Roll Call Present - Mayor Henry J. Crepeau, Jr., Councilmen. John Hollenhorst, Ron Herrick, Charles Crichton, Stan Olmen (8:30 p.m.l. Absent - None. Also Present - Attorney James Lynden, Engineer Donald Lund, Treasurer Richard O,Kelly, Public Works Supervisor Hans Johansen, Parks and Recreation Director John Buckley, Acting Clerk. Administrator Charlotte McNlesh, Deputy Clerk Dorothy Zehm. Approval of Minutes The Minutes of the Ragular Council Meeting of May 14, 1973 were approved as amended. BUSINESS FROM THE FLOOR Lake Johanna Water Level Problems Mr. Norman Bakken, 3203 Shore wood Drive, reviewed his letter to the Ramsey County Board of Commissioners re water leveJ problems on Lak.e Johanna. He indicated that the "on-rush" of water from Rosevllle since the installation of the enlarged culvert (tunnell In Rosevllle at Lydia, and the Improved culvert at Shorewood Drive, the level of Lake Johanna has risen from the normal 876.5 to 878.73, c~usln9~ exten- sive erosion, up-rooting of trees, filling of Little Lake Johahna with dirt. . Engineer Lund suggested that the Counel I work with Ramsey County and the Rice Creek Watershed District re this matter. Mr. Don Reloux,. '209 Shorewood DrIve, stated his beach Is gone and land along the drainage-way has eroded and he hopes we won't have to walt another five years for the situation to be rectified. He requested that the Coucil take immediate action to control the level of Lake Johanna. Mr. Warren Forslund, 3197 Shorewood Drive, said there Is no doubt that the big bridge at Lydia and the one at Shorewood Drive, created the high water problem, and asked about the right to sue for damages. Attorney Lynden explaIned that If it Is a natur~1 depository of water, there Is no flab! lity for the municipal'ity, unless it augments the flow; If the flow is more than normal, there would possibly be some liability. . Mr. Bakken said he feels we have a legitimate complaint. Attorney Lyndan suggested obtaining constructive rell.f from Rice Creek Watershed District and Ramsey County, rather ~han suing for damages. Crichton asked Bakken, 'Forslund and Reioux if they have a solution to the problem In mind. Mr. Bakken suggested two 50lution5~ I. Create a culvert to maintain an even flow In and out of Lake Johanna, and deepen the watershed area (reservoir) on the north side of the culvert north of Johanna. 2. Stop all further building In the Village until we have ade- quate drainage. Mr. Lund explained that the problem extends all along the watershed area; merely enlarging the culvert at the north end of the lake will not solve t~e problem. -1- Minutes of Regular Councl! Meeting Page two May 29, 1973 Mr. Forslund said that the ditch south of Lake Johanna must be rlp- ~a.pped Immediately or there won't be a Little Lake Johanna; dIrt and trees are failing Into the ditch and filling the lake. The Councl I agreed that the problem must be solved and requested that citizens direct letters to the Ramsey County Board and to the Rice Creek Watershed DistrIct, and said that the Village Council will con- tinue Its efforts to resolve tho problem. REPORT Of VILLAGE ATTORNEY JAMES LYNDEN Uniform FranchIse Ordinance - Ordinance No. 172 . Attorney Lynden explained there is no latitude to change the terms of the Ordinance and recommended Counci I adoption of the Ordinance as presented, except to chango the heading to conform with the stand- ard form tor Arden Hills ordInances. Crichton moved, seconded by Hollenhorst, that the rules be waived and the Council adopt AN ORDINANCE GRANTING TO NORTHERN STATES POWER COMPANY, A MINNESOTA CORPORATION, iTS SUCCESSORS AND ASSIGNS, P~RMIS- SION TO CONSTRUCT, OPERATE, RE~AIR, AND MAiNTAIN. IN tHE VILLAGE Of ARDEN HILLS, MINNESOTA~ AN ELECTRIC DISTRIBUTION SYSTEM AND TRANSMIS- sl6N LINES, INCLUDING ECESSARY POLES POLE LINES, AND FIXTURES AND APPURHNANCES: FOR THE FURNISHING OF hECTRIC ENERGY TO THE VILLAGE AND ITS INHABlTANTS6 AND OTHERS, AND TO USE THE STREETS, ALLEYS. PUBLIC WAYS AND PUBLIC GRO NOS OF SAID VILLAGE FOR SUCH PURPOSES; PRESCRIBING CERTAIN TERMS AND CONDITIONS THEREOf, AND PRESCRIBING THE RATES TO BE CHARGED THEREF~, as modified in the title; motion carried unanimously. Herrick moved, seconded by Hollenhorst, that Charles F. Crichton be deslgllated as Arden Hill s' first d I reci'or on the Board of 0 i rectors of the Metro Rate Authority. Motion carried unanimously. Hollenhorst moved, seconded by Horrlck, that the Councl I adopt Resolu- tion No. 72-23: RESOLUTION AUTHORIZING THE VILLAGE!S MEMB RSHIP IN THE METRO RATE AUTHORITY, DIRECTING ITS OF I ER TO EXECUTE AND DELIVER THE JOINT AND COOPERATIVE AGREEMENT! AND DESIGNATING ITS REPRESENTATIVE TO THE BOARD OF DIRECTORS OF THE ME RO RATE AUTHORIty; motion carried unanimOUSly. . - Hlghw~y E~sement Attorney Lynden reviewed his latter of May 25, 1973, re S.T.H. 51-125, Highway Easement. In which he advIsed that the Highway Oepa~tment Intends to retain the highway easement; however, they may be amenable to the Village's using the rlght-ot-way for open space or park purposes on some type of lease or license basis until the Highway Department makes a determInation to use the right-of-way or to relinquish It. The Council refsrred the m~tter to the Parks and Recreation Committee for its recommendations to the Council. REPORT OF VILLAGE ENr,INEER DON LUND . County Road E - Water Break Engineer Lund described the proposed County Road Erepair work and said he wll! have estimates tor the work at the next Council meeting. The Council authorIzed Engineer Lund to proceed Immediately with the repairs. if the estimated cost of final repair Is expected to exceed $5,000, Lund was requested to proceed with temporary repairs until bids can be obtained for the permanent repair; Council to be pollad when Engineer obtains a contractor. -2- Minutes of Regular Council Meatlng Page Three May 29, 1973 . Mr. Johansen reported extensive surface water seapage Into several manholes, citing two specific areas where manholes are located in the bottom of ditches and are covered with water when it rains - east of Highway 10 and along Highway 51. He said there are probably several other similar situations and suggested that an Inspector from the engineer's office assist In locating the manholes which should be raised. Herrick Inquired as to the feasibility of sealed manholes to prevent seapage. Hollenhorst moved that the Public Works Department be authorized to hire the consultant, as proposed, CrIchton seconded the motion, pro- viding that the cost be paid from the Sewer Utility Fund. Hollenhorst agreed, and the amended motion carried unanimously. Mr. Johansen was authorized to proceed immediately. HI9hway Department Plans, 1-35W Engineer Lund was requested to review the plans submitted by the Hlgh- I~ay Department and advise the Council If the plans Indicate changes other than sl9na~e, REPORT OF VILLAGE TREASURER RICHARD O'KELLY Treasurer O'Kelly reported cash balances In the three banks at approxi- mately $8,700.00, and a re-investment of $30,000 at 6.2~ tor 6 months on May 28, 1973, and $35,000 at 7;2~ on June 4, 1973. REPORT OF COUNCILMAN JOHN HOlLENHORST - Planning and Zoning, Human Rights Case No. 73-16, D.H. Gustafson - Stoneeate Hollenhorst referred the CouncIl to the minutes of the Special Planning Commission meeting of May 15, which details ten reasons for the Plan- nIng Commission's recommendations to Council tor denial of the Stone- gate Special Use Permit, preliminary plan and variances. Mr. Dan Gustafson stated that he felt there mayhavG been some mlsunder- 'standing as to meeting dates when the Planning Commission would discuss the proposal, and that he had hoped to be present to answer questions that might arise. He said he feals that all. the problems which the Planning Commission has cited can be resolved and requested an opportunity to discuss the matter. Hollenhorst stated that If Mr. Gust~fson feels he can correct the deficlances out! ined by the Planning CommIssion, he should be given the opportunity to do so, and recommended thet the matter be re-referred to the Planning Commission at Its meetIng on June 5, 1973. The Council concurred with Mr. Hollenhorst's recommendation. . HerriCk requested that the Parks and Recreation Committee be given an opportunity to make iTS recommendations before the Planning Commission recommendations are SUbmitted to th~ Council. Case No. 72-35, Pemtom Registered land Survey ATTorney Lynden recommended Council approval of the Registered Land Survey, as presented. Hollenhorst moved, seconded by Crichton, that the Council approve the Registered land Survey, as submitted, author- Izing its execution by the Mayor and Clerk; motion carried unanimously. Rlcha,rd Hamlin - YarJ!!.llce Hollenhorst reported that the Board of Appeals and Planning Commission have recommended Council approval of the 10 foot addition to the front af the existing garage, which Is located 3 feet from the side property line. He advised that the addition will enlarge the buIlding, but will not increase the sldoyard variance, and the adjacent n~lghbor, Mr. Pllgren, expressed no opposition to the proposed constructIon. . Hollonhorst moved, seconded by Olmen, that the Counci I approve the variance, as requested; motion carried unanimously. Yalentlne Park Warml~q House Pro~osal. Hollenhorst moved, secondod by HerriCk, that the Council concur with the Parks and Recreation Committee and Planning CommiSSion recommenda- tions to approve the moving of the old library building to the Valentine Park, as proposed; motion carried unardmously. Park Slqns - Variance The Counc!1 approved the park sign variance, as propo~ed by the Parks- and Recreation Committee and recomm~nded for Council approval by the Planning Commission. It was noted.thaT the Planning Commission will consider amendment of the Sign Ordinance (Ordinznce No. i6l et Its meeting on June 5, 1973. Garage at lnqerson Park Hol.lanhor'st reported that the Planning Commission had recommended that the garage at Ingerson Park be demolished. Crichton reminded the Council that a determln~tlon must be made re the proposed use of the first half of 1973 Federal Revenue Sharing money; report must be submitted by June 20, 1973, and published In the official newspaper. . REPORT OF COUNCILMAN STAN OLMEN - Public Works Warning Light Cost Analysis Mr. Johansen briefly reviewed his report re warning lights, and the Council requested thatccopJes of the report be sent to the Public Works Committee. . Temporarv Summer Emplo~ee Appointments Mr. Johansen recommended Councl I appointment of William Karth (currently employed In the PUblic Works Department asa part-time employee), Steve Fisher and John Selvog as full time temporary summer employees until, September I, 1973. Olmen moved, seconded by Hollenhorst, that ~he Council approve the appointments, as recommended, at $2.50/hour; Steve Fisher and John Selvog to start June 7~ 1973. Motion carried unanimously. Herrick again urged that Arden Hills residents be employed. Gas Purchaso Status Mr. Johansen reported that It 15 becoming more and more difficult to get ~as deliveries; could not get delivery this week, but may be able to get a delivery naxt week. ThaCouncil authorl~ad the pur- chase of gas for Parks, Public Works and Police Vehicles directly from the stations, if the situation bacomes critical. REPORT OF COUNCILMAN RON HERRICK - Parks and Recreation (Reported by Parks ~Irector John Buckleyl, Valentine Park Oralnag$ Mr. Buckley reported that two verbal estimates have been received for the .proposed dltchln$!. at Valentine Park: $22/hr - estimated time to complete - 5 days $20/hr - no 6stlmat~ as to time to complete. AdditIonal estimates will be pursued. Mr. Buckley reported that the proposed meeting with the University Professor has not been held todats because the professor has been out of town. Mr. Buckley reported that one Informal bid" In the amount of $6,703.65, has been received and Mr. Boss Is seeklog additional Informal bids which will hopefully be under $5.000.00. Crichton noted that the bid received, using optional curb 2, Is actually $4,862.00. Dutch Elm Disease - , Mr. Buckley reported that in the past, two trees have bean infected with Dutch Elm Disease. Dr. French has noted these while conducting the Oak Wilt Survey. He said blower and broom attachments are available at approximately $100.00 difference In cost from that of the Hesston mower attachments. REPORT OF MAYOR HENRY J. CREPEAU, JR. - General Government, Public Safety Fireworks PermIt HerrIck moved, seconded by Hollenhorst, that the Council approve the Fireworks Display Permit requested by Dr. Robert Woodburn, for the July 4, 1973, Lake Josephine Improvement Association Fireworks Display. Motion carried unanimously. Ard~n Hi lis_Sportsman Club Request Mayor Crepeau reported thet the Arden Hills Sportsman Club would like to purchase the Village garage (The earn', 3242 New Brighton Road, for use as a clubhouse. He said the club has stated they would open the clubhouse for the teenagers at specified times by invitation, probably on a weekly or monthly basis. After a brief discussion, the matter was referred to the Public Safety and Parks and Recreation Committees and to Pat Sexton for their recom- mendations. suggesting that they meet with the Sportsman Club. .Mrs. McNlesh was requested to determine the size of the prop~rty Involved. Mayor Crepeau advised that the President of the Sportsman Club is Mr. Henry Kramm, 3240 New Brighton Road. Police Dep~rtment Commendatio~ Crichton reportad that he witnessed the performance of an Arden Hills police officer at th~ scene of an accident In which an Individual was injured, and was pleased to see how efflclently the officer handled the situation. Mrs. McNlesh was r~quested to write a letter to Off leer John Picha advising him of this commendation. I, !974; If earnest money contract Is voided before that date, connection to sewer shall be made within 30 days. 2. ~ames Adams, request~ a SO-day extension for sewer connections at 1948 and 1956 Mounds Ave. After review of the request, Herrick moved. seconded by Hollenhorst, that the 90-day extension be gr3nted.
