Crepeau, Jr. Ro II Call Present - Mayor Henry J. Crepeau, Jr. , Councilmen Charles Crichton, Ward Hanson, James Wingert, Robert Woodburn. Absent - None. Also Present - Attorney James Lynden, Engineer Donald Christoffersen, Treasurer Donald Lamb, Park Director John Buckley, Clerk Administrator Charlotte McNlesh. . Approval of Minutes Wingert moved, seconded by Hanson, that the Minutes of the Regular Counc I I Meeting of November B, 1976 be approved as amended. Motion carried unanImously. BUSINESS FROM THE FLOOR 0 None. REPORT OF PARK DiRECTOR JOHN BUCKLEY Conference Crichton moved, seconded by Wingert, that Council approve Buckley's attending the Minnesota Recreation and Park Association Fall Con- ference, December I, 2 and 3, as detailed In memo of 11/17/76. Motion carried unanimously. . Basketball Instructors Crichton moved, seconded by Wingert, that Counc II approve hiring instructors for Youth Jr. Mustang Program 8S listed on memo of 11/10/76. Motion carried unanimouSly. Buckley reported that rates are the same as last year; boys and girls participate In program. Winter Recreation Program -B-uck ley reviewed his memo of 11/17/76 re Recreation Program data, noting that substantial number of Arden HII Is residents participate In programs offered by neighboring municipalities. The proposed winter programs to be sponsored by Arden HIlls are s I m II ar to last year except that volleyball leagues and open gym have been added. Buckley advised that Mary Jane Olson is handling girls' gymnastic programs; fees, Instructors sal.rles, etc. wll I be her responsibility. Village will advertise gymnastic program In flyer as well as four skating and skiing programs, but will not be sponsoring these. Fees for the programs sponsored by the Village will cover direct costs, cost of maintaining Ice rinks will be financed by Village. Woodburn moved, seconded by Wingert, that Counc II approve the Winter Program as detal led In Buckley's memo of 11/17/ 76. Motion carried . unanimously. 1977 Budget Committee has approved budget changes which will reduce Park budget by about $3,920. ~unters Park Pathway Crichton reported that construction of pathway has been deferred; pathway dedication Involves .5539 acres of land. Counc I I directed McNlesh to write Homeowners Association Inviting them to enter Into discussions with the Village re their purchase of pathway land If It Is not used by the Village as a pedestrian way. Review of Proposed Zoning Ordinance In Il discussion of the changes suggested by Attorney Lynden In his memo of 11/17/76, covering first three parts of the proposed ordi- nance, Counc i I concurred that attorney's recommendations should be accepted with following exceptions: 9. Section Iii ( 13) p. 1-4, delete "moals, ortl; leave In limitation "not exceeding flvo (5) pe rson s " . II. Section ill ( 17) p . 1-4, leave definition of "bu 1 k matoria.ls" as is. . 14. On p. 1-6, Lynden to rewrite definition of easement. 16. On p. 1-7, Lynden to rewrite definition of frontage. 20. Section III (65) p . 1-8. Delete definition of "lot". 21. Section III (70) p. 1-9. Leave IlS proposed. 29. Section III (76) p. 1-9. Leave as proposed. 31. Section ill (83) p. 1-10. Leave as proposed. 32. See Item 43. 34. Section III (96) p. I-II. Change definition of PUD to . "The development of a tract of land In a unified manner, pursuant to a development plan specifically approved by the City." 35. Section iii (97) p. I-It. Delete definition of "plot". 36. Section iii ( 108) p. 1-13. Delete definition of rlghts- of-way, private. 37. Section III ( 109) P . 1-13. Delete definition of Public Right-of-way and add definitions of streets, pathways, etc. 40. Section IV R-l, p. 1-17. Delete this section on existing non-conforming uses. Lynden to re-do as part of "~on- conforming Uses and Structures" p, 4-24 and 25. Also use Lynden's recommendatlolls re definitions No. 85 and 86; delete definition No. 124 p. 1-14. In the discussion of PUD provisions It was noted that the attorney . should add a traffic factor to the Circulation Component, add grading and re-do Construction Order Component. Counc i I requested Lynden to check pages 4-15 to 4-23 and re-do as necessary. In the discussion of the Public Use District provisions, the possl- b II i ty of restricting the number of students per acre or us I ng the population component (p. 4-20) were exp I ored. I t \~as noted that difficulties could be encountered In applying standards where a public use facility Is located In two c:ltles. In the review of Tables 2-3 and 2-4, questions were raised relative to zoning for public use and whether these should be "permitted" or require special use permits. The possibility of establishing special pro- cedures for public use developments was discussed; COUIlC I t generally concurred that the Village should minimize number of procedures and use PUD procedures; this would require adding page 4-16, II st I ng uses In P-I District. Crichton moved, seconded by Woodburn, that the Public Hearing on the Proposed Zoning Ordinance be held on Oecember 20, 1976, at Mounds View High School et 8:00 p.m. Motion carried unanimously. In further discussion, Attorney Lynden determined that In addition to the pub- lIshed notice of Public Hearing, notices should be sent to all property owners. Crichton moved, seconded by Wingert, that the motion be re- considered. Motion carried unanimously. Crichton moved, seconded by Hanson, that the prevlcus motion be resclnd- . ed and the Public Hearing be held Monday, January 10, 1977, at 8:00 p.m. at the Mounds View High School theater. Motion carried unanimously. REPORT OF VILLAGE ENGI NEER DONALD CHRI STOFFERSEN County Road F and Hemline Avenue Improvements County Road F construction Is completed, except for f i net wearing course and slopeclearlng. Completion of project wll I be In spring 1917. Due to weather conditions, Hamllne Avenue Improvement cannot be com- pleted until spring 1977. Crichton noted that entrance to Pemtom has sma II apron, suggesting that apron to the south be widened when Hemline Avenue Improvement Is done. Woodburn moved, seconded by Hanson, that Council approve Change Order No. I , extending time for completion to June 1977 . Motion carried unanimously. . Karth Lake Feasibility Study Chr I stoffersen reported that he had contacted property owner north of the Amble property, who advised property Is for sale. Ma rce I Elbenstelner advised Council that he and Keith Harstad control the Christensen property and are negotiating to acquire abutting tracts. Their plan Is to subdivide the area Into single-fam! Iy home sites; would like to have Village I nsta II sewe r, water, streets and storm drainage; engineer's layout of facilities fits we I I with their tenta- tive subdivision plans. Christoffersen said the pr.oject couldba ,ready for spring construction If developers were ready by February with Pre- liminary Plat for proposed subdivision. Council directed engineer to check with Charles Amble re t I m I n g 0 f proposed utility construction. Elbenstelner stated he would get started on Preliminary Plat procedure and would write Council re- questing that the Village I nsta II uti Iltles and streets for proposed plat. OTHER BUSnNESS Case No. 76-40, lot Spilt and Variance - Irving Rein Wingert noted that the requested variance In lot width from 85 ft. to 75 ft. was consistent with abutting property. Wingert moved, seconded by Woodburn, that Counc II app rove the lot . spilt and variance as recommended by the Planning Commission on 11/3/76. Motion carried unanimously. Sky II ne Bu I I ders William Dolan, architect tor Skyline Builders, reported that the developer now plans to submit a proposal to the Planning Commis- sion on December 7th for single family housing, since there was considerable objection to the townhouse proposal submitted to the Planning Commission In October. Dolan requested Councl I to extend time for removal of fill to spring pending Planning Commission recom- mending approval ot single fem II y proposed development on December 7th. Mr. Dolan said that had he been aware of the importance of the Decem- ber 1st deadline tor remove I of temporary fill , he might have been able to submit single family development proposal to the Planning Commission In November. Iy remove and sell the f I II . Counc i I also noted that the fill temporarily stockpi led on the site was not all class 5 material and sand as specified In the permission for temporary stockpiling. City hopes to see good development in this area; tem- porary stockpl ling of the fill is a separate problem. Counc II took no action to extend time; fill is to be removed by December I , 1976. REPORT OF VILLAGE TREASURER DONALD LAMB Certificate of Deposit which matured 11/16/76 was loe I nvested as follows: $250,000 in Certificate of Deposit, I year,@ 5.65% . 96,996 In Savings Account. Woodburn moved, seconded by Crichton, that Counc II ratify Invest- ments. Motion carried unanimoUSly. Lamb discussed possible refinancing of General Improvement Bond Series I with Bond Counsel Popovich. Interest savings between now and 1988 would be about $46,000. Popovich will check further to determine net savings. Lamb checked with several banks re Interest rates, shou I d V III age ever have need for a short term loan. First National of St. Paul said that Interest rate could be based on one of the Certificate of Deposits which we have at their bank, rate would be 2% over CD rate. Treasurer will check on additional possibilities. . REPORT OF CLERK ADMINISTRATOR CHARLOTTE MCNIESH Change In Precinct Boundaries McNlesh reviewed memo of 11/16/76 showing 1970 and maximum popula- tions for eight areas and various combinations of areas to estab- lish new precinct boundaries. Council reviewed areas which might experience growth In the next five years since no precinct boun- daries may be changed from January I, 1977 to January I, 1982, ex- cept by annexation. Woodburn moved, seconded by Wingert, that Council adopt Resolution No. 76-61, establishing precinct boundaries as follows: Precinct I - South of Soo Line Railroad and east of Snelling Avenue. Precinct 2 - South of 500 Ll ne Railroad and west of Snelling Avenue. Precinct 3 - North of Soo Line Railroad and south of 1-694. Precinct 4 - South of Highway 96 and north of 1-694. Precinct 5 - North of Highway 96. Motion carried (Crepeau, Hanson, WingerT, Woodburn I n favor; Crichton opposed). Note: CrichTon felt area north of Highway 96 shou!d remain 13 Instead of renumbering to 15. . Teamsters Public and Law Enforcement Employees Union, Local 320 Counc II concurred that Crepeau should serve as VI I iage negotiator for Loca t 320. REPORTS ON HEAR'Nns ANn MEETING" Modest Cost Private Housing Advisory Committee Woodburn aTtended recent Public Hearing, briefly roviewed report and said If Village wants to file written response It must be done by December 1st. Counc II deferred action re response to November 29th meeting. Planning Workshop Wingert attended meeting In Rosevllle re new requ I rements, procedures and funding for Comprehensive Plan up-dating. Counc I I reviewed the chart outlining the local planning process under the Metropolitan Land Planning Act. Some citIzens complained that there had not been sufficient Input from area residents to the County study committee; chairman of the comm I ttee may. meet with REAL at a later date. Representative of Highway Department said increase Intra If I c on Lexington wi II be due mostly to develop- ment of open areas In the municipalities. Street lightIng Council reviewed street lighting study and proposa;s of 1961!-70. Request for a light at Ski les Lane and Snel ling Avenue was referred to the Public Safety Committee for recommendations. Adjournment .
