Call to Order Pursuant to due call and notice thereof, Mayor Crepeau opened the meeting at 7:30 p.m. Roi I Ca i I Present - Mayor Henry J. Approval of Minutes Woodburn moved, seconded by Hanson, that Counc II approve the Minutes of the Regular Council Meeting of September 26, 1977 as amended, and the Minutes of the Special Council Meeting of Septem- ber 30, 1977 as submitted. Motion carried unanimously. Business from the Floor None. Police Services for 1918 Woodburn moved, seconded by Hanson, to consider the motion of September 26, 1977 to contract with Ramsey County Sheriff as soon as possible. Motion to con51der carried unanimously. DouQlas Barthanv, 1926 Jerrold, stated that the people are here to hear the pros and cons re Arden Hills Police vs. Contract with Ramsey County and asked that the matter be opened for discussion. Donna Caron said she talked with two signers of the Petition (sub- mitted at 9/26/77 Councl! Meetlngl who had no Idea what they were signing; thinks people should know what they are signing. Rav Jones (resident of Arden Hlllsl said he was not familiar with what happened at the September 26th meeting and asked that the Petition be read. (Mayor Crepeau read the Petitlonl. Jones asked what was done with the Petition by the Council? Crepeau answered that It~as read, accepted, considered and fiied. Vlctor.Pomerenke said he Is a friend of the Council and the Police Department; feels Pollee Department Is part of our city; makes for a closer-knit community; told of an experience he had which was resolved by the Arden Hlils po~ice. Donald Obbarius asked what Is the advantage of County police, other than saving money? Crepeau said that In ~ast 9 months the morale of the department has nearly disappeared at times; fea i s City w I i U ;rece I ve better se!"vl ce from the County. Hanson noted that the Council has not decided to contract with Ramsey County Sheriff; motion was deferred to give Interested people a c.hance to be heard. Counc I I discussed the postponement request; decided to try to accom- modate the people in the Councl i room by removing the ~halrs and providing standing room for all pi"eseni', so that ail who wish to speak can be heard. Ted Rovce said he can talk for ai I here: thinks the world of the Arden Hills Police: aH want the Arden Hills pollee to stay. (Discussion was Interrupted at 8:00 p.m. for Bid Award - General . Improvement Bond Series 3.J General Improvement Bond Sarles 3, Bid Award FI sea I Consu~tant Peter Popovich reported that the bids on $1,765,000 General Obligation Improvement Bonds, Series 3 were opened at 5:00 p.m at. his Office; City Treasurer Donald Lamb was present: four bids were received. Popovich distributed copies of the bid tabulation Indicating results of sale: BancNorthwest (low bldderl with a net Interest rate of 5.IB03% (bids ranged from 5.1803% to 5.317178% Net Interest), Popovich advised that the I nterest rates are In line with current market conditions and recommended adoption of the resolution accepting the BancNorthwest bid. Hanson moved, seconded by Woodburn, that Councl~ adopt Resolution 77-62, Resolution AcceptIng The Bid On The Sa!e Of $1.765,000 General Obli- gation Bonds, Series 3 And Providing For Their ~ssuance. Woodburn advl,sed that It Is not legal to decide by referendum (1954 Attorney General Opinion: raaffl rmed In 1968). Crepeau advised thaT Ramsey County will have II car In the Village 24 hrs. a day: .the sama as now; coveL"age loll i I be the same but will cost less; wll I share cost of administration with other cities contract- Ing with Ramsey County Sheriff. Woodburn saId both departments have same union; therefore, employee costs wi II be about the same; oth3r cities (Shoreview, Falcon Heights, North Oaks, etc.l are very satisfied witb Ramsey County service. Donna Caro~, said If we keep our police, we'll have to up-date It for emergency service. Woodburn advised that Arden H!lls police have had first aid training, as does Ramsay County; If C!ty wants emergency van we will heve to purchase the van; Unity currently provIdes paramedics . and cost Is borne by persons requ!rlng the service. Crichton said that In adopting 1978 budget, Counc! I decflded to e~imlnate the emergency van: additional training of men is necessary to prOVide ~hls emergency service; If want<!ld, van can be purchased. Roseville is the best police department in the arell; service Is excel- lent. You state the "morale" of the Arden Hills pollee Is bad; this has to be "bunk"; they are going out of their way to do a job for the City. Colestock said "bigger Is better" is not true; have dedicated officers - only way to go is to keep our departmsnt. Colestock said Doug McCa II has dona a tremendous job as Acting Police Chief - is dedicated; difficult to find in a large department. Crichton said that McCall is one of the candidates for Chief; recom- mendations have not been made to Counclr as yet, pending determination . of whether or not the Arden Hills Police Department Is retained. Shlrlev Tufte (Dunlap) said the Arden Hills police greeted them when they moved to Arden Hills, sees Arden Hills police In her neighbor- hood, likes hevlng a police department she knows; good for children to know police are there to help them. We know our police; lets keep them. Donna Slmontella (sp?), Arden Manor, said she used to work nights; felt secure because Arden Hills policed in the tral~ar park, would respond in a few minutes. Crepeau said It could be that we'd have the same off I cers It we go Ramsey County. Ted ROYce said he can't believe there's one kid In Arden Hills that does not have respect for the Ardon Hills officers; they understand the kid~ and the kids, the poJ ice; this makes the difference. Lynn Roach said she doesn't believe that by holding a meeting In a room this size, the Council is doing the job they were elected to do. Schrader - a new comer to Arden Hills, said he would not heve moved to Arden HII Is if he thought the pollee department was to be abolished. Brandt Kretch said he has been happy with the Arden Hills police; dedicated service all the years he has i Ived here; would like to keep the pollee force if at ell posslb~e. Frank Stanton, resident since 1950, Is interested In the Police Depart- ment; is on the committee to screen and select a Police Chief; recogn I zes that a fine po~lce department must have a leader they respect; If we cannot get a strong chief who can command respect of ail the officers, It Is time to make the very dlfficu(t decision, which may not be popuHar, but honest, end teke advantage of fu!ler service with strong leadership. Crichton said that if we cannot gst a leader, then we should go with the County. Hanson expialned that the Councli has been concerned about the depart- ment since the retlrem9nt of the Chief; asked Lt. McCaii, in March, on a temporar~ besls, to shape ~p the deperTment during periOd of time Counc II looks for a chief. ,. Bob Witt said he can underst~nd toe poor morale of the department; asked w~y it has been 8 months without a leader; level of training Is the responsibility of the Council. Woodburn said this Is correct; department has been operating short-handed; resources are limited; difficult to send key people for training and cover the shifts with number of officers we have. ~ seld it Is poor judgement to dissolve the department when City has surpius funds; asked what department will cost to maintain and the reason Counci i wants to dlsso~ve police department. O~e Locey said he discussed the matter with residents on Ingerson Road; would fsv.or Ramsey County service - are not under the impression we'd get less service, same people would serve the City if we ask for them, except Ramsey County cannot take on the part-time officers. Crichton explained that we'd have 6 officers with Ramsey County; 6 officers, plus a Chief, If Arden Hills department. -3- -------------^-- , , . Minutes of Regular Coune; , Meeting October II, "977 Page four Loc~ said he understands City can contract for any service it desires with Ramsey County; same amount 8S we have, or more If desired; training Is expensive and equipment Is expensive; Ramsey County can provide flexible hours and we'll have better service because of the training situation - man can be rep~aced with another, if one officer Is In training. Captain Spencer (Ramsey County) was aSked how service would be affected if one of our 6 officers is sent to school. Spencer said the contract Is for service 24 hrs. a day (If that Is the contract) whether man Is being trained, on sick leave or on vacation; if two calls are received at the same time, both will be taken care of. . Locey asked what cost difference will be? Crepeau answered it 'is esti- mated to be from $6000 to ~3,000 (depending on how comparisons are made); probably a difference of $16,000 the first year; could be an additional $9,000 - $10,000 the. next year. Chief Weber (Ramsey Countyl said the savings will come because of centralization of administration; co.st of which is shared with other cities contracting with Ramsey County; by State Statute, a~1 costs 8ttrlbut~d to each city are separately accounted for; City pays costs according to leve! of service requested; has aval lability of additional cars, If wanted on an emergency situation and/or simultaneous calls. Janice Cheney, 1732 Venus, <employed by Falcon Heights) said she signed the Petition; has now read 4 months of Ramsey County Sheriff reports; agrees with Captain Spencer - when car is needed, a car is provided; had a triple need in Falcon Heights - 2 squads and a transport vehicle were provided In 3 minutes response time; completely backs Ramsey County which gives Falcon Heights Immediate response. - Crichton noted that If Arden Hills needs assistance, New Brighton, Ramsey County, Roseville etc. respond at our request now. Woodburn noted that he discussed Ramsey County police service with the City Manager of Falcon Heights; expressed satisfaction with the service and response time. Woodburn said the Councl! Is charged to provide the service whiCh Is considered to be best for the citizens of Arden Hills; we are working together for each other. Bob Anderson said he believes the Arden Hills officers are dedicated; Ramsey County will also be deGicated; does not fee! 8 large force will "s~ough off"; .e'~1 get as good, j f not better, service. Lee Lippert said he believes we have good officers; as an attorney he'd not want to be prosecutor because officers don't have the opportunity to keep abreast of all laws as passed; City Is not large enough to maintain a department of Its own; our department does the best it can but feels Arden Hills cannot afford the I uxury of Its own department. Suzanna Tavlor said she feels Arden Hills has a great police department; If there's a problem, feels the Council is not supporting the depart- ment. Adolph Miller, Pascal Avenue, said he Is pleased with the Arden Hills department; does not believe a bigger department will be better; feels that a smaller department 1'111' do a better job. Jim Schrodi, said he's been a resident since 1963; has had no problems with Arden Hills police; wonders about Ramsey County; they are not doing a good Job with water patrol on L~ke Johanna. Crichton advised that the Review Board is now ready to recommend its list of names for chief, if City decides to maintain its police depart- ment. (Inaudible) asked If the "bad moralen is the fault of the officers or the CounclT? hates to see the City give up one of its freedoms. It was noted by Counc I ~ that the City is not ~arge enough to have Its own engineer, attorney, planner etc; contracts for ai I these services. . Chrence PEerson said the one thing you can't contract for Is personal involvement; contract won't cover this. Crepeau said the Council is trying to do the best job for the most people. Charles Hem~on~, 4434 Arden View Court, said we are talking cost and responsibility; County Is governed by the Board of Commissioners; hates to equate City with the County Board. Chief Weber said the Statute does say "may"; offIcers must make appli- cation with Civil lel"vlce; can't be accepted If person has a record or Is not qualified as a pollee officer. Woodburn asked the polley of the department In the past? in other communities the officers were taken Into the County department; two were not quaDlfied because they had criminal records. Crichton said he tHe!s we have had some difficulties I n the Arden H II ,s PolIce Department over the years; now City has -\a chance to get good leadership; feels strongly that the Arden Hills department Is better for the citizens of the City; need a department that Is responsive to the Counc II; have two options: get a good leader or contract with the Sheriff department. Phil Fabel asked If the name of the "good leader" Is avallab Ie. Us 25 yeal"s; has no complaints re the service of the Arden HIDis Police department; has never called them on his own behalf; appreciates the Job done by our part-time officers, as we! I as the full-time men; feels sorry that County cannot absorb the part-time men as well; noted that part-time men wilD be excluded; advised that the Stanton Survey Indicates a long-range recomnlendatlon that Arden HI I I s contract with Ramsey County for Its poi Ice service; has no reason to beUleve the City will have less service with the County. Crepeau said that no personalities are Involved, as tar as he Is con- cerned; feels too that part-time officer Goerftz has done a tremendous Job. Woodburn said he has been pleased with the service of the Arden Hills Police Department over the 16 years he has been a resident; agrees that Officer Goerltz has done a tremendous job for Arden Hills; wouUd recommend that, If City contracts with County, that he be given every consideration for a job with the County. Motion was re-stated and following the discussion, the motion carried (Crepeau, Hanson, Woodburn voting In favor of the motion; Crichton voting in cpposltlonl. . Resolutlon.No. 77-64. ApprovlnQ Fire Protection AQreement and AuthorlzfnQ Mayor and Clerk to Execute AQreement Woodburn moved, seconded by Hanson, that Council adopt Resolu- tion No. 77-64, APPROVING FIRE PROTECTION AGREEMENT AND AUTHOR- IZjNG MAYOR AND CLERK TO EXECUTE AGREEMENT. Crichton moved, seconded by Woodburn, that Council Introduce Ordinance No. 199 by Title, Rezoning The Three Parce!s Of Land ~n Arden HI~ls. Motion carried unanimously. Final Plat - PendlnQ Items . A. Karth Lake Estates Lynden referred COunci I to his letter of 10-7-77, recommend I ng approval of the Final Plat of Karth Lake Estates, subject to five conditions; letter of 10-11-17 indicates that the Rice Creek Watershed (condition #4) condition has apparently been resolved; therefore, recommends Council approval of the Final Plat subject to conditions I~, 2, 3 an d 5 In his letter of 10-7-17) . 'Woodburn asked about resolution of the park dedication. Crichton reported that developer has IndiCated agreement to a park dedication In the net amount of $29,587.20, payable at $500/lot at time Building Permit Is issued; final balance to be paid In fu II by August 31, 1979 (noted that he had proposed, at Building Permit issuance or at sale of lot; developers prefer at Build- ing Permit time-not at sale of lot). Crichton moved, seconded by Hanson, that Council accept a park dedication for Karth Lake Estates in tha net amount of $29,587. payablo at $500/10t at Building Permit time; balance to be paid by August 31, 191'. . Lynden recommended that the motion be amended to provide that an Agreement be d,-awn setting forth the stipulations of pay-' ment of the park dedication. The amendment was accepted by Hanson and Crichton and Motion as amended carried unanimously. REPORT OF ViLLAGE ENGiNEER OONALD CHRISTOFFERSEN Kerth lake Improvement No. 76-1 , Resolution No. 77-56, Bid Award Christoffersen reported that alt the necessary permits have been re- ceived for the Ka rth Lake Improvement i DNR, PCA, Metro Waste, Board of Health, R.C.W.D.); recommends that Council award the bid for the Karth Lake Development to the low bidder. Woodburn moved, seconded by Hanson, that Coun ell adopt Resolution No. 77-56, Resolution Awarding Bid For Improvement No. W-P-SS-76-1, award- Ing bid to C. W. Houle, In the amount of $591,333.70. Motion carried unanimously. ChanQe Orders Nos. i & 2 - Improvement No. 77-~ (Chatham) ChrIstoffersen explained that Change Order No. ~ I s for a time extensIon, and Change Order No. 2 Is for two live water taps, In lieu of cutting off wate r to a large sector of the Village. Crl chton moved, seconded by Woodburn, that Councl i approve Change Order Nos. I & 2, Improvement No. 77-1 (Chatham). Motion carried unanimously. Chatham improvement - Road Status Ch ristoffersen reported that, because of the excessive amount of ra I n, he will be requesting granular rather than asphalt road base that was specified. Cl'lchton moved, seconded by Hanson, that Council table the matter to permit the City Engineer time to study a method of drainage for the area and the developer to obtain approval of the drainage plan by Rice Creek Watershed District and to obtain approval from New Brighton for the sanitary sewer connectiOn. Mutual Service - Grsdinq and Landscape Plan MI I leI" stated that Mutual Service is offering an idea of its plans, and asking for in-put; no action Is requested tonight. . Terry WObkln, Tom Lynch and Wayne Winsor (Wlnsor/Faricyl displayed a revised mOdel of the proposed site end indicated changes proposed In parking area and drainage ponds. It was noted that point in question is the 100' butter strip, between re51dentiai area of Hunters Park and the recently rezoned R-B portion of the Mutual Service site. Crichton moved, seconded by Woodburn, that the rezoning to R-B previously approved (7/11/77) Is as Indicated on Survey dated 9/15/77. Motion carried unanimously. Lynch reported that an EAW has been prepared for the Mutual Service site, to be submitted by the City. In discussion, it was noted that an EAW Is not mandatory for this project; not feasible for City Planner and Engineer to review the EAW to meet the October 12th monitor deadline. Mutual Service determined to not submit the EAW at this time since It is not mandatory. In discussion of revised site, Planner Mliler noted that when the road Is constructed, some loss of trees may result between the road and the revised parking lot configuration; will want to watch this. Miller said he has no prob~em with defining the drive-in portion of the structure as an accessory usa for the bank; therefore a permitted use In the R-B zone. Lynden advised that the Zoning Ordinance provides that Council may, In Its discrotlon, grant a temporary permit for use of temporary facili- ties as dwe! ling units for up to 90 days when an emergency or hardship situation exists; ordinance does not provide for a temporary permit for other structures; It would be stretching to apply the residential provision to the temporary bank facility. Lynden repor~ad that he requested P~anner Miller to canvas other com- munities re how temporary structures are handied; reports that several have an ordinance provision for temporary structures; one city requires a bond, or letter of credit, In amount of IOO~ of the cost of the oer- manent structure; some cities treat the request as an administrative matter. After discussion, Hanson moved to deny the temporary facility because there Is no ordinance provision and the temporary facility Is out of character and context in the downtown area of the City. Status Report - Site Analysis, Village Hair/Public Works Building Miller reported he met with Councilman Woodburn, Bud Johansen, John Buckley and Charlotte McNlesh to obtain directive for preparation of the site analysis and future anticipated needs. Special Studies Miller reported that the Planning Commission has scheduled a Special Meeting on October 18th to discuss the p~anning of "downtown Arden Hills", requesting that ~ study be made of the area; concern was stemmed by . the application for an addition to Flaherty's Arden Bowl.
