Roll Call Present - Mayor Henry J. Crepeau, Jr., Councilmen William Feyerelsen, James Wingert, Charles Crichton. Absent - Counci Iman Stan Olmen. Also Present - Attorney James Lynden, Engineer Donald Lund, Planner Otto Schmid, Treasurer Richard O'Kelly, Parks Director John Buckley, Clerk Administrator Charlotte McNlesh, Deputy Clerk Dorothy Zehm. Approval of Minutes The Minutes of the Regular Council Meeting of February 25, 1974, were ,pproved as amended (amended Minutes to be sent to Councl I members). Business from the Floor Pollee Chief Pat Sexton reported that the Public Safety Committee has recommended that Council approve the hiring of Mr. Douglas McCall as a full-time patrolman @ $5.21/hr. starting March 25, 1974, for a six month probationary perlo~ at ~~ie~ ti~e ~19 salary wewld ~e Fe vi"""QO. After discussion, W. Feyerelsen moved that the Councl I approve the hiring of Douglas McCal I according to the recommendations of the Public Safety Committee, as outlined by Pollee Chief Sexton, starting March 25, 1974 @ $5.21/hr. Motion was seconded by J. Wingert. In further discussion, it was noted that the Public Safety Committee is also considering hiring a part-time patrolman; if both men are hired, as proposed, salary costs would be considerably above the budget for this year. Motion carried unanimously. REPORT OF VILLAGE ATTORNEY JAMES LYNDEN Case No. 72-35. Registered Land Survey - PemtQm's Sixth Addition Wingert moved, seconded by Crichton, that Councl I approve the R.L.S. and authorize Mayor and Clerk Administrator to execute same. Motion carried unanimously. Gordon Fickett Matter Attorney Lynden referred the Councl I to hIs letter of March I I, 1974. After discussion, Crichton moved, seconded by Wingert, that the Council authorize Attorney Lynden to offer Mr. Fickett's attorney $1500. to settle. MotIon carried unanimously. Attorney Lynden was requested to offer the financial settlement, but no reinstatement and resignation. -. Lambros Ditch Lynden reported that Shorevlew has voted to approve the amended cost allocation; Rosevll Ie will discuss the tncre~jed costs, for their share of the Lambros Ditch project tonight; ~ has not receIved approval, to date, from Ramsey County. He reported that the contractor has been authorized to start work on the project. Special Use Permit - Estben. Inc. Attorney Lynden presented the Special Use Permit for Case No. 73-49, Estben, Inc., to the Council for review; stating that the Council approved the permit on February 25, 1974J-_~' '.. S~stems - Drainage Engineer Lund referred the Councl I to his letter of March 6, 1974 re drainage In the northeast corner" of the I.C. System's property; Indicating a suggested revision to the proposed grading and the need for a control structure, to control the water level in the pond and a rate of out-flow from the pond. . Rein to rectify this dral'la6le p.roblelll. ~O~~~ VILLAGE TREASURER RICHARD O'KELLY Treasurer O'Kelly reported the following Investments: $125,000 on February 27, 1974, for 30 days @ 6.1% $175,000 on March II, 1974- for 30 days @8.45% at First National Bank of St. Paul $50,000 In Treasury Bf lis at Rosevl lie State Bank for 90 days @ 7.3%. Treasurer O'Kelly was requested to check re advisabilIty of continu- ing to Invest at Rosevl lie Bank when these securities mature. REPORT OF COUNCILMAN JAMES WINGERT - Planning and. Zoning, Board of Appeals Case No. 73-50. Lewis Lindemer - Special Use Permit and Org. 98 Varlan<;:e Wingert reported that the Planning Commission held a Public Hearing on March 5, 1974, and It was determIned by the Commission that neigh- boring residents in general were relatively wi I ling to approve Mr. Lindemer's proposal; expressing concern re possible expansion of the business. After discussion, Wingert moved, seconded by Feyerelsen, that the Council approve the consolidation of lots I and 2 of Shady Oaks Addition, and approve the Special Use Permit for use of the existing remodeled building on lot 2 for storage and office, accessory to restaurant on lot I; sUbJect to annual review. Motion carried unani- MOUSly. Attorney Lynde~ noted that If the non-conforming use of thf, structure from multi-family has ceased for a period of I year or more, It can no ~~r be used for such non-conformIng purpose. '..a c ,. David Young - Lot S~lit Wingert reported that the Planning Commission recommends Counci I approval of the lot spilt requested. He explained that the applicant Is currentt-y using this 16.5' x 361.5' portion of his brother's property as a driveway and Is requesting that It be added to his property. After review of the drawing submitted, and discussion, Wingert moved, seconded by Crichton, that the Counci I approve the consolidation and lot split, as requested, SUbJect to the Vi I lage Attorney finding that it Is abstract property. Motion carried unanimously. ArsQnal - S~rplus Parc~ Wingert reported that the Planning Commission recommends that the Council obtain more Information re why these two parcels are being -2- . ~. In discussion, following revIew of the various uses of the parcels, suggested by Ramsey County Open Space, Human Rights Commission, Parks and Recreation Committee and Planning Commission and interested citizens, Crichton moved that the Council Inform G.S.A. that the Village is contemplating rezoning all or part of the Twin City Ordinance Plant property. MotIon was seconded by Feyereisen and carried (Crichton, Crepeau, Feyerelsen voting In favor and Wingert In opposltlonl. . Crichton moved, seconded by Feyerelsen, that the Council take steps to endorse Ramsey County Open Space's plan to acquire parcel "C". Motion carried unanimously. Feyerelsen moved, seconded by Wingert, that the Council cation to Obtain parcel "A" for purposes of public park tion areas. Case No. 73-45, Syrfac~ Water Regulations Wingert reported that~Jle~~g Commission recommends that the Council write to Mr. -~~ e , Department of Natural Resources, reques1"lng D.N.R. to obtain an Attorney General's opinion re Joint County and Village enforcement of surface water regulations if estab- lished by Village ordinance. After discussion, Clark Administrator McNiesh was asked to write to D.N.R. as per Planning Commission recommendations. Flrellmlnar'l Plat. TOl8n. Hous~ Villages at Arden Hills, AdditIon Six Mr. Jim HII I presented the Preliminary Plat for the 6th addition, To\vnhouse Villagesat Arden Hills, for Council approval. Mr. WIngert reported that he had met with Mr. HI II and Fire Chief Fischer and that the Fire Chief accepted the 6th Addition as proposed, making no recommendations for changes. Mr. Wingert reported that the Planning Commission has recommended that Block 7 be moved to the north 5' to 10' . Mr. HI II showed an amerilty plan of al I additions, showing the Fire Chief's former recommendations. . Crichton expressed concern that the long dead-end roadways would present a problem for emergency vehicles; long way to back up and no provision to turn around. Planner Schmid suggested that an emergency connection or widened walkway be constructed (wide enough for a fire lanel from turn- around In the center of the 6th addition to the court. Mr. Hi II said he proposes a berm In this area preventing this pass- through; this was not the Intent desired. Crichton reported that the Public Works Committee was not able to give Council any recommendations re the utilities and availability of easements because of inadequate plans at the Public Works meeting. He said the Public Works Committee is concerned that easements are obtained so the Village will have access to all utility lines. ;.1'-. Minutes of Regular Councl I Mee71ng Page four March II, 1974 After discussion, Wingert moved, seconded by Crichton, that the Council approves the Preliminary Plat of Townhouse Villages at Arden HI I Is, 6th Addition, with the following changes from the plan dated March I, 1974: I. Block 7 be moved In a northwest direction 5' to 10'. 2. An emergency connection be made between the turning circle and long western court (connection to be of gravel or other suitable material which does not encourage short-cutting through the areal. 3. PlantIng list to specify caliper sizes. . Motion carried unanimously. (Attorney Lynden and Planner Schmid left meetlngl REPORT OF COUNCILMAN STAN OLMEN - Finance (absent - no reportl REPORT OF COUNCILMAN CHARLES CRICHTON - Public Works, Ordinance Review Annyal Water and Sewer SchooJ Crichton reported that the Public Works Committee recommends that Bud Johansen attend the Water and Sewer School this year, which will be held the first week In Aprl I. The Council concurred and authorized Mr. Johansen's attendance at the school. He re- ported that specifications are being prepared. Crichton explained that Station No.8 Is presently pumping near capacity; therefore, It may be necessary TO up-grade the station to provide sufficient pumpIng capacity. . Fire Protection - 8amsev. County Park Lands and Open S~ace . Crichton referred the Councl I to a letter from Shoreview (2/26/74), advising of a Fire Protection Agreement between Shorevlew and the Ramsey County Board, and requesting comments from Arden Hills and North Oaks re Intentions to enter inTO similar Fire Protection Agree- ments with Ramsey County for open space and park lands locaTed In Arden Hili s and North Oaks. Crichton suggested this type of agreement might be worthwhile for Arden Hills, also, and asked the Council to consider the matter for action at a later meeting. REPORT OF COUNCILMAN WILLIAM FEYEREISEN - Parks and Recreation, Human Rights Human Rights Commission Meeting - March 7, 1974 Feyerelsen reported that Minutes of this meeting wll I be forth-coming; essence of the meeting was that the group was dIvided Into primary and secondary InTerest groups and time lines for accomplishing their goals were established. -4- . , .--' ~~inutes of Regular Council Meeting Page five March II, 1974 North Suburban Da~ Activlt~ Center Feyerelsen reported that two or three Arden HI lis residents are en- rolled In the North Suburban Day Activity Center, and moved that the Council approve Vi Ilage of Arden Hi lis participation, and con- tribution of $362.40, as requested, for 1973-74. Motion was seconded by Crichton and carried unanimously. Clerk Administrator was requested to~ payment for this contribu- tion from Account No. 4550-379. . Pork ~eQu(~ltIQn - Stltus Report Moss Propertv - 8uckley reported that a written appraisal has not been received from Mr. Bettendorf, to date, re the Moss property, which Is proposed to give access to Ingerson Park; Mr. Bettendorf's verbal appraisal is below the Moss appraisal figure. After discussion, Buckley and/or Parks and Recreation Sub-committee was requested to pursue the possibility of obtaining a walking ease- ment over the exIsting 15' wide sewer easement. Karth Lake area - Buckley explained that the Committee's prefer- ence Is the Cummings property, but have had difficulty making contact with this owner; the second preference being the Amble property, north of this property. Buckley reported that Mr. Amble has expressed agreement that this area is of scenic value to the VI I lage and Is agreeable to sel ling; he Is talking with his attorney, and has agreed to permit the Vii lage to appraise his property. After discussion, Buckley was requested to consider a spilt appraisal; the west side of the property possibly being of more Interest to the Village. Buckley was asked to obtain costs of appraisals of the prop- erty, not of the land at this time, and to report findings to the Council. REPORT OF MAYOR HENRY J. CREPEAU, JR - General Business, Public Safety Letter from Governor Anderson - Conference Mayor Crepeau referred the Council to a letter from Governor Anderson inviting Arden HI I Is to send a representative to the Conference on Natural Disasters. Clerk Administrator McNlesh was asked to request a synopsis of the conference from Rosevil Ie, New Brighton or Shorevlew; there being no one from Arden HI lis to attend. Evaluation of Sal~ry - Off leer Picha Matter was deffered, pendIng receipt of "ranking list" whiCh had been requested.
