MINUTES OF REGULAR COUNCIL MEETING Village of Arden Hills Monday, June 9, 1975 - 7:30 p.m. Village Hall CALL TO ORDER The meeting was called to order by Mayor Crepeau at 7:30 p.m. ROLL CALL Present - Mayor Henry J. Crepeau, Jr., Councilmen Charles Crichton, Robert, Woodburn, ~llllam Feyereisen, James Wingert. Absent - None. ' Also Present - Village Attorney James lynden, Treasurer Donald lamb, Police Chief Pat Sexton, Clerk Administrator Charlot7e McNiesh, Deputy Clerk Dorothy Zehm. . APPROVAL OF MINUTES CrIchton moved, seconded by Wingert, that the Minutes of CouncIl Meeting of May 27, 1975, be approved as amended. carried unanimously. the Regular Motion BUSINESS FROM THE FLOOR Cardiac Pacemaker's, Inc. - Proposed Chan~e In Fundln~ Mr; F. Warren Preeshl, Miller and Schroeder Municipals, Inc.. explained that because of a change in legislation, re Industrial Revenue Funding, Cardiac Pacemakers, Inc. is considering a $1,000,000 loan agreement, with private funding not to exceed $2,000,000. Preeshl explained that the legislation limits capital outlay for research and development at the $3 million bond issue level, but there Is no limitation on caplt&1 outlay at $1,000,000 level. Matter was referred by the Council to Mr. Peter Popovich for recommendations to the Council. REPORT OF POLICE CHIEF PAT SEXTON Sample Ordinances Re Traffic Enforcement Sexton referred Council to sample ordinances pertaining to traffic enforcement, which are not covered by Arden HI I Is Ordinances. These are under consideration by the Public Safety Committee for its recommendations to the Council. Radar Equipment lease Sexton reported that he/has returned the leased unit - should probably not be charged for June rental. He said the department has been "trying out" two hand units, one from CapitOl Sales and one from Custom Signals, which appear to be comparable. are easy to use and give-a good beam - can pick out cars easily. Sexton said the unit can 'also be used on tripod" If desired. Truck Traffic on County Road 0 Sexton reported that the Public Safety Committee discussed the truck traffic problem on County Road 0, but determined that there Is little that the Village can do to restrict the truck traffic. Road Is a 9-ton County Road, over which the Vlllage,has little jurisdiction, except over traffic violations. After discussion, Council suggested that residents contact Ramsey County Commlsslonors Orth and Salverda re their concerns. -1- . Minutes of Regular Counc! I Meeting Page t\;O June 9, 1975 PUBLIC HEARING Ordinance No. 188 - Amendment to Zonln9 Ordinance No. 99 Relatln9 to Fast Food Restaurants. Mayor Crepeau opened the Public Hearing at 8:10 p.m. . After determining there were no questions or comments from the floor, Council reviewed the Ordinance. The Public Hearing was closed at 8:30 p.m., after which Lynden read the Ordinance In Its entirety, Incorporating the amendments noted. Wingert moved, seconded by Feyerelsen, that Counc!1 adopt Ordinance No. 188, AN ORDINANCE AMENDING ORDINANCE NO. 99, AS AMENDED, THE ZONING ORDINANCE, BY CHANGING THE DEFINITION OF "DRIVE-INN BUSINESS", ADDING DEFINITIONS OF "RESTAURANT" AND "FAST FOOD RESTAURANT", ADDING "FAST FOOD RESTAURANT" AS A SPECIAL USE, AND SUBSTITUTING "CITY" FOR "VILLAGE" WHEREVER THE SAME APPEARS, as read; authorizing Its execution by the Mayor and Clerk Administrator on behalf of the City of Arden Hi I Is. Motion carried unanimously. Ordinance No. 100 Counc! I discussed the provisions of Ordinance No. 100, after which Crichton moved, seconded by Woodburn, that Councl I Introduce by title AN ORDINANCE REPEALING ORDINANCE NO. 100. Motion carried (Crepeau, Crichton, Woodburn and Wingert voting In favor of the motion; Feyerelsen voting In opposition.) Matter was referred to Lynden to prepare Ordinance for Council consideration REPORT OF VILLAGE ATTORNEY JAMES LYNDEN Case No. 73-28, Hunters Park Fourth Addition. Lynden referred Counci I to his letter of June 6, 1975 re approval of Amended Final Plat of Hunter's Park Fourth Addition; and Park Dedication Conveyances. Lynden recommended Council approval of the Amended Final Plat, as submitted, on the basis of the provisions noted in his letter. Wingert moved, seconded by Crichton, that Council approve the Amended Final Plat of Hunter's Park Fourth Addition; authorizing Its exe- cution by the Mayor and Clerk Administrator. Motion earrled unanimously. Case No. 74-36, C.G; Rein - Park Dedication Matter was deferred to Council meeting of June 16, 1975. for title opinion from Lynden. Case No. 75-6. Arden Manor Amended Special Use Permit Lynden referred Council to his letter of June 6, 1975, re Ownership and Encumbrance Report for Twin Parks, inc. Lynden reported that Van Putten has Indicated that partial release of the liens can probably be obtained by Thursday, mortgagee Is releasing funds for possible liens. Lynden also noted that the Bond refers to the original Special Use Permit - rider should be attached tying the bond to the Amended Special Use Permlt. ... After discussion, Crichton moved that Council not accept the recreational park and access easements untl I developer can produce written satisfaction of leins and Judgements and has obtained written consent to conveyances from two mortgagees. Motion was seconded by Wingert and carried unanimously. Lift Station Easement, Sewer 12-13 - J. Bussard Bussard suggested that Council average the first two appraisals and not consider the third appraisal, In negotiating a settlement for the 11ft station parcel to be conveyed to the Village. In discussIon, Feyerelsen recommended that Council pay Bussard $8,250 for ~he 11ft station property, based on the following: $3,750 - third appraisal 3,000 - l$/month for rental of the property. 1,500 - special ass.ssments $8,250 Total ';'2- . t~inutes of Regular Council Meeting Pags .t'lree June 9, 1975 After dIscussion, Crichton moved, seconded by Feyerelsen, that Council authorize payment of $8,250 to Bussard for the 100' X 150' lot on Old Highway 12",2,I'!v~w.~J.Shiis constructed the sewer lift station; Bussard to p~ts against the property and 1974 taxes, payable In 1975. Wingert reported he had ~erused the site, parking lot surface Is fairly level and crushed rock wet I tamped - tits residential area, In his opinion; would be in no hurry to require paving the lot; would like east and north sides to be screened with plantings. Feyerelsen agreed that screening; especially on north, should be required. . Crep.eau agreed that crushed rock was preferable to blacktopping the parking lot. Motion carried unanimously. (It was noted that I.O.O.F. Is expected to comply with all other provisions of the Special Use Permit.) ~EPORT OF CLERK ADMINISTRATOR CHARLOTTE MCNIESH Pickup Truck Specifications and Advertisement for Bids McNiesh referred Council to memo from Buckly dated 6/6/75, with at~ached Advertisement for Bids and Specifications for 3/4 ton pick-up truck with 4-wheel drive. Wingert moved, seconded by Woodburn, that Counci I authorize advertisement for bids on June 12th; bid opening on June 26th as per specifications submitted. Motion carried unanimously. Additional cost for automatic transmission to be listed In bids. Federal Revenue Sharin~- Planned Use Report McNiesh referred Council to memo of 6/6/75 re suggested Items for Revenue Sharing - Planned Use Report. After discussion, Feyerelsen moved,that Council declare Its Intentions re this matter Incorporating the following items: . Audit & Publishing re Federal Revenue Sharing Planning Consultant Special Services, I.e. Zoning Ordinance Recreation Programs Summer Playground, Day Camp, etc. Park Site Improvement Codify Ordinances Human Rights Programs $ 550 2,000 Total 4,600 13,669 5,000 1.155 $26,974 Motion was seconded by Wingert and carried unanimously. ?ummer Playground Leaders McNlesh referred Counci I to memo from Buddey dated 6/9/75 re Summer ~jayground staff. After review, Crichton moved, seconded by Feyereisen, that Council approve hiring the playground leaders as listed at rates Indicated In 5/9/75 memo. Motion carried unanimously. ~rnor's Summer Youth Program McNlesh referred Councl I to her memo of 6/9/750 Af~er discussion, Council authorized McNlesh to proceed with program -3- / . '. ~inutRs of Regular Council Meeting Page five June 9, 1975 pomprehBnslve Plan Review Council's review of the Comprehensive Plan was resumed, starting on page 30. - After discussion of net density, Wingert agreed to work out wording for Councl I consideration at June 16th meeting.
