Chvestulk Assessment Matter Mr. Chvestulkasked the status of his compllllnt regarding assessments levied against his property at Thom Drive. Councl lmen Herrick Bnd Olmen reported their inspections of the property. It appelol'"ed to them that the property could be rather easily filled and reclaimed as useilbleland - at least 50% of the land elready ex.lsts as high ground. REPORT OF ATTORNEY VINCENT P. COURTNEY Ordinance Aoprovals - UtilIty Rates The ordinance listed below were read In their entirety by Attorney Courtney. Motion was mad( by Henderson, seconded by Herrick, that the reading of AN ORDINANCE REL",HING TO -THE MUNICIPAL SANITARY SEWER SYSTEM. AMENDING . ORDINANCES NOS. 49, 141 AND 153: PROVIDING A NEW BASIS FOR CALCULATING SEWER CHARGES ON NON-RESIDENTIAL PROPERTY. CHANGING BILLING OATES AND DELINQUENCY PROVISIONS AND PERMITTIHG REDUCTION OF RATES FOR SENIOR ~ITIZENS OR DISABLED. be considered a final reading, and that the ordinance be adopted 85 amended. Motion carried unanimously. Motion was made by Olmen, seconded by Henderson. that the reading of AN ORDINANCE RELATING TO THE MUNICIPAL WATER SYSTEM, AMENDING ORol- NANCE NOS. 103, 119. 142 AND 154 BY ESTABLISHING STANDBY CHARGES, CHANGING BILLING AND DELINQUENCY PROVISIONS. ALTERING HYDRANT CHARGE PROVJSIONS, AND PERMITTING WAIVER OF MINIMUM CHARGES FOR SENIOR CITIZENS AND DISABLED CITIZENS, be considered a final reading, and that tha ordinance be adopted as read. Motion carried unanimously. The Council asked tht Robert McNlesh and the Ad~lnlstratlve Office review the ordln.llnce drafts before publication. Courtney re~l.wed a report by Atty, lunde~, dated December 8, 1972, and by Engineer Lund, dated October 21, /972. He detailed the following potnts regarding the plat: ( I ) It Is posslbj~ that the Rice Creek w~t.rshed District has authority to review and pass on plats abutting lakes within the District. (2 ) Ramsey County has passed a resolution. which prOhibits an increase to drainage of water and/or pollutants Into county ~akes as a result of new ~Iat development. (3) There Is a title problem regarding the plat. Mr. Bussard I s aware of It. Atty. Courtney to continue to work on details concerning theplat. . Gray fox Road and Dunlap Street Atty. Courtney reported that Atty. Daubney Is working out a title question regarding the dedication. We s>>ould be ready to accept the streets In about a week. Courtney. Mr. Christoffersen reported that the survey company was not able to fly the project this past fall, because of I~ck of good flyIng days. The Job If I I I be delayed to spring 197:5. Upon the recommendation of Councilman Henderson, the Council agreed to go on recorn with the Metro Council that Arden Hills does not want to be- come direct I y Involved In the question of the New Brighton Sanitary Sewer Interceptor. Mr. Henderson If III draft the letter to the Metro Council. Our earlier contact with the Metro Council was directed to their Referral Committee. REPORT OF TREASURER RICHARD O'KEllY Federal Revenue SharIng Treasurer O'Kelly reported that the first check from the Federal Govern- ment for the Federal Revenue Sharing Program has been received today In the amovnf of $9,506. This represents the p.ayment for Jan. I , 1972 thru June 30, 1972. The funds can be commingled in our bank account, bu~ are to be established within our accounting system as 8 s~~claH trust fund. Treasurer O'Kelly to check apportionment of the payment. Investments As of Novembe r 30: Tota! REPCRT OF COUNCILMAN JOHN HOLLENHORST - Planning and Zoning Case No. 72-35 - Pemtom Motion was made by Henderson, seconded by Olmen, that the Councl I concur with the Planning ~ommlsslon. and that Council approval be given the plat plan changes and Issuance of building permits for additions one and two, as presented with Case No. 72-35. II, 1972 Atty, Courtney reported th~t Pemtom hes Instigated registration proceedings and Arden Hills Is named defendant, because we own the adjoining property at the Village Hall site. Atty. Sherood cheeked Into the matter and It appears, according to a Pemto~ survey, that there may be an encroachment of about 3 feet of Village property. Motion was made by Henderson, seconded by Olmen, that the Village Engineer check the land shortage claimed by Pemtom and notify Atty. Courtney within 10 days. Case No. 71-34, Little Crow Addition Councilman Hollenhorst reported the Planning Commission r ecommenda- . tlon for approval, subject to Vi Itage Attorney and Village Engineer. Clerk Administrator to refer the matter to them, asking t~et their reports on the metter be reedy for the next Council meeting. Case No. 72-57. Lot Spilt - Midway National Bank Matter held to next meeting for reports on the matter from Atty. Courtney, Planner Shetler end Engineer Lund. Case No. 72-53. Ramsey County Topics Plan Councilman Hollenhorst explained that the Topics Plan Is a lonq ranoo p Ian for Imp rovement of the Ramsey County road system. _ ravaawed the Planning Commission recommendations of December 5, IS/n. The plan end Planning Commission recommendations were referred to the Public Safety Committee for their study and recommendation to the Council. He stated .the reo W<IiS a great deal o~~pposltlon to the plan from affected residents from Shore- view end Arden Hills, Following the hearing, the County Board passed the following resolution on the matter: RESOLVED, That the County Engineer Is Instructed to prepare pi ens for the Improvement of Lexl ngton .Avenue between Larpenteur and County Road J within the prosent existing right of way, thereof, end with no median construction permitted. REPORT OF COUNCILMAN STAN OLMEN - Public Works . None REPORT OF COUNCILMAN RONALD HERRICK - Parks and Recreation Human Rights AdmJnlstratlon Report Councilman HerrIck commended Mrs. StromquIst on the content of the report she submItted on a workshop attended regarding Federal Revenue Sharing, stating he felt the report was excellent. REPORT OF MAYOR HENRY J. CREPEAU, JR. - General Government Public Safety (Absent . report given by Mrs. Stromquist) Squad Car Bid The Public Safety Committee recommends purchase of a squad car from Ron Saxon Ford, Inc., as per earlier Council approved specifications. Although the Counel I asked that two Informal bids be obtained, Lt. Sexton stated he was able to obtain only one. The difficulty In getting bids stems from the new anti-po.: lutlon equipment required so dealers are unsure of cost figures. The Counc II concurred with Councilman Herrick's recommendation that additional bids be obtained by Lt. Sexton, and, In the event that he cannot obtain such bids, that he get letters from dealers stating theywll! not bid the Items and tile reason wily they w I II not bId. Motion was made by Henderson, seconded by Olmen, that Resolution No. 72-58, establishing permit requirements and a schr-dule of permit fees for certain existIng non-conforming activities in the Village of Arden Hills, be approved, effective January I, 1972. Motion carried unanimously. Councilmen Olmen reported thet the metter will be dis- cussed at the next meeting of the Public Works Committee, end thet they will probebly obtain bids es soon thereafter as possible, or otherwise will continue renting the equipment on a rentel only basis. Motion was mede by Henderson, seconded by Olmen, that the clelms be approved as submitted. Motion carried unanimously.
