The Minutes ot the Regular Council Meeting of March 26, 1973, In-
cluding the addendum, were approved as submitted.
BUSINESS FROM THE FLOOR
Beach 1m rovoment A Ilcatlon - Mr. Robert Beck
Mr. obert Beck, repr'esen ng St. Paulo go No.2, I.O.O.F., 1174
Edgewater Avenue, presented an application tor beach Improvement to
the Councl!; stating that the Conservation Department requires Water-
shed District and Village permission before acting on the application.
Mr. Beck showed pictures of the shoreline and explained that they do
not Intend to make any changes In the shoreline, only to remove muck
in an area of about 40 feet a~ong the shore and about 50 teet out Into
the lake; replacing the muck !:lith sand; level of lake bottom to be
essontlal~y the ~am.; aiD to be done under direction of Department of
Natural Resources.

approve the bellch Improvement, In accordance with the application sub-
mitted, subject to approval of the Village. Attorney. Motion carried

al"ound the lake; stating that the U. S. Army COi"pS of Engineers are

He said If It should be determined not to be needed, he does not know
,to whom the land would rovert, but, In any caslll, tne County could not
move to acquire the property unless approval Is granted by the Village.

After discussion, C. C~lchton moved that the Council Join the lawsuit
as "intorvenor Defendants", agr80lng to use the present attorneys In
tho ~Bwsult and accept their advice; authorizing Attorney Lynden to
notify AttornGY R. J. Schieffer and Attorney T. S. Hay that the Village
of Arden HI~~s desires to Join the lawsuit as ~ntervenor Defendent.
Motion was seconded by OUmon and carr!~d ~nanimously.

Case No. 72-48, Amendment to Ordinance No. 98
Attorney Lynden referred the Council to his letter of April 6, 1973,
re Ordinance AMending Ordinance No. 98, and read the proposed ordin-
ance In Its entirety.

After dls~usslon. Olmen moved that the Council adopt the Ordinance
entitled AN ORDINANCE AMENDING ORDINANCE NO. 98, THE SUBDIVISION AND
PLATTING ORDINANCE, BY CHANGING THE PROVIS~ONS CONCERNING RESIDENTIAL
PLANNED UNiT OEVELOPMENTS, RE-DESiGNATiNG THE ADMINISTRATION THEREOF,
AND ElIMI~ATION OF REQUiREMENT IN SECTION 8 B. 8, as read and a.ended.
Motion was seconded by Hollenhorst.
Discussion of discretionary powers followed. and the motion and second
were withdrawn. The "dhcretlon" question wes referred to Councilman
Crichton and Attorney Lynden to resoUve. CounclD action was deferred
to the Council meeting of April 30, 1973.
Case No. 72-35. Pemtom - DeveOoDment Afreement
Attorney Lynden reviewed his draft of he proposed development agree-
ment between Pemtom, inc. and the Village of Arden Hills.
After discussion. and at the recommendation of Attorney Lynden, Holien-
hersT moved, seconded by Crichton. that the CaunclD approve the agree-
ment. as amonded, subject to correction of paragraph 9 to provide that
'occupancy of structures' be withheld until the Developer has completed
the Installation of Daterel water and seW9r mains; authorizing execution
of the agreemant by Mayor and Clerk when corrected. Motion carried
unanimOUSly.

Valentine Park Dralna~e
Crichton reported that from his review and consultations re this
proposed drainage improvement, it appears that the ditching along
the south and east of the park. as proposed, will take care of
drainage from Glenview Avenue and the extreme outfield, but will
have little effect on the playing field.
He suggested that in addition to the proposed ditching, a ditch
be placed on much of the west side (flowing south) and the area
along first base lIne be graded towards the ditch. In addition,
grade the area along third base line toward County Road F and
improve the existing ditch. The total should improve the overal I
situation, but may not be a complete solution. Sloping of the
entire infield and outfield toward Lake Valentine may end up as
the only solution.
