ROLL CALL Present - Mayor Henry J. Crepeau, Jr., Counci lmen Robert Woodburn, Charles Crichton, James ~lingert, WillIam Feyereisen. Absent - Noneo Also Present - Treasurer Donald Lamb, Engineer Donald Christoffersen, Police Chief Pat Sexton, Clerk Administrator Charlotte McNiesh, Deputy Clerk Dorothy Zehmo APPROVAL OF MINUTES Wingert moved, seconded by Feyereisen, that Counci I approve the Minutes of the Special Council Meeting of June 2!, 1976, as amended. Motion carrIed unanlmouslyo New Briqhton Bulletin Reporter Mayor Crepeau welcomed Linda Votel who recently joined the New Brighton Bulletin as a reporter. REPORT OF VILLAGE POLICE CHIEF PAT SEXTON Arden Hi lis Police Reserve Unit - Rules and Requlations In review of the proposed Rules and Regulations the fol lowing concerns were noted: I. No apparent difference between "sworn officer" and "reserve officer" duties. 2. Reserve officer apparently has less training, but is subject to same rules as sworn officer. 3. Only difference between the two, apparently, is that reserve officer takes directions from sworn officer (this would also happen if two sworn officers were working together - one would necessarily be In charge). 4. Sworn officer may not want to be "responsible" for a reserve officer - wi I I reserve officer be assigned by Chief or officer on duty? In discussion, It was noted that if additional police officers are needed, Councl I should probably consider hiring additior.al regular officer to fill this need. If assistance is needed at particular peak times, perhaps a part time officer should be hired or present part time or full time officer called to aid the on-duty officer; would seem scope of operation of reserve officer would be limited, with less training and expel"ience; it also would seem that when the need arises for police ass;stance, that this would also be the time when a full timE', well trained officer would be needed. . Sexton explained that additional police officers are not needed, but an extra man in the car would be beneficial on many occasions, and the reserve officer could give the officer the help he needs. Reserve officer would assist the regular officer; they are well traIned and competent; regular officer directs the reserve officer and lays out plan of action - regular sworn officer would be in charge at all times. After discussion, Feyereisen moved, seconded by Woodburn, that Counci I authorize a Police Reserve Unit and adopt the Rules and Regulations dated 6/14/76 as submitted. In further discussion, Chief Sexton said he would schedule the reserve duty; reserve officer would not be "riding" at his own discretion - only when he is scheduled or Chief determInes there is a need. He said reserve officers would be required to call the Chief when they are avai lable to "ride", not the on-duty officer or dispatcher. -1- Minutes of Special Caunci! Sexton said he plans to SChedule{'r~~ VIIIIi" tests for the two potential reserve officers, not. that the reserve unit has been authorized. REPORT OF VILLAGE ENGINEER DONALD CHRISTOFFERSEN . Storm Draina<:!e Problem, James tkNamee Property - Siems Court and johanna Boulevard Christoffersen referred Counci I to his letter of 6/30/76 and attached contour map indicating the McNamee property on Siems Court at Lake Johanna Boulevard, the existing culverts and the area tributary to the McNamee property. Christoffersen estimated cost of providing a storm sewer (as indicated on the contour map) at $15,000, which would divert the major amount of drainage from the McNamee property, noting that approxirrmtely 306 acres \/ould continue to flow through this property. Christoffersen advised that ditching would be difficult because of the steep terrain; the necessary bends in the ditch would be difficult and costly to line in order to prevent erosion. McNamee stated that highway construction, home construction north of Johanna Blvd. and home construction on the east side of Siems Court heve all contributed to greater surface run-off through his propertyo Crepeau noted that a former ponding area on the north side of Johanna Blvd. Is now drained through a culvert under Joh.3nna Blvd. into this area. Wlnger+ questioned whether proposed storm drain would meet reQulro- ments of Rice Creek Watel"shed; project would have to hav,,, apPI"oval of Boare of Managers before It could be granted a permit by the Vi II age. In discussion of payment for tha project, Christoffersen Indicated that Ramsey County might participate for their percentage of run-off cos t. Minutes of Special Councl I Meeting Pa ge th I-ee Woodburn moved. seconded by Feyereisen, that Counc! 1 adopt Resolution No. 76-31 APPROVING THE PLANS AND SPECIFICATIONS FOR THE HAMLINE AVENUE UPGRADING PROJECT, and authorized advertisement for bids; bid openlng to be at 2:00 p.m. on Friday, August 13, 1976, at the Village Hall. ~10tlon carried unanimously. July 19, 1976 . Christoffersen referred Council to the plans for County Road F Street Improvement and reported that the specifications for the project are completed, but not typed In time for tonight's meeting. Christoffersen advised that In order to obtain M.S.A. funds, Plans and Resolution restricting parking must be sent to the State. Christoffersen reviewed the plans, noting off-set of center line 5' to the north to adjust for sanitary sewer and advised that a copy of the plans wil I be sent to Rice Creek Watershed for their review and comments on drainage. In discussion, Christoffersen noted that the flow through the Rei ling property to the south would be re-dlrected; permanent flowage easement may be necessary and should be obtained as soon as possible. Councl I requested that Christoffersen talk with the property owner re these changes betore contract Is awarded. After discussion, Crichton moved, seconded by Woodburn, that Councl~ adopt Resolution No. 76-32 APPROVING THE PLANS AND SPECIFICATIONS FOR THE COUNTY ROAD F STREET IMPROVEMENT, and authorizing advertise- ment for bids; bids to be opened at 2:00 p.m. on Friday, August 20, 1976, at the Vii lage Hall. Motion carried unanimously. Crichton moved, seconded by Feyerelsen, that Counci I approve Resolution No. 76-30 RELATING TO PARKING RESTRICTIONS ON S.A.P. IB7-IOI-01 FROM HAMLINE AVENUE TO LEXINGTON AVENUE (C.S.AoH. 51) iN THE CITY OF ARDEN HI U.S, MINNESOTA, as amended. Motion carried unanimOUSly. PLANNING COMMISSION RECOMMENDATIONS Case No. 75-17A. Presbyterian Homes - Amended Landscape and Gradin!:] Plans Wingert referred Ccunci I to the Planning Commission's conc~rn re an apparent "tight turn" Into the parking area from the access road. Mr. Tim Howell' presented a tissue sketch of the propcised one-way roadway and parking areas (received 7/'~/76) and indlcatlng a stop sign which Is Intended to alleviate problem of turning; feels turning radius Is satisfactory. Counci I discussed the storm water detention basin proposed and referred to Christoffersen's letter of 6/3/76 which notes that the 12 Inch outlet to Lake Johanna Is adequate based on a ten year frequency. Howell explained that "the 12" Is proposed In addition to the existing 8" which Christoffersen said would take cara of the excess runoff. . Howell explained that pond will retain roughly 3' of IVater; can be completely drained if necessary. Case No. 76-13, Charles Amble - Karth Lake Hills Preliminary' Plat Wlnaert referred Council to Minutes of P'~nnlnn Commission Meeting of 6/30/76, Attorney Lynden's letter of 6/29/76 In answer to questions posed by the Planning Commission on 6/2/76, Planner's Report and Engineer's letter of 6/30/76. Mr. Amble presented a revised Preliminary Plat of Karth Lake Hills (dated 7/6/76) which shows cul-de-sac on Amble Circle moved 10' to the west and the cul-de-sac on Amble Drive moved to the west with radius reducod to SO', as suggested by the Planning Commission. -,3- Minutes of Speciel Councl I Meeting Page four July !9, 1976 Christoffersen noted several alternative possibilities cf Providing sanitary sewer and water uti Iltles to the plat, and after discussion, Wingert moved, seconded by Crichton, that Council approve Resolution No. 76-36 authorizing Christoffersen to prepare feasibi Ilty report for the provision of sanitary sewer and water to the entire Karth Lake area not now served (Hamllne Avenue to Lexington, south of Highway 96.) . Wingert moved, seconded by Crichton, that Councl I refer the plat to the Parks and Recreation Committee for Its review and recom- mendations to the Counci I re tral I and park dedication, and to Planner Fredlund for report to Counci I re lot sizes and need for variances as revised. Motion carried unanimously. Case No. 76-12. Amended Special Use Permit for Bul Idinq Addition - BI ue Fox Inn Wingert described the proposed addition which wi I I provide an additional 68 ~seats (total of 219), requiring 73 parking spaces (89 provided) and referred Counci I to Planning Commission Minutes of 6/30/76. Case No. 76-7, Wayne Gonnella - Commercial Bul!dinq A. Rezonin~ from R-2 to R-B Wingert explained the purpose for the request to re-Zone from R-2 to R-B Is to bring the use of the land into keeping with the commercial corner (now a service station on the site) to al low commercial use of the corner, but restrict the uses to which the corner can be put. Wingert noted that the Comprehensive Plan Indicates the corner as commercial and moved, seconded by Woodburn, that Council approve the rezoning of Lot 13, Block 2, Dalsorar. Addition from R-2 to R-B. Motion carried unanimously. B. Special Use Permi~ Wingert explained that Mr. Gonnella proposes to construct a building on the let for two commercial uses - a John Deere consumer products franchise and a radio dispatch desk; bui Iding to be 60' ): 70' in sl ze and will replace the existing service station (30' addition may be added at some future date as shown on site plan (60' X 100' in size))o . After review by Wingert of neighborhood concerns expressed at the public hearing and review of the site Bnd landscape plan (6/30/76) and proposed bui Iding elevations .!hich were displayed by Mr. Gonnella, Woodburn moved, seconded by Wingert, that Counci I approve the SpecIal Use Parmit for the construction of the commercial building In accordance with site plan dated 6/30/76; construction drawings to be submitted to Planning Commission and Count! I tor approval of Bui Idlng Perm:t and compliance with approved site plan. Motion carried unanimously. (It was noted that sign approval Is not Included In the site plan app rova I. ) Case No. 76-16, Big Ten Supper Club - Variance for Siqn Mr. Welsch described the nsed for replacement of his ex'sting sign Which Is approximately 25' In height (10' sign on a 15' pole); sign has been damaged by trucks. The proposed new sign is B' X B' and would be erected on i'h<l existin!] 15' pole (total height - 23'). Wingert moved, seconded by Feyereisen, that Counci I approve the 7' height variance for the Big Ten Supper Club sign, as requested. Motion carried unanimously. Case No. 76-19, Truman RoY~e - SIde and Rear Setback Variances for Garaqe at 1993 West County Road 0 Mr. Royce explained that he has a concrete slab located 9' from the rear property line and 4' from the side property line, on which he would like to construct a garage (34' X 32'>' . After review of Board of Appeals report (6/28/76), Planning Commission Minutes (7/6/76) sketch of lot showing bui Iding locations, Bui Idlng Inspector's memo 0/7/76) and report of Planner Fredlund, Wingert moved, seconded by Feyereisen, that Council approve the 6' sldeyard and I' rear setback variances for the garage/kennel structure as requested. Motion carried unanimously. Case No. 76-22, Robert C. Jersak - Sideyard Setback Variance for Garaqe - 1921 West County Road 0 Council was referred to sketch of property and proposed garage location, and to reports from Board of Appeals, Planner and Planning Commlssiono Wingert moved, seconded by Crichton, trat Counci I approve the 4' sldeyard setback variance for a garage at 1921 West County Road 0, as requested. Motion carried unanimously. Case No. 76-21, Mrs. Paul Thorne - Lot Split and Consolidation Wingert referred Counci I to the Planning Commission recommendations (Minutes of 7/6/76~ and Mrs. Thorne requested that a spilt of 15' (adding 15' to the rear of her lot) be approved. l\tter discussion, Wingert moved, seconded by Feyereisen, that Counci I concur with the Planning Commission's recommendation .to approve the splitof 10' from 1.0"1" 15 and addition of 10' to l.ot 2; resultant lots being the toi lowing dimensions: Lot 2 - 100' X 135' Lot 15 - 100' X 140' Motion carried unanimously. f:ase No. 76,,20, Bethel College - Amend",d Bui I di ng' Permi t Mr. Lissner explained the changing needs of the College and described the proposed 4-level addition to Bui Iding "0" rather than construction of Bui Idlng "C" as or-iglnally proposed; stated that construction of the "diamond-shape,d" bui Iding is precluded by this addition to Bul Jding D; request does not affect plans for Bui Idlng "A", not yet constructedo . Atter review of amended site and landscape plans, dated 7/19/76, Wingert moved, seconded by Woodburn, that Counci I approve issuance of the Bui Iding Permit for the 8ui Iding "0" addition in accordance with plans submitted. Motion carried unanimously. REPORT OF VILLAGE TREASURER DONALD LAMB July Investment Transaction Treasurer Lamb referred Council to list of Investments and rates from 11/14/74 to 7/16/76 for Council's consideration, and reported the Investment of $150,000 at 5.85% for 9 ffionths on 7/16/76. Woodburn moved, seconded by Crichton, that Councl I ratify the Investment. Motion carried unanimously. REPORT OF VILLAGE CLERK ADMINISTRATOR CHARLOTTE MCNIESH ~eproducible Contour Maps Request McNiesh referred Counci I to request of Edwards and Kelsey Inc. -5- Minutes of Special Counci I Meeting Page six July 19, 1976 for reproducible contour maps of Arden Hi lIs, at no cost, for flood Insurance studies within the City of Arden Hills. Feyereisen moved, seconded by Wingert, that Councl I approve giving the reproducible contour maps to Edwards and Kelsey, Inco at no charge, to be used for the flood Insurance studies for Arden Hills. Motion carried (Feyereisen, Wingert, Woodburn, Crepeau voting In favor of the motion; Crichton voting In opposition). (McNlesh was requested to run a tally of contour map sales for Council's consideration.) . CETA Payroll Crichton moved, seconded by Woodburn, that Co~ncl I approve the CETA Payroll as presented. Motion carried unanimously. Overtime Policy McNlesh referred Counci I to her memo of July 16th re overtime policy for Village emptoyeeso Councl I took no action to change present procedure of paying time and one-half for al I employees over a 40 hour week. Proposed Letter to International Union of Operatin~ En~lneers Council was referred to proposed letter offering certain changes and Improvements to the 1975-76 agreement for public works employees covered under an agreement with the International Union of Operating Engineers, Local No. 49. After discussion, letter was approved and Clerk Administrator was authorized to send letter, as amended.
