MiNUTES OF REGULAR COUNCIL MEET1NG Village of Arden Hills Tuesday, October 12, 1976 - 7:30 p.m. Vi j lage Hall Ca II to Order Pursuant to due call and notice thereof, Mayor Crepeau called the meeting to order at 7:30 p.m. Roll Ca II Present - Mayor Henry J. Crepeau, Jr. , Counc II men James Wingert, Charles Crichton, Robert Woodburn. Absent - None. Also Present - Treasurer Donald Lamb, Engineer Donald Christoffersen, Clerk Administrator Charlotte McNiesh, Deputy Clerk Dorothy Zehm. . Approval of Minutes Wingert moved, seconded by Woodburn, that the Minutes of the Regular Counc II Meeting of September 27, 1976, be approved as amended. Motion carried unanimously. Wingert moved, seconded by Crepeau, that the Minutes of the Special Counc II Meeting of September 28, 1976, be approved as presented. Motion carried unanimously. BUSINESS FROM THE FLOOR Lexington Avenue Recommendations, Ramsey County Environmental and En Ineerln Committee - Commlssicner Donald Salverda Commissioner Salverda District 2 Chairman of the Environmental and Engineering Committee (a 21 member advisory Committee) Introduced . County Engineer Deane Anklan and Transportation Subcommittee Chairman Mike Martllla< Martllla reported the following subcommittee actions: I. Reviewed transportation polley of .Board of Commissioners. 2. Met with concerned citizens from Rosevllle. 3. Met with Rosevl I Ie citizens and Engineer Deane Anklan. 4. Presented alternatives from the County staff. 5. Presented proposal to business men along Lexington Avenue, possibly affected by the. improvement. 6. Met wiTh Shorevlew, Arden Hills and Rosevlilo citizens. 7. Prepa red conclusions and recommendations. 8. Reported findings to the Committee. Anklan noted alternatives to be determined: I. Do nothing. 2. Rebuild road at Its present design. 3. Build 4-lane divided road. 4. Build 4-lane, not divided. 5. Bu! ld a 4-lane combination of divided and not divided. Anklan described the proposed road Improvement, as recommended by the Committee as follows: I. County Road 0 to 500' north of Harriet Avenue - 4 lanes, undivided. 2. From 500' north of Harriet to about Victoria - 4 lanes with left-turn lanes (protected and unprotected) . . 3. Victoria to Highway 96 - 4 lanes, undivided. Marti Ila described Lexington as a major col lector or arterial street (a long distance mover), serving at least 8000 vehicles/day (more than th Is In southern portion). Martilla said the sub-committee was comprised of I Sf. Pau I, I Shore- view, I Rosevllle and 2 White Bear residents. Wingert asked I f Resolutions submitted by Shorevlew and Arden Hili s had been considered by the Committee. Martllla said they are Included In the Committee's report. Slides were shown depicting the road as It now exists, with orange cones placed along the right-of-way to Indicate the delineation of the 4-lane roadway proposed by the Committee. -1- ---- ---- , . Crichton noted that the proposed roadway veers to the we s t , . north of Victoria, cutting Into a portion of Cummings Park property; area would require tremendous amount of fill; suggested plan for roadway be re-aligned to fol low existing roadway. Ma rt I I I a said that Lexington Is a major co! lector street, the 32' width recommended by Shoreview and Arden Hills Is not sufficient in the Com- mittee's estimation. People will continue to use the street, whether . It Is Improved or not; more hazardous as It Is - not adequate shoulders. He suggested that a 4-lane road, not striped, would be acceptable, per- haps; drivers usually use this type of roadway as a single lane each way, except during rush hour traffic. Wingert acknowledged that there is some urgency to decide, but sugges- ted that a roadway bul It to dlfferent~andards than presented would sti II qualify for turn -back funds. In discussion of speed, it was noted that proposed road Improvement is designed for 40 mph traffic. Anklan explained that unwarranted traff i c controls generally Increase traffic problems - County does not establish speed limBs; speed limits are based on what G5) of dr Ivers drive (international situation); signs establish controls for policing area, but do not control the speed. It was noted by Anklan that the County has experienced that roads (eg. Falrvlew, north from County Road BJ, widened to 4 lanes as pro- posed for Lexington, has actually reduced speeds since the i mprove- ment. Salverda said that the area from County Road 0 to E Is the crucial section; beyond thaT Is different funding. Anklan sa I d they will proceed with plan for the south of 0 (In Rosevll ieJ, regard less of the decision north of County Road D. Rosevllle has given conceptual , approval and authorized preparation of plans and specifications which will lead to a publiC hearing. Anklan said the County must have con- cept approval before preparing plans and specifications for section through Arden Hllls/Shorevlew. Anklan said the County wants everyone to be aware; If Improve- men~ Is not desired, It won't be done. it wi 11 have to be done later with local funding, I f turn-back money Is not utilized. Wingert said he I s leery about approving expenditure for plans and specs, knowing there is a high resistance to the Improvement proposal; primarily opposed. Anklan noted that mass transit also requires on-street space for pu II - off for buses; narrower road cannot provide for this. . C.r.i ch ton moved, seconded by Crepeau, that Counc II give concept approval of plans from Harriet to Highway 96, provided that the County give con- sideration to cliff on west side of Lexington at Victoria; suggest County re-examine Shorevlew and Arden Hills resolutions re The area between County Road 0 to Harriet before proceeding with plans and speci- fications. REPORT OF ViLLAGE ENGINEER DONALD CHRISTOFFERSEN Bids - Little Crow Addition improvement Chrl stoffersen referred Council to the three bids received, a I! of which exceed his bid eSTimate; suggested that property owners be con- tacted to see If they des I re Counc i I to proceed, pending Christoffer- sen's check of the bid Items and written report at next meeting. Woodburn moved, seconded by Wingert, that City Accept the street In Pemtom Townhouse Villages North, First Addition. Motion carried unan I mous I y. (Christoffersen noted that warranty begins on date of City acceptance of the street). County Road f Emprovement . Arden HI I Is/Shoravlew Agreement re County Road F Storm Piping Chr I stoffersen referred Counc II to proposed Agreement, and attached Drainage Boundary Map (Exhibit B), between Shorev I ew and Arden H I II s re storm drain Improvement (County Road F Improvement a portIon of Improvement P-SS-W-ST 75-1, S.A.D. 187 -I 0 I -0 I ) . Christoffersen noted that ~ttached map conforms with the Rice Creek Watershed Map, Indicating that approximately 65 acres wi II drain from Shorevlew Into Arden Hills (45 acres, north of County Road F # ~o ac res south of County Road F); 36 n pipe proposed will carry Shorevlew flow and drain the intersection. Crichton displayed a map of water areas, preparej by Rice Creek Watershed about two years ago. Ch r I stoffersen s~id that Shorevlew has not changed the direction of drainage i n rec~nt years and wll I not a II ow additional run-off to occur beyond acr~age shown on the map; Shorevlew wants assurance they can use the pipe I f they pay for the I r share. Christoffersen noted the following alternatives, as he sees It: I. Bull d storm sewer for Arden Hills only. 2. Build storm sewer for Arden Hills and Shoreview. 3. Don't build storm sewer at all. 4. Build larger storm sewer now and pursue drainage agreement with Shorevlew. In discussion, It was noted that approval from property owners should be obtained In order to Increase flow over property not owned by City. It was noted that whether culvert runs under F 01" under Lexington, length of easement across Reiling property is about the same. Christoffersen recommended that some type of dra n be Installed at the County Road F ILex I ngi"on Intersection; Shoraview has agreed to the C.A. financing method; should know this week what size pipe to Install. Chr I stoffersell said that Inspection by Banister Is virtually Impossible for about two weeks; suggested that a good contractor will know what has to be done to pass the specs re- quirements (they have a copy of the specs.l; Banister would prefer to only Inspect for Arden Hi I Is, after work has been completed (not inspect our own Inspections). Counc II concurred that Banister should not perform Inspections during the corrective work at Arden Manor. . Wingert referred Council to Minutes of the Planning Commission Meet- ing ('0-5-76) and to plans submifitid for car wash addition to the east end of the Standard 01 I Service Station, 1306 West CounTY Road E. Wingert noted that the Planning Commission determined that the one-bay cold water car wash proposed, is an accessory use, In its opinion, to the service station primary use of the property; recommends Council approva I of the BuildIng Permit. Wingert moved, seconded by Crichton, that Counc II authorize the Issuance of a Building Permit for the car wash adcltlon as per plans submitted with Case No. 76 -36. Motion carried unenlmously. (It was noted that Ordinance No. 132 (Service Station Ordinance) con- flicts with Ord. 99 (Zoning Ordinance); 132 does not permit vehicle wash and 99 does permit it as an accessory use.) Case No. 76-33, Buzzell Builders - Subdivision Wingert reported great opposition at the Public Hearing held by the Planning Commission ( 10-5-76) to the proposed development of the a rea (Tiller Lane, Hamllns Avenue and Ingerson Road); considers this to be swamp land and If filled, even partIally, they felt would cause water back-up Into basements of surrounding homes on I ngerson Road and Dunlap Avenue. ... ~. Wingert referred Councl I to the SubdIvision plans, as presented, pro- posing six (6) building lots (4 on Ti II er Lane and two (2) on Ham II ne Avenue) ; lots on Ingerson Road are already plattec lots and not part of the subdivision request. Wingert reported that he understands Buzzell Builders have withdrawn their purchase contract, since the Public HearIng; do not Intend to. pursue the subdivision proposed; consequently, no Counc I I action is required at this time. Wingert noted several req u I remen ts In the Subdivision Ordinance (No" 98l regarding subdivisions Involving water courses, areas which are subject to periodic flooding, contain extremely poor drainage facilities etc. It ~as also noted that the Building Code requires that houses be bul It on a so II d foundation; If soi I can't support a hou se, It Is Impossible . to b u I I d on the site. ~ n discussion, It was suggested by Wingert that Council seek a solution re swamp areas, recognize them as wet lands and storage areas for local drainage; suggested that Council determIne what can be permitted In these low areas, and possibly the CI~y acquire these areas. Woodburn suggested that Engineer advise whether a holding pond could be created In this area, also creating a buildable area on the tract; ask Rice Creek Watershed to look at It also to see what It recommends for pond and for building: is pondlng feasible7 ~ s building feasible? I s filii ng feasible? etc. McNlesh was requested to ask Buzzel I to notify City, In wrltl ng, of his determination to withdraw or pursue the subdivision. Counc II deferred action pending receipt of Buzze Il'S decision to pursue or wIthdraw his application for Subdivision. -4- , Minutes of Regular Council Meeting October 12, 1976 Page five Case No. 76-34, Leslie Nordin - Variance for Location of Garage Prior to Construction of Resl~ence on Floral Drive Wingert referred Councl I to sketch of II-acre tract on which Nordin requests to locate a storage garage. Wingert reviewed the Board of Appeals (9-19-76) and Planner (10-1-76) reports and Planning Commission Minutes of 10-5-76, and moved, seconded by Woodburn, that Council approve the variance to locate the garage on the property, as shown on the sketch submitted, prior to construction of the house, provided that al I vehiCles (mobile home, corn planter etc.) be stored In the garage, eliminating outdoor storage on the site, and that the garage not be used as living quarters; variance approvai not to exceed twelve (12) months and is subject to review at the end of that period. Motion . carried unanimously. Case No. 76-35, Minneapolis Hide and Tallow - Building Permit Wingert reported that he and three Planning Commission members visited the Mlnneapo! is Hide and Tallow site on Saturday, October 8th to see the existing operation and locations of the proposed additions whiCh. are proposed to improve air and water quality. Wingert described the proposed construction and referred Councl I to plans submitted, reporting that the Planning Commission considers that the construction proposed Is not expanding the business, but to Improve air and water quality (non-conforming In L-l zone.) Council was referred to letter of 10-12-76 from Tlbor Kosas, Division of Air Quality, and to letter of 10-8-76 from Donald R. Madore, Metro- politan Waste Control Commission, and to Planning Commission's recommen- dation (Minutes of 10-5-76). After discussion, Wingert noted that the on-sight visit by the Planning Commission was satisfactory, and moved, seconded by Crichton, that Coun- cil approve issuance of the Building Permit pursuant to plans dated 10-5-76, with condition that construction plans be signed by registered engineer. Motion carried unanimously. In further discussion, Crichton asked what complications there might be If lots on which Minneapolis Hide and Tallow buildings are located were consolidated Into a single parcel; noted that buildings cover- several platted lots, overlapping lot lines etc. Council expressed concern when and If a portion of the property were sold, possibly with a building on it, causing a non-conforming situation re set-back from property lines. Wingert felt that only a minor purpose would be served by a consolidation at this time; City would always have control as to building occupancy and lot spilt at time of sale. OTHER BUS iNESS Case No. 76-37, Blue Fox Inn - Replacement Sign Wingert reported that the Blue Fox Inn has requested approval of a temporary slgn,d~rlng period of construction and approval of a 23' high replacement sign. Wingert advised that former sign, on the canopy pylo~ was 22' In height; new proposed sign Is 23' high (Internally lighted), to be located 25' ... from LexIngton property line and 20' from Grey Fox Road property line. After discussion, Wingert moved, seconded by Woodburn, that Council approve a height variance of 6' (sign to be 22' In height) as shown on the site plan; curb to be wrapped around base of standard; Including sign In the landscaped area. Motion carried (Wingert, Woodburn, Crepeau votIng In favor of fhe motion; Crichton VOTing in oppOSiTion'. Wingert movad, seconded by Woodburn, that Council ~pprove business Identification temporary sign until November 15, 1976. Motion carried unanimously. REPORT OF CLERK ADM IN I STRATOR CHARLOTTE MCN i ESH Temporary Signs - St. Paul Book and Stationery McNlesh referred two temporary sign applications from St. Paul Book and Stationery to Council for approval; St. Paul Book Intends to use one. of them during Its sale (Oct. 21 through Oct. 25). Claims and Payrolls Crichton moved, seconded by Wingert, th at Counc I I approve Claims and Payrolls as presented. Motion carried unanimously. Fa'l Program ! nstructors . MCNlesh referred Council to memo from Buckley, requesting approval of Instructors for the Fa II programs. Crichton moved, seconded by Wingert, that Counc II approve the Instruc- tors II S3.50/hr. as listed. Motion carried unanimously. I Suburban Rate Authoritf Meeting Rate Authority meeting on October McNlesh reminded Counc I of Suburban 20th. Wingert said he expects to attend; will report on meeting at next Counc.11 meeting. Precinct Boundaries Crichton suggested changed Precinct boundaries for Councl I IS considera- tion as follows: Prec I net 2 - to remain as It Is - Soui-h of 500 Line RR and west of Snelling. Prec I nct I - North of 1-694 to Highway 96. Precinct 3 - North of Highway 96. Precinct 4 - South of U -694 to North of Soo Line RR. Precinct 5 - South of Soo Ll ne RR and (last of Sne I it ng. Special Counc I I Meeting Wingert moved that Council schedule a S~ecial Count: I I Meeting on Mon- day, October 18, 1976, at 7:30 p.m. to review Codification of Ordinances and Proposed Zoning Ordinance. Motion ~as seconded by Crichton and carried unanimously. Motion carried uncnimously.
