Village Council Minutee -~- June 25, 1973 After discussion, lirs. McNiesh was a~knd to request the developer to obtain ao. agreement from Mr. Lametti, approving the excess surface run-off onto his property; she was also asked to check on billing the developer regarding park dedication fee. Engineer Lund advised that the developer be requested to re- submit this plat to the Rice Creek Yater Shed District for approval of the changed drainage plan. Attorney's Opinion Requested . Attorney Lynden was requested to advise the Council which ordinance prevails when ordinance ~~endment8 are adopted after an application has been submitted, whether each phase submitted for llppro,'al is considered all a ne'll application v or if the initial application date is used throughout the development of tbat parcel. Stewart Lumber - Request re Sewer Engineer Lund reviewed the req~est from Ste-.,art Lumber aud recommended that the Council approve the reconstruction of the present drainfie!d, advising that the extension of the municipal sanitary sauer line to serve this property would be expensive; it wo~ld also necessitate jacking under a railway line. Hollenhorst waved, asconded by Olmen, that the Council approve the reconstruction of the private drainfield as requested; notion carried unanmously. Lnmbros Ditch Engineer Lund reviewed his letter of June 21, 1973, in which he described five methods of restoring and protecting tbe ditch: 1. Line dit.ch with timber sheeting - $32,250 2. Install storm S~Ner - $44,250 3. Line ditch with corrugated metal sheets - $37,600 4. Line ditch .dch steel sheet piling - $63,100 5. Line ditch with hand-placed riprap - $29,150. Engineer Lund recommended that the Council approve method No.5. Be advised that he would send a copy of bis letter to Mr. Lambros and that he will work out proposed cost 81100at1ono among the governmental units which con- tribute water to the waCershecl draini~1 through the Lambros property {Arden Hills, Shorev1-ew, Roeevil1e, Rat:lsey County and M1.nnesota Highway Departtlent). F~tacb-Blackmore Sew~r Engineer Lund re...ie-..ed the statuli of the PeCsch-B1s(:kmore cOlUbined sanitary sewer connection, advising that the Petsch property appears to be land-locked with no access to J.akc Johanna Blvd. or the s3uir.sry sewer line. Jim Hill cutplained that the Registered Property Abstracts have not been received from North Star Abstract for Attorney Lyr~en's review, but requested that the Council approve the agreements and tinal plat, subject to the Attorney's review of the Registered Property Report. -2- Village Council Minutes -3- June 25, 19 73 After discuasion, Eollenhorst moved, seconded by Crichton. that the Council approve the Final Plat or Townhouse Villagc~ at Arden Hill., Third Addition; autborizinB execution or the plat by the Mayor and Cler~ Administrator, subject to Council approval of the Development Agreement End Open Space Easements and Covenants (third addition) and subject to Attorney Lyndon's a~proval of the Registered Property Report. Motion carried unanimously. . After assurance by Attorney Lyn.ien tbat the Development Agreement and Open Space Easements and Co?enents are basically t.he same as the agre~ent for additions one and two, and that the bondi-ag recetved, covering additions one, two and three, is in order. P.EPORT OF COUUCILMAtI CHARLES CRICHTON - Finance, Ordinance Revi!$' Finance Committee Meeting Councilman Crichton reported on the following Finance Committee agenda items: . 1. Abate!\lent of Assessen!: referred to C. McNieah to obtain figures for Committee consideration re specific case at hend. 2. Insurance - looking into coverage for volunteers. 3. ~uckley Insurance Request - The Committee recOlllllends that the Counc:J.l not allo>1 Hr. Buckley's request for outside insurance coverage reimbureement because of the precedent it would e8t. Crichton moved, seconded by 01men, that the Council concur with the Pinance COilll\\ittee'a recoamendation to not approve the request. Motion carried. (Crepeau, Hollenhorst, Olmen, Crichton votil18 ill favor of the motion, and Herrick abstained.) (Mr. CrichtoDsaid that no specific ex~.1usion8 were discussed.) Metro Leap;ue Councilman Crichton reported that the Metro League has asked that membership dues be paid as early as possible; Arden Hills' dues this year are $592.00. After discussion. the Counc~l agreed to defer payment of du~~ until actual benefits to the Village can be evaluated. Bud&!!...Gu:l.delines A memorandum, dated June 22, 1973, prepared by C. McNies", was reviewed by Crichton. He requested that the guidelines be used by the various departments in preparing budget proposals for 1974. Purchase Considerat~ Councilman Crichton expressed a need for 3 transparency projector and micrcpnoDee for us~ at Council and Committee me~ti"gs, acd asked that these items be considered as ?ossible budget items for. next yesr. Mr. Crichton agreed to research coses and models for consideration by the Council. REPORT OF COUNCILlWl STAN OLMEN - Public Works G1eaardan Road Pond. . 01men l-eported that the PubHc Works CorlUllittee recommends that. the pond be checked for health and safety hazards; Council noted that maintenance of the pond is a private matter to.be handled by the property owner. Valentine Park Drainage Ditch .In .diacU8sion of the status of the drainage ditch proposed at Valentine Park, Eollenhorst asked vhy hourly rates, rather than job quotes, were obtained. O~n explained that only a portion of the job is to be contracted; the balance is to be done by Village personnel. After discussion, the Council agreed that the work should he started as soon as possible, and Olmen said the project will proceed using the bids which have been l.ccei....ed. -4- . . Mrs. Mellieoh was reqnested to mite the State Highway Dept. regarding Village proposed ~ of land. Parks and Recreation Comeittee Appointment Councilman Herrick recommended and moved that tbe Council approve the appointment of 'Walter lIeggin to the Parks and Recre.ation COllIIA1ttee. Motion was seconded by 01lllen and carried unanimously. . . Herrick reported that tbe .Parks and Recreation Committee recommends that the building (Barn) not be aold because access is needed for the park property behind the lIarn. It was suggested that the building be leased on a yearly basis, that a representative of the Sport8lJlan Club, Police Departlllent and Parks and Recreation CollllDiUse meet to discuss the proposal. Herrick to keep the Council advised on sub-committee meetings.
