June, 1972, at 8:00 o'clock p.m. The following members were present: I~yor Crepeau and Council- men Hollenhorst, Olman, Henderson and Herrick. and the following were absent: None. The Village Clerk Administrator presented an affidavit showing publication of notice of hearing on proposed Street Improvement No. 72-3 in accordance with the resolution adopted May 22, 1972, which affidavit was examined and found to be satisfactory and was directed to be filed by the Clerk Administrator. The Village Clerk Administrator also exhibited a Certificate of ~ailing Notice of Hearing to all affected property owners, which certificate was examined and found to be satisfactory and was directed to be filed by the Clerk Administrator. The Mayor then directed the Clerk Administrator to read the description of the general natu~e and estimated cost of the proposed improvement and the area proposed to be assessed therefor, as stated in the published notice of hearing. After reading of the notice, all persons present were afforded opportunity to be heard, and the names and addresses of the persons appearing and heard by the Council, and the substance of the views presented by them were as follows: . ;, HR. ROBERT HANSEN, 1465 Floral Drive: Asked if property owners were always assessed for street repair after utility construction. He said the road had been in good driving condition, but after both the sewer and water construction it was left in bad condition. Also asked if the property owners were not liable for the repair, if there was a misunderstanding on the part of the contractors. NR. CURT NELSON of Emil FI. Nelson Realtors, representing Jim Johnson who owns the lots on James Circle: In favor of the improve- ment. Said it would greatly improve that particular part of the area if permanent street surfacing could be done. . COUNCILNAN OUiEN: Said that the village Public l<?orks Committee indicated to the Village Council that since there would be additional settling on Floral Drive and the Circles, to do the work this year would cause premature repair costs to the village. They felt the entire area should be done at the same time. Their recommendation to the Council is that the water contractor repair areas damaged by water installation and that the PUblic Works Department patch other areas on Floral Drive, and further that the Circles should be rough graded and graveled with the entire surfacing project delayed until next year. The Public ~IDrks Committee also questioned why storm sewer was not included in the Floral Drive portion of the improvement, and if curbs are put in, where the' storm water would flow. COUNCILliJAN HERRICK: Said he didn't believe that James Circle and Gale Circle are dedicated roads. Further said he believes that two years ago the Council told the people on Floral Drive to be patient because there would be more construction; the road was damaged because of sewer and water construction and he felt the village had an obligation to repair the road to its condition before the construction. COUNCILHAN HENDERSON: Said he didn't think you could put sewer and water across streets and get the street back to 100% but they should insist that the contractors get it back to as close to 100% as it was in the first place. He agreed with Councilman Herrick that those areas that are definitely below what they were before the con- struction began should not be repaired at the cost of the individuals residing on that particular street. e5 . COUNCILN1lli OUJEN: Said he recalled that the developer was to pay for the cost of roads in that area. Furthur con~nted that it would be cheaper to surface all of the streets in the area at one time. He said there would be no objection to doing each road indiv- idually if the property owners or developer didn't object to the additional cost. [vJR. RICHARD 11YERS, 4117 Gale Circle (Spoke before): Said thEY have water on their property due to the drainage of the village park on the ot~er side of Floral Drive. ASked if there were any plans in this imp~ovement to take care of that. . COUNCILHAN HOLLENHORST: Asked -,,'ilY there should be a delay in surfacing the roads in the circles. Engineer Christofferson replied it was because of possible settling. Councilman Hollenhorst asked the engineer if, in his opinion, the surfaci.ng should be delayed. ~trQ Christo=ferson replied th~t he would not guarantee no settling if the roads ",ere surfaced nO\\". Councilman Hollenhorst then said he dion't believe the property owners on Floral Drive should be subject to a 100% assessment for street resurfacing if the reason for it is due to problems created by the "'lai:er project. Asked how practical it would be to put the street in reasonably good driving condition for a few years without doing the permanent street surfacing. Mr. Christofferson indicated that he had had assurances from the contractor that. they would repair the crossings which are in bad condition. MR. ROBERT ANDERSON, 1357 Floral Drive: Said that neither the se\!er or water contractors fulfilled their obligations of repairing the streets and it was his understanding that the sewer contractor hadn't been paid in full because of the street work yet to be done. l~. Christofferson said he would check into the matter. HR. ROBERT HANSEi~, 1465 Floral Drive (Spoke before) : Asked how long the contractors had to complete their jobs. Mr. Christofferson repli.ed it was usually one year but there have been oontractors who have come in after the length of time to !aake repairs. COUNCILV~N HOLLEl1HORST: Suggested that if the people on James Circle are willing to gamble on the road not settling, he was in favor of putting in that portion of the improvement. HR. The improvements on Gale and Norma Council, asked if the engineer suggests MR. RICHARD HYERS, 4117 Gale Circle (Spoke before): He didn't think Gale and Norma Circles should be excluded from the improvement. MR. ROBERT ANDERSON, 1357 Floral Drive (Spoke before): Asked if anyone on Floral Drive had indicated that they were in favor of curbs and gutters. MR. RICHARD MYERS, 4117 Gale Circle (Spoke before): Wants his road improved. . MR. STANLEY BERGLUl,m, 4133 James Circle (Spoke before): Asked when a definite commitment would be made as to what action the Council will take on this improvement. ~:ayor crepeau explained the statutory provision that a decision could be made any time within the next six months. COUNCILIlJAN HERRICK: Said that at this point his impression was that the property owners want James Circle paved immediately and he felt they could then be assessed 100% for the improvement. The pro- perty owners on Floral Drive want the water contractor to upgrade the street to the condition it was before they started working: the people in the area totally agree they do not want curbs and gutter although they realize there is a drainage problem. MR. ROBERT ANDERSON, 1357 Floral Drive: They would like Floral Drive upgraded to its condition before sewer construction. COUNCIU'lAN HENDERSON: Asked if the Circles could be improved by putting in the base gravel and compaction so they have a good driving surface with the expectation that the settling is still going to happen which can then be repaired before the overlay is put on. Nr. Christofferson indicated that it could be done but to travel over it during the winter and during muddy times tends to contaminate the gravel and create undue pumping from the bottom and it could cause costly repairs when you're ready to resurface. Councilman Henderson asked if it would be more costly than repairing the overlay after it settles down. The, answer was no. t~. Christofferson further said this would create a passable surface although it would be dusty in dry times and muddy during the wet season. NAYOR CREAPEAU: l\sked if there would still be settlement on all three of the circles if they were compacted property and the work done this season. l>lr. Christofferson replied that this involves a difficult clay type material to work with and he couldn't guarantee that there would be no further settling. . 4. filRS. SUE HUSTINGS, 4136 Norma Circle: She'd rather wait and have the jOb done the cheapest after the road has settled. MR. DON SALMELA, 4123 Norma Circle: Agrees with Mrs. HUstings about Norma Circle but thinks Floral Drive has been neglected and j I1st a little work could make it at least driveable. MR. I-JAX ROBINSON, 1869 Noble Road: If the improvement t...ould be delayed for a year, wouldn't there still be the same problem of com- paction at that time. Vir. Christofferson replied that this \'las true and there have been occasions when the settling occurred as much as five years later. . MR. CHARLES CATHCART, 1399 Floral Drive: Would like to delay the improvement on Floral Drive but make an attempt to have the con-' tractors repair the street to the condition it was in before the util- ity improvements were put in. COUNCI~llU1 OLMEN: Since no one can guarantee that there would be further settling he thought it was up to the property owners to decide whether they want to risk putting in the improvement now or wait another year and have a little more assurance. MR. DOt1 CHRISTOFFERSON: Commented that if the whole roadway i...as compacted and surfaced now it would prevent water from entering the roadway area which luight improve the chances of not having further settlement. COUNCIU'UU" HOLLENHORST: Said he thought the three circles should be surfaced now with the hope that they wouldn't settle too badly. MRS. SUE HUSTINGS, 4136 Norma CirclG: Since the cost of sur- facing each circle is different and since Norma Circle is in the best condition, would their assessment be less. l~en told the construction would be done at one time and the assessments would be the same she indicated that she would want Norma Circle done separately. Further said their street is in good enough condition that it could be dropped from the improvement. MR. DON SAU~illLA, 4123 Norma Circle: (Spoke before): Said they have a base for blacl~top on Norma Circle. It was put in by the platter and then it was resurfaced with the same material after the sewer was put in. Then it was oiled but was torn up for the water improvement and regraded after that. COUNCILNAN OLMEN: Asked how effective a rolled curb would be instead of concrete curb and gutter so far as drainage is concerned. After the public had full opportunity to be heard, the hearing was closed.
