Crepeau, Jr. at 8:00 p.m. Mayor Crepeau welcomed Senator John Milton who had met with his Arden Hills constituents prior to the Council meeting. . Roll Call Present: Mayor Henry J. Crepeau, Jr., CounCilmen Charles Crichton, William Feyereisen, James Wingert. Absent: Councilman Stan Olmen. Also Present: Engineer Donald Lund, Parks Director John Buckley, Clerk Administrator Charlotte McNi~sh, Deputy Clerk Dorothy Zehm. Approval of Minutes The minutes of the Special Council Meeting of July 22, 1974, were approved as amended. Feyereisen suggested that copies of Council Meeting minutes be available at Council meetings so those in attendance may follow Council's actions; Council concurred. BUSINESS FROM THE FLOOR Liquor License Applications - Ramada Inn - McGuire's Mr. Cass explained that there is a change incorporate structure; therefore, new liquor license applications are being submitted for Council approval; licenses to be effective August 1, 1974. After discussion, Crichton moved, seconded by Wingert, that the Council approve the issuance of On-Sale, On-Sale Sunday and Off-Sale Liquor Licenses for Ramada Inn- McGuire's, subject to approval of applications and bonds by Village Attorney. Motion carried unanimously. REPORT OF VILLAGE ATTORNEY JAMES LYNDEN (Absent - no report) REPcmT OF VILLAGE ENGINEER DONALD LUND Lexington Avenue Drainage Plans Lund submitted copies of the Lexington Avenue Drainage Study for Council consideration; study includes alternate plans which were briefly described by Lund, advising that estimated costs of land or eas~nts are not included, only engineering and construction. Council requested McNiesh to send copy of report to Shoreview for their input. . Nursery Hill Utilities and Street Plans Lund submitted plans for the construction of utilities and street in the Nursery Hill Plat and recommended th~t. the Village advertise for bids as soon as possible; advising specifications will be ready in a few days. After discussion, plans and specifications were referred to the Public Works Committee for review and recommendations to the Council at the next Council meeting. j Eide Circle Performance Bond - Ii " ! Lund reported that some street settlement repairs in the Eide Terrace Plat are pending completion; last fall repairs were delayed pending current house construction completion " in Eide Terrace. Lund recommended that the Village approve a reduction in the performance bond to $1,000, covering the remaining work. ,,~9 Village Council Minutes -2- July 29, 1974 After discussion, Feyereisen moved, seconded by Wingert, that the Council approve that a Performance Bond in the amount of $1,000 be submitted for completion of repair work in Eide Terrace; motion carried unanimously. REPORT OF VILLAGE TREASURER RICHARD O'KELLY (Absent - Report by McNiesh) Investments Plans to invest $205,000 for 90 days at 11.25% on August 30, 1974, at First National Bank of St. Paul. . REPORT OF COUNCILMAN JAMES WINGERT - Planning and Zoning, Board of Appeals Case. No. 74-26, Mounds View School District 621 - Building Permits Mr. Chatfield and Mr. Winsor (architect) described the two steel buildings proposed for classroom use at Mounds View High School and submitted plans for review (dated July 23, 1974), signed b~ Architect Mark F. Winsor, Bissell Belair and Green, Inc. AFter review of the plans and discussion, Wingert moved, seconded by Feyereisen, that the Council approve issuance of the building permits for the two steel buildings, in accordance with plans, dated July 23, 1974, subject to approval of Fire Chief Fischer. Motion carried (Wingert, Feyereisen, Crepeau voting in favor of the motion; Crichton voting in opposition). It was noted that plans will have to also receive approval by the State, prior to issuance of the building permits. Case No. 74-14, Pemtom, Inc. - Special Use Permit Wingert referred the Council to Attorney Courtney's letter of July 26, 1974, stating that the need for a "new Special Use Permit" is clear, but that he still has trouble re the density calculations. Crichton stated that he cannot agree with a more dense development than the ordinance allows. Feyereisen stated he feels that Attorney Courtney has answered this question in his letter of July 26, 1974, but if there are still questions, which Attorney Lynden can clarify by a review of his density calculations of 1972, perhaps the matter should be tabled until his return. After discussion, matter was tabled to the next Council meeting on August 12, 1974. Case No. 74-14, Sheehy Tennis Court The status of the Sheehy tennis court construction between Ridgewood Road and Snelling Avenue, north of GleDhill Road,. was reviewed by Wingert, advising that the Department of National Resources has stopped the construction-pending the applicant's obtaining a permit from DNR. Mr. and Mrs. Bill Krueger, 3160 Rid~od Road, said they were surprised when filling began. Mr. Krueger said he does not object to the tennis court, but expressed con- cern for the protection of the swamp, which is a wildlife area. . Crepeau explained that the Council acted in good faith when it approved the issuance of the building permit, taking steps deemed necessary and required by ordinance: the confusion has apparently arisen from lack of communication. . Mr. R. Sheehy reviewed the verbal approval of the fill project received from Engineer MacLennan of the Rice Creek Watershed District: explaining that the written approval is necessarily delayed pending the completion of the fill so an aecura~B description of the portion of land to be deeded for open space can be defined. Mr. Joe Kahnke, 1541 Edgewater, objected to fluctuations in the lake level and questioned the advisability of the issuance of the tennis court building permit which may disburh the utility of the swamp in connection with the lake. -?- . '" - Village Council Minutes -3- July 29, 1974 R. Sheehy reported he has discussed the project with Mr. Ronald Imrnsck, DNR, who said he anticipated no problem in obtaining a permit from DNR. The matter was referred to Mr. Sheehy to pursue with Rice Creek Watershed District and DNR, submitting approval from both to the Arden Hills Council prior to proceeding with the project. Case No. 72-50, Comprehensive Development Plan The proposed Arden Hills Comprehensive Development Plan (Revised 1974) was reviewed by the Council and suggestions re wording changes, deletion of repetitive statements and correlation of maps and text were made. . Planner Schmid reminded the Council that a Comprehensive Development Plan must be a flexible document containing continually changing materials describing a program for the Village. It should not be confused with Zoning, which is the implementation of the Plan. Schmid explained that the Comprehensive Plan can be used as the basis for reaching determinations in the Village (i.e. zoning changes, etc.). If the change is in accordance with the policy statements of the Plan, it can be deemed ,"o.k. to proceed". Schmid said that the legal basis of the Plan comes mainly from the policies; a "policy statement" should back up each "goal". In discussion of ~h~ Park Plan, Schmid said this Plan should also include goals, policy standards statistcs, .etc.,indicating what the Village intends to do; without this, there would be no basis for implementation of the Park Plan. After discussion, the Council commended the Planning Commission for its untiring work and effort in the development of the Plan, and concurred that a con4ensus should be achieved by the Council re recommended changes to the Plan prior to its reconsidera- tion by the Planning Commission. (Council members agreed to convey proposed changes to each other in an effort to obtain a consensus.) REPORT OF COUNCILMAN STAN OLMEN -; Finance (Absent) Garage Sale Permit Crichton moved, seconded by Feyereisen, that the Council approve the permit for a garage sale at 1906 Grant Road, on August 8 and 9, 1974, aa requested by R. Hebert. Motion carried unanimously. Audit Referral Council directed McNiesh to refer the recently completed Village audit to the Finance Committee for its review. REPORT OF COUNCILMAN CHARLES CRICHTON - Public Works No report. . REPORT OF COUNCILMAN WILLIAM FEYEREISEN - Human Rights, 'Parks and Recreation Mounds View Joint Powers Agreement After discussion of alternate lighting proposals and review of memo from Buckley, July 1, 1974, Feyereisen moved, seconded by Crichton, that if the Joint Powers Agree- ment is signed by both Mounds View School District and Arden Hills, the Council autl.cl"izes advertisement for bids on the specificatioQs for Alternate 111 with two meters (see memo of July I, 1974) for the lighting of courts. Motion carried unanimously. REPORT OF MAYOR HENRY J. CREP~U, JR. - General Government, Public Safety Street Light Request - Mrs. Floyd Olson Crepeau reported that Mrs. Floyd Olson, 1900 Edgewater Avenue, requests the installa- tion of a street light at Edgewater Avenue and New Brighton Road. -3- . After discussion re effect light may have on others in the neighborhood, McNiesh was asked to contact Mrs. Olson and request that she obtain comments from six or seven affected neighbors for review by the Council. Stophlet Realty Letter Matter was referred to Building Inspector Squires for his recommendations to the Council. REPORT OF CLERK ADMINISTRATOR CHARLOTTE MCNIESH . Claims and Payroll After review, Wingert moved, seconded by Feyereisen, that the claims and payroll be approved as submitted. Motion carried unanimously.
