Roll Call Present - Mayor Henry J. Crepeau, Jr., Councilmen James Wingert, Robert Woodburn, Ward Hanson, Charles Crichton. Absent - None. Also Present - Attorney James Lynden, Engineer Donald Christoffersen, Planner Orlyn Miller, Treasurer Donald Lamb, Clerk Adminis- trator Charlotte McNiesh, Deputy Clerk Dorothy Zehm. Approval of Minutes Woodburn moved, seconded by Wingert. that the Minutes of the Regular Council Meeting ot July 25. 1977, be approved as amended. Motion carrIed unanimously. Business from the Floor None. 1EPORT OF VILLAGE ATTORNEY James Lynden Status of EAW for Chatham Lynden referred Council to his letter of 8-4-77 to the Environmental Quality Board, re Chatham Subdivision, describing the City's reasons for Its request for an exemption from the preparation of environmental documents for the Chatham development. Lynden reported that he, Engineer Christoffersen and Hans Hagen (BanCon) will attend the Environmental Quality Board Meeting on lues, August 9th when the City's request for exemption will be considered; will request that work on the project be al lowed to continue, if It is determined that the EAW Is required; EAW has been prepared and will be submitted to EQB at the meeting, If the exemption Is not granted. Christoffersen advised that, as the result of revocation of the PCA permit, he has directed the contractor (Houle) to cease work on the project; noted that a Change Order wll I be forthcoming, because of the construction delay. After discussion, Wingert moved to ratify previous Councl I action, authorizing Attorney Lynden to file the Negative Declaration for EIS, and authorizing execution of same by the Clerk Administrator on behalf of the City. MotIon was seconded by Hanson and carried unanimOUSly. EAW - KarthLake Estates Wingert moved, seconded by Crichton, that Council authorize a Negative Declaration for an EIS for Karth Lake Estates development; authorize execution and filing of same by the Cierk Administrator. Motion carried unanimOUSly. Request for Reimbursement re Fire Line Instailedat Llndey's Steak House Lynden referred Council to memo from Public Works Supervisor Hans Johanse~ and to his letter of 8-8-77 re Widmer Bros., Inc. vs. City of Arden Hills. Banister, Short et al. . After discussion, Woodburn moved, seconded by Crichton. that Council authorize Attorney lynden to advise Widmer Bros, Inc. et al that the Clty declines any responsibility or liability In connection with the fire line Installation at Llndey's Steak House. Motion carried unani- mously. Speed Limit in Mobile Home Parks Lynden referred Council to his letter of 8-8-77, noting that Minnesota Statutes, Subd. I of Sec. 327.24 provides that "It shall be unlawful for any type vehicle to traveU et a rate In excess of 10 mph while within the limits of a mobile home park or recreational camping area and such 10 mph limit shall be clearly posted throughout the mobile home park." Lynden noted that enforcement of the speed limit Is the duty of the State Department of Health; therefore, It does not appear that the City of Arden Hills is responsible for enforcement of the speed limIt. -f- Minutes of Regular Council Meeting Page two August 8, 1977 it was noted by Council that the Vi Ilage Is empowered to enforce state laws, however; so. if necessary could enforce this speed limit. Crichton referred Council to a memo from Officer Fish. In which he sug- gests that Park Manager Instal I speed signs in the Arden Manor Mobile Home park, and that consideration be given to the Installation of bituminous ridges at Intervals In the street, to deter fast speeds. Engineer Christoffersen suggested that "dips" are more easily plowed than "bumps", if park manager decides to install a deterent of some type. REPORT OF ViLLAGE ENGINEER DONALD CHRISTOFFERSEN Petition for Construction of Harriet Avenue Council was referred to petition requesting construction of the ex- tension of Harriet Avenue to County RoadE. Christoffersen noted that the feasibility study for this Improvement has been prepared; cost estimates will have to be revised. ~''''''~) -::d!-" discussion, Crichton noted that the petition.. Crichton asked that consideration be given to the provision of an underpass under Harriet Avenue wher$ ,t is proposed to bend northward; under~ass to go diagonally across the bend of the road from the 50' wide easement on the west to the 20' wide easement on the east; sug- gested It be constructed with the road Improvement. After discussion, Woodburn moved. seconded by Hanson, that Council author12ecompletlon and up-date 0' the feasibility study as outlined. Motion carried unanimously. Little Crow Addition Assessments Crichton moved, seconded by Wingert, that Council amend Resolution No. 77-30, correcting the cost of improvement to $22,891.32 ($379.34 more than Indicated originally), and adopt Resolution No. 77-43, RESOLUTION PROVIDING FOR HEARING ON THE PROPOSED ASSESSMENT FOR LITTLE CROW ADDITiON IMPROVEMENT. Motion carried unanimously. County Road F Assessments - Resolution No. 77-44 Wingert moved, seconded by Woodburn, that Council adopt Resolution No. 77-44, RESOLUTION PROViDJNG FOR HEARING ON THE PROPOSED ASSESSMENT FOR IMPROVEMENT NO. P-SS-W-ST-75-1. Motion carried unanimously. McMlesh noted that the Notice of Hearing states that assessments will be spread over 20 years; polley has previously been to spread street assessments over 10 years (20 years on general Improvements). After discussion, McNiesh was requested to determine If the number of years, over which assessments are to be spread, can be changed at the Public Hearing (either up or down); if City cannot change the ~Ime at the Public Hearing, Not!ce of Hearing should be changed, before publication, from 20 years to 10 years. Resolution No. 77-46 - Department of Transportation Plans for Land- scanlno and Traffic Noise Attenuators Wingert moved, seconded by Hanson, that Council adopt Resolution No. 77-46, relating to the transportation plans for landscaping and traffic noise attenuators on Highway 35W from TH 694 to the north corporate Umlts. Motion carried unanimously. After discussion, Woodburn moved. seconded by Hanson, that Council adopt Resolution No. 77-45, RESOLUTION APPROVING PLANS AND SPECIFI- CATIONS AND ORDERING ADVERTISEMENT FOR BIDS ON lMPROVEMENT W-P-SS-76-1; bid opening to be on September 15, 1977 at 2:00 p.m. at the Village Hall. .Motlon carried unanimously. -2- Minutes of Regular Council Meeting Page th ree August 8, 1977 REPORT OF ViLLAGE PLANNER ORLYN MILLER Case No. 77-37. Front Setback Variance for House Addition - 3244 Sandeen Road. Miller referred Council to his report (7/28/77), and to reports of the Board of Appeals (8/1/77) and Planning Commission (8/2/77). both reco~- mending Council's approval of the 5' front setback variance. Miller noted that the affected property owners, on either side and across the street from the SUbJect property, have signed a statement that they have no obJections to the proposed addition. . After discussion. Wingert moved, seconded by Woodburn, that Council approves the 5' front setback variance for the house addition at 3244 Sandeen Road because of the hardships of the land features of the lot. narrowness, grade, etc. Motion carried unanimously. Case No. 77-39. Side and Rear Setback Variances for Garage - 1892 Lake Lane Miller referred Council to his report (7/28/77), and attached sketches of the site; noted that the rear setback variance Is appropriate be- cause of the shallow lot (81' deep); requested side setback variance Is based on need for maneuvering space because of location of a large pine tree, and for aesthetic reasons (contrasting exterior treatment, screening of motor home from view by parking it between the two garages) . Miller noted that the Board of Appeals 18/1/77) recommends approval of both the side and rear 5' setback variances; neighbors to the east and south have signed a statement that they have no objections to the proposed garage location; Planning Commission recommends approval of both variances with the condition that one curb cut Is closed and land- scaped. Wingert moved, seconded by Woodburn, thaT Council approve the 5' rear setback variance, based on the minimal depth of the lot, on the con- dition that the westerly of two curb cuts Is closed. After discussion. motion did not carry (Wingert voting in favor of the motion; Hanson, Crepeau, Crichton voting In opposition; Woodburn abstain- Ing) . Crichton moved that Council approve the 5' rear and 5' sldeyard setback variances, as recommended by the Planning Commission, with the condi- tion that one curb cut Is closed. Motion was seconded by Hanson, and carried (Crichton, Hanson, Crepeau voting In favor of the motion; Wingert voting in opposition; Woodburn abstalnlngl. Case No. 77-33, Special Use Perm!t for Planned Unit Development for Twin Clty.Christian Homes Retirement Center. Miller referred Council to his report (j/28/77~ to Minutes of the Plan- ning Commission Meeting of 8/2/77 and to the plans submitted In support of the Special Use Permit application. - . Miller reviewed the current proposal as it compares to the Initial proposal; noted that the City Council's decision to grant a Special Use Permit on August 25, 1975 established that the proposed Retirement Cen- ter is an officially acceptable use of the subJect site. Architect Wayne Winsor (Winsor/Farley) presented sitellne drawings, In- dicating the views of the apartment building from the various residential areas to the east, west and south. Council compared the site pl~ns of the Initial and current plans and noted that additional plans will be required for review and approval (grading, building elevations, utility etcJ prior to approval of the first phase of construction. Wingert noted that the 4-plex units are not actually depleted on the site plan; only a concept location; there- fore. they were not part of the Public Hearing. . Winsor noted that the site plan has been amended since the Planning Commission meeting of 8-2-77, to comply with the Commission's recom- mendations (copy of revised site plan to be submitted for the Village record) . > -3- . . Minutes of Regular Council Meeting Page four August 8, 1977 After discussion, Crichton moved that the Council authorize the City Attorney to prepare a Special Use Permit In accordance with the amended site plan for 214 units. presented to Council on 8/8/71. with contingencies numbered 1,2,3,4 and 6 listed in Planning Commis- sion Minutes of 8/2117, pius 7. approval of plans by the City EngIneer, 8. a provision for re-revlew by the Council, If there Is a two-year stoppage of construction and 9. resolution of the park dedIcatIon requirements. Motion carried unanimously. (Draft of Special Use Permit is to be considered by the Council at Its meeting on August 29. 1977.) Case No. 77-~6, Special Use Permit for Ramsey County Park and Build- Ing Permit for Toilet Building. Miller noted that the Public Hearing on August 2nd. held by the Plan- ning Commission. was on a Special Use Permit for the park as well as on the construction of the toilet building. Miller explained that the site plan presented is very preliminary, reflecting concepts of how Ramsey County proposes to proceed, and reported that the Planning Commission recommends Council approval of the Issuance of a Special Use Permit for the existing park, Including the proposed toilet building, as per plans submitted. After review of the preliminary sIte plan of the park, and discussion, Wingert moved, seconded by Hanson, that Council approve the Issuance of a Special Use Permit for the park as it exists todayCplan received on 8/8/77), Including the proposed toilet building. and the Issuance of a Building Permit for the toilet building as per plans and speci- fications submitted; other future construction Indicated on the pre- liminary site pian (received 7/1/77) Is not Included In this approval. Motion carrIed unanimously. Case No. 17-38. Special Use Permit for Underground Oil Tank _ Control ~ Corporation (Councilman Crichton left the Councilroom for this portion of the meeting.) Miller referred Council to his report (7/28/71) and reported that the Planning Commission recommends Council approval of the issuance of the Special Use Permit for the installation and operation of ~ 20,000 gallon underground oil tank, as proposed, subJect to Control Data's obtaining a P.C.A. permit. Mil Per said that peA advises that they do not require a permit, but approval of the State Fire Marshal is needed. Wingert moved, seconded by Woodburn, that Council approve the Issuance of a Special Use Permit for the construction and operation of a 20,000 gallon underground 011 tank at Control Data Corporation, as per plans submitted, subject to approval of the State Fire Marshal. Motion carried unanimously. (Crichton returned to meetIng.) Case No. 76-41, Identification Sign for Chath~ Hans Hagen presented a sketch of the proposed "Chatham" Identification sign, to be 7' x 16' wide and constructed of boulders and timbers; a matching boulder wail to be constructed on lot across the street, creatIng an entrance to "Chatham" at McCraCken Lane and-Old Highway 10. Miller referred Council to the PlannIng Commission Minutes of 8/2/77; reported that the Planning Commission recommends general approval of the sign, subject to receipt of a scaled drawing. Miller noted that the sign ordinance (No. 76) does not permit signs In resldentia~ zones; identification signs are becomIng popular and. If done well. very de- sirable; If sign Is approved, sign ordinance should be amended accord- Ingly. (It was noted that sign is not to be lighted.) -4- Minutes of Regular Council Meeting Page five August 8, 1977 Metropolitan Systems Statement MIller referred Council to the Preliminary PopulatIon ProJection (8/1/77) and to Minutes of Planning Commission Sub-committee (7/26/77); noted that the metro proJectIons are lower; feels that the compilation, as presented to Council by the sub-committe, is a "common sense" approach, possibly needing some review before discussion with Metro CouncIl. OTHER BUS I NESS . Case No. 77-14. Park Dedication for Town Crier Pancake House Wingert reviewed Park Dedication negotiations re the Town Crier Pancake House property, and moved that Council accept a $4.000 park dedIcation for the approximate 1.54 acres of leased land, payable withIn 30 days of issuance of the Bui Iding PermIt. Motion was seconded by Woodburn and carried unanimously. Case No. 77-22. Park Dedication - Buesing Property Deferred to later meeting, pendIng receipt of detaIled drawing of proposed park dedication. Refuest for Time Extension to Complete LandscapIng at Hunters Park De erred action. Request for Exemption from Park Dedication Requlremen~s - U.S. General Services AdminIstration Woodburn moved, seconded by Wingert, that Council respectfully decline to exempt U. S. General Services Administration from park dedication requIrements. Motion carried unanimously. FIre Protection Status Report Woodburn reported that Attorney Lynden has been directed to draft the fire contract for review by the Fire Board. Public Safety Committee Referral Council was referred to a letter from Townhouse Villages Home Owners Association, requesting suggestions re traffic control at Arden View Court and Arden View Drive. Matter was referred to the Public Safety Committee for review and recommendations. REPORT OF CLERK ADMINISTRATOR CHARLOTTE MCNIESH Resolution No. 77-42. ApprovIng 1977 Labor Agreement with Minnesota Teamsters Public & Law Enforcement Employees Union #320 CrIchton moved, seconded by Wingert, that Councl I adopt Resolution No. 77-42, RESOLUTION APPROVING 1977 LABOR AGREEMENT WITH MINNESOTA TEAMSTERS PUBLIC & LAW ENFORCEMENT EMPLOYEES UN!ON, LOCAL #320. Motion carried unanimously. Guidelines for 1978 Budget McNlesh requested that Council determine guIdeline percentages for use in preparation of the 1978 Budget. CouncIl concurred that 7$ be used for budgeting purposes on salaries; 6~ for Interest on Investments. . A roval of Refuse Hauler LIcense - Cral Tabled pending add tiona! Information. Claims and Payrol Is Hanson moved, seconded by Woodburn, that Councl I authorize payment of Pollee Department salary adjustment for period 1/1/77-7/31/77. Motion carried unanimously. Department of Public Safety Letter Requestlnq Waiver ?f Sign Permit and License Fees Woodburn moved, seconded by Wingert, that Council approve the waiver of Sign Permit and License Fees for a sign at the Highway Patrol building, 3800 Dunlap, for 1977; Building Inspector to determine, after checking with other municipalities re waiver of fees for State agencies, whether sign permit and license fees should be exempt for 1978. Motion carried unanimously. Joint Powers AQreement for the Suburban Ramsey County Emerqency Com- munications Board Woodburn moved that Council authorize execution of the Joint Powers Agreement for the Suburban Ramsey County Emergency Communications Board; defer adoption of Resolution and appointment of a director and alternate director unti I the August 29th Council meeting. Motion carried unanimously. Pursuant to due call and notice thereof, a regular meeting of the City Council of the City of Arden Hills, Minnesota, was duly held at the City Hall in said City on Monday, the 8th day of August, 1977, at 7:30 o'clock p.m. The fOllowing members were present: Mayor Crepeau and Councilmen Wingert, Hanson, Crichton and Woodburn; and the following were absent: None. Councilman Woodburn introduced and moved the adoption of the following motion: MOTION DECLARING ADEQUACY OF PETITION AND ORDEllING PREPARATION OF REPORT ON IMPROVEMENT NO. P-77-4 HWEREAS, a certain petition requesting an improvement in the City of Arden Bills generally in the area bounded by Lexington Avenue on the east, Snelling Avenue on the west, County Road E on the north, and 1400 feet south of County Road E on the south, by the consuuction of bituminous surfacing, concrete curb and gutter, necessary drainage, right-of-way acquisi tion, pedestrian underpass, and necessary appurtenances, filed with the Council on August 8, 1977, is hereby declared to be signed by the required percentage of owners of property affected thereby pursuant to Minnesota Statutes, Sec. 429.035. NOW. THEREFORE, IT IS MOVED that the petition be referred to the City COnsulting Engineer for study and that he is instructed to report to the Council with all convenient speed, . r~: . .. , .. advising the Council in a preliminary way as to whether the propOsed improvement is feasible and as to whether it should best be made as proposed or in connection with some other improvement, and the estimated cost of the improvement as recommended.
