Absent: None. Ihlrd Addition - Preliminary Plat ~ Engineer Lund referred the Council to his letter of July 2, 1974, written In response to letter from Mr. Len Olson of Bether, Ringrose and Wolsfeld, recommending controlled entrance conu.ltlons to the southwest pond with storm sewer outlet llmi~ed to 24 CFS. B. Mro Olson described the existing land contours and proposed plan to deepen the ditch two feet so that the overflow elevation would be 914 Instead of the formerly proposed 916; providing greater assurance that an overflow condition would be contained and allowed to flow westerly. Mr. Olson said they are working with residents to the south of this area and propose to blend the terraIn with the properties south of the Dreyfus development so that water would flo; westerly overland without backup onto local residents' property. Olson explained that certain lots In the Dreyfus development will necessarily be restrls:ted to "no basement" ~~~~~~~Ld"-~ After discussion, Wingert moved, seconded by Feyereisen, that the Council approve the Preliminary Plat of ~unters Park, Third Addition, contingent upon acceptance by Dreyfus Corp. and Arden Hills of Development Agreement, to be drawn by Village Attorney, detailing drainage re~ulrements. Motion carried unanimously. Access Road to C':ou!!!L. Road E Engineer Lund referred the Council to his letter of JUly 22, 1974, re estimated cost for preparation of a feasibility study concerning the westerly extension of Harrle+ Avenue with access to County Road E. . A. Counci' Minutes -3- July 22, 1974 . REPORT OF COUNCILMAN JAMES WINGERT - Planning and Zoning Board of Appea I s Case No. 74-14, Pemtom. Inc. - Special Use Permit for North Area Mr. James Hill briefly reviewed the 140-unlt townhouse development proposed for the north area of the Pemtom site replacing the 130 patio homes originally proposed In this area. Hili e~plalned that the total density of the Pemtom development has been reduced by I unit (total number of units - 306>. and that greater open space has been achieved with the new proposal. Increasing open space from 40 acres to 51 acres (about 73% of acreage in open space>. HilI advised that the major pool has been enlarged and a wading pool added; a double tennis court is proposed in the north area and earth moundinq and planting is proposed to achieve Interest In the northern terrain. Wingert referred the Council to the Parks and Recreation minutes of July 9, 1974. re park dedication recommendations for the Pemtom north area and to amendments recommended by Fire Chief Fischer In plan sheet 5/5. Engineer Lund reported that proposed grading plan shows bulk of north- erly property will drain southerly. with only a small portion draining northerly onto adjacent lands; this Is generally in conformance with the direction of natural drainage. He suggested that a control structure and piping be conSidered between the two pondso Hill advised that he proposes a cash park dedication for the north portion of the development of approximately $16.000 (about $115/unlt). based on 12% of purchase price of land ($135.000>; land dedication. as proposed by the Parks Committee is not feasible for several reasons: I. Southern portion of development has been platted and Is now In ownership of the Homeowner's Association. 2. Terrain Is too extreme to construct play area recommended between north and south portions at west property line, ' and walkway along the Nest property line to Floral Park. 30 Pemtom does..not have control of area under power poles across south portion cf the development. Feyerelsen asked solution to dust on truck routes In construction areas. suggesting possible use of chloride; residents across Hamllne Avenue have registered complaints. HilI said he will do what he can to alleviate this sltuationo Feyereisen asked additional fighting be considered In northern area; considers south area to be Inadequately lighted. After diSCUSSion. Hili stated that they do not desire to create a "white way". but noted a few areas In which he agreed that additional lighting would be effective and desirable. . Hill described a proposed ppthw~y and school bus wait on the north side of the entrance road a+ Hamllne Avenue along which three lights were also proposed. Crichton noted that the Public Works Committee has no comment on the general utilities layout, but will want to review utility construction plans when available. Density of the development was reviewed re conformance with zoning ordinance requirements. The provision In the original Special Use Permit that a "new" Special Use Permit '"e obtained if development In the north area Is changed from "patio hc~es" was discussed. Crichton and Wingert expressed difficulty in approving the density. as proposed. In view of Ordinance Noo 99 I'equlrements; also expressed concern re "Amended Special Use Permit" application in view of wording In existing Special Use Permit. -3- " Council Minutes -4- July 22. 19? After discussion, Feyerelsen moved, seconded by Crichton, that the matter be tabled to the Council meeting of July 29, pending opinion from Attorney Courtney re amended Special Use Permito Motion carried unanimously. Feyerelsen noted that the Parks Committee wil~ m$et on July 23, at which time the Park dedication can be reconslde~ed'for recommendation to the Council on the 29tho REPORT OF COUNCIL~AN STAN OLMEN - Finance Nursery HII' Sewer Connection CharQ~ . Olmen reported that the Finance Committee recommends a se~er con- nection charge of $1,776.30, the amount that would have been charged at the time of assessment, if Nursery Hill had been Included In Sanl.tary Sewer Improvement 12-13. In dlscusslon~"tt was noted by Feyerelsen that the east portion of the plat woul~ve been served by sewer, if included in the Improye- ment; ellmina?ing the need for the 11ft stations ?n lots 4 and 6. CrIchton noted that the portion of the parcel, 200 feet in depth, abutting Hamllne Avenue, was assessed In Sanitary Sewer Improvement 12-13, and moved thi'!t the Council make a Sanitary Sewer connection charge to the Nursery Hi II parcel equal to the acreage rate charged to the area In the orlg~nal assessment (SS 12-13) x acreage resulting ~r6m that portion of the parcel more than 200' from Hamllne up to, not Including, the ~asterly two lots (lots 4 and 6). Motion was seconded by Feyerelsen and carried unanimOUSly. Lund was requested to determine amount of assessment. (Note: Lund reported assessment for 2.25 acres@ $465/acre would be $1(47000) Door to Door Sales Permit Olmen referred the Council to an application from Kevin J. Cranford to sell Websters Student Handbooks, door to door. After discussion. Olmen moved, seconded by Wingert, that the Council deny the request. Motion carried unanimously. REPORT OF COUNCILMAN CHARLES CRICHTON - Public Works Bethel Master 'Meter Crichton reviewed the master meter proposal for Bethel College and Seminary, and current negotiations under consideration between Hender- son and the Col lege, indicating that Bethel would be wlllin~ to in- stall a master meter if cost were divided equally between Bethel and the Village. Crichton reported +hat the Public Works Committee feels that a master meter is advantageous primarily because it would enable the Village to reduce water leakage and Improper or accidental use of water from hydrants, etc. . After discussion, Crepeau moved, seconded by Crichton, that the Village repurchase from Bethel the 27 existing meters at the original purchase price of $5040.00, If Bethel will Install the master meter; Village to pay for engineering costs. Motion carried unanimously. (Lund estimated engineering costs at t $I,OOC.OO. McNiesh to notify Henderson of the Council action and to request that he work with Bethel to effectuate the master meter Installation. Public Works Department Inspection Forms Crichton referred the Council to three (3) forms, recommended by the Public Works Committee, for use by the Public Works Department In making inspections of utility installations and road construction. -4- '"" Council Minutes -5- July 22, 1974 After discussion, the Council concurred that the forms, as presented, be used for Public Works Department inspections. (It was noted that periodically the Council would expect an interpreta- tion or commentary, after inspections are made.) Truck Specifications and EQuipment Needs Crichton referred the Council to a memo from Johansen, dated 7-12-74. re speclflcatlon~ proposed for new truck (to replace 1965 GMC tank truck) ; After discussion, Crichton moved, seconded by Feyereisen, that the Counci I approve the Specifications for a 1974 Truck, as presented, and authorize advertisement for bids. Motion carried unanimously. . Water Service Contract Between Rosevllle and Arden Hills Crichton referred the Council to Jl.ttorney Lynden's letter of 7/16/74 and after discussion, moved that the Council authorize execution of the FIRST ADDENDUM TO CONTRACT FOR WATER SERVICE BETWEEN THE VILLAGE OF ROSEVILLE AND THE VILLAGE OF ARDEN HILLS, by the Mayor and Clerk Administrator. Motion was seconded by Wingert and carried unanimously. Lift Station No.8 Crichton reported that the Pub~ic Works Committee recommends the up- grading of Lift Station No. B, which has been a continual source of trouble. After discussion. Council concurred with Crichton's recommendation that Engineer Lund be authorized to proceed with preparation of recom- mendations for lift station No.8 (Hamllne Avenue and Ingerson Road); report to include: I. Capacity d~.t~$~~t~~~ed on anticipated need (suggested use of ~p~~r~"e Qevele~me". rlaR In making calculations). Type of lift station for this area. Some type of auxilllary power supply (portable, permanent or combination of both, for use at this and other lift stations). 2. 3. Vodonlk Sewer Service Crichton referred the Council to a memo from Johansen, 7-18-74, re- porting that Vodonlk, sewer service problem was caused by Village water main Installation; therefore, repairs will be at Village expense. REPORT OF COUNCILMAN WILLIAM FEYEREISEN - Parks and Recreation, Human Rights ~ounds View Joint Powers Aoreement Buckley reported that Ralph Tieso (Tieso Flectrlc) estimates the cost of light installations at the tennis courts at $5,000.00, or less. Crepeau suggested that cost estimates also be obtained from Hoffmann Electric and Hi Ilcrest Electric (Village residents)o In review of the JoInt Powers Agreement, the following comments were noted: . I. Exhibit A (page I) is not attached. 2. Page 4 wording change (last line) - .Hlt shall give the City not less than forty-eight (48) hours notice... 3. Page 5 ('6) wording change to add "after 90 days ap~urte- nances will remain the property. of the City; costs tor) 4. ~1,rl:2~:,I,(d~~"t~~#-~..,L~~ Buckley was requested to review these changes with Mr. Bauer, Mounds View School District. After discussion of proposed lighting specifications, Buckley was requested to obtain: I. Estimated power costs for tennis courts (Roseville cost figures>. 2. Lighting Installation estimates from Hillcrest Electric and Hoffmann Electric. -5- 1 1 -" Counci! Minutes -6- July 22, 1974 Specifications for Hard-surfaced Areas Buckley referred the Council to his memo of 7-19-74, requesting authorization to seek formal bids for the bituminous surfacing of areas at Ingerson, Valentine and Freeway Parks and a practice tennis court area at Mounds View High School. After discussion of the four sites and proposed uses of hard-surfaced areas, Crichton moved, secon.ded by Wingert, that the Council authorize Buckley to proceed to obtain bids for bituminous surfacing, as pro- posed, at Ingerson and Valentine Parks, based on Lund's specifica- tions (7-16-741. Motion carried unanimously. ~ Buckley was requested to re-consider Freeway Park plans; converting proposed parking area to play ground use i.e. paddle ball, practice tennis court etc. Snowblower and Broom for Massey Tractor Buckley referred the Council to his memo of 7-19-74 re purchase of a broom and snowblower for the new Massey Ferguson tractor, to be used for rink clearing. Crichton moved, seconded by Feyerelsen, that the Council approve the purchaseo Motion carried unanimously. Perry Park Fill Operation Buckley reported that 50,000 to 75,000 cu. ~s. of fill have been placed at Perry Park; filling will be complUted soon and area will be graded this fallo Buckley said he will request a letter from the Arsenal approving this fill programo Ingerson Park Access Crichton proposed a land trade offer re the Moss property access to Ingerson Park, for Council consideration. After discussion, Crichton moved that the Village offe~ to trade to Mr. Moss a lot In the southeast corner of Ingerson Park, for the southern portion of his lot, to be used as an access to the parko Said lots to be equal In square footage, with the lot on Lexington Avenue to have between 90' and 100' frontage on Lexington Avenue. Motion was seconded by Crepeauo After discussion, action on the motion was tabled to a future Council meeting pending Lynden's opinion re legality of the offer and Parks~ and Recreation Committee's recommendations. Tree Ord i nance McNiesh reported that copies of Nbrth Oaks' and L.MoMo's ordinances have been obtained. Buckley was requested to check with Ramsey County re possible County-wide ordinanceo . Crichton requested that the COuncil think about the recommendation by Dr. French that Du+ch Elm and Oak Wilt diseaSed trees be removed by the Village, rather than by individual property owners; noting that a determinatIon re this matter should be made for inclusion In the new tree ordinance. Ramsey County League Meetino - JulV Feyereisen reported that the League stresses that Special Use Permits Should Include specific reasons for denial, and should be made at time of denial. Microphone System and Pro lector Council generally concurred that a microphone system is needed for Village meetings, and Crepeau offered to pursue the matter. Feyerelsen noted the need for an overhead projector, which Crichton agreed to pursue; advising that the Village does have equipment to make transparencies. . .,.... Apportionment Resolutions Feyereisen moved, seconded by Olmen, that the Council adopt Resolu- tions Nos. 74-20.74-21, 74-22 and 74-23 re apportionment of assess- ments, Water Improvement 68-1, Sanitary Sewer I, Sanitary Sewer 3 and Water 67-1 and 67-2.
