Crepeau, Jr. at 8:00 p.m. Roll Call Present - Mayor Henry J. Crepeau, Jr., Councilmen William Feyerelsen, James WIngert, Charles Crichton, Stan Olmen. Absent - None. '. REPORT OF VILLAGE ATTORNEY JAMES LYNDEN Case No. 73-28, Dreyfus - Hunter's Park Second Addition Attorney Lynden referred the Council to his letter of June 24, 1974, re FInal Plat of AdditIon 2, Hunter's Park, Open Space Easements and Covenants for the Second Addition and the Hunter's Park Subdivision Landscape Plan and landscape bond. Wingert moved, seconded by Feyerelsen, that the Councl' approve the Final Plat of Hunter's Park Second Addition, and the Open Space Ease- ments and Cevenants; authorizing the execution thereof by the Mayor and Clerk Administrator on the conditIon that the Open Space Easements and Covenants be regIstered In the office of the Ramsey County Registrar of TItles either contemporaneously wIth the registratIon of the Final Plat or at least before the first sale. Motion carried unanimously. After discussion of the landscape plan, landscape bond and suggested letter of contract, Wingert moved, seconded by CrIchton, that the Councl I approve the amended landscape plan for Hunter's Park SubdIvision (re- vIsed 5/21/74) and the Performance Bond; authorizing execution of the letter contract by the Mayor and Clerk Administrator, subject to Its f1~st being executed b-y a Dreyfus officer. ~4otlon carried unanimouSly. It was noted that the landscape Plan Is for the entire Hunter's Park S~bdlv1slon, except the apartment area north of Harriet Avenue (extended), Case No. 73-48 Nurser Hili - Easements Attorney Lynden referred the Counc I to his letter of June 24, 1974, and copy of easement he prepared for turn-around based on his being advised Informally that Harold A. (It was noted that sentence structure In Declaration of Covenants re two 11ft stations should be corrected.) . . Uniform Building Code Lynden reported he will have ordinance re adoption of Uniform Building Code for Councl I consIderation at the next Council meeting. Ord I nance No, 172 As recommended by Attorney Lynden, Crichton moved, seconded by Wingert, that Ordinance No. 172 not be published, since the matter no longer requires attention by the Village. Minutes of Regular Councl I Meeting Page two June 24, 1974 REPORT OF VILLAGE ENGINEER DONALD LUND Arden Manor - Status Report Engl neer Lund referred the Council to Report No. 12 (6-20-74) from Suburban Engineering and to his letter of 6-24-74 re status of utili- ties In Arden Manor Mobile Home Park; advising that Mr. Adams has been requested to correct al I deficiencies In the sewer system and have system ready for an Inspection within a week or so; final Inspection to be made by Suburban Engineering Company's inspector, a man from the Village Public Works Department and a man from Banister's office. . Pemtom Planned Unit Development - Utilities Lund referred the Council to his letter of 6-24-74 re Inspection of uti Iltles recently constructed In the Pemtom PUD; Pemtom Is to make all adjustments and call for a final Inspection which will be made by Suburban Engineering Company's Inspector, a man from the VI I lage Public Wo~ks Department and a man from Ba~lster's office. Lamb ros Ditch After dlscussl~, of letter dated 6/11/74, from Northdaie Construction Company, Wingert moved, seconded by Olmen, that the Councl I approve a time extensIon on the Lambros DItch Project untl I the end of August, 1974. Motlo.n carried unanimously. Nursery Hili Utilities Lund referred the Councl I to his letter of 6/24/74. After discussion, Feyerelsen moved, seconded by Wingert, that the Council approve a con- nection charge of $1200 for the 3.82 acres of Nursery Hili pl",t not previously assessed for sanitary sewer In' Improvement 12-13 (approxi- mately 75% of acreage charge assessed under this Improvement), In lieu of the acreage charge. After further discussion, motion and second were withdrawn and C~lchton moved, seconded by Feyereisen, that Councl I refer the matter to the Finance Committee for Its recommendations of a connection charge for the 3.82 acres of Nursery HIli, not assessed for sanitary sewer In Inprovement 12-13. Motion carried unanimously. REPORT OF V~LLAGE TREASURER RI~HARD O'KELLY Invel;tments Treasurer O'Kelly reported an Investment on June 19 of $350,000 @ 10.80% Interest for two months; reporting that he will Invest $310,000 on June 25, for 90 days, @ 11.15% Inte~est. REPORT OF COUNCILMAN JAMES WINGERT - Planning and Zoning, Board of Appeals Case No. 74-15, Steak Inn - Sui Idlng Permit Wln~ert reviewed Engineer Lund's report of 6-18-74 and ~he Planning Commission's recommendations of 6-18-74. After discussion, Wingert moved, seconded by CrIchton, that the Councl I approve the Issuance of the Building Permit, subject to receipt of: . I. Amended grading plans showing changes proposed and accepted by Village Engl neer. 2. Landscape bond In amount of 125% of fl~m bid re approved landscape plan. Motion carried unanimously. Service Drive Easement Mr. Hage reported that a request to release the 50' road easement across the Standard 01 I property I'll II be forthcoming; there appears to be no need to provide for this service drive since the widening of County Road E. (Amount of park dedication was deferred to the Council meeting of July 8, 1974.) . Dre fus Hunter's Park - Access Road to Count Road E A cost estimate from Planner Schm d re feasibility study for routing' of State-aid road (Harriet Avenue extended to County Road E) was re- vl-ewed. After discussion, Councl I requested that Banister Engineering also sub- mIt a cost proposal for this study. It was noted that the request Is to provide a State-aid Road west from Lexington Avenue and north to County Road E,(not an expansion of Hamllne Avenue) . Case No. 72-50, Comprehensive Development Plan Wingert reviewed the Revised Comprehensive Development Plan and asked Councl I for comments re action to be taken: I. Submit to Metro Councl I for comments In unapproved form, or 2. Incorporate corrections by Councl I now and re-submlt to Plan- ning Commission to be amended prior to sending to Metro Councl I. After discussion, Councl I determined that correctIons be made prior to submission of the Comprehensive Plan to the Metro Councl I; Planner Schmid to discuss re-zonlngand Comprehensive Plan with the Councl I at the COuncil meetIng of July 29th. (~Ingert requested that comments or questions be sent to him or Planner S.chml-d p rl or to the meetl ng.) Case No. 73-45, Surface Water Regulations Wingert reviewed proposed Surface Water Regulations recommended by the Planning Commission for Counc! I consideration 16-18-74). After discussIon, Clerk Administrator McNlesh was requested to send an amended map to the Department of Natural Resources Indicating center Island area marked with buoys; Indicating area not suitable for powe~ boating. Mayor Crepeau thanked the Planning Commission and sub-committee for their research study and report on surface water reguletions. Field Insp.ectlon Proposal - Planner Schmid After review of the proposal, and discussion re possible Inclusion of this Inspection with other Inspections by the Vii lage, C. McNlesh was requested to talk with Attorney Lynden re how this might fit Into schedule of fees for permits and inspec~ions. . ConsIderation was also given to resident landscapers making the Inspec- tions. Matter was deferred to next Council meeting. REPORT OF COUNCILMAN STAN OLMEN - FInance Door-to-Door Sales Permit Crichton moved, seconded by Wingert, that the Councl I approve the permit for Minneapolis Recreation Development for door-to-door candy sales, as requested, subject to confirmation by McNlesh of licenses In other municipalities, as stated in the application. REPORT OF COUNCILMAN WILLIAM FEYEREISEN - Human Rights, Parks and Recreation . Ingerson Park Access - Status Report Buckley reported that he had tried to obtain an alternate access to Ingerson Park, as suggested by the Council, but parties were not In- terested In selling; explaInIng that these property owners have older children and do not wish to encourage small children through this area. Mr. Moss explaIned that hIs property Is currently being used as an access to the park, and he would like a faIr price If the Village wIshes to continue to use this access. Mrs. Lindquist stated there Is a need for this access. cannot use the Lexington Avenue route because of heavy now are going through n3lghbors' yards; some neIghbors but others do not. Bicycle riders would also use this ence to the Lexington Avenue access. Small children traffic; they encourage this, access In prefer- A fenced walkway along Lexington was suggested to provide safer access to the park. Buckley said an access at both ends Is needed. Mr. Moss said his property Is a natural access route which Is being used; If the Village does not secure an easement, It should eliminate use of his land for access to the park. In discussion of the proposed Moss property purchase, It was noted that more property Is Involved than Is needed for the access and, If pur- chased, restrictions should not be placed on It. Mr. Moss said that If the Village sold the land, he would lIke first optIon to purchase It. Feyerelsen moved that the Councl I authorIze Attorney Lynden to draw up necessary papers for purchase of the property for $5,000, as per sketch, with the restriction that the owner of property to the north be given first option to purchase this land, If sold by the Village. There was no second to the motion. Crichton moved, seconded by Feyerelsen, that the Councl I ask the City Attorney to arrange for drawing up the necessary papers and legal des- cription of the lot that the Village Is to purchase. MotIon did not carry (Crichton and Feyerelsen voting In favor; Olmen Wingert and Crepeau voting In opposition). Playground Instructor - Sylvia Bruns Feyerelsen moved, seconded by Crichton, that Councl I approve the employ- ment of Sylvia Bruns as Playground InstrUCTor at $2.00/hour. Motion carried unanimouSly. .summer Flyer Delivery Feyerelsen moved, seconded by Crichton, that the Councl I approve payment of $22.50 for the delivery of the Parks and Recreation Summer Program flyer. MotIon carrIed unanimously. Dep.artmen.t of Agriculture - Tree Survey Letter After review of letter and dIscussion, Crichton moved, seconded by Wingert, that the Council appoint Dr. French, University of Minnesota, as Tree Inspector for Arden Hills. Motion carried unanimouSly. McNlesh to ask Dr. French If he wi II accept this appointment and prepare the required tree Inventory and reports, as outlined In letter from Minnesota Department of AgrIculture; also to Inquire about the status of model ordinance re diseased trees. -4- .- Minutes of Regular Council Meeting Page f I va Jun6 24, 1974 Valentine Park Parking Lot B~ckLey advised he is working with a ditch to carry water run-off and Public Works Department to provide to raise grade of the parking lot. REPORT OF MAYOR HENRY J. CREPEAU, JR. - General Government, Public Safety Ramsey County Pollee CommunIcation Study Mayor Crepeau requested Clerk to send copies to the Counci I of a memo dated 5-15-74, re Ramsey County PolIce CommunIcation Study and proposed changes In the Arden Hills Pollee Communication System. ~ REPORT OF CLERK ADMINISTRATOR CHARLOTTE MCNIESH CIQrk-tYDlst - Florence Honan Crichton moved, seconded by WIngert, that the Councl I authorize the employment of Florence Honan @ $3.2~/hour on a part-tIme basis, as needed durIng the months of July and August, 1974. Motion carried unani- mously. ADD rova I of Fund Trans fe r CriChton moved, seconded by Wingert, that the Council approve the trans.fer of Temporary Loan for Street Improvement 72-3 from General Fund 101 to Bond Improvement Series 2 Fund 510, effective June 30, 1974. Motion carrIed unanImously. Lake Johanna Volunteer Fire Department Contract Crichton moved, seconded by Wingert. that the Council approve payment of the Fire Contract, In the amount of $8,670.00, by July I, 1974.
