The meeting was called to order by Mayor Crepeau at 8:05 p.m.
Roll Call
Present - Mayor Henry J. Crepeau, Jr., Councilmen Charles Crichton,
Robert Woodburn, William Feyereisen, James Wingert.
Absent - None.
Also Present - Attorney James Lynden, Treasurer Richard O'Kelly,
Parks Director John Buckley, Clerk Administrator Charlotte

App-roval of Minutes
Wingert moved, seconded by Crichton, that Minutes of Council Meet-
ing of December 23, 1974, December 30, 1974 and January 2, 1975,
be approved as amended. Motion carried unanimously.
BUSINESS FROM THE FLOOR
C. G. Rein - Amended Special Use Permit
Mr. Randy Samuelson and Mr. Mike Rich were present and presented
an amended landscape and site plan indicating proposed changes for
the Arden Plaza development, after meeting with Planner Fredlund
and his staff and various representatives of the Village Committees
and Village staff.
Mr. Rich described the changes, which relat~d to parking, traffic
patterns, roof screenlny, compactor screening, slgnage and graphics
and landscaping. He explained that the changes, as presented, are
conclusions to which Fredlund and the Rein staff have concurred:

Parking: Revised plan proposes a change to 600 angle parking,
in two areas, providing batter orientation and traffic
flow; parallel parking in areas west and south of
shopping center; perpendicular parking elsewhere -
providing a total of 407 stalls (405 required).
Traffic Flow: Revised plan shows 3D' wide entrances from east
and north: 25' wide interior lanes for two-way traf-
fic; 26' wide lanes along west side of shopping
center building; 18' wide lanes for one-way traffic;
16' wide v~e-way lanes in office parking area.
Rich noted that a 5' wide walkway along west side of
building (shopping center) Is provided, and indicated
locations of meters which are protected by guard posts.
Comnactor Screenlno. Compactor is provided with a 10' screen.
Roof-top
Equipment Screening: Rich explained that rooftop
screening, on the multi-shop area has been substan-
tially comp!eted; providing 4t' high redwood fencing
of mechanical equipment on three sides and by the
mezzanine on the 4th side of the super-market portion
of the building. Rich explained that the redwood
screening has been extended to cover the entire roof
of the multi-shop building.

South Boundary Screening: Rich explained that a planting screen
was favored for screening to the south of the site,
and stated that, after discussing the matter with
Dreyfus, I. C. Systems and Planner Fredlund, they are
proposing a row of Black Hill Spruce..-5' to 6' in
height, as Indicated on plan (1-'6-75) 8' onto Dreyfus
and I. C. Systems properties; stating that both I. C.
Systems and Dreyfus have Indicated they are amenable
to this approach. (Cross sections of the three plant-

park configuration (comprising approximately 10 to 12 acres) and
an appropriate legal description (not a survey) for Council approval;

A. Dedication now of 5.946 acres in full satisfaction of dedi-
cation requirements for future division of 49.55 acres now
owned by Rein Co. in area of New Brighton Road and Cleveland
in the event the Counci I approves the subdivision plat.

B. An additIonal dedication of 4.375 acres in lieu of $35,000.00
due on Rein property at Lexi~gton and County Road E.
C., The City has the option to buy additional acres up to a maxi-
mum of 12. (It was noted that about II total acres may suffice.
This flexibility Is needed to arrive at a mutual south boundary
settlement so as not to make unusable pieces of property.) ~.

able title in C. G. Rein and conveyance by a Warranty Oeed to

Ordinance Amending Ordinance No. 142 re Water Meter Char~
Matter deferred to next Counci I Meeting.
MMIR,/nc. Request
Lynden advised that MMIR, Inc. has requested that Arden Hi I Is seek
recourse on bonds for breech of bonds re delinquent taxes, under
New World Inns and IOC on-sale and off-sale bonds (6 In number)
over a three-year period.
After discussion, Feyereisen moved, seconded by Crichton, that Council
direct the City Attorney to take appropriate action to recover the
money for reimbursement to MMIR, Inc. for payment of del inquent taxes
and assessments, minus costs of recovery of same. Motion carried
unanimously.

Arden Manor Sa I es Lo';-
Adam's. request to relocate his mobile home sales lot from the southern
portion of the park to an area north of Prior Avenue, was discussed,
and it was generally felt that if home~ are located on a permanent
pad, on approved lots within the park, they could be considered to
be simi lar to model homes for sale, and, therefore, permissible.
Location of model homes, in areas other than on permanent pads, and
for sale and removal from the park, was considered to be an open sales
lot and not permitted In the R-2 zone.
McNiesh was requested to convey Council's interpretation of the matter
to Mr. Adams by letter, requesting that he submit a drawing of the
site plan of the entire older, or northern, portion of the park, in-
dicating the location and number of mobile home lots, including area
in which he proposes to locate the model mobile homes (they could
be located on any approved mobile home pad in the park).

If area for model mobile homes is in an area not yet approved, plan
must be submitted for approval.
StatistIcal Survey re McDonalds
In review of survey submitted, Lynden requested that an additional
survey be conducted on a weekend, probably noon and ni~ht on a
Saturday. Feyerelsen agreed to request Mounds View students to
conduct this additional survey, and moved that Council authorize
the payment of $12.98 to Jeff Bentler for expenses Incurred In
conducting first survey. Motion was seconded by Wingert and carried
unanimously.

GSA Property Sale
After discussian of answers received to informational questions
re 35 acres for sale In the arsenal grounds, and Lynden's opinion
that InvestmenTs of Village funds in property should serve pUblic
purpose and should not be speculative, Council took no action to
pursue purchase of the property.
REPORT OF VILLAGE TREASURER RICHARD O'KELLY
Treasurer O'Kei Iy reported no Investments since the last Council
meeting.
REPORT OF COUNCILMAN JAMES WINGERT - Planning and Zoning, Board
of Appeals

Case No. 74-~9, Amber Construction Company - Sign Variance
Wingert reviewed Board of Appeals and Planning Commission recom-
mendations th~t Council approve the 4' x 8' non-conforming sign,
as proposed, meeting the 25' setback requirement from both streets.
Wingert noted that a simi lar request for this type of sign was
denied rec9ntly because Councl I felt a 4 sq. ft. sign would be as
effective, and not obJectionable in a residential area.
After discussion, Woodburn moved, seconded by Feyereisen, that be-
cause of the specific location of this sign, Council approve the
variance for the Ambe~ Constructiqn Company 4' x 8' sign; sign to
be located at least 25 feet from property line of both streets;
sign to be permitted for a period not to exceed 18 months. Motion
carried (Feyereisen, Crichton, Woodburn voting In favor of the
motion; Crepeau and Wingert voting in opposition).
Case No. 74-40, Arthur H. Lewis - Front Setback Varianc~
Wingert referred Council to the Board of Appeals report (1-6-75)
and Planning Commission Minutes (1-7-75).
Mr. Grekoff, builder for Mr. Lewis, was present and indicated there
would be no problem In locating house I~ to 15' from north property,
as recommended by the Planning Commission.
After discussion re determination of "front property line" as the
west side of the lot, Wingert moved, seconded by Feyereisen, that
Council approve the 10' front setback variance, as requested; house
to be located 10' to 15' from north property line. Motion carried
(Wingert, Feyereisen, Crepeau, Woodburn voting in favor of the motion;
Crichton abstaining).

Case No. 75-1, Variance for Lot Sp 111' and Consolidation
Wingert referred to the Minutes of the Planning Commission Meeting
of January 7, 1975, In which the Planning Commission recommends
Council approval, in concept, of combining Lot 7 (Bussard Addition)
with Lot 9 (Prcposed Lametti Addition) and that a letter be sent to
Mr. Anderson and Mr. Lametti re this action by the Council. He ex-
plained that formal application would be made after negotiations and
agreement with Mr. Lametti have been completed.
After discussion, Wingert moved, seconded by Clrchton, that Council
approve the lot spl it and consolidation, as described, In concept,
and authorized McNiesh to convey Council's action to Mr. Lametti
and Mr. Anderson by letter. Motion carried unanimously. It was noted
that a park dedication would be required re property to b~ purchased
from Lametti; Council suggested 10% of purchase price be payable to
the Village at the time of approval of lot spilt and consolidation.
