Courtney, Engineers Donald Lund and Donald Christoffersen Approval of Minutes The minutes of the Regular Council meeting of November 13, 1972 wara considered by the Council and amended by Atty. Courtney's remarks as follows: Atty. Courtney referred to Page 3 of the mInutes under the Item Tractor-loader. He Informed the Council that formal bids must ba obtaJned on the unit since the cost wltl exceed $5,000. even though the monthly rentel fee cen apply to the purchese price. The Counc II then referred the metter to Councilman Olmen and the Public Works Committee, asking that they arrange for cpmpetltlve bids on the equip- ment. Ramsey County Open Space Program A proposal for county open space acoulsltton In ~he vicinity of Schmidt Perk and north to County Road F In Arden HII is was presented by Mr. larry Holmberg, representing the Ramsey County Open Space System. The area to be ecqulred was shown on a map. He eXlflalned the plenned use for such land, stilting that the open space IH"ogram Is not a park system, but rather a plan for retaining land tracts as open natural space and trails. Acting Mayor Hol lenhorst asked for Council and citizen comments. Councilman Henderson stated that c~mplalnt$ have been heard from New Brighton regarding drainage and silt coming Into their lekes because of drlllnage Into them from this aroa. Donald Obberlus, 1619 Lake Johanna Blvd., and Mr. and Mrs. MacEachron, 1963 W. County Road E2, .- expressed concern that land sold for open space might be used for a different purpose after purchase by the County. They asked if they have the power to exclude their property entirely from the open space project. It was felt that the Village Counc i I hes the authority to determine which property Is to be Included r- . in the plan, but the county, In turn, could conceivably ebandon the entire plan In Arden Hills If It Is changed too drastically. Mr. Holmberg Informed the group that the county's Intent Is to retain the land for open space purpose~, thet any property owner having buildings on his property Clln be excluded from the program for as long as desired, end loll I I not be forced to sel I the property. ^ property owner within the open spece project who retains his land can se" such property to a third party, but the third party might then be subject to county condemnation of the land for open space. Counc I I Minutes -2- Nov. 27. 1972 Mr. Holmberg said the county open space program has the funds to purchase the Arden Hills property Involved. He Informed the Council that the county will pay past end future assessments against all property In the open space program In the same proportion as private land owners. The Village will be notified of this polley In writing. He felt that the approximately $85,000 due on existing assessments on the Involved Arden Hills property would not hinder progress of the acquisition program. For property owners who do wish to sell, two Independent appraisals will be ordered on eechproperty before pur- chase. The epprelsels teke approximately two months. Philippa lindquist, Janet McTevlsh and Tom laNasa spoke, representing the Arden Hills Parks and Recreetlon Committee. They asked the county to consider the possibility of establishing a fifty mile corri- dor pattern In the open space program with the following additions: I- Acquire the drainage strip between lake Josephine and lake Johanna. 2. Ask New Brighton not to let the existing long lake Beech revert to private ownership. 3. Consider the use of some existing lerge culverts under 35W and County Road F as passage ways under the roads. With the above Items added 'to the existing. plan, a pOSSible pede.trllln traffIc path and/or snowmobile route mIght be established. They estImated that most neighborhood areas today have a maximum of two miles of walking area and many areas heve much less. Mr. Holmberg said his staff wIll study the proposal. MI5. He recommended acceptance of Elde Circle as a Village road with maintenance of the road to be done by the Village. He further reco.mended Village acceptance of the sanitary sewer and water Installation and release of the bond furnished by Mr. Elde. The Counc II asked ~alntenance Superintendent Johansen to look at the road for maintenance purposes. The matter was tabled to December II, 1972, Gray Fox Road and Dunlap Street Engineer Lund reviewed his letter, dated November 27, 1972; reported that the roads as constructed are adequate for a 9-ton roadway as . required by the Village and he recommended that the Village accept the roads subject to any legal difficulties that may be remaining. Motion was made by Henderosn, seconded by Olmen, the Dunlap Street and Grey Fox Road be accepted as Village streets subject to the approval of Attorney Courtney and Maintenance Superintendent Johansen; motion carried uannlmously. The Council then detailed the following Items regerdlng the program: I . The long range planning program Is separate and apart from the short range project now underway. 2. The ~ long range planning program ~ require 6-9 months to complete. . 3. The Village park director will work out the Parks System Plan, which can become the Village park plan, thereby, reducing the $IIOOOplanner's fee by approximately $2500. ' 4. B~~sey County Public Hearing - lexln~ton Avenue Improvement The Planning Commission recommended that the Council proceed cautiously and be well Informed before takl'ng action on the matter. They asked that the same concern be given pedestrian traffic as vehicular traffic. The Councl I asked Councilman Herrick to represent the Village at the hearing to be held at Rosevllle, Wednesday, November 29, 1972. -5- . Nov. 21, 1912 Council MInutes -6- Mr. Joe Perutka, Ra~sey County EngIneer's office, reviewed a letter, dated Nove~ber 22, 1912, fro~ County Engineer Anklan, asking the Village to furnish the county a statement of the LexIngton Avenue project's effect on the operatIons of the Arden Hills Parks and RecreatIon Department relative to Ingerson Park. Mrs. LIndquIst reminded the Council that the noise and safety problem was one of the first worked on with I nge rson Park. She suggested the CouncIl deter~lne whether federal funding could be used to pay for a pedestrian and bike track along and across Lexington Avenue as a safety tartor. Mr. Perutka requested that the Village submit, I n letter form, Its feelings and raquests In the matter. . B!oort of Co~ncll~en Henderson - Finance Regulations reqardlng Tax Levv Limit Councllman-~Iect Crichton attended the public hearing regardIng the proposed rules end regulations for the State Tax Commissioner In administering the tax levy limitations lew. He reported that the regulations will not affect Arden HI lIs In 1973, but may In future yea rs. He reported that one point In contention Is whether or not the tax commissioner has the authority to reduce a municipal tax levy that exceeds the limit. Councilman Henderson reported thet Rept. Dick Anderson has agreed to Introduce legislation to allow Arden HIlls a refund of the tax levy penalty of 1972.
