Approval of Minutes The Minutes of the Regular Councl I Meeting of August 26, 1974, were apprQved as amended. BUSINESS FROM THE FLOOR Rice Creek Watershed DIstrict Hearing - Roger Short EngIneer Roger Short reported that he attended the Rice Creek Water- shed Hearing. as a representative of Arden HI lis and Rosevll Ie. He said he requested addItional tIme to allow Arden Hills to complete Its review of the plan and submit comments. The request was granted, asking that comments be received by the next Rice Creek Watershed meeting on September 18, 1974. Mr. Short stated that he Is generally In favor of the Watershed Plan as proposed, but feels that the policies are quite "vague", which could lead to some uncertainty as to where responsibility lies, In SOILe Instances. Council concurred with Mr. Short's suggestion that the Councl I review the plan, especially the policies section, and submit comments for Rice Creek Watershed District consideration at Its meeting on Septem- .' ber 18, 1974. REPORT OF VILLAGE ATTORNEY JAMES LYNDEN Stave-Clatterbuck Agreement re Maintenance of Private Lift Station, Sewer and Water Lines. Lynden reviewed the agreement draft which he had prepared for Council cons I deration. After discussion, Wingert moved, seconded by Feyerelsen, that the Council approve AGREEMENT RE OPERATION, MAINTENANCE AND REPAIR OF SANITARY SEWER, WATERLINE AND LIFT STATION AND MUTUAL RESTRICTIVE COVENANTS, as amended; changing language In paragraph 7 to Include Attorney's fees, and authorize execution of the agreement by the Mayor and Clerk Administrator after It Is executed by Stave, Clatter- buck and the contractor, Motion carried unanimously, . Speed Limits on Village Streets Lynd'..n referred the Council to his letter of September 5, 1974, re procedure to effect speed changes on Village streets; suggesting that a resolution be prepared when appropriate speed for A;~IJit~ Court has been recommended by the Public Safety Commlttee~. ~--~- Watermaln Connections, South Side of County Road E Lynden referred to hIs letter of September 9, 1974, re Case No. 74-15, A-rthur W, Hage re financing procedure for future connections to water main along the south side of County Road E. In discussion, concern was expressed re determination of amount each "connector" would pay. Lynden was requested to discuss the matter with Ik. Hage before preparing the agreement for Councl I considera- tlon. Development Agreement, Hunters Park - Fourth Addition Lynden referred the Council to the Hunters Park, Fourth Addition Develop- ment Agreement and to his letter of September 6; 1974. -1- ,. Minutes of Regular Council Meeting Page two September 9, 1974 After discussion, Wingert moved, seconded by Feyerelsen, that the Councl I approve the Development Agreement Re Hunters Park Fourth Addition, as presented, subject to correction In title to "Fourth" Addition; authorizing Its execution by the Mayor and Clerk Adminis- trator after It has been executed by Dreyfus Interstate Development Corporation. Motion carried unanimoUSly. (It was noted that park dedication Is not Included In the Development Agreement.) Hunters Park PlantIng Lynden reviewed a letter request from Dreyfus Interstate reQuesting the Inspection and acceptance of plantlngs Instal led on August 19, 1974; one year guarantee beginning on receIpt In wrIting of acceptance. . Mr. Schwa.kopf explaIned that once the grade is established, plantlngs are Installed; Intent Is to plant as much as possible during the plant- ing season. After dIscussion of the plantIng substitutIons and revIew of Planner SchmId's report (8-30-74), Schwawkopf assured the Council that, If substItutions a~i~L~~~~o~9YJ.~~tlon will be given, and approval reques~~~1n~ditl-~ne-'~~4 fal I plantlngs, he said he anticipates plantlngs next spring and next fall, requiring two more InspectIons In 1975. The Council concurred that the phased planting, as described, would be acceptable and InspectIons wIll be made accordingly, Hunters Park, Third Addition - Final Plat Wingert referred the Council to reports from the EngIneer, Attorney. Planning CommIssion and Planner, all Indicating that the FInal Plat conforms to the PrelIminary Plat of Third AddItion. After discussIon, Wingert moved that the Council approve the Final Plat of Hunters Park, Third Addition, as presented. MotIon was seconded by Crichton and carried unanlmuosly. Hunters Park, Fourth Add.ltlon - Preliminary Plat Wingert revIewed the Planning Commission recommendatIons (Minutes of 9/3/74), reports from the Engineer (9-3-74) and Planner (9-3-74) and letter from Attorney Lynden re alternative park dedicatIon methods (8-29-74) . After discussIon of the three park dedication alternatIves, Crichton moved, seconded by Wingert, that the Councl I Instruct the Attorney to proceed with the third alternate (Attorney's letter of 8-29-74). Motion carried unanimously. (Lynden noted that the park dedicatIon wi II not be shown on the plat, but will be a separate Instrument filed contemporaneously with the Plat.) REPORT OF VILLAGE ENGINEER DONALD lUND , New BrIghton Road Drainage - BIds Lund revIewed the eIght bIds received for the New BrIghton Road Storm Sewer Project and referred the CouncIl to the tabulation of bIds of the three low bidders and to hIs letter of September 9, 1974, explaining his reasons for recommending that the bId be awarded to the second low bidder. Mr. Dick lund, Underground UtIlities Company (low bidder) was present and explaIned that Underground Uti Iltles has recently merged with B & B Excavating Company (Mr, Borchert, President), and they are completing B & B Excavating Company contracts; they are not B & B ContractIng Company doIng business under a new name. He saId they have been engaged In Iowa, particularly wlth Northwestern Bell Telephone Company, Instal- ling underground cable, etc. -2- , . ,. Arden Manor - Status Report Lund submitted copies of Suburban Engineering Company's report and reported that Mr. Adams had conducted a test on the water system last week, but did not notify his offIce, Suburban Engineering or the Village; so the pressure test was re-run today; results of which are satisfac- tory, He advised that the electrical conductivity test has not been run. . (It was noted that occupancy of the mobile home park is to be with- held untl I Mr. Adams meets with Councl I and submits a drawing Indi- cating the area to be approved for occupancy, electrical conductivity test has baen satisfactorily run and matter of wel I upgrading resolved.> Mounds Vjew High School Tennis Court Llrhtlng Bids Lund reported that three bids were rece ved: Tleso Electric Company Collins Electric Company Batzll Electric Company $8,267 12,750 14,900 and recommanded awarding the bid to the low bidder, Tleso Electric Company. Feyerelsen moved, seconded by Olmen, that the Councl I award the bid for the tennis court lighting at Mounds View High School to Tleso Electric Company, In the amount of $8,267. Motlo~ carrIed unanimously. REPORT OF VILLAGE TREASURER RICHARD O'KELLY O'Kelly reported no Investments since the last Council meeting. REPORT OF COUNCILMAN JAMES WINGERT - Planning and Zoning, Board of A-ppea I s Case No. 73-28, Dreyfus - Hunters Park: A. Final Plat - Third Addition (See Attorney Lynden's Report> B. Preliminary Plat - Fourth Addition (See Attorney Lynden's Report> Case No. 74-30, Variance - Sign Wingert reviewed the variance application for a 4' x 8' s'gn adver- tising, "Will Build to Suit on These Choice Homesltes". wingert referred the Council to the Board of Appeals report (9-3-74> and Planning Comm~sslon Minutes (9-3-74>, both recommending approval .,of the variance, and moved that the Council approve the variance for a period not to exceed three years, or until the last lot Is sold, ~hl~hever event occurs first. Planner Otto Schmid Resignation Wingert reported that Mr. Otto Schmid has accepted a~ assignment In the St. Cloud area as Director of the Regional Development Commission. Mr. WI'lgert said that Mr. Richard Fredlund of Nason, Wehrman and Chapmwl will be briefed on Arden Hills planning matters and will meet ~Ith the Planning Commission at Its Special Meeting on Septem- ber 24th. Th~ Councl' extended an Invitation to Mr, Fredlund to attend a COuncil . meetl ng I n the near future. ~EPORT OF COUNCILMAN STAN OLMEN - Finance (No report) Feyerelsen referred the Council to Finance Committee Chairman's memo and expressed disappointment that the Committee did not consider alterna- tives, e.g. what services could be added If the mill rate 15 Increased, etc. He said he would relay his comments to the Finance Committee at the joint-meeting on September 12th. REPORT OF COUNCILMAN CHARLES CRICHTON - Public Works Inspections - Sewer. Water. Roads Crichton reported that the Public Works Department has experienced the tendency of developers and/or contractors to request Inspections before they are ready, necessitating additional Inspections. The Public Works Committee recommends that a fee be established for In- spections made, after the Initial Inspection. Leaf Burn I ng Crichton reported that the Public Works Committee recommends that Attorney Lynden research State law re burning of leaves, Buckley suggested the research also Include tree burning as a means of elimina- ting diseased trees. The Council concurred and requested McNlesh to ask Lynden ~o research the I aw . Bethel Master Meter Crichton reviewed the status of the master meter negotiations with Bethel College and reported that the Public Works Committee recom- mends th at the Councl I req uest bids for the Bethe I Maste r Mete r; re- suits of which wi II be the basis for further negotiations with Be+hel Co I lege. . . Crichton moved, seconded by Feyerelsen, that the Councl I authorize EngIneer Lund to prepare the Bethel Master Meter ProJect.spec:flcatlons and adVertise for bids. Motion carrIed unanimously. Human RIghts Ramsey County Open Space - Proposed Nature Tral I _ Mr. Larry Holmberg, Ramsey County Open Space, descrIbed a proposed nature trail, circlIng the low area west of Mounds View High School, north of County Road E2, and distrIbuted copIes of a map IndIcating the proposed 6' wIde pedestrian tral I on whlc~ no motorized vehIcles wI II be permItted. The CouncIl expressed concern re Its use by snowmobIles, motor cycles, etc. brIdges would be a deterrent and the . He said two or three brIdges are proposed over the wet areas; the tral I wi II not be hard surfaced, just mowed; they plan to clear areas of ~olson Ivy. The portIon through school property wi II be under a joInt powers agreement wIth Mounds View School DIstrict, anticipatIng potentIal use of the tral I by the two schools (Mounds View HIgh-School and ValentIne Elementary) and by the Ramsey County Library, for nature and environmental programs. After discussion, Wingert moved, seconded by Feyerelsen, that a reso- lution be prepared approving the concept of the proposed nature trail; resolution to Include Installation of proper slgnage along the trail that motorized vehicles are not permitted and that structural Impedi- ments wi II be Installed on the brIdges. Motion carried unanimously. Land Acquisition In Johanna East Area Buckley stated that the Parks CommIttee recommends that a 10-acre park area be obtained In the area north of County Road E, south of the 500 Line tracks, between Highway 10 and Hamllne Avenue. He said Reverend Peterson, Twin CIty ChristIan Homes, had proposed dedication of a linear ~ark In this area (If they should proceed with theIr building applicatIon In thIs area). Buckley' said it may be possIble to obtaIn two or three acres, In addI- tIon to the proposed linear park from ChrIstIan Homes, whIch are adjacent to four lots owned by another party with whom Buckley has had prelIminary contact re possIble sale for park purposes. Land AcquisItion In Johanna West Area Buckley reported he has talked with Mr. Samuelson, C. G. Rein Company, re avaIlabilIty of up to 10 acres in the New Brighton Road portion of the C. G. ReIn acreage, north of the church property. Karth Lake Area Park AcquIsItion CrIchton reported that he contacted Lund Realty re appraIsal costs of the proposed Karth Lake park sIte. Lund Informed hIm that realtors can make an estImate of land value, but not an appraIsal - appraIsals are consIderably mor elaborate, The Councl I concurred that an estI- mated land value Is what Is needed In order to begin negotIations. Matter was referred to CrIchton. to obtain costs for Council consIderatIon at the next Councl I meeting. . Ingerson Park Access Buckley reported that Mr. Moss has IndIcated he Is not Interested In the land trade proposed. Buckley reported that a neIghborhood meeting re Ingerson Park access Is beIng planned; Council wIll be Informed of tIme. and place .of meeting. Shade Tree Disease Control Buckley refe~red the CouncIl to his memo re control of shade tree dIsease and asked for Council reaction to hIs suggested ordinance amend- ments. Counc! I requested Buckley to obtaIn copy of North St. Paul's contract for tree removal, Matter was deferred to the next.Councl I meeting. Blacktopping Bids - Various Parks After revIew of the two bids received, Feyerelsenmoved'1 seconded by CrIchton, that the Counc! I award the bid to T. A. Schlfsky In the amount of $1,626.00. REPORT OF MAYOR HENRY J. CREPEAU, JR. - General Government, PublIc Safety AudIo Equipment Crepeau referred the Council to the cost estimate receIved from H. H. H. Sales ana Service for audio equIpment and Installation @ $2,019; . firm bid for 30 days. After discussion, Council referred the matter to Wingert to obtain additIonal quotes for Council consIderatIon. County Levy for SenIor CItizen Program Crepeau referred the Council to the letters from Senator Jerome M. Hughes (8-23-74) and Commissioner Knaak (9-4-74) re the mill levy which legislature authorIzed County to levy for senior citizen Pi"()grams. The Council concurred that It should be determined what addItIonal programs should be establIshed that would be appropriate for senIor citizens prior to County levying for the program. Councl I suggested that the Mounds View School DIstrict Community EducatIon DIrector be contacted re coordination of programs. McNlesh was requested to relay the CouncIl's opInIon to CommIssIoner Knaak. REPORT OF CLERK ADMINISTRATOR CHARLOTTE MCNIESH Claims and Payroll CrIchton moved, seconded by Wingert, that the CouncIl approve the Claims and Payrol I as presented. Including an added claim In the amount of $24.72 to RIchard Shetler. Motlan carrIed unanimously. Dog Licensing Enforcement Council concurred that the Dog Licensing Ordinance should be enforced.
