Ca II to Order Pursuant to due cal I and notice thereof, Mayor Crepeau called the meeting to order at 7:30 p.m. Rol" Ca II Present - Mayor Henry J. Crepeau, Jr., Councilmen Ward Hanson, James Wingert, Charles Crichton, Robert Woodburn. Absent - None. Also Present - Representative Steve Novak, Bond Counsel Peter Popovich, Attorney James Lynden, Treasurer Donald Lamb, Clerk Administrator Charlotte McNlesh, Police Lieutenant Douglas McCall, Deputy Clerk Dorothy Zehm. Approval of Minutes Crichton moved that the Minutes of the Regular CouncIl Meetlng'of January 31, 1977, be approved as amended. Motion was seconded by Hanson with an addendum which he read and suggested be Inserted as part of the January 31, 1977 Minutes. After discussion, Hanson withdrew the addendum and motion carried unanimously. leqlsiatlve Reoort Representative Steve Novak reported pending legislative actions re proposed budget reforms, state aid to municipalities, Ramsey County bl lis, open meeting law changes, Dutch Elm disease programs. Council expressed interest and concern re Metro Council. authority, Metro housing policy and school district proposed consolidation; Novak said he would keep Council apprised of hearings and status of proceedings. $500,000 Government Obllqatlon Refundinq Bonds of 1977 - Bid Openlnq, 8:00 p.m. Bond Counsel Peter Popovich reported that ratings have been assigned for this issue of General Obligation Refunding Bonds as follows: Moody's Investors Service - Provisional A Standard and Poor's Corporation - AA Popovich reported that seven bids have been received; anticipates savings of $74,000 to $98,000 If bids received are @ 5.25 to 4.50%. (See attached Resolution for Bid Tabulation). After discussion, Crichton moved, seconded by Hanson, that Council adopt Resolution No. 77-10, RESOLUTION AWARDING BID TO THE FIRST NATIONAL BANK OF ST. PAUL, canceling present ~evy and substituting new levy. Motion carried unanimously. REPORT OF ViLLAGE ATTORNEY JAMES LYNDEN . Proposed Zonlnq Ordinance Lynden referred Council to his letter of February 10, 1977, and attached memorandum re City Attorney's and Planner's Suggested Re- visions to Proposed Zoning Ordinance. Crichton moved, seconded by Woodburn, that Council accept definition of Offlce(s) 691, as per memo of 2/10/77. Motion carried unanimously. Wingert moved, seconded by Crichton, that Council accept minor change in definition of "Restaurant, Fast Food" as per memo of 2/10/77. Motion carried unanimously. Wingert moved, seconded by Crichton, that Attorney Insert In Design Standards (#12, p. 3-9) the wording as per Crichton's memo re I Non- Residential Uses In Residentia! Districts: correcting types of streets to correspond with ordinance definitions (p. 1-16); changing numbering .of Aesthetics to #13 (p. 3-91. MotIon carried unanimously. -1- " / . . (See Amended District Requirements Chart on page two of Minutes). Crichton moved that Councl I approve the deletion of 12 Applicability on page 4-16 of Ordinance, In Its entirety. Motion was seconded by Woodburn and carried unanimously. Mr. Ken Lukaska, 3125 Asbury Avenue, read a statement prepared by Frank Stanton, dated 2/11/77 In Its entIrety, suggesting that the proposed ordinance be amended as follows: . The definition following Item Iii (p. 1-14) Schools, General Education, should be limited to - nursery, primary, elementary and secondary schools: that the definition following Item 112, Schools, Special Education, should be amended to read as follows - Trade, business, barber, beauty, art, music, dancing, driving, and other professional schools, and colleges which are accredited by The North Central Association. Lukaske presented original of letter to M~yor, and copies to Councilmen. Lukaska presented a Petition which he said consisted of over 160 signatures, obJecting to definitions I I I & 112 in Proposed Ordinance, and requested Council to not vote In favor of the Proposed Zoning Ordinance. Hanson suggested that Clerk Administrator and Attorney be given time to up-date the proposed ordinance, as amended, for CouncIl's considera- tion on February 28th. Thomas Erickson presented two petitions to Councl I which he said contains 206 signatures of residents and voting citizens of Arden Hills, requesting that Northwestern College be allowed responsible growth at Its present location. Wingert asked If it would be worthwhile for the City to obtain an additional Attorney's decision re the ordinance Interpretation. General concurrence from all factions was that this would not solve the problem. Case No. 77-5, Lot Spilt - Herman Friesen, 3390 New BrlQhton Road Wingert reviewed the Planner's Report: advising that both lots, after the proposed spilt, will contain the required 11,000 sq. ft. minimum/ lot. Reverend Friesen presented a sketch of the proposed house, as they intend to locate It on the southerly lot: Wingert noted that Council should probably contemplate a front and rear setback variance when house plans are finalized. After discussion, Wingert moved, seconded by Hanson, that Council . approve the lot spilt as proposed In survey presented, with the under- standing that a 40' street right-of-way will be preserved for f~ture straightening of New Brighton Road: recognizing the high probability of fr~n1 ~nd re~r Retha~k variances which are not included in the ~ppraYa[ ~t this time. Sideyard Variance for Garace - Raymond Stolp. 3235 North Lexlnqton Avenue Wingert reviewed the application and the Board of Appeals and Planning Commission recommendations. Wingert moved, seconded by Hanson, that CouncIl approve the 4' slde- yard variance as requested. Motion carried unanimously. Case No. 76-24, RezonlnQ from R-2 to R-B - Rocer ReilinQ Wingert referred Council to documentation presented, and to the Planning Commission recommendations of 2/1/77. After discussion, Wingert moved, seconded by Crichton, that Council approve the rezoning of the property at 3151 Lake Johanna Boulevard as per survey presented, from R-I to R-B. Motion carried unanimously. -3- .' . . . , , Minutes of Regular Council Meeting Page four Feb ruary 14, 1977 Case No. 76-38, Building Permit for Garage - Adolph Miller, 3609 North Pascal Avenue Wingert referred COuncil to Agreement between Miller and Miles Garage Company, and to recommendations of the Planning Commission suggesting that Counci I take some remedial recourse against the builder, After discussion, Crichton moved, seconded by Hanson, that Council direct Milas Garage Company to make application for a Building Permit for the garage for whatever location is permitted by ordinance; appli- cation to be completed by March 1st. Motion carried unanimously. (copy of letter to be sent to Mr. Miller.) REPORT OF ViLLAGE TREASURER DONALD LAMB ~nvestments February 7, 1977 - S120,000 for one year 8 5.65%. Crichton moved, seconded by Hanson, that Council ratify the Investment made by the Treasurer. Motion carried unanimously. OTHER BUS i NESS Memos from Lieutenant McCall: A. Purchase of Squad Cars After discussIon of specifications and memo of 2/9/77 from McCall, Council authorized advertisement for bids for one squad car per amended specifications. O. Part-time Pollee Officers CouncTr--i:lTsc-u'ssed-quai fTCcations and duties intended for the proposed part-time temporary poi ice officers. After discussion, McCall was requested to explore Sheriff's office for pOSSible provision of Saturday and Sunday shifts; also to explore possibility of standby of regular Arden Hills officers for "backup" of part-time officer. McCall was requested to work up a "package" for Counci I's consideration at February 28th meeting. C. Equipment Purchases Wingert moved, seconded by Hanson, that Council authorize the purchase of First Aid kits and Blankets as per memo of 2/11/77; McCall was asked to obtain cost of oxygen inhaler. Public Safety Committee Recommendations Re Closing of Median on Highway 51 at Bethel Co~leQe Entrance Council was referred to the Public Safety Committee's recommendations (Minutes of Meeting of 2/7/77). Crichton moved, seconded by Wingert, that Council concurs with the Minnesota Transportation Department to close the median on Highway 51 at the entrance to .Bethel Co~ lege and Seminary. Motion carried unanl- mousDy. DOQ Ordinance - First Reading Crichton moved, seconded by Wingert, that the dog contro~ ordinance be Introduced by tit~e and tbat It be given Its first reading; Attor- ney is directed to draw an ordinance similar to the New Brighton Ordi- nance. Motion carried unanimously. REPORT OF CLERK ADMINISTRATOR CHARLOTTE MCNIESH Arden Hills Club Request to Use Facilities for Senior Graduation Crichton moved, seconded by Wingert, that Council approve the Arden HiDls Club's request to utilize its premises for a graduation, subject to decision of Attorney Lynden. Motion carried unanimously. Standby Electric Generating Unit - Bid Award Counci I was referred to memo from Johansen (2/11/77) re used stand- by electric generating unit. After discussion, Woodburn moved, seconded by Wingert, that Council award the bid to Jeffeo Power Systems in the amount of $19,595.00. Motion carried unanimousty. . Approval of Licenses McNiesh referred Council to I ist of 1977 renewal licenses. Woodburn moved, seconded by Wingert, that Council approve the licenses No. I through No. ~8, as ~Isted, and ,"9 and #20. subject to approval of Health Inspector' Ausffiell, tnd waive license fee for pop vending machine at the Village HaiO. Motion carried unanimously. Park Maintenance Employee ~ Layoff Council was referred to memo from Buckley (2/fil/77) re temporary layoff effective March B. After discussion, Crichton moved, seconded by Wingert, that Councl I authorize Buckley to continue the employment of Mark Paterson If use- ful work can be provided. Motion carried unanimous~y. (Buckley, Johansen, McNiesh to collaborate re work assignments.) Claims and Payroll Crichton moved, seconded by Wingert, that Counci I approve the Claims and Payrol! as submitted. Motion carried unanimously. Resolution No. 77-9 Wingert moved, seconded by Hanson, that Caunci I adopt Resolution No. 77-9, RECONVEYANCE OF TAX FORFE!TED LAND TO THE STATE OF MINNESOTA. MotiGn carried unanimously. Suburban Rate Authority McNiesh reported that Arden Hilts' notice of withdrawal from the Sub- urban Rate Authority was received too late, according to the SRA Joint Agreement; therefore, fee of $~50 for ~977 wi II havs to be paid. After discussion, Wingert moved, seconded by Hanson, that Village cOfumlttee meetings be held in the Village Ha~ I Council Chambers, when- ever possible, which is al'ready zoned for "smoking" and "no smoking". P!annlnQ Seminar Wingert moved, seconded by Hanson, that Council approve Gary Thorn's attendance at a planning seminar; authorized VI Hiage payment of the $20.00 fee for costs of the workshop.
