which the Village may rent @ $24.00/hour. Johansen recommended the
rental of this machine, at about $1,000 less In cost than ~:ommerclal

Lift Station Safety Devices
Johansen reported that safety devices have ~ean installed In seven
11ft stations; four stations and water tower Installations remain to
~e done; cost of water tower safsty device Installation will ~e sub-
mitted to Councl I at next Council meeting.

Lake Johanna Marking Buoys
Johansen reported that the Public Works Department was directed to
Install the regulatory buoys In Laka Johanna as designated by Ordlnance
No. 181, and he understood that the buoys were to be furnished by
Ramsay County. Jobansen reported that Ramsey County has no money
budgeted for these buoys, which he understands cost about $60.00 each.

After discussion. matter was referred to AitorneyLynderl to review'
JoInt Po~ers Agreement ra this matter, and to write to Ramsay County;
possibly requesting that the County InclMd~ the purchase of the buoys
in next year's budge~.

Nursery H I I L t<ssessments
Mayor Crepeau opened the Public Hearing at 8:15 p.m.
Bond Consultant Peter Popovich stated that the proposed assessment
roll for Nursery Hill utilities and stt'eats is before the Council
andavaiiable for review by all persons int.rested in the N~rsery
Hill project. which "rota I assessment is In the amount of $48,013.27.
~Opovich explained that 100' of the project costs have been assassed
against the property owners over 20 years,at 8% interest; advising that
property owners may pay the total assessme:,-j', or i of amount assessed,

Popovich said the Village Clerk is required to sendnoticesto the
latest i 1st of property owners submitted to her by the County Clerk'S
office; any contracts between seller and buyer are not of Vlllage
conc.srn.
Mr. Art Erickson, 1297 Nursery Lane, advis;~.j that when he closed on
hls house, FHA withheld double the amount oj assessments, pending
thIs hearing. Popovich said the assBssment9 can now be paid within
30 days with no Interest charge.
After determining .there were no further qua~tfons or comments, Mayor
Crepeau closed the Public Hearing at 8:27 p m.

Nursery Hi II Improvement - No.2 and Final ,!'ayment Request
Christoffersen reported that since his lettBr of June 9, 1975,
recommendi ng Counci I accepta?ce of the Nursory Hi II project and
approving No. :2 and Final Payment, a road cava-.in has occured, and
he is rescfndlng this recommendation until ,'oad has been satls-
factorl Iy rap~lred. Matter was defBrrSd to Council meeting of
June 30, 1975.

Mr. Warren Praeshl, Miller Schroeder I~unlcirals, Inc., reported
that Mr. Popovich has reviewed the new propcsal in which $1,000,000
in Industrial -Revenue Bonds are proposed tc, be issued under a loan
Agreement, with the balance of the costs of the project financed
from privata sources.

million proposals and, after discussion, Crichton movelJ, seconded

Christoffersen referred Council to his lethr of June 9,1975, and
reported Thai" he a-nd Mayor Crepeau rr.et on Hasite to discuss
possib~e resolution of the problem.
Christoffersen referred Council to the sellelal al-rernatlves posed
to the Council, prior to Counci 1'5 approval of this project; stating
that the leval of the lake is the reason hi the existing flooding -
not the result of drainage from the pipe tc the ditch. Christoffersen
stated that unless the property is fl I led cr both sides of the ditch,
additional planking wi II not rectify the siluation; this Is a
natura! drainway to Lak~ Johanna.
Mr. Lambros countered that I -r- i-he di tch hac, been constructed at
880, instead of 875, the problem would be nsolved.
In disGussion, Christo-ffersen said that adeitional fi II and sod
can be placed above the planking, but unles~ a lower 18k~level-

After discussion, Councl I concurred thBt un1il the level of the lake
Is determined, further steps to resolve Inoivldual drainage problems
would be to no avai I. Mr. Lambros was encc'raged to attend the Rice
Creek WatershBd meeting at the Cent.rvi lie ~chool on June 21st and
to_advise them of his prOblem.

James r~~e - Drainage Problem
Mr. McNamee read his letter of June 3, 1975, asking that surface
drainage water be redirected to prevent Its 3ntry onto his recently
purchased property at the southwest corner ;f Siems Court and
Johanna Blvd. McNamee circulated photograp's depictIng the loss of
soil from his property and asked that corre;tiv6 measures be taken.

In discussion, it was noted that this Is a 'atural dralnway to Lake
Johanna; pattern has not been changed - there Is a culvert from the
north side of J~hanna Blvd. which empties o.to this property, as
wel I as a culvert ~nder Siems Court, into t~, northeast corner of
the property. -
Council concurred that this is another dral~9ge problem which Is
dependent on the I ake level; be-ion, i'lny cha' Jes can be cons i dered,

MeNa_ls said the water is coming off the Vi! lage streets. Chrls~offersE
said that drainage is naturally through tl1i, property; culverts are
not directing 2ddlt!onal water which would nJt have gone that way
otherwise; it had been an open ditch.
McNamee asked if a storm drain could be Instilled to drain directly
into the lake. Christoffersen said that la~) level must be de~ermined
first; when solving one problem, another co~ld bi created elsewhere;
it may not be possible to design a draInage !ystem unless the
property elevation Is raised. Crepeau askeJ Christoffersen to look

Bethel College - Drainage Ditch
Mr. Hugh McLeod explained that the creek through the Bethel Campus
has presented erosion problems which must be corrected. He explained
that Bethel had made an attempt to place rip-rap In various places
last year, which had the endorsement of thl Rice Creek Watershed
District, but increased pressure has washed It away. McLeod asked
if Bethel could expect some financial assistance to correct the
problem.
In discussion, i,t was noted that much of the Increased water runoff
is from i'he development of lands east of L<'xington Avenue; Rice
'Creek Watershed Is currently studying the overall drainage of the
area.

McLeod said that Bethel has been considsrirg various proposals and
wll! prob<lbly accept the rai Iroad tie rip-r'ap proposal, which is
guaranteed and is estimated to cost S4~90D (for about 100 feet).
It was suggested that perhaps the question of financial aid for the
project could be posed to Rice Creek Water!hed. McLeod stated that
Rice Creek wi Ii have no funds for probably 2 years.
Christoffersen explained that meandering s':reams (ditches) are
subj€lct to erosion, and suggeS"led several alternative methods to
reduce the velocity; the proposed rip-rap froject wi II protect
for a tlme, but may be only temporary - slDw down of flow for entire
area, which is currentJy under st~dy, will ultimately protect this
are.a.
~ussard Court Drainage Problem - Lot 10
Christoffersen displayed a map of Bussard Iddition, and Indicated
the location of the drainage pipe and rip-lappet! ditch, which empties
Into Lake Johanna. Christoffersen said this present plan is not
acceptable to Mr. Carlson, purchaser of the lot, and Mr. Bussard
haS referred the matter to his engineering firm; a civil matter
between buyer and seller.
Mrs. Carlson said the drainage is directed "catty corner" across
the property and reques tad that it be red i ,octed; I t was not th i s
way when lot was purchased.
Council refer'red Mrs. Carlson to Mr. Bussal'<l, asking that she let
Council know If matter is not resolved satisfactorily.

After discussion, Wingert moved, seconded ty Feyereisen, that Counci I
accept the uti lities and streets in Townhobue Villages at Arden Hi lis,
Addition I thru 7 approving relcase of the necessary bonds as
determi ned by the Eng I neer and Attorney, an; I ud I ng Open Space Bonds.
Motion carried unanLmously.

In discussion af the 1st Addi~ion North uti lities, Christoffersen
advised that Pemtoffi Is not asking that the Vi I lage accept the utilities
at this time, but is asking release 0'1 the honds; roads are not
constructed - acceptance of roads and uti ll":ies will be requested
after completion of road construction.

MetropoliTan Waste Control Commission Agre6..!lent to Replace Existing
Meters at Two Locations
It was noted that the Village Engineer and Attorney have reviewed

and approved the contract documents for replacement of meters at
two locations in Arden Hills, by Metropolitan Waste Control Commission,
as amended; amendment was approved verbally by Matropol itan Waste
Control Commission.
Feysrelsan moved, seconded by Crichton, that Council authorize
execution of the ~greement by the Mayor and Clerk Administrator,
as amended, on behalf of the Village. Motion carried unanimouSly.

Christoffersen reported that some repair work has been done, but
some "bird baths" remain - not ready for acceptanca by the Village
to date.

Fredlund displayed the amended building a~d site plans for Carroll's
Furnltur~ addition and described the mlno, changes as follows:

2. Entrance approach is ch~nged slightly.
3. Parking spaces originally shown at 8i'width, have been
reduced In number by 3, and spaces are widened to 9',
providing one space for handicapped at front door.

It was also noted that Weber Cabinet has submitted a letter, permitting
excess Carrol I Furniture parking on the Nubar Cabinet property
d~ring hours whon Weber Cabinet is not opun far business.
After discussion Wlngart moved, seconded by Woodburn, that Council
approve issuo~ce of the Building PermIt for Carroll's Furniture
(Case No. 75-9) in accordance with pl311S dated "received 6/3/75",
subject to receipt of suitable document from Weber Cabinet 'or
shared parking; document to be approved by Vi Ilage Attorney. Motion
carried. (Wingert, WONiburl1, Crepeau, Crichton voting in favor
of the motion; FeyerBlsan voting in opposition.)
McNiesh was requested, when relaying Council's action, to request
that applicant consider on.site ponding, since land coverage Is in
excess of Ordinance requirement; suggesting consideration of either
contour or roof top storage. Copy of Ordinance requirements to be
given to Mr. Carrol!.

reported that the Planning CommiSSion recommended Council
of the Landscape Plan, subject to:
Receipt of Landscape Performance Bond in amount of $10,000.

both sides or fenco.

Fredlund reported that fence datail has been submitted, which
Indicates a 4' h!gh so!ld fence 6s proposed, which he said sho~ld
!,rovlde the required screening of car headlights for residents to
the wBSt. (PlannIng Commission has not seen this plan to date,
but it appears to be In accordance with Planning Commission
~ecomrnendations).
Mr. Engstrom said that planting on the west side of fence may pose
housekeeping apd maintenance difficulties for McDonald.. Council
suggested that a few RussIan Olives o~ the west side would not
require much maintenance and would break the massive appearanc~

of tile fence.
Engstrom advised that 2 rather than 3 flag poles will be installed
on the site and that light poles are to be 18' in height, with
250 hps lamps (off-white) directed downward on the site.

After discussion, Crichton moved, seconded by Feyereisen that Council
approve the McDonald's Corp. Landscape Pier (2/14/75), site plan
indicating fence location (5/30/75), and f.Ence detail plan (6/13/75),
with the understanding that a landscape performance bond be submitted
in the amount of 510,000, and that a few plantings wi I I be placed
on west side of fence to break massive appEarance of fence, main-
tenance bond to be furnished on acceptance of :landscaplng. Motion

Case No. 75-23, Parkinq Modificat~ - FI<>herty's Arden Bowl
Fredlund reported that the Planning Commission revlawed several site
plans and recommends Council approval of the plan dated 5/27/75,
SUbject to landscaping on the west side tD be moditl~d to provide
2 rows of coniferous trees, staggered 15 'ft. apart, and that a ponding
area be provided cnthe site, as approved by the EnQineer.
In discussion, parking needs were discussec for Flaherty's proposed
over-all activities <inducting off-Sale liquor store), and the
possible rerouting of traffic in the area which wi II possibly affect
Flaherty's, as wet I as other parking in the area. It was noted that
curbing on both sides of Connelly would bo raquil"ed, which may affect
parking on the existing Arden Bowl site.
After considerable discussion, Fredlund was requested to provide
Counci I with a map of the area, indicating existing bui Idings, parking
areas, roadways and driveways etc. Wingert agreed to discu.s Counci.i's
concerns with Mr. Flaherty and to relay Coune! Its thoughts as possible
ways to resolve the traffic, parking and drainage problems in the area.
Feyereisen agreed to discuss dedication for drainage with Attorhey
Lynden.
Mattel- was deferred to Council meeting of June 3D, 1975, pending
reports from Wingert and Feyereisen.
OTHER BUSINESS
Steak Inn - Request re Landscape Plan Modification
Wingert reported that it appears that the Steak Inn landscaping, as
planted departs considerably from the approved landscape plan and noted
the following differenceS:
I. Af nOI-th-west of building, plantings have been added which
are not shown on the plan.
2. Grouped plantings along east of other access road are not
on the plan.
3. Most of the Indicated planting on the west has been omitted.
4. South side of lot has not been planted as indicated.
5. Five pines have been planted on th3 Standard 011 site.
All in all, abou.l" ~ of the pl<lntingS on the approved plan have been
omitted.

tn discussion, it was noted that a drain is installed in the bottom
of the ponding area on the site; possibly should install a partial
plug so water is actually retained and run-off is thereby retarded-
this was purpose of the pondlng area.

Hunters Park Pathway
In ~Iscusslon of request by Dreyfus Interstate to delay constructIon
of the 5 foot bituminous path along the west side of Hunters Park,
pendl ng poss i ble deve lopment of the acreage. to the west of the Hunters
Park site, Crichton reported that the Parks Committee has discussed
this matter and recommends that Council approve the request subject
to:
I. Dreyfus putting cost of project in escrow for construction
at later date.
2. Counci I review of status of proposed development of land
to the west In 6 months.

He reported that Parks and Recreation Committee considered the
possibility of a 20' easement (Instead of 10' wide) which would
permit a more interesting meandering pathwlY.
After discussion, Crichton moved, seconded by Wingert that Council
concur with the Parks and Recreation Committee recommendatIon.
Motion carried unanimously.
Resolution re Human Rights Nett Lake Program - Resolution No. 75-26
Crichton read the Resolution in its entirety and moved that Councl I
adopt Resolution No. 75-26, authorizing its execution by the M~yor
and Clerk Administrator, on behalf of the Vi Ilage. Motion was
seconded by Feyereisen. Motion carried unanimously.
Comprehensive Plan Review
Fredlund reviewed Metro Counei Its response to housing provisions in
the proposed Comprehensive Pian and noted vsriobs cens~s Information,
compiled by v8rious sources whJch differ from the Metro Counci I
estimates.
Fredlund noted that If the Vi llage uses the density figures In the
ComprehensivePlani the Vi Ilage residentlaJ tones probably ~JII reach
saturation in about 1985 at 12,000 to 14,000 population (3;11 & 3.96
net combined) - Metro Counci lIs estimated census Is about 1,000
fewer and therefore a later saturation date.
Vlllaqe at Arden HI I Is Homes Association Letter of 6/15/75
McNlesh reported that Lynden-advised her that the HOMes Association
legally become the owners of the open space at Townhouse Villages
at Arden Hills; therefore their Interest In completion of various
Items noted in letter.
Wingert offered to gather explicit Information relating to requests In
letter, fer Council consideration, prior to release of performance
bonds.

McNlesh reported that landscape plans for Additions I through 3 have
been insp~cted by Schutts; plans are marked indicating plantings that
are installed as per plans, omis'ions which appear to not be ~eeded
as wel I as omissions which he feels should 18 Installed and plantlngs
whiCh were Installed but not Indicated on t~e plan.
Feyerelsen said he fee1s that some differen~es should be understood,
but the concept should be similar; if Landscape Inspector approve~
replacement or alternate planting, which In his judgement compensates
for original plan, then planting should be approved.

Park Development Plans
Crichton reported that an alternate plan for Freeway Park has been
proposed, which indicates use of b'acktop~ed area for game activities
Instead of parking, as was proposed on the former plan.
Crichton referred Counci I to memo of 6/13/75 .from K.aren Caswel!, and
reported that the Parks Committee recommends Council approval of
preparation of constraint maps for two parks (Hazel Nut Patch and

floral Park) as described in memo.
Crichton moved, seconded by Wingert. that Counci I authorize Buckley
to enter into an agreement 'with Karen Casw~,II, Megan Gange and Brad
SI~loh, for preparatjo~ of park constraint maps, as outlined in memo
of 6/13/75 from Karen Caswell. Motion carried unanimously.
