Approval of Minutes Wingert moved, seconded by Woodburn, that Council approve Minutes . of Councl I Meetings of October 4, 1976 and October 12, 1976 as amended, and of Council Meeting of October 18, 1976 as submitted. Par-Z Contracting Inc. - Application for Payment No. 4 and Final, Revisions to lift Station No. 8. Woodburn referred Councl I to letter from Christoffersen ( 10-15-76) and moved that Council accept the lift Station No.8 project and approve Payment No.4 and Final in the amount of $6,433.70. The motion was seconded by Wingert and carried unanimously. Pemtom Request for Reduction In letters of CredIt for Townhouse Villages North, 1st, 2nd and 3rd Additions. Counc I i reviewed Christoffersen's letters of 10-20-76 re Pemtom North 1st, 2nd and 3rd Additions, and attached letters from Pemtom ( 10-14-76) requesting reductions 1 n letters of Credit. After discussion, Wingert moved, seconded by Woodburn, that Council approve the reductions In letters of Credit 17018 to $8,785, 11218 to $4,883 and 11402 to $10,746, as recommended by the Engineer. Motion carried unanimOUSly. Resolution re Classification and Sale of Three Pdrcels of Tax Forfeited lands. Wingert moved, seconded by Woodburn, that Councl I approve Resol u- tlon No. 76-56, Approving the Classification and Sale of Three Parcels of Tax Forfeited land, re lands declared as non-conserva- tion'lands. Motion carried unanimously. . (Wingert noted a possible discrepancy in the lagal description of parce I 25-02800-060-81, which he requested be verified by the County. ) Re ort on Suburban Rate Authorlt Meetln Wingert referred ounc i I to his Report on the Quarterly Meeting of the Suburban Rate Authority, October 20, 1976. In discussion, Wingert said he feels It Is an advantage to Arden Hills to contribute Its share to SRA ($150 based on two votes @ $75/votel. Counc j I deferred action re Arden Hills participation to a later meeting. Case No. 76-33, Buzzell Builders - Subdivision McNlesh reported that she has been unable to contact Mr. Buzzell re requested written notification from him as to his decision to pursue or withdraw his application for subdivision. -1- . . , .~ . ,. ,";';:. REPORT OF VILLAGE TREASURER DONALD LAMB Lamb discussed short-term loan feasibility for periOds of up to 30 days, If deemed advisable in order to protect Investments In C.D.s until maturity. Counc II requested Lamb to report costs of loans of this nature; also suggested that consideration be given to bond re-flnancing for report to Council. . REPORT OF CLERK ADMINiSTRATOR CHARLOTTE MCNIESH Request for Reduction In Diseased Tree Removal Bill - Bruzek 1284 Nursery Hill Lane McNiesh reported that trees marked and Identified to be on Chris- tensen property and authorized for removal by the City by the property owner, were found to actually be on the Bruzek property. Bruzek, therefore, was not given the opportunity to remove the trees himself (has equipment to do this). Bruzek has asked that bill be reduced from $390 to $350. Woodburn moved, seconded by Wingert, that Counci I authorize the reduction of the Bruzek bill for tree removal from $399 to $350 as requested. MotIon carried unanimously. (McNiesh was requested to thank Mr. Bruzek for his cooperation In this matter.) Acceptance of Landscaping - Steak Inn Wingert reported that Landscape Inspector Schutta has re-Inspected the landscaping at the Steak Inn, reporting that al I plantings, noted In his July report, have been replaced and recommends . acceptance thereof. Wingert moved, seconded by Woodburn, that Council accept the landscaping at Steak Inn, as planted and recommended for approval by the Landscape Inspector. Motion carried unanimously. November Councl I Meetings Wingert moved, seconded by Woodburn, that November Council Meetings 00 scheduled as follows at the Village Hall: Special Council Meeting - November 4, 1976 - 5:30 p.m. Regular Councl I Meeting - November 8, 1976 - 7:30 p.m. Special Council Meeting - November 15, 1976 - 7:30 p.m. Regu 1 ar Counc II Meeting - November 29, 1976 - 7:30 p.m. Motion carried unanImously. Special Council Meetin~. October 27, 1976. at Shorevlew VII~ Hall -7:30p.m. Joint Powers Agreement - After discussion re proposed Joint Powers Agreement, TO establish a Joint Fire Protection Board, Wingert moved, seconded by Woodburn, that Counc II approve . the Joint Powers Agreement, as amended by North Oaks, and authorize Its execution by the Mayor and Clerk Administrator. Motion carried unanimously. McNlesh was requested to advise Shorevlew that the Arden HI lis Council will have a representative at the meeting In Shorevrew on October 27th to take part In the negotiations. , Pavrol I seconded by Wingert, that Council app rove the Woodburn moved, October Payroll as presented. .Motlon carried unanimously. Motlcn carrIed unanimously. Letter from Secretary of the Treasury McNlesh referred Councl I to letter of October, 1976, from'Jeanna D. Tu Ily, D I rector, Off I ce of Revenue Sharing re AntirecessIon FIscal AssIstance. After dIscussion, Counc I I authorized execution by the Mayor of the statement assuring compliance by Arden HIlls with all provIsions of the AntIrecession Fiscal Assistance law. . Prollress Report - E. Gray Henderson McNlesh reported that Henderson, In memo of 10-17-76, feels he can establish that rainfall does cause an Increase In flow at meter 154 and suspects this Is also true of 151: cannot develop facts because of "down-time" of 151, but wi" be able to conduct a better study with next spring's records. Henderson expects to prepare Water comp I I a t I on for 3rd quarter on Tuesday (Oct. 26th) and to submit the work-up for meter 154 for Council's consideration. Hunters Park and Pro osed Harriet Avenue Extension cN esh reported at I" . rown, Drey us nterstate Corp., wants to get started on the plans for the apartment buildings In Hunters Park, and has requested status of Harriet Avenue and Its effect on the apartment development. Counc II reviewed former Counc i I action re Harriet Avenue and the Hunters Park Special Use Permit (Case No. 73-28) . After discussion, Counc II requested that Engineer advIse Council what Is Involved re acquisItIon of easements for road, and to discuss status of HarrIet Avenue at Councl I meeting on November 8, 1976. Ha/loween Crepeau reported that a request was received this evening from Ilene Parker that Council change Halloween in Arden HilI s from Sunday, Oct. 31st, to Saturday, October 30th, because of conflIct with relIgious convIctions and dIffIculty for young chi Idren to be out on Sunday evenIng, with school the next day; requests notices be placed In New Brighton Bulletin and Suburban Sun advising of change of day for the celebration of Halloween this year. After discussion, Counc I I determined that it Is too late to get notices to newspapers; changing the date now would cause confusIon. McNiesh was requested to advise Mrs. Parker of Counci I's concern, and to advise her that Council Is sorry but feels It is too late to change the date of Halloween this year. Zoning Ordinance Review WIngert referred CouncIl to proposal to create a Public Use District, Zone P-I (10-25~76) which J s Intended to provide a means of regulating development or expansion of Instltutlon,'!1 or major public use facll i- . ties. After dIscussion, Counc I I amended the Public Use District proposal, as attached, and made the following changes In the Proposed Zoning Ordinance: page 2-3, Land Use chart e) Add a P-I column, inserting an "S" for the following: Accessory Uses other than normal Clubs and Lodges Houses of Worship InstitutIonal Housing Medical Clinics Pub Ii c Uses (added) and Government Buildings (definition to be revised) Research, Animals Schools, Gene ra I Education Schools, Special Educat i on -3- . . Council referred the Proposed Zoning Ordinance to Attorney Lynden for his review, and to Include the new Zoning District P-I; re-deflne Pub- lic Uses (p. I-II ) to Include uses as II sted In proposal for P-I; maximum density suggested for P-I to be about 15 persons per net acre.
