MINUTES OF REGULAR COUNCIL MEETING Village of Arden Hills Monday, June 10, 1974 --8:00 p.m. Village Hall Ca II -to Order The meeting was cal led -to order by Mayor Henry J. CrepGau, Jr. at 8:00 p.m. Roll Call Present - Mayor Henry J. Crepeau, Jr., Councilmen S-tan Olmen, Charles Crichton, James Wingert, William Feyerelsen. Absen-t - None. -. Also Present - Village Engineer Donald Lund, Public Works Super- visor Hans Johansen, Police ChIef Pat Sexton, Clerk AdmInistrator Charlotte McNlesh, Deputy Clerk Dorothy Zehm. Approval of Minutes The Minutes of the Regular Council Meeting of May 28, 1974, were approved as presented. Business from the Floor None. REPORT OF VILLAGE ATTORNEY JAMES LYNDEN (Absent - No Report) REPORT OF VILLAGE ENGINEER DONALD LUND Lambros Oltch Engineer Lund reported that rain, and the resultant high water, have presented problems for the contractor. Actual construction time Is estimated at two weeks, wl-th one week for clean-up. Com- pletion date Is July 7, 1974, but Lund said he expects It will be necessary for the contractor -to request an extension of time. Engineer Lund noted that road restrictions In early spring, and dalay In letting the contract, also kept the contractor from starting construction as soon as he had anticipated (before the spring rains). Arden Manor Engineer Lund distributed copies of a report from Suburban Engineer- Ing Company, Report No. II, re Arden Manor Mobl Ie Home Park. After review of this report and a memo from H. Johansen, dated June 6, 1974, ~r. Johansen described the seven (7) sewer connec- tions noted In his memo and the condItions of the uti II-tles pro- ject. -. Lund advised that he had personally met with ~1r. Adams and had thought he understood that no service connections should be made to the V III age II nes until II nes had been thorough I y I nspected and approved. Lund saId ha Is aware of 4 connections, but not of the additIonal 3 Hoted by Johansen. He said one connection has been uncovered, Inspected and ap~roved - the remaining 3 connections were -too wet and caved In before Inspection could be made. A thorough Inspection of the sewer mains was considered to be Im- perative, and after discussion, -the mat-ter was referred -to Johan~en, Lund and Suburban Engineering Company -to make the proper Inspections; costs of inspections to be bl I led to Mr. Adams. GlenD-au! Drainage Project Crichton reported that the Public Works Committee recommends Council approval of proceeding with the Glenpaul Drainage Project In accor- dance with plans revised and dated June 5, 1974. After review of the plans and estimated CO&ts ($7,829.00), Crichton moved, seconded by Feyerelsen, that the Councl I authorizes pro- ceeding with legal action to obtain the necessary easements and to advertise for bids. Motion carried unanimously. -1- . Minutes of Regular Councl I Meeting Page two June 10, 1974 Nursery Hill Pro,iect Feyerelsen reported that Mr. Schutta has expressed concern re street and uti Ilty constructIon by the Vi I lage, and assessment of costs to the property owners. Mr. Schutta wants assurance he wi II not be assessed. Lund advised that that portion of Nursery Hili, In excess of 200' from Hamllne Avenue, has not been assessed for sewer and water. Counci I requested Lund to determine what acreage charge for this area would have been, and to check with Popovich and Lynden re pos- sible charges for connection to utilities for areas not previously assessed. REPORT OF VILLAGE TREASURER RICHARD O'KELLY (Absent - Report by C. McNlesh) The $50,000 Investment which matured June 3rd has been reinvested In Treasury Bills @ 8.5% dl scount until June 19, 1974, at which time it wi II be combined with a maturing Certificate of Deposit and reinvested. REPORT OF COUNCILMAN JAMES WINGERT - Planning and Zoning, Board of Appeals Case No. 74-15.. Steak Inn - Fill Permit Wingert referred the Councl I to the Planning Commission Minutes of June 4, 1974, reporting that Rice Creek Watershed District has approved the fill plans, and, because fill Is available now, the Planning Commission recommends Councl I approval of the Fill Permit. Wingert moved, seconded by Olmen. that Councl I approve the Fill Permit In accordance with plan approved by Rice Creek Watershed 01 strl ct. In discussion, It was noted that a proposed State-aid road, extend- Ing Harriet Avenue from Lexington Avenue west to a point parallel to to Highway 51, and north to County Road E, Is currently Indicated In this area; fl II permit could be approved with the understanding that permission to fill the property does not give permission to build the restaurant. This was agreeable to Mr. Hage, and the motion carried unanimously. Case A. B. C. . No, 73-28, Dreyfus - Hunters P~: FIQal Plat Approval - Hunters Park Second Addltl~ Council action wes deferred pending Attorney Lynden's review of Open Space Easements and Covenants and Landscape Bond. Amended Landscape Plan - Hunters Park Wingert moved that the Council concur with the Planning Commis- sion's recommendation that Councl I approve the Amended Land- scape Plan for Hunters Park and the landscape bond, In amount of 125% of "firm bid" presented. Motion was seconded DY Feyerelsen and carried unanimously. Harriet Avenue Extension Wingert reported that the Planning Commission recommends the extension of Harriet Avenue west from Lexington Avenue to a point parallel to Highway 51, and an access road from Harriet Avenue (extended) to County Road E and from Harriet Avenue (extended) to the Intersection of Ingerson Road and Hamllne Avenue; recommendIng that Councl I authorize a feasibility study as soon as possible to determine appropriate location and cost estimate of proposed State-aid road. Wingert moved, seconded by Feyereisen, that the Councl I authorize the feasibility study recommended by the Planning Commission. Motion carried unanimously. Matter referred to Wingert to pursue. Pat Sexton, owner of the property adjacent to and south of the Hopkins property, stated that he feels the garage reconstruction will be a big Improvement, and ha,; no objection to the requested variance. . After review of the plan presented, Wingert moved, seconded by Crichton, that the Coun~11 approve the variance and Issuance of the Bu! Idlng Permit, ~s requested. Motion carried unanimouSly. Case No. 74-l6. Cyril ~heehy - Tennis Court Building Permit Wingert reviewed the Rice Creek Watershed District stipulation that It approves the 1120 cu. yds. of fill, as proposed, providing that four (4) sq. ft. of open space be dedicated for every I sq. ft. of filled area (cannoT build on open spacel. After discussion of the proposed tennis court location on the 8-acre site, Wingert moved, seconded by Olmen, that the Council approve Issuance of the Building Permit and fill, as requested. Motion carried unanimously. Case No. 74-17. McDonald's Corporation Matter deferred to Cou;cll Meeting of June 24, 1974, at request of applicant. Case No. 71-21. Arden M<3nor Lighting Chanae Wingert reported that the Planning Commission recommends Council approval of the requested change In lighting In Arden Manor, and moved that the Council <3pprove the substitution of Adjusta-post Manufacturing Company Sphere-lites #2301 with 12 ft. steel posts, In- stead of the originally apprvoed Weyerhauser #15S lights. Motion was seconded by Olmen and carried unanimously. Case ~o. 73-42, .LamillL Addition - Preliminary Plat Wingert reported that the Planning Commission does not recommend approval of the amended Preliminary Plat of Lamettl Addition be- cause: I. Travel lane of.oad has bean narrowed to 28 feet (34' required by ordinance). 2. Fire hydrant has not been Indicated mid-way between cul- de-sac and Snelling Avenue as requested. It was noted that a det.)rmlnatlon has not been made by Mr. Lamettl as to whether proposed 'itreets are to be dedicated or privately .owned. Clerk Adml n!strltor was requested to ask Mr. Lamettl to determine this, and, If streets are to be dedicated, request that the Preliminary Plat be amended to incorporate the 34 foot wide travelway required; hyd~ant to be indIcated, whether or not streets are dedicated. . BussC)rd Court CouncIl expressed concern re the adequacy of the storm sewer spl 11- way, and requested that EngIneer Lund Inspect the construction for compliance with Rice Creek Watershed District's requirements. REPORT OF COUNCILMAN STAN OLMEN - Finance Federal R~venue Sharing - Planned Use Report Olmen moved, seconded by Crichton, that the Councl I authorize Clerk Administrator MCNlesh to file the Federal Revenue Sharing Planned Use Report as submitted In the memo of I~ay 28, 1974; balance to be allocated for Capital Outlay - Parks and Recreation. MlnlJtes of Regular Council Meeting Page four June 10, 1974 Vodonl k Sewer Crichton reported a plugged sewer at 1723 Glenvlew Avenue; evidently caused by the settling of soil after Installation of the Village water line. Crichton referred the Council to a memo from Johansen re this problem and, after discussion, the Council authorized the Village Public Works Departmen1' .to chW.til~o;puse and make repairs, If poss'ble; Vodonlk to pay for-~f it Is determined that problem was not caused by the Village water Installation. REPORT OF COUNCILMAN WILLIAM FEYEREISEN - Human Rights, Parks and Recreation Case No, 73-48, Nursery Hill - Park Dedication Feyerelsen reported that recant land transactions In this area could not be verified and suggested that the Councl I accept the purchase price ($30,000) as the basis for the park dedication. Feyerelsen said he felt this Is a reasonable price for this property, which Included approximately $5,000 worth of nursery stoc~ and a uti llty assessment about 200 ft. deep along Hamllne Avenue.~~~~ ~ ~", (JIfJ~/ Feyerelsen moved that the Councl I approve a $2,300 ca park dedl- ... cation. Motion was seconded by Olmen. After discussion, Council agreed to deduct the nursery stock, but not to deduct the utilities assessments from the land valuation f I gu re. f,tf'NrJ) (j""'1~'J. Feyerelsen amended his motion to approve a $25004park donation. Amended motion was seconded by Olmen and carried unanimously. In~erson Park Access Feyerelsen referred the Council to a memo from John Buckley re proposed Moss property purchase for access to Ingerson Park, and reported that the Parks Committee recommends that the Council authorize this purchase. In discussion, Importanca of this access was questioned; $5,000 was considered to be a high ~rlce, especially with stipulations requested. Alternate access possibilities were discussed, and the matter was re fe rred to Buck I ey and the Parks Comm I ttee to research. Gymnastic Assistant Feyerelsen moved, seconded by Wingert, that the Councl I approve payment In the amount of $39.00 to Jerry Pepper, Gymnastic Assistant. Motion carried unanimously. Bethel Golle~e Student H0uslng - Fire Safety Status Report Zoning Administrator was requested to obtain a progress report re compliance with fire safety requirements In the townhouse student housing area of the Bethel College campus, for Councl I review at the next Council Meeting. REPORT OF MAYOR HENRY J. CREPEAU, JR - General Government, Public Safety Control of Recreational Vehicles Crepeau reported that tho Public Safety Committee recommends an Arden Hills Ordinance slrallar to the Shorevlew Ordinance for control of recreational vehicles. Police Chief Sexton stated that the Shorevlew Ordinance generally fol lows State Statutes. After discussion, Council concurred that enforcement of State Statutes would probably resolve the problem In Arden HI lis; Counc( I would be receptive to a Village Ordinance If It Is determined that this would make enforcement easier. Minutes of Regular Council ~';eetlng June 10, 1974 Page five Surface Water Regulations The Mayor referred the Council to a memo from ChIef Sexton re Surface Water regulations and putrol of lake. Mrs. Kiene presented a petition to the Councl I, sIgned by approxi- mately 30 residents, opposing several of the proposed time period and horsepower limit regulations, and supporting a lake patrol of deputized Village residents to aid the Sheriff In enforcement of State Statutes. Crepeau suggested that the boat patrol be expedited, rather than an ordinance at this time. . Wingert expressed concern re patrol of lake by riparian owners; this Is a State lake and all must share use of the lake. Wingert refer- red the Council to Proposed Regulations which he prepared as a compro- mise measure. Feyerelsen spoke against a volunteer boat patrol and, after review of regulations proposed oy Wingert, suggested that the Council take some definitive action. Crepeau stated we have State Statutes that govern the lakes, and the Sheriff Is charged to patrol Lake Johanna. Sexton said he discussed the patrol of Johanna with Ramsey County Sheriff's office - they are short-handed and could use a deputized Village boat patrol to aid In enforcement. After discussion, Crichton moved, seconded by Feyerelsen, that the Council authorize the Clerk Administrator to forward the Regulations For Watercraft Operation on Lake Johanna, as amended, to Department of Natural Resources, as Intent of a proposed ordinance; Attorney Lynden to simultaneously draw up an ordinance incorporating the Regulations. Motion carried (Crichton, Feyerelsen, Wingert, Olmen voting In favor of the motion; Crepeau voting In opposition). Police Chief Sexton was reqeusted to set up specific proposals for enforcement of the propo~ed ordinance to assure adequate patrollng this year. Sexton advised he wi II h~ve Arden Hills Pollee officers deputized to augment the Sheriff patrol. Public Safety Committee Resignation Crepeau referred Councl: to a letter of resignation, effective June 15, 1974, from Dr. Wlndorfer. McNlesh was requested to write to Dr. Wlndorfer, thanking him for his services to the Village In thIs capacity. Salary Approval - Willard John Feyerelsen moved, seconded by Wingert, that the Council approve the $5.10/hr. salary for OffIcer Willard John, effective June I, 1974. Motion carried unanimOUSly. ... REPORT OF CLERK ADMINISTRATOR CHARLOTTE MCNIF.SH Preliminary Population Estimates McNlesh advised that she has a confirmed Metro CouncIl population estimate for Arden Hills of 5,831. as of April 1,1974. Claims and Payroll Wingert moved, seconded approved as submitted. by Crichton, that the Claims and Payroll be Matlon carried unanImously.
