MINUTES OF SPECIAL COUNCIL MEETING Village of Arden Hills Monday, September 23, 1974 - 8:00 p.m. Village Hall Call to Order The meeting was called to order by Mayor Henry J. Crepeau, Jr., at 8:00 p.m. Roll Call Present - Mayor Henry J. Crepeau, Jr., Councilmen William Feyereisen, James Wingert, Charles Crichton, Stan Olmen. Absent - None. . Also Present - Attorney James Lynden, Treasurer Richard O'Kelly,' Parks Director John Buckley, Finance Committee Chairman Ward Ranson, Clerk Administrator Charlotte McNiesh, Deputy Clerk Dorothy Zehm. Approval of Minutes The Minutes of the Regular Council Meeting of September 9, 1974, were approved as amended. BUSINESS FROM THE FLOOR Robert Peterson, 1112 Carlton Drive - Case No. 74-30 Mr. Peterson presented a letter to the Council requesting that the Council reconsider his request for a sign at Bussard Court and Snelling Avenue. After review of the letter, and discussion re the proposed construction and placement of the sign, Crichton moved that the Council approve a sign variance for a 3' x 5' sign at Bussard Court and Snelling Avenue for a period or three years, or until the last lot is sold, whichever should occur rirst. Motion was seconded by Feyereisen and carried ~animously. REPORT OF VILLAGE ATTORNEY JAMES LYNDEN Resolution reRamsey County Open Space Nature Trail After review of Attorney Lynden's letter of 9-23-74, and Resolution concerning the pedestrian and nature trail proposed by the ,Ramsey County Open Space Commission, Wingert moved, seconded by Olmen, that the Council approve Resolution No. 74-29, RESOLUTION .l\.PPROVING NATURE TRAIL PROPOSED BY RAMSEY COUNTY PARKS AND OPEN SPACE COM- MISSION, as amended, and authorized its execution by the Mayor and Clerk Administrator. Motion carried unanimously. Burning of Leaves Attorney Lynden referred the Council to his letter of 9-23-74 re burning of leaves, explainins that APC8 of the Rules and Regulations of the Minnesota Pollution Control Agency, adopted by reference in Village Ordinance No. 135, remains substantially un- cha~ged since its adoption and prohibits the open burning of leaves and other refuse anywhere in ~tlnnesota, with certain exceptions. Lynden further explained that Minnesota Pollution Control Agency has issued permits to municipalities which have requested approval of sites within their jurisdiction for the burning of diseased trees, and he referred the Council to the six requirements specified in Section (d) (5) of Rule APC8. -. Ramsey County Open Space Land Acquisition After discussion by the Council re the apparent deletion of certain lands in Arden Hills from the land acquisition program by the Ramsey County Open Space Commission, Crichton agreed to draft a letter re Ramsey County deleting certain parcels without Council approval of the deletion. Surface Water Regulations Wingert referred the Council to a letter from the Minnesota Department of Natural Resources (9-6-74) re the proposed Water Surface Use Regulations on Lake Johanna. After discussion, Attorney Lynden was authorized to prepare an ordinance for Council consideration on September 30, 1974. REPORT OF VILLAGE ENGINEER DONALD LUND (absent) -1- . l , .. Minutes of Special Council Meeting Page two September 23, 1974 Nursery Hill Utilities - Bids After review of the seven bids received and Engineer Lund's letter of 9-23-74. recom- mending that the bid be awarded to the low bidder, Erwin Montgomery Construction Com- pany, the Council deferred its action until the September 30, 1974 Council meeting pending reaction from Amber Construction Company re the bids received. McNiesh was requested to contact Mr. Breems and to relay his comments to the Council prior to September 30th. . Steak Inn Water Connection - Mr. HaRe tIr. Hage reviewed the problems he encountered re the proposed construction of the 8" water line along the south side of County Road E to serve the Steak Inn restaurant, and their subsequent decision, after discussion with Councilman Crichton, Fire Chief Fischer, Building Inspector Squires, Engineer Lund and the County Highway Department, to extend a 2" line under County Road E; eliminating the sprinkler system originally pro,pO$ed. In discu$sion, it was noted by the Council that the propo$ed 2" line would remain a 'private line and would be the respon$ibility of the Steak Inn to maintain. Arden Manor - Statu$ Report Mr. and Mrs. Adams were present and submitted a letter to the Council. Mr., Jim Parker. Advance Engineering Company, informed the Council that his firm ill replacing Suburban Engineering Company, and will be completing the inspections for the Arden Manor Mobile Home Park. In discussion of the water $ystem, Parker said that by installing a 25 hp pump. and adding a $torage tank, it is anticipated that the existing well would produce an additional 250-300 gpm, which would provide an adequate water snpply for the approxi- IIlSte 50 units in the first phase until a new well, can be built. Mr. Adams said he intends to construct the building now and anticipates that the portion whieh would house the storage tank could be finished in about one month. Mrs. Adams explained that 5 or 6 people are rea4y to move into the park imlIIediately (she had told them, overt:wo months ago. that thay could move into the park). She said there are six vacancies in the old portionaf the park. and asked if the Council loJould permit these 6 occupancies in the new park;this would not increase the load on the present water system. Council requested Mr. Adams tameet with Engineer Parker and Village Engineer Lund, in an effort to resolve the water problem. When specifications are agreed upon, and the area and number of units the system will adequately handle is determined, and outlined on a map. the Council agr,eedto hold a special meeting to c.ohsider the proposal. McNiesh ~~s requested to ask Attornev Lvnden to render an opinion re owner allowing oecupancy of the park prior to Council's approval. . 'Tennis Court LightinR Project Council reviewed Engineer Lund' s letter of 9-23-74, ,re Tieso Electrical Contractors, Inc. letter of9..19-74 requesting completion date extension for the Mounds View Tennis Court Lighting Project. After discussion, McNiesh was asked to obtain a written request for the time extension from Tieso Electrical Contractors, Inc., explaining all work included in the request for the delay of completion. REPORT OF VILLAGE TREASURER RICHARD 0' KELLY O'Kelly reported an i~lestment of $330.000 for 120 days @ 10.40% on September 23, 1974; anticipating an additional $115,OOO investment on September 25th. -2- .. Minutes of Special Council Meeting Page three September 23, 1974 REPORT OF COUNCILMAN JAMES WINGERT - Planning and Zoning, Board of Appeals Metro Transit Bus Route Proposal Wingert described a proposed bus route from Northdale to St. Paul which will involve a portion of Arden Hills from Highway 8 along Highway 96 to Hamline Avenue~ south on Hamline to County Road F, east on County Road F to Lexington etc. to St. Paul. Wingert said that at present road widths are adequate; so, no road up-grading is needed; we will be required to place sign along the route eventually (signs will be furnished by Metro Transit, to be installed by the Village). . After discussion, Council requested McNiesh to convey-the Council's endorsement of the bus route as proposed. Proposed Surface Water Regulations (See Attomey , s Report) REPORT OF COUNCILMAN STAN OLMEN - Finance 1975 Budget Olmen introduced Finance Committee Chairman Ward Hanson wbo presented the proposed 1975 Budget recommended by the Finance Committee for Council approval. Mr. Hanson reviewed the 15 points on whicb the Finance Committee had reached a consensus, and advised that, if adopted, the proposed budget of $227,444 would re- quire a mill rate levy of 9.533, slightly above the 1974 mill rate. Olmen moved, seconded by Crichton, that the Council adopt the 1975 Budget as recom- mended by tbe Finance C01Jllllittee. In discussion, Crichton reported that after meeting with Lake Johanna Volunteer Fire Department, Shoreview and North Oaks re tbe 1975 proposed fire contract, he moves that the motion be amended to reduce the Fire Protection Account No. 332 expenditure by $3,000. Motion was seconded by Wingert. . The amendment to the motion carried unanimously. Crichton moved, seconded by Wingert, that the motion be further amended to reduce Park Site lmprovement account No. 510 by $7,900. Crichton expressed concern about rising costs in the present economy and stated he would like, if possible, to cut Village taxes. This $7,900 reduction rel<1tes to proposed capital improvements to various school properties; since the Council recently approved an expenditure for lighting tennis courts at Mounds View High Scbool, Crichton expressed concern about spending this additional Village money for further improvements on school property in 1975. Feyereisen concurred with Buckley that it is cheaper to improve existing school facilities rather than build facilities in our parks and felt Village should consider best use of total facilities in the Village. After, considerable discusflion, the motion on this amendment carried (Crepeau, Crichton, Wingert, 01men voting in favor; Feyereisen voting in opposition). . The original motion carried (Crepeau, Crichton, Wingert, Olmen voting in favor; Feyereisen voting in opposition). (Feyereisen noted that his opposing votes do not mean he is opposed to a tax decrease.) The Mayor and Council thanked the Finance and other committees for their conscien- tious work on the 1975 budget. REPORT OF COUNCILMAN CHARLES CRICHTON - Public Works Public Works Department Employees Crichton moved, seconded by Wingert, that the Council approve the employment of John Thompson (On-the-Job Training Program) at $2.50 per hour in the Public Works Department. Motion carried unanimously. Crichton moved, seconded by Wingert, that the Council approve the full-time employment of Eugene Waldoch in the Public Works Department at $5.10 per hour, starting October 1, 1974.' After completion of a satisfactory 6 months probationary period, salary to be raised to the "then lowest" Public Works Department rate. Apache Container - Application for Buried HOlding Tank Crichton presented a request from Apache Container Company to bury a 1500 gallon pre- cast concrete tank in which they propose to store ''water soluable draw and iron fluid", a waste product which may not be disposed of in the sanitary sewer system. He explained that this fluid will be trucked to Minnesota Pollution Control by tank truck for dis- posal, rather than in arre1s, which is their present procedure. After discussion, Crichton moved that the Council approve the issuance of a permit for the installation of the proposed holding tank; Building Inspector to convey code soecifications to P1umbin~ Inspector for inspection of the installation; sewer permit to be issued for a holding tank, and inspection fee to be $25.00. Motion was seconded by Olmen and carried unanimously. . Bethel Student Housing After review of Building Inspector Squire's memo reporting completion of the student housing corrective fire protection construction at Bethel College, McNiesh was requested by the Council to contact Fire Chief Fischer, advising him that this work has been completed and requesting his report re compliance with corrective measures he had requested. REPORT OF COUNCILMAN WILLIAM FEYEREISEN - Parks and Recreation, Human Rights Rice Creek Watershed District Meeting - September 18, 1974 Feyereisen reported that Rice Creek Watershed District, at its meeting on 9-18-74, advised they would study the comments submitted by the various municipalities re the Rice Creek Watershed Plan, and would welcome additiDnal comments as well. Feyereisen reported that the Plan was not adopted at this meeting. After discussion of Roseville's Resolution, Wingert was requested to convey the Council's concerns re certain portions of the proposed Plan to the Rice Creek Watershed District. Feyereisen stated he was most impressed with the Board's handling of Rice Creek Water- shed Permit requests which were considered at this meeting. Karth Lake Property Appraisal Cost Crichton reported that Mr. Elmquist had estimated a cost of $75.00 to prepare an estimated land value of property in question; if a full-blown appraisal is later desired, the $75.00 would then be applied to this cost. Feyereisen moved that the Council authorize Crichton to negotiate with Mr. Elmquist to secure an estimated land value. Motion was seconded by Wingert, and carried unani- mously. Shade Tree Disease Control Matter deferred to meeting of September 30, 1974. ,Park and Recreation Department Employee F~ye~eisen moved, seconded by Olmen, that the Council approve the part-time employment of Stephen Zehm in the Parks Department for the fall and winter season, until roughly March 1, 1975 (10-15 hours per week) at $3.50 per hour, starting immediately. Motion carried unanimously. . Highway Department Berm Construction - Status Report 'Feyereisen reported that the Highway Department has replaced the berm along 1-694 at Hamline Avenue and the neighbors seem satisfied that the sound barrier has been restored. He reported that Mr. Perez, Minnesota P~11ution Control, has stated he will meet with the Highway Department again to verify that construction was completed according to specifications. Feyereisen agreed to answer letter from Mr. McVay on behalf of the Council. Operating Engineers Local 49 Council set two alternate dates to meet with Union Local 49 re 1975 Contract: Wednesday, September 25, 1974 - 7:30 p.m. or Thursday, October 3, 1974 - 7:30 p.m. McNfesh to contact Union Representative J. CREPEAU, JR. - General Government, Public Safety Seminar Feyereisen moved, seconded by Ceichton. that the Council authorize Police Chief Sexton's attendance at a Criminal Justice Seminar. Oct. 6-8, 1974, at $84.75; Village cost to be $24.75 plus mileage (if personal car is used). Motion carried unanimously. Speed Limit Request - Indian Oaks Trail Matter referred to Public Safety Committee for speed recommendation. . Letter from Resident re Licensing of DollS and Not Other Pets McNiesh was requested to inform the resident that the Council will set forth in his letter. Matter was deferred to a later meeting. . consider the proposals National Alliance of Businessmen Job Recruiters - Proclamation Mayor Cr.epeau read the Proclamation declaring the week of Sept. 30 to October 4 to be "Job Week", after which Cri~hton moved, seconded ,by Feyereisen, that the Council authorized its execution by the Mayor. Motion carried unanimously. Letter from Mayor Bromander, New Brighton, Re Proposed Area-wide Golf Course Matter was deferred to meeting of September 30. 1974. Arden Hills Club - Sian Status Matter was referred to Police Chief Sexton to issue citation if unapproved eign has not been removed or properly located and licensed. Vacant Ilouse at 3403 Johanna Boulevard Council requested Building Inspector Squires to r,eport status prior to September 30, 1974 meeting. REPORT OP CLERK ADMINISTRATOR CHARLOTTE MCNIESH . _tera Park Landscape Inspection McNiesh reported that Mr. Schutta has completed the landscape inspection on the first phase of Hunters Park. Council requested McNiesh to bill Dreyfus $35.00 for the cost of the inspection, noting that by 1975, the Village hopes to have adopted a schedule of standard landscape inspection fees. Pilings for Village ,Election McNiesh reported tbat filingS open on Tuesday, September 24th and close Tuesday, October 8th for the two Councilmen to be elected on November 5th for 4-year terms.
