormwater facilities shall be the responsibility of the Applicant. 15. All light poles, including base, shall be a maximum of 25 feet in height and shall be shoebox style, downward directed, with high-pressure sodium lamps or LED and flush lenses. 16. All rooftop or ground mounted mechanical equipment shall be hidden from view with the same materials used on the building in accordance with City Code requirements. 17. A separate sign permit shall be required for all signs on the site. 18. Any future trash enclosures shall utilize gates and be constructed on three sides using the same materials and patterns used on the building. Locations shall be approved by the Planning Department. 19. The Applicant shall be financially responsible for all applicable water and sanitary charges. Rates applied shall be memorialized in the Development Agreement. 20. All disturbed boulevards shall be restored with sod. All areas of the site, where practical, shall be sodded or seeded and maintained. The property owner shall mow and maintain all site boulevards to the curb line of the public streets. ARDEN HILLS PLANNING COMMISSION – December 4, 2024 5 21. A right-of-way permit shall be required for work performed within the City and/or Ramsey County right-of-way. 22. The Applicant shall provide the City an executed copy of the shared access agreement with North Heights Lutheran Church for the Subject Property that shall be reviewed by the City Attorney and recorded as part of the Development Agreement. 23. All items identified in the November 20, 2024 PW/Engineering Division memo shall be addressed. All comments shall be adopted herein by reference. 24. The proposed structure shall conform to all other regulations in the City Code. Consultant Planner Hofer reviewed the options available to the Planning Commission on this matter: 1. Recommend Approval with Conditions 2. Recommend Approval as Submitted 3. Recommend Denial 4. Table Chair Weber opened the floor to Commissioner comments. Commissioner Blilie asked what was being considered by the Planning Commission, given the fact the City Council approved this project in September. Consultant Planner Hofer stated he could not speak for the City Council. Chair Weber requested staff to clarify what action was taken by the City Council in September. Consultant Planner Hofer explained the City Council approved the preliminary plat in September and the final plat was now before the Planning Commission for consideration. He recommended the Commission’s focus be on the flexibility requests within the PUD and CUP. Commissioner Collins stated it appears the City modified its perspective to allow for increased density in order to meet the goals within the comprehensive plan. He asked if the proposed deviation was to meet the comprehensive plan. Consultant Planner Hofer commented this was a difficult question to answer. He noted this area was not guided for residential use, however, this does not preclude the area from being developed into residential. He reported establishing additional housing units would not be inappropriate for a PUD for property guided High Density Residential. Commissioner Wicklund questioned if there was any flexibility in the park dedication fees. Consultant Planner Hofer stated residential dedication was based on the 10% of the estimated market value of a property. He indicated there was some discretion within the code that allows for this number to be flexible. Commissioner Wicklund inquired if the Planning Commission could change the $773,000 to a different number. ARDEN HILLS PLANNING COMMISSION – December 4, 2024 6 Consultant Planner Hofer stated this number was established within the fee ordinance. Commissioner Wicklund asked if the exit location for this project would be directly across from the spine road where there would be a traffic light. Consultant Planner Hofer reported this was the case. Chair Weber commented on the park dedication fee, noting the City has the authority to waive certain fees or change the number. Commissioner Erler questioned if the Commission should be considering the development given the fact the City Council has tabled action on the zoning of this property. Consultant Planner Hofer indicated there was not a procedural conflict at this time. He stated approval of this Planning Case would be contingent upon the rezoning. Commissioner Erler asked if it would be pertinent to add a condition to that affect. Consultant Planner Hofer stated this would be appropriate. Commissioner Erler requested further information on what a residential dedication was. Consultant Planner Hofer explained this was either land or a fee that was required of residential developers and has to do with the dedication of a reasonable portion of land for open space or other public use. He indicated this development was dedicating right of way along with drainage and utility easements. He reported cash in lieu could be offered by a developer for 10% of the property value. He stated the proposed property was valued at $22 million prior to the subdivision. Commissioner Erler indicated this would mean the developer was responsible for paying the City $2.2 million in dedication fees. Consultant Planner Hofer reported this was the case, but commented this may depend on if the subdivision for the property has paid park dedication in the past. He explained he did not believe park dedication had previously been collected. Further discussion ensued regarding the size of this property. Commissioner Bjorklund indicated this was a large housing project. He asked if the Commission was bound by the goals of the City as stated within the comprehensive plan. Interim City Administrator Jagoe commented on the housing goals within the comprehensive plan noting Commission should look to these as goals, but not strict adherence. She indicated the land use chapter should be considered for guidance of future land uses. Commissioner Bjorklund commented on the goals of the City within the housing chapter of the comprehensive plan. He reported one of the goals was to encourage the incorporation of affordable housing in new development. He reviewed the language within the comprehensive ARDEN HILLS PLANNING COMMISSION – December 4, 2024 7 plan that states Arden Hills needed more affordable housing units. He believed the City had a clear goal when it came to housing and he was of the opinion the City should be following this goals. He supported relaxing the dedication fees in order to receive more affordable housing units. He stated without the inclusion of any affordable housing, he may be voting against this entire project. Chair Weber stated he was not entirely supportive of this project, but he understood the City Council wanted to see it moving forward. He understood the City needed to work to achieve its affordable housing goals and recommended 20% of the units be affordable. He explained if the developer were to work towards this goal, he could support lowering or lessening some of the dedication fees. Chair Weber questioned if the south parking lot was connected to the church parking lot. Consultant Planner Hofer explained these two parking lots were connected. Chair Weber recommended a trail connection be provided by the developer in order to provide pedestrian access to the trail adjacent to this property. He asked if it was the applicant’s intent to have a left turn only onto Highway 96. Interim City Administrator Jagoe recommended the applicant speak to this further. Chair Weber asked if the additional church parking lot that was being built was required to meet minimum parking requirements. Consultant Planner Hofer stated the church needed additional parking based on the reduction that would occur for the multi-family dwelling project. He indicated the house of workshop currently has 866 parking stalls. He noted this number would be reduced if the multi-family project were to move forward. For this reason, the house of worship was proposing to construct a new parking lot with 76 parking stalls. He explained the site would then have 795 stalls where 774 were required. Chair Weber questioned why the house of worship would be constructing this additional parking lot. Roger Fink, Trident Development, stated he was a representative for North Heights Lutheran Church. He explained the parking allocation for the house of worship has always exceeded the code minimum. He indicated North Heights Lutheran Church holds worship services and a variety of other community events. He stated the church feels a need to preserve a portion of surplus parking given how a portion of parking would be lost to the multi-family development. Chair Weber asked why this project was being presented in the manner that it was. He stated he was concerned with the slow roll of this development and how it has been brought to the Commission for consideration in several different iterations. He reviewed comments from the developer stating they had told the City this project would come forward with all the pieces and conform to City Code. He indicated the proposed plans do not conform to City Code. He inquired if there had been an intent to conform to zoning code requirements. ARDEN HILLS PLANNING COMMISSION – December 4, 2024 8 Mr. Fink stated in one of the early worksession meetings with the City Council, he identified several potential flexibility areas, one was the floor area ratio (FAR) and the other was building height. He commented the density number was also being considered. He commented on the landscaping plan noting he would have to plant a great deal more plantings than he had originally thought. He indicated the building height could probably be brought into conformance. He stated the proposed building was at 38 feet when the City allows for 35 feet. He believed the three feet difference was reasonable given how building standards have changed and renters now want nine foot ceiling heights. He reported Arden Hills was quite unique in having an FAR in a residential district. He stated in order to reduce the FAR he would have to eliminate the proposed public space or amenities within the building. He indicated when it comes to density, this matter was addressed early on through the comprehensive plan amendment, which allowed for a flexibility to exceed 12 units per acre. He explained he would only be exceeding this by one or two units per acre. Chair Weber stated this may only be one or two units per acre, but ended up being 20+ units more for the entire development. Mr. Fink discussed how he exceeded many of the performance standards required by the City by having more open space than required by ordinance, the building had a smaller footprint, more parking, and the project had more landscaping and less impervious surface than was required. Chair Weber was of the opinion the City needed more affordable housing and asked if there was any opportunity to add affordable housing units to this development. Mr. Fink commented this was the first time this has come up. He indicated he had not addressed affordable housing. He reported typically affordable units came with some sort of assistance from the City. He stated he would need to know what an affordable unit means. Chair Weber stated this development was providing a unique opportunity to the City by providing residential housing on a property that does not pay property tax. He explained he would like to see affordable housing incorporated into this housing development and if finances were required from the City this would be a good investment for the City. Commissioner Wicklund asked where the proposed housing product sits on the expense side of construction. Mr. Fink reported the proposed units would have high quality construction and finishes and the building would have architectural appeal. He indicated he would not be building the highest quality building, but anticipated the units would be constructed above average. He believed his market rate rents would be comparable to the other rental units in the community. Commissioner Collins questioned what the rental rates would be. Mr. Fink estimated the rental rate ranges would be $1,900 to $3,000 per month depending on the size of the unit. Chair Weber asked if the developer had spoken with Ramsey County regarding coordination for the intersection. ARDEN HILLS PLANNING COMMISSION – December 4, 2024 9 Mr. Fink reported civil engineers have been in touch with Ramsey County to address right of way, access, the intersection and permits. Commissioner Bjorklund questioned why some of the trees within the landscaping plan were being planted on the church property. Mr. Fink explained he was required to plant more trees than would fit on the lot and for this reason, he was proposing to put surplus plantings on the church lot. He indicated the church supported the proposed placement for the plantings. Chair Weber indicated another way to address the planting needs would be to plant larger trees on the multi-family housing lot, instead of planting 2” trees on the subject property. Mr. Fink commented he would like to further investigate what size caliper trees were being proposed. Commissioner Collins addressed Attachment J and asked if the development intention has changed since the traffic study was completed. He stated he was surprised by the low trip generation from the proposed housing development. Mr. Fink reported an age restricted housing development was proposed which led to the low trip generation. Commissioner Mitchell inquired if the residential dedication was tied to an expense for the City. Consultant Planner Hofer stated the proposed fee was tied to utility improvements, such as streets, roads, etc. He commented if a CUP or PUD is required, the dedication payment can be determined as a result of the increased demand on park land or park improvements. He reported this meant the City had to consider how this development will impact demand for the public facilities in the community. Commissioner Mitchell discussed how part of affordable housing was to keep overall construction costs down. She anticipated if the dedication fees were lower, this would assist with providing more affordable housing units. She indicated this land has access to roads and parking. She hoped because these expenses do not apply that the City could keep the residential dedication lower in order to make the units more affordable. Consultant Planner Hofer stated it was relevant to consider minimum needs for parks, trails and wetlands for the subject development and what the City would be responsible for maintaining long-term. Chair Weber commented this also involves connection to and use of City utilities. Mr. Fink indicated the tabling by the City Council for the rezoning occurred because the Council was uncertain with how the project would move forward. He explained the City Council was apprehensive about the number of units that would be included in this project and for that reason, tabled the rezoning. ARDEN HILLS PLANNING COMMISSION – December 4, 2024 10 Chair Weber opened the public hearing at 8:03 p.m. Chair Weber invited anyone for or against the application to come forward and make comment. There being no comment Chair Weber closed the public hearing at 8:04 p.m. Councilmember Rousseau discussed the City’s fee schedule and asked when was the last time the City updated its park dedication fees. Interim City Administrator Jagoe reported this was last done in approx. 2015/2016. Chair Weber stated it would be useful to know if other cities have recently made changes or updates to their park or residential dedication fees. Commissioner Wicklund stated he was in favor of pushing this project forward. He indicated he was comfortable with the increased density, FAR and building height. He explained the value of the entire parcel was $22 million and the developer was proposing to purchase 10 of the 40 acres. He stated this would lead to a land dedication payment (at 15%) of $825,000. He suggested the Commission deal with the affordable housing piece as a separate motion or condition for approval. Interim City Administrator Jagoe commented on the City’s public use dedication and park development fees. She indicated the City could waive public use dedication fees and recommended the Commission discuss this matter further, but noted subsidizing the development for affordable housing would have to meet a “but for” test. She explained the developer should assess whether or not a fee waiver was necessary. Chair Weber stated if the Commission were to ask for affordable housing, could the Commission offer an amendment to waive fees or recommend the City negotiate as necessary in order to achieve affordable housing units. Interim City Administrator Jagoe reported if the Commission wants this brought forward, she recommended the developer communicate if this was something they would be seeking from the City. She explained the affordable housing request was a new add that staff had not prepared for. Chair Weber stated a lot of information would have to be gathered that may put this project in a table situation. Interim City Administrator Jagoe indicated this may be the case. She stated the Commission could make a recommendation on public use dedication but noted other reduction of fees or waivers should wait until the developer brings forward a request to ensure all criteria within the City’s public financing guidelines for affordable housing requirements were being met. Chair Weber stated the Commission could make a recommendation with respect to park dedication and land dedication and the City Council could take it from there. He explained if there was no agreement on affordable housing, this project may not happen in its current form. ARDEN HILLS PLANNING COMMISSION – December 4, 2024 11 Commissioner Bjorklund indicated he did not have any objections to the project, except he would like to recommend Condition 25 and that it read: The project will include an affordable housing component, with or without subsidies. Commissioner Erler stated in the past four years the City has added two multi-unit age restricted buildings or 211 market rate units. He indicated this development would raise this number to 330. He explained this was a 10% increase in the total number of residential units in the City. He commented his extra housing was a good thing in the tight housing market. However, he did regret that not one of these units would be available to low income seniors. He stated by comparison, both New Brighton and Roseville have added entire buildings of income adjusted rental units for seniors. His opinion that Arden Hills was part of the problem as the City has not made affordable housing a priority. He commented he could support the minor flexibilities that are being requested, but recommended this project not move forward without affordable units included. Commissioner Collins reported this project does not meet the comprehensive goals when it comes to affordable housing. He believed this was a pretty big miss. He stated he would like to see intentionality from the developer when it comes to affordable housing units, especially because this was a 55+ community. Commissioner Mitchell indicated she would support this project. She believed the variances the developer was requesting were reasonable. She commented further on the process that must be followed by developers in order to pursue State grant funding for affordable housing units. She believed the affordable housing discussion was being brought in late from the Commission for this project. She anticipated the developer would have to start this project over if affordable housing was required. She believed it would benefit the community to have more median priced rental housing available and noted this new housing could lead to more single family homes being on the market. She stated she would be voting to move this project forward. Chair Weber commented this was the Planning Commission’s first look at this project in the past three years. He indicated he has heard about the comprehensive plan and zoning changes, but noted this was the Commission’s first chance to provide input on the City’s affordable housing goals. He believed now was the chance to ask for affordable housing. He was of the opinion this was a must for this project, especially given the flexibilities that were being offered by the City. Interim City Administrator Jagoe explained the comprehensive plan amendment that allowed for the PUD process allows for a density bonus if through the PUD process, other performance criteria are met. She reported the criteria that needed to be met does not require the creation of affordable housing. She stated if the Commission feels the application has not met the criteria for a PUD to grant the flexibility for 13.9 units per acre, the applicant would be held to the 12 units per acre as allowed by city code. She indicated the Planning Commission did not have the option to extend the review period any further because the City was up against the January 13, 2025 15.99 deadline. Commissioner Wicklund reported he was ready to make a motion. ARDEN HILLS PLANNING COMMISSION – December 4, 2024 12 Commissioner Bjorklund requested the developer speak if they would be willing to extending the application time period. Interim City Administrator Jagoe commented the 15.99 timelines are for the rezoning and the final plat and the City has no additional time to review these matters. She indicated the City may have an opportunity to extend the PUD review, but noted the City Council wanted to see the land use application align with the rezoning review. She stated it would be a challenge if only the PUD portion of this project were extended. She reiterated that the rezoning and final plat would have to be reviewed on January 13, 2025. Commissioner Bjorklund stated he would be voting against this project because of its abject nonconformance to the City’s comprehensive plan. Chair Weber agreed. Interim City Administrator Jagoe indicated the Planning Commission could recommend denial of the project for reasons it was not consistent with the goals of the comprehensive plan, or the Commission could put forth a recommendation for approval without flexibility in certain areas of the project. Commissioner Bjorklund stated he has been talking to a gentleman from North Heights Lutheran Church for years about this project and how low income housing should be a factor. In addition, he noted he spoke with the developer as well. Commissioner Collins reported the comprehensive plan was explicit when it came to low income housing and this was something that should be taken into consideration. He believed there was something missing from this development and noted he would be leaning towards not supporting this project. Commissioner Wicklund stated he appreciated the comments about the desire to follow the comprehensive plan, but it was his opinion this would do a disservice to an outside business that was coming into this situation. He reported casting this expectation on their business model near the end of the process was burdensome. He was of the opinion staff has heard the concerns of the Commission and as new developments come forward considerations will be made. He stated he would be supporting this project moving forward, with the understanding the Planning Commission was a recommending body to the City Council. Commissioner Collins indicated his difficulty with this was that this was an outside business and the affordable housing units could benefit the residents of Arden Hills. He questioned if this project should benefit the outside business or the residents of Arden Hills. Chair Weber stated this was going on year for of this project and he was of the opinion the developer had slow rolled this project intentionally. He explained he would not feel guilty about the applicant now being in a position for the manner in which this project was presented to the City. He commented on how the need for affordable housing has grown over the past two or three years. ARDEN HILLS PLANNING COMMISSION – December 4, 2024 13 Commissioner Blilie reported even if these units were not affordable, if seniors in the community moved to them, it would open up single family houses in Arden Hills. Chair Weber stated he understood this to be the case, but noted the existing senior rental units within the community were not full and he did not believe it was in the City’s best interest to build more of the same. Commissioner Collins explained if this building were to move forward, these types of developments would pull tenants from the surrounding communities as well. Chair Weber reported this was a tax exempt property that does not pay property taxes. He indicated the City could add an enormous amount of affordable housing to this site without impacting the City’s bottom line, and there would still be a net positive for the community. Mr. Fink stated he was not opposed to having affordable units on this property. He indicated when he brought forward concepts, the concept has explained the units were intended to be market rate. He explained he did not receive any push back from neighbors or the City Council on this concept. He asked that the Commission recommend approval of the project with a suggestion an affordable element be included. Chair Weber asked if Mr. Fink had experience with creating affordable rental units within his previous developments. Mr. Fink stated he did have experience noting these projects required TIF. Chair Weber was of the opinion the only feasible option for the Planning Commission was to recommend denial of this request with the intent to continue moving forward in order to work towards a viable product for the City. Commissioner Bjorklund stated there was a clear failure to comply with the City’s comprehensive plan. Commissioner Bjorklund moved and Commissioner Collins seconded a motion to recommend denial of Planning Case 24-018 for a Master Planned Unit Development, Final Planned Unit Development, Conditional Use Permit, Site Plan Review, Final Plat, and Easement Vacation for a Multiple Family Dwelling at 1700 Highway 96, based on the findings of fact and the submitted plans based on the fact the project fails to meet the goals within Section 7 of the City’s comprehensive plan and it fails to recognize policies implemented in Section 6. Commissioner Erler stated the Commission could deny on the basis of not accepting the flexibility requests on the grounds that they are not consistent with the comprehensive plan. Commissioner Collins reported this would be a denial based on the density and the Commission was not supporting the proposed density because the City’s comprehensive plan and affordable housing goals were not being met. ARDEN HILLS PLANNING COMMISSION – December 4, 2024 14 Interim City Administrator Jagoe indicated the PUD does not require affordable housing to be a part of the project. She stated the Planning Commission would have to be specific on where the PUD does not align with the goals of the comprehensive plan. She reiterated that the comprehensive plan does not require affordable housing. Consultant Planner Hofer explained the staff report included language regarding approval and denial and could be reviewed by the Commission for motion language. He stated that there are review criteria established in the zoning ordinance for CUPs and these standards were included in the staff report. Chair Weber stated the Commission would be making a recommendation for denial for the additional density, FAR and building height based on the lack of conformance to the comprehensive plan, based on orderly development of the neighborhood and City within the general purpose and intent of the zoning code and comprehensive plan for the City. He suggested this be added as a friendly amendment to the language within the motion. Chair Weber moved and Commissioner Collins seconded an amendment to the motion language to include the following: denial for the additional density, FAR and building height based on the lack of conformance to the comprehensive plan, based on orderly development of the neighborhood and City within the general purpose and intent of the zoning code and comprehensive plan for the City. Property Location: 4200 Round Lake Road Request: Planned Unit Development Amendment and Site Plan Review Requested Action Rick Ferraro (“The Applicant”) is requesting a Planned Unit Development Amendment and Site Plan Review to amend the Final Planned Unit Development Plan for 4200 Round Lake Road (“PUD Development Agreement”) to allow for flexibility from the required auxiliary sign standards for an existing approximately 250,000 square foot commercial building on the property at 4200 Round Lake Road (“Subject Property”). Background 1. Overview of Request Scannell Properties previously submitted a land use application for a Master Planned Unit Development, Conditional Use Permit, Site Plan Review, and Preliminary/Final Plat to develop the existing approximately 250,000 square foot office and warehouse building on the property at 4200 Round Lake Road. This application was approved, with conditions, with Resolution 2020- 045 on October 12, 2020. It was stated in the approvals that a separate sign permit would be required for all proposed signage and that all proposed signage shall meet the requirements of Sign District 6. Delkor Systems, Inc. previously submitted a land use application for a Planned Unit Development Amendment to allow flexibility from the City Code on wall signage. This application was approved, with conditions, with Planning Case 22-014 on August 3, 2022, by the City Council. The Subject Property is currently owned by Altus Properties, LLC., and the building is currently occupied by Delkor Systems, Inc. and Colder Products Company (CPC). Page 2 of 9 The PUD Development Agreement for Gateway Interstate (“PUD Development Agreement”) was approved on April 16, 2021. The Applicant is now asking to amend the PUD agreement to allow for an increase in the amount of sign area permitted and allow for flexibility of commercial text on the sign faces. The Applicant has provided a description in the submitted narrative Propose a sign adjustment for 3 Auxiliary directional signs to be installed on the property along Gateway Boulevard. We are requesting to 1) increase the sign area from 4.5 to 6 square feet and 2) flexibility to allow commercial text on each sign, to effectively direct traffic and maintain safety. Rendering of Proposed Signs – Northwest – Signs 4A and 4B Rendering of Proposed Sign – Southeast – Sign 4C Page 3 of 9 A Site Plan Review is required by the City Code for any Planned Unit Development Amendment, but no changes aside from the signs are proposed. This commercial corridor is accessible by way of Gateway Boulevard. This area is used by a number of small and large businesses for a variety of manufacturing, distribution, warehousing, and office uses. 2. History of the Subject Property The Subject Property was subdivided into two parcels, with the larger parcel developed in 2021 as a warehouse and wholesaling use, with associated non-warehouse uses, for an approximately 250,000 square foot principal structure. A site plan review was required for this development as the property had previously been vacant since 2006, when three lots were consolidated into one and the existing building was demolished. An additional site plan review was required in November 2021, approved as Resolution 2021-066, to expand the parking area on site. A Planned Unit Development Amendment for signage for the site was approved in August 2022, permitting an additional wall sign on the southwest elevation. Subject Property – Proposed Auxiliary Signs Approvals 1. Planned Unit Development Amendment Page 4 of 9 The site currently has a PUD that was approved with Resolution 2020-045. This PUD allowed for flexibility on the site and approved the warehouse uses. The flexibility approved with the PUD includes: • Flexibility from district provisions that require warehousing and wholesaling uses shall not exceed 75% of the building and office uses cannot occupy less than 25% of a project’s total floor area. • Flexibility to allow Lot 2 to be less than the required 5 acres. • Flexibility from the required street frontage of at least 100 feet and lot depth of at least 130 feet. • Flexibility from the required parking setback of 50 feet in the GB district. • Flexibility from the maximum building height of 35 feet in the GB district. • Flexibility for aesthetics to allow a combination of painted pre-cast, glass, architectural metal panels with concealed fasteners, and thin brick veneer. • Flexibility from minimum caliper inches to allow off-site tree planting or fee in lieu. • Flexibility from the requirement for a minimum of 10% of the total landscaped area to be covered with perennials and/or shrubberies. • Flexibility to install an additional wall sign on the southwest elevation where one sign was allowed in Sign District 6. A Planned Unit Development (PUD) is required for all new development and redevelopment in the GB District. Under the 2022 PUD Amendment, the Applicant was provided flexibility for signage standards. The proposal would provide additional flexibility from signage standards. The Applicant has provided details in the Proposed Sign Plan (Attachment E) which identifies where flexibility is requested. 2. Site Plan Review An application for a PUD Amendment requires Site Plan Review. No changes aside from the signs are proposed. Plan Evaluation Overview of Proposal The Applicant is proposing changes to signage on the Subject Property to add three auxiliary signs. Existing conditions for the site can be found in Attachment D. The Applicant states that the purpose of the request is to direct traffic and maintain safety through clear signage for direction on the site, which will not impact the surrounding area. In addition to the review required for the PUD Amendment, there are two sections of the City Code that establish standards for signs within the City Chapter 12, Sign Code and Appendix A, Descriptions of Various Land Use Procedures. Chapter 12, Sign Code 1. Auxiliary Signs – Flexibility Requested The original PUD for the Subject Property did not include a request for flexibility on signage. A condition of the initial approval stated that all proposed signage shall meet the requirements of Sign District 6. The Subject Property has existing flexibility as part of the previous sign plan from Page 5 of 9 the requirements for location of wall signs, permitting an additional wall sign on the southwest elevation. The Applicant is seeking flexibility for the size of auxiliary signage and to allow commercial text on the sign faces. Auxiliary signs are defined as (emphasis added): Auxiliary sign. A sign that provides direction for internal circulation, parking or entry, restrictions on parking, security warnings, or other similar primarily noncommercial signs that are directed at people that are entering, exiting, or on a particular property. Auxiliary signs do not include outdoor advertising signs. Commercial Message The city has historically prohibited commercial messages on auxiliary signs. A commercial message is defined as: Commercial message sign. Any message which identifies a business or product or promotes the sale of any product or service. The inclusion of the business’ names, instead of an identifier such as “Suite 1” and “Suite 2” creates a primarily commercial sign. The Applicant is proposing two auxiliary signs on the northwest entrances of the site and an auxiliary sign on the southeast entrance of the site. Under the proposed signage plan, the Applicants are requesting to have the tenants of the building business names on the auxiliary sign. Sign Size Flexibility is not required for the size of the proposed auxiliary signs, but previously 4.5 square feet were reviewed. Properties in Sign District 6 are allowed auxiliary signs up to six square feet. The proposed auxiliary signs are each six square feet and comply with the sign district requirements. The Applicant has proposed no other changes and shall follow all other city standards for the signage on the building. The signage plans are shown in Attachment E. 2. Sign Standard Adjustments – Section 1260.01 The Applicant requests to increase the size of auxiliary signage and flexibility to allow commercial text on the sign faces. City Code Section 1260.01, Sign Standard Adjustments states: …adjustments to the requirements and standards for the height, number, type, lighting, area, and/or location of a sign or signs established by this Chapter may be approved with a Site Plan Review or a Planned Unit Development process. In order to approve an adjustment, the Planning Commission will need to make a determination that the following criteria in the sign code have been satisfied: Subd. 1 There are site conditions which require a sign adjustment to allow the sign to be reasonably visible from a street immediately to the site. Page 6 of 9 The Applicant has stated the sign adjustment is required to identify and orientate customers, delivery trucks, and emergency vehicles. Subd. 2 The sign adjustment will allow a sign of exceptional design or a style that will enhance the area or that is more consistent with the architecture and design of the site. The proposed auxiliary signage will match previously approved materials and color of signs and building features. Subd. 3 The sign adjustment will not result in a sign that is inconsistent with the purpose of the zoning district in which the property is located or the current land use. The proposed auxiliary signage appears consistent with current zoning district and land use. Chapter 13, Zoning Regulations Review 1. Number of Signs Appendix A sets standards for signs and sign permits. Appendix A uses different language for signs than the sign code does and refers to auxiliary signs as directional signs. New building construction or site modification identified requires the submittal of a Site Plan Review application prior to construction. 6. The Planned Unit Development generally conforms to the requirements of the City Zoning Code and design standards. 7. Resolution 2020-045 approved a Planned Unit Development for the Subject Property with flexibility for the following areas: district provisions, lot area, lot dimensions, parking setbacks, building height, minimum caliper inches, aesthetics, perennials and shrubberies. 8. A Planned Unit Development Agreement was approved by the City Council on February 8, 2021. 9. A Planned Unit Development Amendment related to signage was approved by the Planning Commission on August 3, 2022. 10. Where the plan is not in conformance with the City Code, the Applicant has requested flexibility. 11. The final location of auxiliary signs shall be subject to the approval of the PW Director/City Engineer and shall comply with comments as provided within the application review. 6. The proposed signs shall conform to all other regulations in the City Code. The City provided the petitioner with a written extension based on meeting schedules over the winter holiday period for an additional 60-day review period, meaning the City must act on this request by April 5, 2025. The existing property signage includes 6 wall signs – 3 per tenant: CPC (North, West and Southwest elevations) and Delkor (Southwest, South and East elevations). CPC signs on the North and West walls are the only wall signs visible from Gateway Boulevard. The proposed directional signs would be fabricated aluminum, with minimal White vinyl arrows and text, using a uniform, easily readable font. In summary, the following site conditions would require the requested sign standard adjustment: 1.A large, 22-acre property 2. An unusual, angled building with multiple tenants 3. Multiple driveways (4) on the same street in which only 1 has Dock Area access 4. Limited visibility of all tenants’ wall signage from Gateway boulevard. Increasing the sign size and adding tenant names to the signs would provide simple, effective wayfinding and eliminate confusion. It would also help maintain the safety of visitors and truck drivers by reducing the likelihood of truck drivers choosing driveways with no dock area access. The proposed sign adjustments would not result in signs that are inconsistent with the purpose of the Gateway Business (GB) zoning district or the current land use.
