Roll Cat I Present - Mayor Henry J. Crepeau, Jr., Councilmen Ward Hanson, James Wingert. Absent - CounCilmen Charles Crichton, Robert Woodburn. Also Present - North Oaks Mayor Warren Johnson, Councilman Richard lange; Shoreview Mayor James O~son, Councllmembers David McGraw, Mary Newbold, R. A. Wedell and Robert Weyandt; Shor.vlew Attorney Jerome Filla; Shorevlew Civil Defense Director C. J. Michaud. Report of Attorney Jerome Filla The second dra ft of Jo.lnt Powers Agreement and Proposed Ord I nance incorporate suggestions of the meeting on March 9th; Joint Powers Agreement Includes revisions of North Oaks Attorney. The Joint Powers Agreement establishes relationship of three cities, creates and defines duties of Joint Fire Protection Board, provides formula for cost allocation and purchase or lease of equipment, provides for termination of agreement wIth one year's notice. Filla noted that fire chief Is non-voting member of board; cities' representatives do not have to be Councilmen; board would adopt ordinance establishing volunteer fire department. Filla advised that legally cities can delegate authority to adopt ordinances etc. to the board or could make it en advisory board. Attorney Gene ra Its opI n Ion states that boa rds can have a II except taxing power. Revisions - Draft No.2, Joint Powers Agreement it was the consensus of the city representatives that: I. Fire Chief should be voting member of the board. 2. EaCh city Should appoint member and alternate to serve on the board for term designated by each Council. 3. Fire Chief should designate his alternate. 4. Meetings of the FIre Protection Board shall be held only when ail members and/or alternates .re present. 5. Members of Board shell not be compensated for services. 6. Rewrite III B. i la) to include mutual aid agreements with Independent or other municipal agencies. . 7. Rewrite last sentence of B I (a) and (b) to provide for approval by each of the City Councils of the municipalities. 6. Add to III B 4 provision to make recommendations regarding number of personnel necessary to provide adequate protection. 9. Reword V to Include operational costs and Fire Protection Board costs. . Proposed Ordinance -Draft 2 FIlla said thet normally Fire Protection Board would have respo~slbi~lty to develop this ordinance, but time factor doesn't permit this. He drafted ordinance which may be in conflict with LJVFD B~aws, Fire Department wi I I have to review. The ordinance should provide gulde- ~Ines for the By-Laws. He also noted that there may be a legal prOblem If the name stays LJVFD and that he did not address the problem of equip- ment which the Fire Department presently owns <could be handled later with separate agreement). In a brief discussion of the Proposed Ordinance following corrections we re noted: I. First sentence of Section I should be "There Is hereby establ 'shed". 2. Minimum number of fire fighters Should be Increased probably. 3. Rules, regulations and By-laws Should be subject to approval of Fire Board. -1- . . . Add Section 4 i to make Chief responsible for preparing speci- fications for equipment and submIt to Board. 6. SectIon 8 should be changed to "fire fighters shall be eligible to retire. Filla agreed to check so that Ordinance and Joint Powers Agreement have compatible provisions and references, saId Draft 13 of the docu- ~ents would be ready Monday, will send third draft to Fire Department with cover 1etter stating cities' Intent Is to Incorporate LJVFD By- laws In Ordinance (realIze there may be conf!lcts as written), to re- quest LJVFD Input, to continue as three cities negotiating via Fire Protection Board. Councilman Crichton was appointed as Arden Hills member of the Fire Board, Wingert as A!ternate. Adjournment.
