MINUTES OF REGULAR COUNCIL MEETING Village of Arden Hills Monday, September 27, 1976 - 7:30 p.m. Village Hall CALL TO OROER Pursuant to due call and notice thereof, Mayor Crepeau called the meeting to order at 7:35 p.m. ROLL CALL Present - Mayor Henry J. Crepeau, Jr., Councilmen Robert Woodburn, James Wingert. Absent - CouncIlman Charles Crichton. Also Present - Village Treasurer Donald Lamb, Public Works Super- visor Hans Johansen, Clerk Administrator Charlotte McNlesh, Deputy Clerk Dorothy Zehm. APPROVAL OF MINUTES Wingert moved, seconded by Woodburn, that Council approve the Minutes of the Special Councl I Meeting of September 8, 1976, and the Regular Council Meetinp of September 13, 1976,. as submitted. Motion carried unanimously. BUSINESS FROM THE FLQQR None. REPORT OF VILLAGE PUBLIC WORKS SUPERVISOR HANS JOHANSEN Johansen referred Council to hIs memo of 9/23/76 re the following: Manpower for Snow PlowlnQ Woodburn moved, seconded by WIngert, that Councl I euthorlze the hiring of Mark Peterson at $4.50/hr. and Steve Zehm, at current pay rate, for Public Works specIal services as outllned In memo of 9/23/76. MotIon carried unanimously. Woodburn moved, seconded by Wingert, that Council approve the hIring of Mark Peterson by the Parks Department at $3.50/hr. untIl December 31, 1976, as ,er memo from Buckley (9/24/76). MotIon carried unanImously. Standby Power for LIft Stations Johansen reported that the Public Works Committee recommends the purchase of a mobile standby generator for 11ft station operation. After discussIon, Wingert moved, seconded by Woodburn, that Council authorize preparation of specifications for diesel type unit; Engineer to review specs and advertise tor bIds. Motion carried unanimously. Landscape Presentation for Booster, Tower and Lift Stations 10 & 8 Johansen showed sketches of proposed landscaplnp for the water booster station, water tower and sewer 11ft stat)ons 8 8. 10, which were prepared and recommended by the Parks Committee, and are recommended for Council approval by the Public Works Committee. After discussion, CouncIl concurred with the recommend~ng plans for lift stations 8 & 10 and the water tower and booster station properties, as shown on the sketches presented. PLANNING COMMISSiON RECOMMENDATIONS Case No. 76-32, Sldeyard Variance for Gara!:!e - DavId Gehrke, 1854 Glenpaul Ave. WIngert referred Council to the applIcation for a 5' sideyard variance (1854 Glenpaul Avenue) to construct a 24' X 24' garage in the rear yard; exIsting attached I-car garage to be removed; new garage wi1 I utilize exIsting driveway extended. Wingert explained that the house Is to be remodeled, and with the removal of the ex1stlng garage, house side setback wi II then conform to ordInance requ I rements. -1- I September 27. 1976 Minutes of Regular Counci i Meeting Page two Wingert reported that Board of Appeals (9/20/76) and Planning Commission (Minutes of 9/7/76) recommend Co~ncl I arprovai of the 5' sldeyard setback for the proposed garage as requeste~ and moved that Councl I concur with their recommendations. Motion was seconded . by Woodburn and carried unanimously. . . . . . . Case No. 76-28, Alex Chvestulk - Lot Consolidation Wingert referred Councl I to application and attached sketch of lots 42 and 43. Rohleders Home and Garden Acres, showing a power lIne easement which diagonally crosses both lots. Wingert explained that the application was made subsequent to CouncIl's suggestion that the lots be combined to form one buildable lot. After discussion, Wingert moved. seconded by Woodburn, that Councl I approve the lot consolidation, combining lots 42 and 43, Rohleders Home' and Garden Acres Into one resIdential building lot. Motion carried unanimously. Case No. 76-31, Donald Palme - Special Use Permit for Two Duplexes Wingert referred Councl I to application and documentation submitted for building permits for two duplexes on County Road E. Wingert reported that a petition, containing about 22 sIgnatures, was submitted to the Planning Commission at the Public Hearing, opposing the duplexes. He also reported that the Parks Committee advised that one of the lots Is Included In the Parks Committee's original park recommendation to CouncIl for the proposed neIghborhood park north of County Road E. Wingert referred Council to the Planning Commission Minutes of September 7, 1976, recommonding Council denial of the Special Use Permit for Two Duplexes for the fol lowing reasons: l. Lot 4 Is. designated In the Comprehensive Plan as an Important part of the helghborhood park In the orderly development of this area of the Vi I lage. 2. The proposed duplex land use Is not compatible with the existing low density In this area. 3. Neighbors have voiced strenuous opposition to the duplex development. 4. Proposed construction would require extensive fll ling and would thereby create additional drainage problems for t his a re a. Wingert commented that the 'spottln!1' of duplexes In this area is a change - al I other homes are single family detached. Duplexes, he said, tend to be rental properties (at least one of the units); therefore, there may be a tendency to not ke~p property In as good repair as a totally home-owned property. Wingert noted tnat the park situation Is not resolved at this time; so, He park consider- ation should probably not be an Issue at this time. The possible drainage problem noted by the Planning Commission could probably be resolveo by the Engineer. After discussion, Woodburn moved, seconded by Crepeau, that the Special Use Permit be denied because duplexes would be Incompatible with the neighborhood which Is comprised of single-family houses. Attorney James Nielson, representing Donald Palma, reviewed the Zoning Ordinance provisions whiCh permits duplexes in residential zones with a Special Use Permit. He noted that th~ lot sizes are almost twlcethe size required by ordinance and are close to (within 200') a heavily travelled highway (Highway 51) with traHlc noises which are not conducive to construction of single-faml Iv r'esldenC8S; only fll I proposed on the lots Is to the front, rear of lots will not be fl lied because of walk-out design of the proposed duplexes. Nielson said the park questIon should not be an Issue unless the property is obtained by the City; City already has an access to the proposed park via Wesley (when constructed) and Pascal Aves. -2- / . . Resolutions Resolution No. 76-48 Wingert moved, seconded by Woodburn, that Council approve Resolution No. 76-48, RESOLUTION CERTIFYING DELINQUENT UTILITY ACCOUNTS TO RAMSEY COUNTY FOR COLLECTION WITH TAXES, as submitted. Motion carried unanimously. B. School Bus Stop at Pemtom Townhouse Villages Council discussed letter re bus stop situation at Pemtom Townhouse Villages, dated 9/27/76, requesting that chi Idren be picked up with- In the confines of Pemtom instead of on Hamllne Av~nue. After discussion, Council concurred that the north temporary cul-de- sac on Arden View Drive would provide adequate turn area for school bus; cul-de-sac was designed for fire tanker to turn; cars are not parked In this area; road will eventually continue west. Council did not suggest this as a piCk-Up point - a turn area only. City would cooperate to see that area Is adequatMy plowed. Zoninq Ordinance Wingert suggested thet Councl I consider the addition of a "Public Use Zone" In the proposed Zoning Ordinance, to cover colleges, bus barns, schools, Village buildings etc. and applying regulations for th I s zone. Woodburn noted the fol lowing apparent omissions in the new ordlnence, wlllch ere covered In the existing Zoning Ordinance:, I. Minimum floor area for a resIdence. (Check to see If reason for this is that It Is regulated by the U.B.C.l. 2. Required number of parking soaces for Industrlel and commercial sites. (no number requirements ere Included). 3. Height restriction of 35' In residential zone seems excessive. 4. "Commercially licensed" (page 3-10, vehlc!e parking d.) Refer to Attorney Lynden to comment ,re whnt vehicles require a commercial license; apparently Home yehlcles used as trucks do not require a commercia, license, and some station wagons etc. are commllrclally llcer.sod. 5 p. 4-26, A.
